통관거점을 이용한 국제물류의 지역구조 (Regional Structure of International Physical Distribution through Clearance Depot)

  • 본 연구는 내륙지방에 입지한 청주세관을 사례로 통관거점을 이용한 국제물류의 지역간 결합과 지역구조를 밝히는 것을 목적으로 한다. 청주내륙통관거점의 무역은 관할 배후지에 입지한 공업의 특색을 반영한다. 화물의 발착지는 수출입지로서, 특히 일본, 중국, 미국과의 거래가 탁월하다. 청주세관 관할지역의 화물 발착지는 인천공항과 부산항의 배후지와 지향지가 되며, 수출의 경우 부산항의 지향지가 넓고, 수입의 경우는 인천공항과 부산항의 배후지가 거의 비슷하다. 청주 내륙통관거점은 신속하고 저렴한 비용의 수출입 체제를 구축하고 있는데, 개개 기업의 화물의 종류나 기업의 물류체계가 다른 특성을 나타내고 있다. 국제물류의 지역구조는 하주기업이 각각 수출입화물에 대하여 독자적인 물류체제를 구축하는데, 보세공장과 보세창고에서 수출하는 형태로 크게 나누어진다. 보세창고에 의한 형태는 다시 해외생산거점과 분업을 하는 본선인도가격제, 해외생산거점과 분업을 하는 균일배달가격제의 형태가 있다. 이러한 현상은 본사와 해외법인간의 거래, 수출기업의 화물취급 주도, 저렴한 비용의 선택, 국제적 관행 때문에 일어난다.

WCO의 CDM과 UCR을 수용한 전자통관시스템 발전 방안 (A Study on Acceptance of CDM/UCR in WCO as e-Customs clearance procedures)

  • A single window platform must be successfully established by implementing CDM/UCR in WCO and UNeDocs in UN/CEFACT, which is part of the framework of standards for secure and facilitate global trade. Core success factors in single window platform for international trade depend on political innovative capacity, advanced leadership of high ranking officials and departments in charge, effective collaborations between the ministries and offices concerned which are supported by supreme executives, self-controlled coordinations between users, convenience and access availability to users, promotion and marketing, identification on predictive impediments, financial raising and revenue model payable, communication's strategy, valid legal basis etc. To settle a stable ubiquitous e-trade platform, firstly, procedures and practices of customs clearance which different from one another mutually must be standardized globally. Secondly, the international standard electronic data exchanges must be introduced to facilitate and simplify customs clearing procedures by holding administrative informations in common between public institutions. thirdly, cooperative work model must be accepted with enhancing outsourcing business between reference groups (export-import firms and IT service providers).

Trade Facilitation for the Products of the Industry 4.0: The case of Customs Classification of Drone

  • Purpose - This paper investigates the implications for facilitating trade in the products of Industry 4.0. To identify the issues caused by the conflicts of policy objectives such as applying the tariff concession under the ITA and imposing the export control, by exploring the case of classification of drones. Design/methodology - We adopted a single case study method to gain a deeper understanding of the complex and multifaceted issues of Customs classification in the context of facilitating trade in the products of Industry 4.0. This study employs the case of drones to explore how these issues of Customs classification affect trade facilitation. We ensured the internal validity of the study by confirming the pattern of the results with the existing theories. Findings - Our main findings can be summarised as follows: the intrinsic nature of the products that converge several technologies causes issues in the classification. The inconsistency in product classification delays customs clearance by hindering the Customs risk-management system that pinpoints products subject to controls. To address the issues, therefore, we proposed fundamental reforms of Customs to empower themselves with management roles. Facilitating trade in the products of Industry 4.0 requires more enhanced Customs capability. Therefore, the reforms should include comprehensive capacity-building activities, such as changes in staff-trainings, promotion system, organisation and culture. Customs also need roles in robust designing of cooperative systems to compensate for the lacks of controls and to ensure concrete risk management for expedited Customs procedures. As well, by equipping the Single Window of Customs with crucial control functions of other ministries, Customs need to support the cooperation. The role of harmonising various preaudits of other ministries with its own is another essential role that ensures predictability of clearance procedure. Originality/value - There are scanty studies in the field of knowledge about what obstacles exist and what solution is available in the course of transforming to 'Industry 4.0'. In filling out the gap of knowledge, this paper is of academic significance in that it applies the research theory on trade facilitation for the specific cases of classification of the product of Industry 4.0 to verify its effectiveness and to extend the subject of the studies to the scope of Industry 4.0. It also has practical significance in that the results have provided implications for reforms of Customs procedures to facilitate trade in the products of Industry 4.0.

관세법상 지식재산권 침해사범 수사와 물품검사와의 상호관계 (A Study on the Correlation between the Investigation on the Violation Crime of Intellectual Property Rights and the Goods Inspection in Customs Law)

  • 지식재산권 침해여부를 판단하는 것은 전문적인 지식이 필요할 뿐만 아니라 상당한 시간이 소요되므로 신속한 통관을 추구하는 무역원활화라는 명제와 철저한 심사를 통한 사회 안전 및 권리의 보장이라는 상반된 명제를 조화롭게 아울러야 한다는 관세행정의 과제 앞에서 범죄수사와 관련이 있다면 통관절차의 일부분인 물품검사에도 형사법상의 통제가 있어야 한다는 논의가 있다. 그런데 관세법은 관련 규정들을 살펴보더라도 지식재산권 침해물품에 대하여 조사부서에 송치를 의뢰하더라도 그전에 이를 적발하기 위한 물품검사 등에 대하여는 행정적 의미에서의 조사일 뿐 형사법적 통제를 받는 검사 내지 조사는 아니라고 보는 입장인 것으로 보인다. 관세법상의 물품검사가 형사법상의 수사의 단서로서의 성격을 갖고 기능을 한다는 것은 우범성 선별검사를 포함한 통상적인 물품검사의 경우에 국한 된다고 할 수 있다. 만약 특정한 범죄정보로서 특정한 물품을 검색한다는 것은 그 자체로서도 이미 범죄의 혐의를 갖고 수사를 개시하였다고 봄이 타당하므로 해당 개장조사의 경우 수사행위로서 형사법상의 규율을 받아야 한다. 이렇게 해석해야만 관세고권에 바탕을 둔 통관절차상의 물품검사와 형사법상의 강제처분인 압수 수색간에 조화로운 운용의 묘를 찾을 수 있는 계기가 될 수 있을 것이다.

Kano-IGA 통합접근법을 이용한 전자통관 서비스 품질의 평가에 관한 연구 (A Study on the Service Quality Evaluation in Electronic Customs Clearance Making Use of Kano-IGA Integrated Approach)

  • 본 연구는 국가 관세행정 종합정보 시스템인 UNI-PASS의 서비스품질을 평가함에 있어 Kano모형과 Timko의 BW계수, Tontini et al.의 개선갭분석(IGA)을 적용하여 전자통관서비스(UNI-PASS) 품질속성들을 비교 검토하고, 전자통관서비스 이용 고객들의 만족도를 높이기 위해서는 어떠한 품질 속성에 집중해서 서비스 품질을 제고해야 하는지를 규명하였다. 분석결과, 전자통관서비스 품질 속성의 분류에서는 Kano, Timko, IGA모형 모두가 공통된 4가지 품질속성인 매력적품질, 일원적품질, 당연적품질, 무관심품질로 분류되었다. Kano-IGA 통합접근법을 이용한 결과에서 일원론품질의 경우 개선이 시급한 1사분면 영역에 포함되었고, 당연적품질은 중점적인 유지관리가 필요한 영역인 2사분면에 포함되었다. 무관심품질은 Care free 영역인 3사분면에 그리고 매력적품질은 경쟁우위 영역에 해당하는 4사분면에 포함되었다. 본 연구는 선행연구와는 달리 전자통관서비스 품질속성을 일원론적 관점이 아닌 이원론적 시각에서 Kano모형에 의거 서비스품질 속성을 분류하였고, 더불어 Kano, Timko, 개선갭분석(IGA)을 종합적으로 적용하여 각각의 품질속성의 분류결과가 일치하는지와 영역별 개선우선순위와 영역내 개선 우선순위를 검토하였다는 점에서 의의가 있다. 그러나 실증분석에 사용된 표본의 업종이 일부 특정 업종(일반기계 및 장비류, 전기전자제품류)에 편중되어 있다는 점에서 연구결과를 일반화하는 데는 조심스런 해석이 요구된다. 향후 연구에서는 산업별, 업종별 비교분석이나 기업의 규모나 사용기간을 중심으로 분석해 보는 것도 의미가 있을 것이다. 그리고 설문문항의 측정척도는 리커트 5점 척도 보다는 7점 척도를 사용하여 판별력을 높이는 것도 바람직 할 것으로 사료된다.

  • The World Customs Organization (WCO) has designed standards to secure and to facilitate the ever-growing flow of goods in international commerce since 9.11 terrorism in U.S.A. These standards are set forth in the SAFE Framework of Standards, which was adopted by the WCO Council at its 2005 Sessions and the SAFE Framework incorporates the concept of the Authorized Economic Operator (AEO), and the Council directed the WCO to develop more detailed implementing provisions for the AEO concept. It is considered to be reliable in customs-related operations and ensures an equivalent level of protection in customs controls for goods brought into or out of the customs territory, whereas it is difficult for many Korean companies to make a decision of introducing the AEO certification programs because of a lack of cost and benefit information. In this article, We have reviewed the definition and the developing status of an AEO programmes and have studied the benefit and expected effect through documentary research methods. Therefore, it is essential for Korean companies to be certified the AEO programmes from Korea customs service for increasing security in international supply chains through risk management and customs compliance, in addition, the key-driver in the future will be expectations from the business community to work with AEO partners.

수출식품산업의 국제경쟁력 확보를 위한 식품안전국가인증제 (Korea National Food Safety Certificate for ensuring global competitiveness of food export industry)

  • To resolve difficulties of export process and strengthen competitiveness, Korea National Food Safety Certificate (K-NFSC), a comprehensive food safety support system, has been promoted to introduction. K-NFSC is at a developmental stage where the government certifies the safety of exported K-foods by developing Korean certification system based on HACCP and food safety management added for international use, and provides consulting on regulations of customs clearance and safety test analysis of food intended for export. To apply for the Global Food Safety Initiative (GFSI) technical equivalence in 2022, developmental direction of Korean certification system is set referring to FSSC22000. If selected as participants of an export supporting project, regulatory information such as customs clearance procedures and food labeling will be provided. In addition, the results of safety test analysis will be certified to help export products pass customs entry. K-NFSC is expected to support K-food exports and be growth engine for K-food industry.

  • As the interest about smooth logistics increases lately, the importance of multimodal transport, which performs the key role of logistics emerges, Through there are many issues respecting multimodal transport, the issue of the efficiency of multimodal transport seems to be the most importance. This paper examine as to the problems & systems of the multimodal transport including transportation document and customs clearance for door to door services. I wish our country will use total logistics automation systems for encouraging multimodal transport chance and make a partial amendment of commercial code including the customs clearance regulation. This study will assist in the development of logistic and the enlargement of multimodal transport transaction.

무역절차 간소화를 위한 Single Window 구축에 대한 연구 (A Study on the Establishing of Single Window System for Simplification of Trade Procedures)

  • In many countries, a Single Window system for simplifications is establishing in order to reduce works submitted double data and compliance costs. A Single Window is defined as a facility that allows parties involved in trade and transport to lodge standardized information and documents with a single entry point to fulfil all import, export, and transit-related regulatory requirements. A Single window can bring improved level of security, faster clearance and reduced compliance costs. UN/CEFACT released "Recommendation and Guidelines on establishing a Single Window to enhance the efficient exchange of information between trade and government". Also, WCO has made progress several projects to assist effective establishing a single window, i.e. CDM, UCR, ICT. Korea has being established a single window system, "e-trade platform" connected with trade, clearance, logistics, marketing and payment system. Some suggestions to establish a effective single window system in Korea are as follows. Firstly, it is necessary to clearly define roles and responsibilities of a lead agency in a single window system and form a organic relationship with PGA. Secondly, a single window system has to be progressed by stages, namely, customs clearance portal system should be established first, and later established e-trade platform. Lastly, the Korean government has to take part in CDM project to gain an advantage over other countries.
