In 2008, the Korean Supreme Court came across a plaintiff's claim to return his deceased father who had left family more than four decades ago and lived with another spouse(de facto) in the meantime to be buried after death in a cemetery of his own choice. The major opinion decided to approve the claim, on the ground that the first legitimate son should be the "head worshiper" prescribed in the article 1008-3 of the Korean Civil Code and that the corpse belong to the head woshiper, i. e. the head woshiper has a special "limited ownership" over the corpse for the purpose of its burial and worship, adding that a deceased's disposition inter vivos, if any, be only ethically but by no means legally binding others, including the head worshiper of course. Here scrutinized are the historical developments starting from the Roman criminal law of sepulchri violatio(trespass to grave) through the Canon law of the Middle Age and the doctrinal reactions to the challenges of anatomy and surgery to the formation of the "supporting the deceased" theory in Germany as well as the similarities in other european continental countries(Switzerland, Austria and France). The comparative review shows that the right of remaining family could neither be identified as limited "ownership" nor that the controversy over a corpse be solved by exclusively attributing/distributing it to one/some of the descendants. In principle, the question should be approached in the extension of family support.

In this paper, a micro-mechanical failure prediction program is developed based on SIFT (Strain Invariant Failure Theory) by using the multi-scale modeling method for fiber-reinforced composite materials. And the failure analysis are performed for open-hole composite laminate specimen in order to verify the developed program. First of all, the critical strain invariants are obtained through the tensile tests for three types of specimens. Also, the matrices of strain amplification factors are determined through the finite element analysis for micro-mechanical model, RVE (Representative Volume Element). Finally, the microscopic failure analysis is performed for the open-hole composite laminate specimen model by applying a failure load obtained from tensile test, and the predicted failure indices are evaluated for verification of the developed program.

Overseas marketing before the conclusion of a contract is a huge obstacle to enter the global market because it has needed the company's maximum capacities which are some cost, time and human resources. Thus it required a reestablishment about the education fields and research schemes. Due to the advancements in ICT and internet, a subject of e-trade is becoming a critical issue with a subject of a practice of international trade. However, since the mid-2000s, e-trade research articles and educational materials such as textbooks, research papers are being gradually reduced. Therefore the purpose of this study, from an oversea marketing point of view among the various e-trade fields, is to measure an education performance and an academic research scheme. And this study will suggest direction of improvement about research scheme and educational performance in the overseas marketing. According to the result, to establish the education and research scheme about SEM(Search Engine Marketing), SEO(Search Engine Optimization) and SNA(Social Network Analysis) which are introduced in the industry among the education and research field related the e-trade is urgent. And some subjects need a capstone-design reconcile theory and practice.

Recently the effort of retailers improving the efficiency of store operations by using the information technology (IT) is increasing. Among them, the analysis of the shoppers' flow in retail stores is one of the critical tasks since it is an essential part in optimizing store layout and item grouping, and in developing the customized services specialized to shoppers' classification. Agent-Based Modeling and Simulation (ABMS) is one of the most promising methods which support analyzing the shoppers' flow. In this paper, we suggested a shopper's behavior model and developed an agent-based simulator for optimizing the operations of retail stores. In order to model the shoppers' behavior, we analyzed the behavioral characteristics of shoppers based on their shopping lists, suggesting BDI-based agent models of the shoppers' behavior. The shopping agent model were suggested, which has an additional mental state, the shopper's behavioral characteristic, as well as the original mental states of the BDI theory which has beliefs, desires and Intentions. The result of this study can be used in as a preliminary study for modeling and simulation of retail stores congestion and in the end the optimization of item grouping and store layout.

The prefix 'bio' with the meaning of 'life,' has been used for biotechnology, biochemistry, bioengineering, biomedicine, bioethics, bio-information as well as 'bio art' since 1990s. Bio art is an art as life itself and a kind of new direction in contemporary art that manipulates the processes of life. Bio artists use the properties of life and materials as scientists in laboratory of biology, and change organisms within their own species, of invents life with new characteristics. Technologically and socio-culturally, bio art has been connected with bioengineering. This essay is on the bio art that use vegetables, and on the specified gaze of so-called 'Sci-Artists.' Not only the genetically modified vegetables like works of George Gessert, Ackroyd & Harvey, and Eduardo Kac, but also the works made from the critical viewpoint like those of Paul Vanouse, Natalie Jeremijenko, and Amy Youngs, have 'the molecular gaze'(Suzanne Anker and Dorothy Nelkin's concept) of the genetic age in their art works. As the art history have showed, artists' gazes have insights about social problems that surround us. Bioartists' gazes reveal their insights about social and ethical problems, possibly concealed by science itself. Those problems are about results from practical discoveries of the sequencing of the genome, genetic engineering, cloning and reproduction of human and animals, body transformation, and the commercialization of cell and genes etc. We can find the significance of bioart in the molecular gaze about those problems, and we can rethink the identity of human, the reception of social influences from bio-technology and medicine.

This paper explores rich and complex implications of Marcel Duchamp's Mile of String which he created for "First Papers of Surrealism," the Surrealist international exhibition in New York in 1942. Part of a larger project devoted to investigating Duchamp's role in Surrealist exhibitions and his relation to the avant-garde group, this paper focuses on Duchamp's exhibition installation in the 1942 show. Under the title of "g$\acute{e}$n$\acute{e}$rateur-arbitre" Duchamp played an important role as installation and exhibition designer in a series of major Surrealist exhibitions in the 1930's-1960's. The "First Papers of Surrealism" was held by Surrealists who exiled in New York during World War I, and Duchamp created a labyrinthine installation of string for the exhibition, which physically blocked the spectator and optically hindered his or her contemplative view. Unraveling the intricately related meanings of Mile of String as an independent work of art and an installation for a specific exhibition, I examine the work on two levels: first, how the work was situated in the context of Duchamp's oeuvre, particularly his earlier work employing string or thread; second, how and in what way the installation rendered a critique on Surrealism as a group and an avant-garde movement. More specifically, by exploring the concepts of 'pataphysics' and voluntary 'nomadism' implicated in Duchamp's work, I suggest that his Mile of String asserted a critical stance against nationalism and collective identity of Surrealism and manifested a radical individualism founded upon what he called the spirit of 'expatriation.'

The "Economy" is one of the hottest issues in Korean society these days, but there are still mixed views on the definition and approach to the creative economy, which is the catch phrase of the new government. Under these circumstances, this study assumes the current perspective of the domestic science and technology community on the creative economy fails to properly reflect the spirit of the times and so aims to suggest the "creative economy for people's happiness" as an alternative perspective along with a set of policy implications. To that end, this paper looks through the theory of the creative economy and examines existing perspectives on the creative economy from a critical point of view. And then, it explores the characteristics of the creative economy for people's happiness and related examples. Lastly, policy implications are drawn up for the Park Geun-hye government.

Animation are consist of consecutive various images, and there are figure and ground. The value of figure image as character in animation consider more significant than the background image, it can be detected many literature reviews on that subject. It, however, is also a critical element for completing animation, in reality, it is not found many academical achievements on this subject. The background images imply the information of environment and atmosphere, and elucidates where the story happen, therefore character move, talk and express themselves there. In terms of academic endeavour to extend the knowledge on animation, this paper is one of vital researches to be suggest on background image study. The main purpose of this study is to classify the background images in the ways of three categories such as painting concepts of concrete, semi-abstract, and abstract to camera concept of deep-focus, out-focus, and distortion. It is to instigate for the study of background images, in the practical view. And it will be utilizing the basic theories of cognitive psychology, painting and camera techniques, in the ways of It is analysed to frequency of use, reality, amount of information, perspective, and role of background image. This study is to provide a basic theory of visual classification on background image for practicing animations and researching on this subject.

With angle resolved photoemission spectroscopy (ARPES), the surface electronic band structures of Pt3Co (111) and Pt3Ni (111) single crystals are investigated, which allow to study the bonding interaction between chemically absorbed atomic oxygen and its surfaces. The d-band electrons of subsurface TM are separated from the direct chemical bonding with atomic oxygen. That is, the TM does not contribute to direct chemical bonding with oxygen. From the density functional theory (DFT) calculations, it is identified that the main origin of improved oxygen absorption property, i.e. softening of Pt-O bonding, is due to the suppression of Pt surface-states which is generated from change of interlayer potential, i.e. charge polarization, between Pt-top and TM-subsurface. Our results point out the critical roles of subsurface TM in modifying surface electronic structures, which in turn can be utilized to tune surface chemical properties.
