International commercial mediation of intellectual property rights fully meets the interests of the parties in such disputes in terms of their needs for neutral forum of dispute resolution, cost-effective settlement, objective opinion of relevant experts, internationally enforceable solution. In addition, as a procedural flexibility, respected self-determination of the parties, exploration of possible creative business solutions, maintenance of business relationship and confidentiality of mediation are major characteristics which can be competitively differentiated from the lawsuit or arbitration. The settlement agreement as a result of the WIPO mediation has an effect of contract while the settlement agreement as a result of most domestic ones has an effect of judicial reconciliation which can be domestically enforced. The latter is not subject to the application of the Singapore Convention on Mediation which establishes a harmonized legal framework for the right to invoke settlement agreements as well as for their enforcement. The WIPO international mediation system and its experience may be a good reference for Korea to take an initiative to establish a globally competitive international mediation system in the area of intellectual property rights.

본 연구는 경기도교육청 공공도서관 정체성 확립 및 발전방안을 논의하고 이를 통해 교육특화형 공공도서관으로의 모형개발을 수립하고자 한다. 이를 위해 경기도교육청 도서관의 운영현황 및 학교도서관 지원체계를 분석하고 연구결과로 교육중심의 패러다임 전환, 학교도서관 지원과 평생교육영역의 구분 및 확대, 지역교육청 중심의 협의체 구성 및 역할정립, 공공도서관의 창의지성교육 공간으로의 변화를 제시하였다. 본 연구는 교육청과 지자체 소속 공공도서관의 정체성에 대한 고민을 제시하고, 다른 지역 교육청 소속 공공도서관의 발전모형을 제시하는 데 활용될 수 있을 것이다.

This paper seeks to build on previous work conducted by Porter, Devol, Florida, Bahrami and Evans, Wennberg and Lindqvist, and others contained in the literature, to construct a new way of looking at innovation cluster development. It seeks to describe the key elements contained in the research that serve as building blocks for innovation clustering, adding analysis dimensions that aim to further illuminate understanding of this process. It compares those building block characteristics to the innovation topography of U.S. urban centers, to shed light on a new framework through which urban innovation cluster formation can be considered. It identifies three building block analysis categories: 1) Technological Capability and Capacity (TCC); 2) Intellectual Propulsion Capacity (IPC); and 3) Structural Creative Inspiration (SCI). These three pillars form the architecture for creation of a Strategic Innovation Network (SIN), upon which clustering can be systematically analysed and built. The purpose of the SIN is to optimally organize and connect all available resources that include physical, financial, and human, such that innovation clustering is inspired, encouraged, nurtured, and ultimately constructed as fully functioning socio-economic organisms that provide both local and regional benefits. It is designed to aid both private enterprise and public policy leaders in their strategic planning considerations, and to enhance urban economic development opportunities.

학습자가 맥락적 상황 속에서 개인 사회적 문제를 해결하기 위하여 자기주도적 탐구 및 창조 활동을 하며 가시적 결과물을 제작하는 것이 목적인 메이커 교육은 메이커 운동이 지닌 교육적 가치와 의미를 강조하고 있다. 즉, '메이커 정신'의 함양을 강조하며 기존의 교육과 다른 가치와 목적를 추구하므로 메이커 교육의 평가는 기존의 결과 중심의 평가가 아닌 과정 중심의 평가로 메이커 활동의 특성을 반영할 수 있어야 한다. 이러한 맥락에서 본 연구는 메이커 교육을 위한 새로운 평가틀 탐색을 위하여 문헌연구를 실시하고, 기존의 지 덕 체의 3 요소 외에 상호작용성 및 사회적 참여를 평가틀의 5가지 구성요소로 제안하였다. 곧, 5 가지 구성요소는 5 ONs(Minds-on, Hands-on, Hearts-on, Social-on, Acts-on)로 요약되었으며, 이와 더불어 각 요소별 세부항목을 규명하였다. 이후 이렇게 도출된 5 ONs의 구성요소 및 각 요소별 세부항목에 대한 내용 타당도를 위한 델파이 조사를 실시하였다. 그리고 그 결과로서 '5 ONs 기반의 평가틀 구성요소 및 세부항목'으로 구성된 메이커교육을 위한 평가틀을 제시하였다.

본 연구의 목적은 한류의 비즈니스 영역을 확장하는 것을 목적으로 한다. 선행연구 조사 결과, 2012년 '강남스타일'을 기점으로 산업에 대한 관심이 고조되나, 당시엔 유통망 확대가 주를 이룬다. 이에 연구자는 예술적, 경제적, 과학적, 기술적 창의성으로 구분된 '창의성 유형(Creativity type)' 모델을 토대로 한류산업을 문화산업에서 창의산업으로 확대해 "한류 자산의 생성과 활용을 바탕으로 부와 일자리를 창출할 잠재력을 보유하면서, 개인적 재능이 한류 가치 생산의 기원이 되는 산업"으로 조작적 정의한다. 이를 토대로 한류 자산 생성은 3위권에 있는 영화, 드라마, K팝에 대해, 한류 자산 활용은 화장품, 식음료, 의류산업에 대해, 개인적 재능은 새로운 한류 가치 생산의 기원이 되는 흥행 지적재산권(IP)인 웹툰IP에 대해 2013~2017년 동안 분석하였다. 그 결과, 한류 자산 생성에서 중국 쏠림 배경으로 토종 OTT 발달과 규제를 회피하려는 콘텐츠기업의 대안 찾기 등이, 한류 자산 활용에서 중국향 제품 개발 활성화와 K뷰티콘텐츠 등 유튜버를 통한 뷰티콘텐츠화로 선순환됨이 확인된다. 마지막으로 개인의 재능에서는 탄탄한 스토리로 더욱 짜임새 있게 된 웹툰 IP가 영화, 드라마 등의 새로운 한류 가치 생산의 기원이 됨이 확인된다.
