수축-이완 운동이 기능적 하지길이 불균형과 하지 근활성도에 미치는 영향 (The Influence of Contract.Relax Exercise on Functional Leg Length Inequality and Muscle Activity)

  • Purpose: The purpose of this study was to evaluate influence of contract-relax exercise on functional leg length inequality (FLLI) and muscle activity. Methods: The subjects were consisted of 40 healthy adults who had FLLI of which degree was at least 10mm. All subjects were randomly assigned to two groups : Contract-Relax Exercise (CRE) group (n=20), control group (n=20). The experimental group underwent CRE for 3 times a week for 4 weeks. Myosystem 1200 was used to measure the activity of rectus femoris and hamstring muscle. The tape measure method was used to measure FLLI. Statistical analysis was used repeated ANOVA know comparison of period, independent T-est know comparison of experiment group and control group. Results: All measurements for each subject took the following test : pre-test, post-test in 2 weeks, post-test in 4 weeks. The FLLI of the experimental group was significantly reduced according to within intervention period (p<0.05). Rectus femoris and hamstring muscle activity of the experimental group was significantly increased (p<0.05). Conclusion: The CRE can reduce FLLI and increase rectus femoris and hamstring muscle activity. Various contract-relax exercise for reduced of FLLI and the methods should be customized for the patients.

질적 연구를 활용한 위탁급식 고객, 급식관리자 및 경쟁자 환경요인과 삶의 질 개선요인 도출 (Qualitative Research to Understand Environmental Factors of Customer, Foodservice Management, and Competitor and Factors that Improve Customer Quality of Life)

  • The objective of the current study was to analyze the major factors affecting quality of life improvement for contract foodservice customers by identifying the contract foodservice environment consisting of the customer, foodservice management, and competitor. Qualitative research method was performed on foodservice customers and foodservice management using in-depth interviews. First, the customer environment was classified into three categories, including convenience of location, foodservice management environment into six categories, including comfort level of dining facility, and competitor environment into three categories, including service competition between foodservice providers. Second, quality of life was defined as the level of contentment felt by both the customer and foodservice management consuming the food provided. Third, both the customer and foodservice management perceived that the management environment of contract foodservice had a "medium" effect on quality of customer life. The findings of this study could be applicable for development of a contract foodservice business strategy through objective comparative analysis of the customer, foodservice management, and competitor environments.

수축-이완과 수동신장 기법의 단기 적용이 슬괵근의 길이 적응에 미치는 영향 (Effects of Short-term Application of Contract-Relax and Passive Stretching on the Length Adaptation in Harmstring Muscles)

  • Objectives: Few studies have reported on the flexibility of the hamstrings resulting from variable stretching method, and little studies of length adaptation at 1 day after intervention. Methods: Fifty-four healthy a woman in her twenties with no history of musculoskeletal or neurogenic disorder volunteered for this study. Subjects were randomly assigned to either a contract-relax group or a passive stretching group. Methods: Hamstring flexibility was measured with a sit and reach test(SRT) (RF-D18; SPC) before, immediatly after interventions, and 1 day after interventions. Results: Flexibility scores for participants in each of the groups significantly increased from pre-interventions to immediate and 1 day after interventions. However, the length of 1 day after interventions was shorter than immediate length after interventions. Difference in length between immediate and 1 day after interventions was some shorter in the contract-relax group versus the static group but, not significantly. Conclusions: The results of this study suggest that a contract-relax is an effective length adaptation of hamstring muscles by 1 day after intervention.

  • Recently, much attention has been increasingly paid to the efficiency of the delivery system in order to manage construction project in a smooth and effective way. The integrated plan in consideration of the life cycle of building is required for the effective and integrated management of information in a huge amount. To this end, collaboration between each field is indispensable from the beginning of project. But there is a limitation that the designer and the constructor sign the contract separately in the conventional delivery system. In the US, the recent trend is that the Integrated Project Delivery (IPD) has been introduced to improve the effectiveness of project management in an increasing number of the cases where project is implemented by utilizing the IPD. In Korea, there is also an increasing need to introduce the IPD for the integrated project management. Consequently, the purpose of this study is to examine and analyze the laws and the contracts that are applied to domestic cases of placing order and signing contract based on the concept and principle of the IPD before the actual introduction of the IPD. Based on such examination and analysis, this study intends to figure out the constraints to the introduction of the IPD. It is expected that the results of this study will be used as basic data for IPD-related study in the future.

병원급식 위탁계약에 대한 병원과 위탁회사의 견해 비교 분석 (Comparative Analysis on the Perspectives of Hospitals and Contractors on Items related with Contracting Hospital Foodservice Management)

  • The purposes of this study were to : a) investigate the current status of contracted hospital food services, b) analyze and clarify various perspectives of contractors and hospitals. Thirty six hospitals and their contractors which were having more than 100 beds located in Seoul, Inchon and Kyungkido, were the subjects of this study. Data were collected through surveys. The survey was conducted during March to April in 2002. Questionnaires were mailed to the 36 directors of dietetic departments of hospitals and 36 managers of contract foodservice management company. Statistical analysis was completed using SPSS Win(11.0) for descriptive analysis, t-test and $x^2$-test. The results of the study can be summarized ; 1. The type of contract considered adequate by directors of dietetic departments and managers of contractors was fee-contract, combined type, followed by profit-and-loss contract. 2. According to the results from analysis on the contract cost per meal considered adequate by directors of dietetic departments and managers, the directors of dietetic department indicated that showing no difference with the current contract cost per meal. However, the managers of contractor indicated that showing significant differences compared with the current contract cost per meal(regular diet p<0.01, therapeutic diet p<0.001). 3. In the composition of contract cost per meal considered adequate, the managers of contracting businesses accounted labor cost (p<0.01) as a major cost, whereas the chiefs of nutrition departments accounted miscellaneous or controllable expense (p<0.001) and VAT (p<0.01) as major costs. 4. The directors of dietetic departments and managers thought that the hospital should be responsible for utility costs. On the other hand, directors of dietetic departments regarded that the contractor and managers thought that the hospital should pay for facility investment cost.

병원급식 위탁관리의 운영 실태조사 (A Study on the Status of Contract Managed Hospital Food Services)

  • The purposes of this study were to investigate the current status of contracted hospital food services and to find out the difference in accordance with the number of beds in hospitals. Thirty six hospitals having more than 100beds in Seoul, Inchon and Kyungkido were the subjects of this study. Data was collected through surveys. The survey was conducted during March and April in 2002. The Questionnaires were mailed to the 36 directors of dietetic departments of the hospitals and 36 managers of contracting patient food services. Statistical analysis was completed using SPSS Win(11.0) for descriptive analysis and t-test. The results of the study are summerized as follows; Ⅰ. Hospital perspective : The range covered by contract food service was 63.3% and 36.7% in hospital food services, and medical nutrition services. The patient and employee food services were in 83.3%, and patient food services were in 6.7%. The methods selecting contractors are general, limited, selected and competitive biddings, and private contracts. The responsibility for supervision of contract food services was the dietetic department (51.7%) in most cases. Hospitals having personnel responsible for contracting affairs were in 75.9% of the cases and 24.1% did not have personnel. The biggest reason for contracting was facilitation of personnel management. The most important criteria on selecting food services contractors was the professionality of the contractor. Ⅱ. Contractor's perspective : The cost per meal in the year 2001 was composed of 1,905 won for food cost, 1,081 won for labor cost, 222 won for expenses, 114 won for VAT, 14 won for rent and 146 won for miscellaneous or controllable expense, representing 109 won loss per meal. The profit-and-loss contract cost is higher than the fee-contract cost. The ratios of food cost, labor cost and expenses are higher and the ratios of miscellaneous or controllable expense, VAT, rent and profit are lower in hospitals with more than 400 beds compared with those less than 400 beds. However, no significant differences are present between these two groups of hospitals. The actual contract period was 2.2 years upon initial contract and 1.2 years upon renewal. The initial investment cost was 53 million won and the cost of renovation and repair was 8.5 million won. Significant differences were present between two groups of hospitals. The conditions of employment and number of personnel hired by contractors for contract patient food services were significantly different according to the number of beds.

특수 항공기 공급계약의 법적 성질 - 구매규격서상 성능요건 미달을 이유로 한 계약해제의 정당성 - (The Legal nature of a contract for supply of a special purpose aircraft -The legitimacy of contract cancellation on the grounds that the performance specification is not satisfied in the purchase specification-)

  • 항공우주분야에서 특수 목적 항공기 이외에도 시제기, 무인비행장치, 우주발사체 등 다양한 형태의 제작물공급계약이 증가하고 있다. 도급인의 입장에서는 거액의 비용을 지출하여 제작물을 공급받기로 예정되어 있었는데, 제품의 품질과 성능의 기준을 제시하는 구매규격서가 부실하거나 성능미달여부를 판단할 만한 능력이 부족한 경우에는 목적 달성 불능 이외에도 막대한 시간과 비용을 소모하게 된다. 수급인으로서도 계약 목적 달성에 필요한 성능과 품질을 갖춘 제작물을 공급할 능력이 없음에도 불구하고 무리하게 계약을 체결하게 되면, 일의 미완성에 따른 매몰비용과 계약해제에 따른 손해배상을 감수하여야 하므로 막대한 손해가 발생한다. 대상사안에서 피고는 원고에게 구매규격서에 규정된 바와 같이 ILS Offset 비행이 가능한 Happy Box 방식에 의한 항공기를 납품하도록 하였으나, 원고는 RNAV 방식에 의한 항공기를 납품하려고 하였다. RNAV 방식에 의하여도 ILS 지상신호의 검사가 가능하더라도 원고가 주장하는 방식으로 제작된 항공기는 구매규격서에서 요구한 ILS Offset 비행기능을 갖추지 못하여 피고가 구매규격서에서 요구한 목적을 달성할 수 없으므로, 이를 이유로 한 피고의 계약해제가 적법한지 여부가 문제되었다. 이 사건 계약의 목적물인 항공기는 부대체물에 해당하므로 이 사건 계약은 도급의 성질을 가지고, 따라서 이 사건 계약에서 일이 완성되었다고 하려면 항공기의 주요구조 부분이 약정된 대로 제작되어 사회통념상 일반적으로 요구되는 성능을 갖추고 있어야 한다. 그런데 원고가 납품한 항공기는 구매규격서에서 요구한 ILS Offset 비행기능을 갖추지 못하여 피고가 구매규격서에서 요구한 목적을 달성할 수 없으므로 중대한 하자가 있고, 이러한 하자는 원고가 보수하는 것이 불가능하므로, 이를 이유로 한 피고의 계약해제는 적법하다.

  • 급속한 사회변화와 함께 사회적 위험요소가 고조되면서 이에 대한 안전문제가 크게 대두되고 있다. 이에 안전욕구의 증대에 따라 위험에 대비하는 치안서비스를 제공하는 민간경호경비에 대한 수요도 증가하고 이에 따른 경호경비업도 발달하고 있다 이에 본고에서는 경호경비계약에 대한 법률 구조를 파악하여 경호경비업자와 의뢰자 사이에 발생 가능한 분쟁을 예방하거나 해결하기 위하여 계약의 성립과 그에 따르는 문제점을 분석하고자 한다. 특히 경호경비관계에 따르는 분쟁을 최소화하기 위하여 경호경비 계약을 체결하여 그 합의내용을 명확히 문서화하는 것이 필요하다. 여기에서 본고에서는 각 당사자간에 자율적으로 체결하는 경호경비계약조건을 표준화하는 방안 중에서 분쟁해결조항의 표준모델을 제시 하고자 한다. 특히 당사자 간 사법상의 분쟁을 해결하는 효과적인 방법으로 합의에 의한 방법이 최선이겠으나, 불가피한 경우에 재판에 의한 소송에 의한 해결보다는 중재를 통한 해결 방안을 권고한다. 당사자가 중재로 분쟁을 해결하기 위해서는 경호경비 계약서에 중재조항을 삽입하여 체결해야 한다. 실제 경호경비업계에서 이데 대한 적용성 시험 및 평가를 거쳐서 이를 경호경비 표준계약서로 제정하여 업계 전반에 확대 적용을 추진하고자 한다.

  • 공공건설사업은 수많은 공종의 집합으로 이루어져 있어 공사중단, 공사지체 등으로 인한 공기지연이 필연적으로 발생하고 있다. 공기지연이 발생하는 경우에 지연일수를 산출하는 방법은 많은 연구를 통해 제시되고 있으나, 공기지연에 따른 계약금액조정에 대해서는 구체적으로 언급하고 있지 않기 때문에 실제 공공건설사업에 적용하는 데는 어려움이 있다. FIDIC계약조건에 비해 회계예규인 공사계약일반조건에 불분명한 문제를 안는 있는 것으로 나타났다. 따라서 본 연구는 공공건설프로젝트에 국한하여 공사 수행중에 공기관련 설계변경사유가 발생될 경우 공기연장 절차를 보다 투명하게 하고, 계약금액산정의 기준이 되는 구간에 대한 기준을 명확히 하기 위한 방안으로 명확한 공기연장사유, 수정공정표제출 등에 대한 방안을 제시하였다.

A STUDY ON CONSTRUCTION SCHEDULE OPTIMIZATION INTEGRATING WITH CASH-FLOW

  • This paper presents a system called a Cash-flow based Construction Schedule Optimization system(CfSO). The existing CPM effectively handles schedule and cost management. However, funding strategy should be considered to obtain maximum profit and to progress a project favorably. One of measures is to coordinate the contract terms between owner and subcontractors (or suppliers). Contractor may decrease the interest cost attributed to project financing by adjusting the timing of cash-inflows and cash-outflows. It is an excellent method maximizing profits. This paper presents a method to estimate the amount of a cash-flow occurred periodically by integrating the terms of contract into scheduling. The proposed method is implemented as a system prototype in Microsoft Excel. This system provides a user an automated tool that identifies an optimal schedule that secures maximum profit by adjusting start and finish times of non-critical activities' free-floats without affecting on the project completion time. This system supports a project manager to establish an optimum project schedule and identifies profitable contractual conditions against to a construction owner.
