THE STUDY ON THE PROBLEMS OF MARITIME FACILITIES(GAS PLANT) INSURANCE REGULATIONS

  • The purpose of this study is to provide the problems of insurance system of maritime facilities(Gas Plant) in korea. In order to find out the problems of insurance system of construction work, the literature research and case study on the maritime facility construction are adopted as research method. And this study analyzed the construction cases of maritime facilities(Gas Plant) to which the national contract law was applied for the first time. The findings of this study are as follows: In the case analysis of 00 facility construction, the contractor pay additional insurance fees for the construction. And the regulations on insurance registration are not stated clearly relating to the enforcement ordinance of the national contract law.

영국 해상보험법상 담보(warranty)에 관한 연구 (A Study on the Rule of Warranty in the English Law of Marine Insurance)

  • Marine insurance contracts, which intended to provide indemnity against marine risks upon the payment of price, known as a premium, originated in Northern Italy in the late 12th and early 13th centuries. The law and practice were later introduced into England through the Continent. It is, therefore, quite exact that English and European marine insurance law have common roots. Nevertheless, significant divergences between English and European insurance systems occurred since the late 17th century, mainly due to different approaches adopted by English courts. The rule of warranty in English marine insurance was developed and clarified in the second part of the 18th century by Lord Mansfield, who laid the foundations of the modern English law of marine insurance, and developed different approaches, especially in the field of warranty in marine insurance law. Since the age of Lord Mansfield, English marine insurance law has a unique rule on warranty. This article is, therefore, designed to analyse the overall rule of the rule of warranty in English marine insurance law. The result of analysis are as following. First, warranties are incorporated to serve a very significant function in the law of insurance, that is, confining or determining the scope of the cover agreed by the insurer. From the insurer's point of view, such the function of warranties is crucial, because his liability, agreed on the contract of insurance, largely depend on in, and the warranties, incorporated in the contract play an essential role in assessing the risk. If the warranty is breached, the risk initially agreed is altered and that serves the reason why the insurer is allowed to discharge automatically further liability from the date of breach. Secondly, the term 'warranty' is used to describe a term of the contract in general and insurance contract law, but the breach of which affords different remedies between general contract law and insurance contract law. Thirdly, a express warranty may be in any form of words from which the intention to warrant is to be inferred. An express warranty must be included in, or written upon, the policy, or must be contained in some document incorporated by reference into the policy. It does not matter how this is done. Fourthly, a warranty is a condition precedent to the insurer's liability on the contract, and, therefore, once broken, the insurer automatically ceases to be liable. If the breach pre-dates the attachment of risk, the insurer will never put on risk, whereas if the breach occurs after inception of risk, the insurer remains liable for any losses within the scope of the policy, but has no liability for any subsequent losses. Finally, the requirements on the warranty must be determined in according to the rule of strict construction. As results, it is irrelevant: the reason that a certain warranty is introduced into the contract, whether the warranty is material to the insurer's decision to accept the contract, whether or not the warranty is irrelevant to the risk or a loss, the extent of compliance, that is, whether the requirements on the warranty is complied exactly or substantially, the unreasonableness or hardship of the rule of strict construction, and whether a breach of warranty has been remedied, and the warranty complied with, before loss.

A Basic Study on the Introduction of Professional Indemnity Insurance for Construction Project Managers

  • During the administration of a construction project, various types of participants are engaged in the project. From the design phase to the maintenance phase, these participants may confront many risks. To avoid these risks, participants should utilize an insurance company or a bond company. The types of risks and liability that a construction manager may face are listed in the construction law or contract. But there are some arguments related to risk transferring and the content of risks. For this reason, construction managers must carefully consider any possible risks in the contract and the construction law. Therefore, for construction managers to deal with risks appropriately, the introduction of a legal requirement to carry professional liability insurance, a defined compensation range for damages, a method of guarantee in the event of defects, a defined compensation claim period for damage, and a method of damage claim were suggested in this study.

  • 건설프로젝트 관리자는 성공적인 프로젝트의 완성을 위하여, 공사기간 중에 발생될 수 있는 위험을 분석하고 위험요소에 대한 대응책 및 위험사고의 발생 시 사고에 대한 복구방안을 대비하여야 한다. 보험은 위험전가의 일종으로서 피보험자의 보험가입을 통해 미래에 발생될 수 있는 피보험자의 위험을 대비할 수 있는 제도이다. 건설공사보험의 가입이 일반화되고 가입률 또한 증가하고 있음에도 불구하고, 실제 건설현장의 프로젝트 관리자는 보험가입을 정해진 예산 범위 내에서 보험사에서 제공하는 보험안내에 따라 가입하는 위험대비 정도로 인지하고 있다. 이러한 현실은 실제 당해 건설공사에서 발생될 수 있는 위험과 평가된 위험에 대한 보험사의 보험료에 대하여 프로젝트관리자가 보험료의 적정성을 판단하지 못할 뿐만 아니라, 보험가입 후 건설현장에서 실제 발생될 수 있는 위험요인을 보험가입 당시 평가된 위험요소와 연계하여 관리하지 못하고 있다. 본 연구에서는 이러한 현행 건설공사 보험가입의 증가추세에 따라 합리적인 건설공사보험의 보험조건 및 보험가입을 위하여 현행 건설공사 보험 운영현황의 고찰을 통한 건설공사 보험운영의 문제점 제시 및 성공적인 건설공사보험 가입방안을 제시하였다.

건설공사보험 확대 당위성 및 예산소요 분석 연구 (An Analysis on Expanding Construction Insurance and Estimating Necessary Budget)

  • 본 연구에서는 건설공사보험 확대의 당위성을 분석하고 확대를 위한 예산소요를 추정하였다. 건설공사 손해배상보험은 국가계약법, 지방계약법 등 관련법규에서 의무화하고 있으며, 건설공사의 수행 중에 발생하는 예기치 못한 사고로 인한 사업목적물이나 재산상 손해의 배상을 위하여 가입하고 있다. 현재 200억 이상 PQ공사 및 대형공사만을 의무가입대상으로 공공발주자가 보험료를 지원하고 있다. 의무가입 대상 공사의 경우 발주자가 보험료를 부담하지만, 200억 미만 공공공사의 경우 업체가 자기부담으로 손해를 배상해야 하는 형평성문제가 발생한다. 비의무대상 공사라도 많은 경우가 자기비용으로 보험을 가입하고 있으며, 민간 공사의 경우도 건설공사보험 가입이 많은 것으로 나타난다. 건설공사보험을 가입하면 건설업체의 부족한 사고관리능력을 보험회사로부터 지원받아 안정적인 조업이 가능하게 된다. 따라서 중소업체에 대한 보호와 중소규모 공사의 조업안정성을 위해 200억 이상 공공공사에만 의무화 되어 있는 현재 규제를 개선하여 중소 규모 공사까지 가입 범위를 확대시킬 필요가 있다. 비의무가입 공사의 최근 3년 평균 비중은 46%이며, 보험사의 보험료율에 근거한 원가반영율은 0.2%로 산출된다. 여기에 공종별 위험도를 감안하면 비의무가입 공사의 원가반영율은 0.13%로 추정된다. 이에 따라 향후 200억 이하 공사에 대한 보험 가입을 위해 공공공사 발주가 35조원 규모라면 209억원, 40조원이라면 239억원의 예산이 추가로 필요할 것으로 추정된다.

A Comparative Study on a Supplier Credit and a Buyer Credit in International Transactions of Capital Goods - Focusing on Industrial Plant Exports, Shipbuilding Exports, and Overseas Constructions -

  • The international transactions of capital goods such as industrial plant exports, overseas constructions, and shipbuilding exports, are so huge that tremendous amount of funds are required, and that most of the loans are long-term credits of over five years. In the export of huge capital goods, financing is more crucial than technology itself. Some of the importing countries are developing ones that are politically and economically unstable. Therefore the financing mechanism for these transactions is conclusive in winning these projects. Global financial market instability caused by US sub-prime mortgage financial crisis expanded all over the world, and the international transactions have been decreased due to global credit crisis. This indicates how much influential the financing market is in international transactions. The financing schemes are classified into supplier credit and buyer credit by who provides the financing. A supplier credit is a credit extended by an exporter(seller) to an importer(buyer) as part of an export contract. Cover for this transaction may be extended by an export credit agency('ECA') to the exporter. In a sales contract a seller shall provide fund required to manufacture goods, and in a construction contract a contractor shall provide fund required to complete a construction. A buyer credit is an arrangement in which an exporter enters into a contract with an importer, which is financed by means of a loan agreement A Comparative Study on a Supplier Credit and a Buyer Credit in International Transactions of Capital Goods 155 where the borrower is the importer. In a sales contract a buyer shall provide fund required to manufacture and procure the goods, and in a construction contract an owner shall provide fund required to complete a construction. Therefore an exporter is paid on progressive payment method. A supplier credit and a buyer credit have their own advantages and disadvantages in the respect of the parties respectively. These two financing methods are selectively used considering financing conditions such as funding cost, importer's and/or exporter's financial conditions, importing country's political risk.

해상보험증권의 해석상 작성자 불이익의 원칙의 적용에 관한 연구 (A study on the Application of the Contra Proferentem Rule in the Interpretation of Marine Insurance Policies)

  • In the absence of any guidance under statutory law, such as the Rules for Construction of Policy, MIA 1906, judges should follow the general principles of interpretation that apply to all contracts. In simple terms, Contra Proferentem Rule means that if the contents of the terms and conditions are ambiguous, they are interpreted against the writer of the terms and conditions. In the Anglo-American Contract Law, the 'default rule' is an important judicial tool that can supplement defects in contract norms and reinforce the principle of private autonomy through gap-filling techniques related to the interpretation of contracts. In Korea, it is sometimes mentioned in case of precedent, and it has been established as a clear rule. This study analyzes the interpretation of terms and conditions is not in the form that the interpretation of other general contracts and other interpretation principles are valid, but contracts based on terms and conditions are also contracts, and as a general rule, the interpretation of terms and conditions is explained like the general contract interpretation.

공공건설사업의 하자에 대한 수급인의 책임에 관한 연구 (A Study on the Contractor's Liability for the Defects in the Public Construction Works)

  • 건설사업에서 공공건설사업은 국가계약법령에 의해 집행되고 있고, 계약유형으로 볼 때 도급, 위임, 고용 등 복합적인 계약성질을 띠고 있으므로, 수급인의 하자책임을 단일화하여 규정하는 것이 쉽지 않다. 이로 인해 계약이행중 발생하는 불완전이행과 목적물 인수 후 발생하는 하자에 대한 수급인의 책임에 대한 적용 및 해석은 어려운 작업이 되어 왔다. 그리고 불완전이행이나 하자에 대한 연구는 활성화되지 못하였고, 불완전이행이나 하자관련 분쟁이 발생하게 될 경우 당사자 일방이 포기하거나 일반론적으로 접근하여 본질적인 문제해결을 이루지 못하였다. 따라서 공공건설사업에 있어서 수급인의 하자책임에 대해 심층적으로 고찰할 필요성이 있다. 이러한 문제점을 인식하여 본 연구에서는 건설공사의 하자나 불완전이행은 제조물책임법에서 규정하는 결함과는 다르므로 국내외 수급인의 하자책임에 대해 고찰한 후, 우리나라 국가계약법령에 근거한 수급인의 불완전이행 및 하자책임을 분석하여 문제점을 도출한 후 개선방안을 항목별로 도출하였다.

A Relationship of Managing Impacts of FOREX Fluctuations and Organizational Capabilities in Construction Business

  • Construction projects are high-risk activities. When undertaking such projects in an international setting, it can be complicated by foreign exchange (FOREX) fluctuation risk. This affects the construction business performance in various ways, namely its progress due to delays, which in turn create further problems, specifically cost overruns as a result of price increase in raw materials, disputes, arbitration, litigation and even, total abandonment. Thus, the effective management of FOREX fluctuations is crucial. Previous studies have focused on the need for contract safeguards, adequate insurance, careful planning and management, as well as foreign exchange futures hedging to address some of the risks triggered by FOREX fluctuations. An analysis of FOREX fluctuations in the international construction industry revealed that more often it was focused on project-specific issues. Currently, there is a relative lack of awareness on Organizational Capabilities (OC), the abilities that owned by the organization, which is essential in managing the impact of FOREX fluctuations. Where research has focused on OC, these are viewed in isolation. Therefore, this study attempts to close the gap by proposing a framework on managing the impact of FOREX fluctuations in the international construction industry, employing the OC perspective.
