  • This study is to develop a non-contact construction project management solution that can reduce cost and construction period through on-site information sharing, minimizing contact with others by COVID19, and improving the productivity of the construction industry. Decisions, checklists, and execution rates of construction costs can be checked with smart devices through sharing on-site photos and videos, exchanging opinions. Details and checklist data stored on cloud servers of sites that apply non-face-to-face construction project management solutions will be used as data for analyzing amounts and construction periods depending on the size of the construction. Real-time field information sharing will reduce expected problems and waste factors, expand communication channels with users to prevent or minimize construction disputes and claims, and contribute to the expansion and growth of new research industry markets in construction technology.

  • Construction delays are a common occurrence of most construction projects and difficult to analyze. there are some techniques to analyze delays, such as using CPM, Bar Chart but they are not enough to analyze concurrent and productivity lost delays. Productivity lost delays are different to interruption delays in computing the number of delays and analyzing concurrent delay. This paper describes the delay analysis method considering productivity including concurrent delay analysis.

  • Change is inevitable and is a reality of construction projects. Most construction contracts include change clauses and allowing contractors an equitable adjustment to the contract price and duration caused by change. However, the actions of a contractor can cause a loss of productivity and furthermore can result in disruption of the whole project because of a cumulative or ripple effect. Because of its complicated nature, it becomes a complex issue to determine the cumulative impact (ripple effect) caused by single or multiple change orders. Furthermore, owners and contractors do not always agree on the adjusted contract price for the cumulative Impact of the changes. A number of studies have attempted to quantify the impact of change orders on project costs and schedule. Many of these attempted to develop regression models to quantify the loss. However, regression analysis has shortcomings in dealing with many qualitative or noisy input data. This study develops ANN models to classify and quantify the labor productivity losses that are caused by the cumulative impact of change orders. The results skew that ANN models give significantly improved performance compared to traditional statistical models.

  • One of the controversial issues in English locative inversion (LI) construction( e. g. Under the tree sat a woman) has been the functional status of preverbal PP and postverbal NP, i.e. whether they are a subject, a complement, or filer (topic) Based on the distributional parallelisms between the PP and NP on the one hand and an ordinary subject and filler on the other this paper proposes that the PP has a dual function as a subject and filler, while the NP also has some subject properties that the PP does not have These mixed functional properties are analyzed in the theory of HPSG expecially with the versions recently developed by Sag(1997) Manning and Sag(1999) and Ginzburg and Sag(to appear). This analysis claims that the LI construction needs to satisfy two general, independent constraints head-subject- phrase and head-filler-phrase. This position suggests that the English LI construction is an instance of the peripheral phenomena whose construction specific constraint is inherited from more general core constraints.   • Recently, the number of project delay-related claims and disputes in Korean construction projects has been increasing rapidly. This suggests that the domestic construction contract practice, which has traditionally been superior to the client, is changing into a mutually balanced relationship among the contracting parties. The project delay analysis selects the application method according to the type of schedule approved at the start of the construction and how the schedule management was performed during the construction. The most important prerequisite for project delay analysis is that a complete CPM schedule agreed at the beginning of the construction is prepared and the actual progress of such schedule is well documented. This study is about applying the project delay analysis methodology of a case where a contractor claims damages to a client while constructing a large new private building construction project. In this study, it is determined whether the application of the as-planned analysis method is appropriate to the incomplete CPM schedule and then proposes the as-planned vs. as-built analysis method based on the new standard as an alternative. Next, apply the as-planned vs. as-built analysis method to the schedule in the case project, and then compare it with the result of the as-planned analysis method. The purpose of this study is to suggest a project delay analysis method suitable for the domestic schedule management practices, so that it can be used as a meaningful reference in project delay disputes and litigations of domestic construction projects.

A Study on First Demand Guarantees in International Construction Projects -Disputes arising from the DG and Recommendations for their Drafting- (해외건설공사에서 독립보증에 관한 분쟁과 그 대책)

  • Since the 1970s, international construction employers have commonly requested first demand guarantees upon their contractors as a form of security for due performance of their works. Contractors prefer the greater protection offered by more traditional forms of security requiring presentation of an arbitral award or other evidence of the caller's entitlement to compensation. Many contractors nonetheless feel that they have no alternative but to provide these unconditional guarantees in order to compete. However, these unconditional first demand guarantees are controversial and have given rise to numerous disputes both in arbitration and litigation. Disputes arising from first demand guarantees can be broken down into a) applications to prevent a perceived fraudulent or otherwise unfair or improper calling of a guarantee, b) claims arising from such abusive calls and c) claims relating to the consequences of such calls even if the call itself may not be abusive as such. The contractors should carefully assess the risk of an abusive call being made bearing in mind the difficulties he may face in seeking to prevent such a call. He should also bear in mind the difficulties, delays and cost he is likely to encounter in seeking to recover any monies wrongfully called. One option would be to provide that the call can only be made once and to the extent that the employer's damages have been assessed or even incurred or even for the default to have been established by an arbitral tribunal or court. Another option would be to provide that any call be accompanied by a decision of a competent and impartial third party stating that the contractor is in breach. For example, such a requirement could be incorporated into a construction contract based on the FIDIC Conditions by submitting this decision to a Dispute Adjudication Board. Another option would be to provide for the "ICC Counter-Guarantee Scheme". In sum, there would appear to be room for compromise between the employer and the contractor in respect of first demand guarantees by conditioning the entitlement to call such guarantees to the determination of a competent and impartial third party.

  • Construction projects have high potentials of claims among a variety of stakeholders. Claims on their own are not disputes but they have high potentials leading to disputes if agreements are not made between parties due to conflicting opinions. In the event of the construction disputes between clients and contractors, it could give negative impacts to both parties and, to minimize or pro-actively manage construction disputes, the role of clients is more significant. The objective of the study is to analyze a level of associations between the types of disputes and causes of construction projects based on the association rule analysis, and to identify and discuss key characteristics and implications from client's perspectives. The study analyzes associations between the types of disputes and causes, and also identifies those with a high level of associations. It also presents the outcomes of more systematic analysis compared to descriptive statistics just based on frequencies. Through the analysis of the data cases, the study proposes the directions to resolve the causes of disputes from client's perspectives. It can assist to improve understandings of the relationships between the types of disputes and causes and to pro-actively manage the disputes of construction projects.

  • Many contractors have overlooked the construction contract general conditions and it was a bad construction practice. Today, construction project is very complex and complicated. This requires a networked contract document and results in a complicated contract conflict hardly to be solved. Therefore, to reduce the construction dispute and to enhance construction practice, clarification of definition of Owner, several conditions to be revised, insertion of design supervision were suggested in this paper.

A Study on Substantiation Methodology for Extension of Time in International Mega-Project Claims (해외 대형건설공사 공기지연클레임의 공기연장기간 입증방법)

  • Recently many Korean large-sized construction companies as well as specialty contractors have been expanding their business in the overseas market to mitigate impacts from long-term stagnation in the domestic market. Such as a result, it has been arisen as a major issue that contractors effectively manage the delays which have been commonly faced with in international mega-projects. Therefore it can be said that the ability of the delays management leads a success of project. This paper presents a review of literature for delay analysis methods such as time impact analysis(TIA) and raises practical problems to rationally substantiate the duration of extension of time(EoT) in international mega projects which have wide scope of works as well as complicated and detailed contract baseline programs by taking theoretical approaches. We suggest the two improvement concepts to substantiate the EoT claims which are effectively applicable to practical projects. The first is to sort out dominant delays among numerous delays in advance of applying a delay analysis. The second is to set up the delay sections with the advanced concept for analysing delays' effects by TIA. This study performed a case study on an actual international mega-project. to confirm the effectiveness of improvement concepts that this practical approach is applicable for the assessment of EoT. In conclusion, this paper supposes to provide practitioner in charge for an EoT claim with an advanced substantiation methodogy when they not only analyse the construction delays by using TIA, but also negotiate with stakeholders about with the assessment of EoT.
