해외건설공사 분쟁에서 ODR의 적용가능성에 관한 연구 (A Study on Applicability of ODR in the Disputes of Overseas Construction Projects)

  • Traditionally construction has been an industry that favoured ADR over formal litigation due to the complexity of technical issues. However, over the past decade construction arbitration has come under increasing attack for its rising costs and growing delays, and expansion of arbitration processes to the point that those processes are approaching the more complex and formal processes followed to resolve disputes litigation. As a result, parties are looking for new methods of resolving their disputes in a more efficient and economical manner, such as ODR. A review of the history of ODR and the practical applications of ODR in use today lead to the conclusion that the concept of ODR for construction dispute resolution appears to be possible and realistic. The advantages seem to outweigh the disadvantages, especially given the solutions suggested to overcome many of the disadvantages. While ODR may not be a realistic venue for large complex construction cases, it may be just the ideal venue for smaller and simple construction disputes. In conclusion, given the advantages that ODR arbitration does offer, the most realistic use of ODR in the short term would involve disputes consisting of a simple, one-dimensional dispute within which the parties can stipulate to the facts in the case. In such simple disputes ODR may be not only an appropriate vehicle within which the dispute can be resolved; it might be more easily accepted by the parties as the preferred platform for resolution. Hopefully, international institutions of arbitration will be successful in their development of a international standards and platform fir disputes that can be adapted for use in construction and will serve as the first step in developing ways to handle small construction claims, thereby allowing parties to resolve their disputes in a faster and more economical manner.

  • 건설사업에서 설계변경으로 인해 공사기간의 연장뿐만 아니라 이로 인한 추가적인 비용이 발생하고 있다. 추가비용 중에서 간접비 부분은 산정방법이 다양하다. 외국의 경우, 작업 생산성 손실 산정과 관련된 많은 클레임에서 각 연구기관에서 수행한 발표자료를 인용하고 있다. 하지만, 국내의 경우 생산성 손실을 발생시키는 여러 요소들이 왜 발생하는지, 그리고 전체 프로젝트에 어떤 영향을 미치는지에 대한 이해 및 연구에 관한 자료는 극히 미비한 실정이다. 따라서, 본 논문에서는 건설현장에서 생산성 손실에 영향을 주는 요소들을 분석하고, 이로 인해 발생하는 손실을 국내 현실에 적합하게 정량적으로 산정 한 수 있는 방법을 제안하고자 한다.

Bayesian Theorem-based Prediction of Success in Building Commissioning

  • In recent years, building commissioning has often been part of a standard delivery practice in construction, particularly in the high-performance green building market, to ensure the building is designed and constructed per owner's requirements. Commissioning, therefore, intends to provide quality assurance that buildings perform as intended by the design and often helps achieve energy savings. Commissioning, however, is not as widely adopted as its potential benefits are perceived. Owners are still skeptical of the cost-effectiveness claims by energy management and commissioning professionals. One of the issues in the current commissioning practice is that not every project is guaranteed to benefit from the commissioning services. This, coupled with its added cost, the commissioning service is not acquired with great acceptance and confidence by building owners. To overcome this issue, this paper presents a unique methodology to enhance owner's predicting capability of the degree of success of commissioning service using the Bayesian theorem. The paper analyzes a situation where a future building owner wants to use a pre-commissioning in an attempt to refine the success rate of the future commissioned building performance. The author proposes the Bayesian theorem based framework to improve the current commissioning practice where building owners are not given accurate information how much successful their projects are going to be in terms of energy savings from the commissioning service. What should be provided to the building owners who consider their buildings to be commissioned is that they need some indicators how likely their projects benefit from the commissioning process. Based on this, the owners can make better informed decisions whether or not they acquire a commissioning service.

  • 클레임의 발생원인과 예방에 대하여 많은 연구들이 수행되어 왔으나, 개선방안 혹은 제도개선, 대응방안 등에 대한 연구가 대부분이었다. 특히, 잠재되어 있는 클레임에 대한 구체적인 내용들을 정리하고, 예방을 위한 실무적인 연구는 미흡한 실정이다. 그러므로 향후 발생할 수 있는 클레임에 대해, 그 중 설계단계에서 잠재될 가능성이 큰 원인들을 사전에 검토 및 재확인하여 클레임을 예방할 수 있는 수단이 부족하다. 본 연구에서는, 클레임이 발생되는 시기가 대부분 시공단계이지만 클레임의 원인은 설계단계에서 발생하는 점에 착안하여, 설계단계에서 잠재된 클레임 예방을 위하여 설계단계의 설계서 등을 포함한 계약문서를 중심으로 연구를 수행하였다. 클레임의 근거서류를 준비하고, 관련법규의 적용규정을 확인하면서 클레임 발생원인을 짚어볼 수 있는 체크리스트를 개발하였다.

  • 최근 공공공사에서 공기지연은 지속적으로 발생하고 있으나 책임 미 이행으로 인하여 당사자의 손해 발생은 물론 클레임 및 분쟁으로 비화될 가능성이 점차 커지고 있다. 이는 현행 공정관리가 책임구분이 불가능한 문제점을 내포하고 있어 공기지연이 반복적으로 발생되며, 당사자의 책임이행도 불가능하게 만들고 있기 때문이다. 따라서 공기지연의 반복적 발생을 예방하고 공기지연에 대한 당사자의 능동적 책임이행을 위하여 책임구분이 가능한 공기지연관리 방안의 마련이 매우 필요한 실정이다. 이러한 관점에서 본 연구는 건설현장에서 쉽게 활용할 수 있는 지연사유에 대한 사전적 관리 개념을 도입한 공기지연 사유 관리 모델을 제시하였다. 제시한 모델은 첫째, Cell 개념의 사유 세분화 및 계층화를 통한 사유의 근본 원인을 파악하기 용이하게 하였으며, 둘째, 발주자, 시공자, 제3자로 업무 수행 절차를 구분함으로써 지연사유를 명확하게 구분할 수 있게 하였다. 셋째, Matching 시스템을 통한 사유, 일수 및 해당근거를 연계함으로써 클레임에 대한 명확성을 제시할 수 있도록 하였다.

한국어 피동문의 구조와 가능(potential)의 의미 해석 -대조적 관점에서- (A Structure of Passive Constructions in Korean and their meaning 'Potential')

  • Which syntactic function should we assign to the 'ga-type' constituent which occurs in the morphological passive constructions in Korean, [N0-neun N1-i Vpass-ending]? This problem is very important in two respects. First, a small change of status of the particle 'i/ga' can exert an overall influence on the Korean grammar. Second, the particle '-i/ga' cannot guarantee that 'ga-type' constituents are subject of the sentence, so that the concept of syntactic category should be distinguished from that of syntactic function. This paper claims that the analysis of sentence has long been focused on the structure of proposition, namely the argument structure and that the direction of analysis should be turned to the 'person structure' which can be revealed on the pragmatic level. On the basis of this, this paper suggests that the specific type of the morphological passive constructions in Korean, [N0-neun N1-i Vpass-ending] should be analysed in line with the psych-verb constructions and that the modal meaning 'potential' of the passive constructions is correlated with sentence pattern and 'person structure'.

  • It is an social issue that is various claim related on the defect of apartment house. The cost of defect repair is the most important matter that residents dispute constructers with the huge time wasting and cost loss. For resolve the matter of defect claim, it must to be analyze to the cost property that study and find to pending issue about the cost of defect repair. Therefore this study is investigated the cost property of defect repair relation on correlation analysis and regression analysis around the judgement cost. Consequently, cost of the judgment is associated with cost of the accusation and cost of the defect repair, is recognizable as them that is closely connected. Meanwhile, the more time of take effect and time of lawsuit increase, the more cost of the judgment decrease by draw the regression equation. On the contrary, there are same aspects in the case on the cost of the accusation and cost of the defect repair.

소비자 관점에서 본 주택 및 인테리어 하자 실태 분석 및 인테리어 서비스 평가 (Analysis on Defect Disputes in Housing & Interior Design from Consumers' Perspective and Interior Design Service Evaluation)

  • The purpose of the study was to investigate defect cases in residential interior design, to identify the state of defects, and to categorize types of defect and disputes. In addition, consumer appraisal to residential interior design service were analyzed. The results of this study could provide fundamental information regarding the defects and claims in residential interior design. First, we did literature review for defect disputes in architectural design and interior design. We identify the definition of defects by building life cycle, by state of construction, by activity, and by design performance. Second, we analysed interior design defects cases reported in Korea Consumer Agency & Ministry of Land, Infrastructure and Transport. A total of 49 cases of defect disputes in residential interior design from 2000 to 2015 were investigated. As a result, many defects appeared during the construction stage. A majority of defects cases fall into insulation, water-proofing/leakage work. In terms of design aspects claim, functional and aesthetic defects were claimed. Third, from Consumer Market Evaluation Indicators, raw data from 500 respondents were investigated for the housing repair and interior design. It is found that information comparability, responsiveness to consumer claim, price, and safety are important factors for consumer satisfaction in interior design.

건설공사보험 피해 보상금 지급액을 활용한 리스크 분석 (Risk Analysis using Construction Insurance Claim Payouts)

  • 최근 건설프로젝트는 산업성장의 영향으로 대형화 복잡화 첨단화 되어 가며, 이로 인해 건설공사 리스크의 불확실 요소가 증가하고 있다. 이에 따라, 복잡해진 현대 건설 프로젝트에서 예측 및 대응할 수 없는 리스크 관리 방법에 관한 연구가 필요하다. 이에 본 연구는 A보험사의 클레임레코드를 토대로 실제 건설 공사 현장 내에 보상금 지급액 데이터를 수집하였으며, 사고원인 분석 및 회귀분석을 실시하였다. 사고원인 분석을 위해 본 연구에서는 공정률별, 계절별, 총공사금액별로 분류하고, 사고 빈도와 보상금 지급액으로 분석하여 리스크 중점관리요인을 도출하였다. 두 번째, 종속변수로 피해율을, 독립변수로 자연재해 위험도와 지리정보, 시공방법 및 능력, 프로젝트 규모로 분류하여 다중회귀분석을 실시하여, 총공사금액 대비 보상금 지급액에 대한 피해율 예측 모델을 개발하였다. 회귀분석 결과 45.5%의 설명력을 가진 피해율예측모델을 개발 및 검증하였다. 본 연구의 결과는 향후 건설 공사의 정량적인 리스크 분석 모델 개발 및 리스크 인자에 대한 검토를 위한 자료로 활용될 것이다.

The Effect of Process/Result Distinction on the Grammaticalization of Verbs

  • Tobin (1993) argues that verbs can be classified according to the process/result distinction. He further claims that the grammatical development of the lexical verbs into auxiliary/aspectual verbs is motivated by the distinction. In this paper, first, I reconsider Tobin's (1993) claim in the viewpoint of the principle of persistence (Hopper 1991) or the source determination hypothesis (Bybee, Perkins, and Pagliuca 1994), which states that the meaning of the source construction determines the path of grammaticalization. I then classified tense/aspect/ modality markers according to Tobin's (1993) process/result distinction. Finally, I argue that Tobin's (1993) process/result distinction constrains the distribution of grammaticalized verbs among tense/aspect/modality markers not only in English and but also in Korean.
