A nuclear power plant construction is a complex form of construction which comprises various stakeholders and contractors. Therefore, contract disputes will occur due to conflicting interests of contracting parties and unpredictable factors which arise during construction work. Even if the contract is well prepared, it cannot fully prepare for future situations in actuality. Claims management is very important in carrying out construction management. This study intends to define claim, and delve into development of claims management processes from the viewpoint of owners and contractor through consideration on international contract terms on claims management and the details of the claims management of the Construction Extension to the PMBOK. In addition, it is needed to accumulate and manage data on claims that have occurred so that they can be referenced in the future. As information should be accumulated so that type classification can be carried out and that lessons can be learned on claims that have occurred in each business site, study on establishing data-based systems relating to claims processes will be needed in the future.

Dispute related to construction projects involving numerous persons is one of the biggest challenges faced by contractors today. It costs a substantial amount of money and time in resolving these kinds of claims. Recently, with the changes in the construction environment and thought of relation with owner, the number of construction claims has increased. But, a majority of these claims do not prevail, and in fact, frequently get dismissed in its entirety. The reasons for such dismissals include the ignorance about the claims, lack of clear and convincing evidence, and so on. But most of reasons are the claims are not managed well on construction process. This paper analyzes the failure causes by relying on past claim failure cases, and then drew works that have connection with failure causes through interview. It also presented importance degree of construction management works.

This paper discusses the role of construction management (CM) profession in claims management. It reviews the attitudes, psychology and practices relevant to CM knowledge. Although claims and disputes may be never avoided in construction industry, until 1998, there are no systematic claims in the public sector in Korea. But, because of IMF, Contractors have been recognized that cost management is essential factor and contractual right can be demanded against the Public Orderer. Many affirmative effect such as, appearance of new professional service, prevention of lower quality construction, restrain of unnecessary budget expenditure, arrangement of duplicated or triplicated liability and revision of unnecessary administrative control may be anticipated through alleging claims, but in site representative manager and construction company may have ambiguous fear, somebody tried to allege claims. Therefore, to activate systematic construction claims, 32 public construction project claims alleged by contractors from 1998 to 2001 were analyzed, inactivated reasons of claims were examined and contractor's action plan to allege claims was suggested in this paper.

This study analyzed and summarized claims that took place during the past three years in the Korean construction-bonds market. Specifically, this study first examined the trend of construction-bonds claims. Second, the claims categorized according to the types of projects, suretyships, duration of settlement, amount of repayment and so on. Finally, based upon the analyzed results several suggestions, which will improve the efficiency of construction claim process, were provided.

As various stakeholders are involved in construction projects, disputes between the parties are more likely to occur, which is a very important issue for the participants in the projects. Claims in construction projects, however, are very complex and thus difficult to manage. In particular, as the cause of a claim in the preceding stage that has not been resolved in a timely manner has an effect on the cause of a claim in the following stage, it is difficult to find a point of compromise regarding a claim caused by the relationship between the causes that occur in the preceding and following stages. In this regard, this study sought to examine the rules for the generation of change order claims, which occur most frequently among the construction claims, and thus to select the key management targets through the analysis of the relationship between the causes of claims arising in the preceding and following stages for the efficient management of claims. It is expected that the use of rules for the generation of change order claims as well as of representative and similar cases will help the construction practitioners in judging claims, considering the relationships among the causes of the claims. Meanwhile, in this study, association analysis was conducted regarding the causes of the occurrence of change order claims in a design-build delivery method, and therefore, it is necessary to verify the effectiveness of the method when applied to other delivery methods.

Design-build projects were devised to enhance the design technologies of the domestic construction industry and the efficiency of public works, contributing greatly to the development of construction technologies. However, as various stages of the process, such as formulation of basic plans and design documents, and deliberations proceed, claims, including changes in the requirements of clients, and design changes occur. These claims result in the delay in construction and an increase in construction costs. In this regard, this study attempted to identify main claims that delay construction and increase the costs of design-build projects, prevent claims in the future, and improve the efficiency of project implementation.

Claims and disputes are major causes of cost and schedule overruns in the construction business. In order to manage claims and disputes effectively, it is necessary to analyze various types of contract documents punctually and accurately. Since volume of such documents is so vast, analyzing them in a timely manner is practically very challenging. Recently developed approaches such as artificial intelligence (AI), machine learning algorithms, and natural language processing (NLP) have been applied to various topics in the field of construction contract and claim management. Based on the systematic literature review, this paper analyzed the goals, methodologies, and application results of such approaches. AI methods applied to construction contract management are classified into several categories. This study identified possibilities and limitations of the application of such approaches. This study contributes to providing the directions for how such approaches should be applied to contract management for future studies, which will eventually lead to more effective management of claims and disputes.

Differing Site Conditions('DSC') Claims among construction claims are on the increase as a direct result of the steady construction of Social Overhead Capital Facilities initiated by Government. As DSC claims generally became apparent during the intial stage of the construction project, it is necessary to timely review and study the proposal on the prevention of DSC claims because delayed settlement will incur more substantial damages to all parties concerned. This research is focused on the identification and analysis of the causes for DSC claims as applicable to design-build project in public sector and it presents the possible short term, medium and long term proposals on the improvement of causes related with DSC claims. The major results of this research are summarized as follows: 1. Improvement of contractor's tender practice 2. Contractor's division of responsibility on the site survey 3. Improvement of owner's exculpatory clause 4. Flexibility on the adjustment of contract amount The proposals stated above could be useful in resolving the DSC claims between owner and contractors.

In the inner turn key constructions the problems of uniform types are repeatedly occurred, and, especially, many problems happen up to the stage of pre-construction(from a bid to a contract) owing to the specialties of the turn key constructions. So the claim factors of the Korean turn key constructions were abstracted in antecedent paper. When the technicians meeting the interior turn key constructions for the first time and working here now are well acquainted with only these factors, many claims will be prevented. By analysing the degree of claims by claims factors through the questionnaires to the experts about the abstracted factors and surveying the amount of the claims through the case studies, what factors exerted how much of influence on the claims was tested and analyzed. Studying and Managing the factors affecting the claims much led the technicians in charge of internal turn key constructions to the prevention and the proper solution of the site claims.
