Construction bid documents contain various errors or discrepancies giving rise to uncertainties. The errors/discrepancies/ambiguities in the bid document, if not identified and clarified before the bid, may cause dispute and conflict between the contracting parties. Given the fact that bid document is a major resource in estimating construction costs, inaccurate information in bid document can result in over/under estimating. Thus, any questions from bidders related to the errors in the bid document should be clarified by employers before bid submission. This study aims to examine the pre-bid queries, i.e., pre-bid request for information (RFI), from state DoTs of the United States to investigate error types most frequently encountered in bid documents. For the study, around 200 pre-bids RFI were collected from state DoTs and were classified into several error types (e.g., coordination error, errors in drawings). The analysis of the data showed that errors in bill of quantities is the most frequent error in the bid documents followed by errors in drawing. The study findings addressed uncertainty types in construction bid documents that should be checked during a bid process, and, in a broader sense, it will contribute to advancing the construction management body of knowledge by clarifying and classifying bid risk factors at an early stage of construction projects.

Civil projects are associated with many uncertainties because they involve a long duration, many resources, a large area, and many supply chains. Therefore, the price of a civil project is not simply proportional to the quantity and unit price of the item but has a variable value, including uncertainty risk. This study investigates the influence of the uncertainty factors in the pre-bid clarification document on bid price formation during the project bidding phase. To this end, civil projects from the California Department of Transportation (Caltrans) were used as research data. This study randomly selected fifty sample data from each of twelve counties from 2008-to 2020: six hundred. The authors observed that each project sample had 0 to n query cases due to uncertainty. Then, this study examined the project uncertainty cases and categorized them into the following four uncertainty factors: 'conflict' (UF1), 'impossibility' (UF2), 'lack' (UF3), and 'missing' (UF4). Under the extracting process, the cases are classified into four uncertainty factors. With the project not containing any uncertainty factors as a control group, the project containing these uncertainty factors was designated as an experimental group. After comparing the bidder's price, the experimental group's bid price was higher than the control group's. This result suggests that uncertainty factors in bid documents induce bidders to set a high bid price as a defense against uncertainty.

It's became essential that Korea construction companies should enter into the overseas construction market for their growth and sustainability. In order to comply with the client's required global standard and to compete with in the international market, the shifting the construction project management system to global level is required. In accordance with the demand, this paper proposes the top-level document of construction project management system as a to-be model that utilized in overseas construction projects. The project management plan ("PMP") suggested in this paper is not only the most appropriate one, which complies with the global standard, to be used when companies bid for international construction projects against foreign competitors but also has the process modeling and hierarchical structure.

In the inner turn key constructions the problems of uniform types are repeatedly occurred, and, especially, many problems happen up to the stage of pre-construction(from a bid to a contract) owing to the specialties of the turn key constructions. So the claim factors of the Korean turn key constructions were abstracted through the literature searches, the site document examinations, the case studies and the interviews with the experts. When the technicians meeting the interior turn key constructions for the first time and working here now are well acquainted with only these factors, many claims will be prevented. By analysing the degree of claims by claims factors through the questionnaires to the experts about the abstracted factors and surveying the amount of the claims through the case studies, what factors exerted how much of influence on the claims was tested and analyzed. Proposing the response devices to the factors affecting the claims much led the technicians in charge of internal turn key constructions to the prevention and the proper solution of the site claims.

건설 프로젝트에서 생산되는 대부분의 데이터는 텍스트 기반의 비정형 데이터이다. 계약서, 시방서, RFi 등 수많은 텍스트 문서들을 효과적으로 분석하기 위해서는 텍스트 마이닝과 같은 비정형 텍스트 데이터 분석 방법이 필요하다. 이에 본 연구에서는 과거에 수행되었던 해외건설공사 프로젝트의 입찰 관련 문서들을 대상으로 텍스트 마이닝을 실시하였으며, 그 결과 빈출단어의 유형, 단어들 간의 연관관계, 문서들의 토픽 유형들에 대한 파악이 가능하였다. 본 연구는 텍스트 마이닝을 활용한 해외건설공사 입찰 정보 분석을 통해 비정형 텍스트 데이터를 효과적으로 분석할 수 있는 방안을 제시하였다는 점에서 의의가 있으며, 향후 관련 분야 연구를 확장시킬 수 있는 기반을 마련할 수 있을 것이라 기대한다.

현재 우리나라에서 진행되고 있는 턴키사업은 근원적인 장점을 살리기 보다는 여러 가지 문제점이 지적되고 있다. 설계심의 방법 및 적격자 선정단계의 문제점과 제도 및 계약기준, 입찰안내서(지침서)의 불명확한 내용 등으로 턴키사업수행과정에서 각종 클레임(Claim)이 증가되고 있는 것이 현실이다. 국내 턴키사업이 바람직하게 정착되기 위해서는 입찰 및 계약단계에서 설계심의 방법과 실시설계 낙찰자 선정에 대한 적정한 대안을 마련하여야 하는 것은 물론, 턴키사업과 관련된 계약 및 발주기준, 입찰안내서의 불합리한 부분에 대한 합리적 기준을 마련하여야 한다. 본 연구는 설계변경 등 계약변경이 어려운 턴키발주사업의 클레임 사례를 분석하여 문제점을 도출하고, 이를 토대로 관련 계약 조건 및 입찰안내서의 개선방안을 제시함으로써 턴키사업으로 추진하는 공동주택건설사업의 클레임을 저감하여 효율적 사업수행에 기여하고자 하는 것이다.

클레임의 발생원인과 예방에 대하여 많은 연구들이 수행되어 왔으나, 개선방안 혹은 제도개선, 대응방안 등에 대한 연구가 대부분이었다. 특히, 잠재되어 있는 클레임에 대한 구체적인 내용들을 정리하고, 예방을 위한 실무적인 연구는 미흡한 실정이다. 그러므로 향후 발생할 수 있는 클레임에 대해, 그 중 설계단계에서 잠재될 가능성이 큰 원인들을 사전에 검토 및 재확인하여 클레임을 예방할 수 있는 수단이 부족하다. 본 연구에서는, 클레임이 발생되는 시기가 대부분 시공단계이지만 클레임의 원인은 설계단계에서 발생하는 점에 착안하여, 설계단계에서 잠재된 클레임 예방을 위하여 설계단계의 설계서 등을 포함한 계약문서를 중심으로 연구를 수행하였다. 클레임의 근거서류를 준비하고, 관련법규의 적용규정을 확인하면서 클레임 발생원인을 짚어볼 수 있는 체크리스트를 개발하였다.

국내 건설수주 규모는 2013년 91.3조원에서 2021년 총 212조원으로 특히 민간부문에서 크게 성장하였다. 국내외 시장 규모가 성장하면서, EPC(Engineering, Procurement, Construction) 프로젝트의 규모와 복잡성이 더욱 증가되고, 이에 프로젝트 관리 및 ITB(Invitation to Bid) 문서의 위험 관리가 중요한 이슈가 되고 있다. EPC 프로젝트 발주 이후 입찰 절차에서 실제 건설 회사에게 부여되는 대응 시간은 한정적일 뿐만 아니라, 인력 및 비용의 문제로 ITB 문서 계약 조항의 모든 리스크를 검토하는데 매우 어려움이 있다. 기존 연구에서는 이와 같은 문제를 해결하고자 EPC 계약 문서의 위험 조항을 범주화하고, 이를 AI 기반으로 탐지하려는 시도가 있었으나, 이는 레이블링 데이터 활용의 한계와 클래스 불균형과 같은 데이터 측면의 문제로 실무에서 활용할 수 있는 수준의 지원 시스템으로 활용하기 어려운 상황이다. 따라서 본 연구는 기존 연구와 같이 위험 조항 자체를 정의하고 분류하는 것이 아니라, FIDIC Yellow 2017(국제 컨설팅엔지니어링 연맹 표준 계약 조건) 기준 계약 조항을 세부적으로 분류할 수 있는 AI 모델을 개발하고자 한다. 프로젝트의 규모, 유형에 따라서 세부적으로 검토해야 하는 계약 조항이 다를 수 있기 때문에 이와 같은 다중 텍스트 분류 기능이 필요하다. 본 연구는 다중 텍스트 분류 모델의 성능 고도화를 위해서 최근 텍스트 데이터의 컨텍스트를 효율적으로 학습할 수 있는 ELECTRA PLM(Pre-trained Language Model)을 사전학습 단계부터 개발하고, 해당 모델의 성능을 검증하기 위해서 총 4단계 실험을 진행했다. 실험 결과, 자체 개발한 ITB-ELECTRA 모델 및 Legal-BERT의 앙상블 버전이 57개 계약 조항 분류에서 가중 평균 F1-Score 기준 76%로 가장 우수한 성능을 달성했다.
