체질 의료 서비스 시장규모 및 현황 조사 -전국 한방의료기관을 중심으로- (The Survey on the State and Scale of Constitutional Medical Service Market in Korea)

  • Objectives The aim of this study is to survey the present scales of constitutional medical service market on the base of Korean medical service market following 2006, 2008 year survey. Methods This survey was conducted from Nov. 1 to Dec. 15, 2011 by offline mail. A questionnaire including personal information, general information, and management related to constitutional medicine of Korean medical institution was sent to each subject with a returned envelope. The subjects were asked to complete the questionnaire and 108 data were collected and analyzed. Results This study revealed that the 62% facilities of all Korean medical clinics in Korea are using constitutional medicine for patients. The proportion of constitutional medical service was 13.7% in Korean medical care insurance and 23.5% in total Korean medical service market. Conclusion It is assumed that the scales of total Korean medical service market seemed to be 3,974,425 million won and the scales of total constitutional medical service market seemed to be 929,404 million won.

문헌고찰을 통해 알아본 2020년 체질 의료 서비스 시장 규모 (The Predicted Scale of Sasang Constitutional Medical Service Market in 2020)

  • Objectives Recently, the demand for complementary & alternative and personalized medical service has increased in the world. The purpose of this study was to predict the future market size of constitutional medical service in Korea through past surveyed studies Methods The portal sites of OASIS, NDSL, RISS, KISS, Koreamed, were used to select the researches related with constitutional medical service market. Total 1,477 papers were identified and 43 of them were fully reviewed. Finally, three of them picked up. Two specialists joined this review. Results and Conclusion The rate of constitutional medical service market among Korean medical service market was 23.2% in 2004 survey, 26.6% in 2007, and 23.5% in 2010. The number of Korean medical clinics and hospital was assumed 17,118 in 2020. The market size of Korean medicine was predicted 698,929 ten million won and among them, the scale of constitutional market size was 181,171 ten million won which meaned 25.9% proportion of Korean medical market size. Conclusion Constitutional medical market seems to be developed faster than Korean medical market in future.

체질의료서비스시장의 현황파악을 위한 조사연구 (Study on the Present Status of Constitutional Medical Care Market)

  • The objectives of this study were to examine the present state of Oriental clinical service based on Constitutional medicine and to make an accurate estimate of it's scale in 2015. The data for this study were collected from a questionnaire survey to 335 Traditional Korean Medical doctors who were selected as random samples. And this questionnaire is consist of several inquiries related with management and application of constitutional medicine. The 38.8% facilities of all Oriental medical centers and Clinics in the whole country are applying Constitutional medicine for treating patients. The 8,870 persons in all health workers are engaged in Constitutional clinical service. The proportion of sales by Constitutional clinical services to the total sales by Traditional clinical service is 26.6% in 2007. The proportion of application to medical care insurance by Constitutional clinical service is 21.6% of all amounts. After taking these results into consideration, the sales of Constitutional clinical service now are estimated to make up 26.6% percent of the total traditional medical service and the amount of it's sales in 2015 is expected to increase up to 2.8 times as much as the current quantity.

Objects The objectives of this study were to examine the present state of Oriental clinical service based on Constitutional medicine and to make an accurate estimate of it’s scale after 10 years. 2. Methods The data for this study were collected from a questionnaire survey to 319 Traditional Korean Medical doctors who were selected as random samples. And this questionnaire is consist of several inquiries related with management and application of constitutional medicine. 3. Results and Conclusions The major results of this survey are following: l. The 52.8% facilities of all Oriental medical centers and Clinics in the whole country are applying Constitutional medicine for treating patients. 2. The 24.8% persons of all health workers are engaged in Constitutional clinical service. 3. The proportion of sales by Constitutional clinical services to the total sales by Traditional clinical service is 23.5% in 2005. 4. The proportion of application to medical care insurance by Constitutional clinical service is 17.9% of all amounts After taking these results into consideration, the sales of Constitutional clinical service now are estimated to make up 23.8% percent of the total traditional medical service and the amount of it’s sales after 10 years is expected to increase up to 3.6 times as much as the current quantity.

  • 우리 헌법은, 국가로 하여금 국민의 건강을 보호할 의무를 지우고 있고, 이에 따라 구체화된 규범인 의료법은 의료기관 개설 등에 관한 사항을 상세히 규정하고 있는데, 그 내용 중 하나가 의료인의 의료기관 복수개설·운영 금지제도이다. 이에 대하여, 종래의 판례는 '다른 의사 명의로 추가 개설하는 의료기관에서 직접 의료행위 등을 하지 않는다면 여러 개의 의료기관을 개설·운영할 수 있다'라고 해석함으로써, 사실상 복수의 의료기관을 개설·운영할 수 있었다. 하지만 일부 의료인들이 다른 의료인의 면허로 의료기관을 여러 장소에 개설하고 이익을 극대화하기 위하여, 환자유인행위를 하거나 과잉진료 및 위임치료를 하는 등의 불법의료행위를 조장할 뿐만 아니라 국민의 건강권 등을 침해하는 현실적 문제가 발생하게 되었다. 이에 입법자는 의료법의 개정을 통해 의료인은 어떠한 명목으로도 둘 이상의 의료기관을 개설하거나 운영할 수 없도록 의료기관 개설제도를 정비하게 되었다. 이와 같은 개정 의료법 제33조 제8항이 위헌인지 여부에 대하여, 헌법소원과 위헌법률심판 제청이 되어 헌법재판소에서 오랜 기간 심층심리 끝에 최근 합헌결정이 선고되었다. 헌법재판소는, 보건의료는 상거래의 대상이 되어서는 아니 되고, 공공의료기관의 비중, 영리목적 환자유인, 과잉진료 등을 방지하기 위한 점을 감안하여 '목적의 정당성'을 인정하였다. 또한 의료인이 외부 자본에 종속될 우려가 있는 점, 의료기관 개설 명의인과 실제 운영자가 분리되는 것은 우려스러운 점, 인간의 신체와 생명이 수단이 되어서는 아니 된다는 점, 현재의 의료체계상 과잉진료 확인이 불가한 점 등을 고려해 볼 때 '침해의 최소성'도 인정하였다. 나아가 '법익 균형성' 등 기본권 제한의 원칙인 과잉금지원칙을 준수하여 합헌이라고 판단하였다. 이와 같이 헌법재판소가 우려하고 있는 영리추구, 과잉진료를 현실적으로 방지하기 위해서는 입법적 보완이 필요하다. 이와 관련하여 소비자단체는 입법의 필요성에 적극 찬성하고 있고, 보건의료 공급자 단체 또한 입법의 필요성에 공감하고 있다. 따라서 입법자는 헌법재판소의 이번 결정을 존중하고, 국민들의 입장을 반영하여 빠른 시일 내에 보완입법을 마련하길 기대한다.

일본인의 모 한방병원 체험에 관한 분석 (Analysis on Oriental Medical Tour Experience of Japanese)

  • This survey was designed to analyze questionnaire of Japanese who experienced Oriental Medical Tourism and to facilitate it afterwards. The survey was organized for 38 Japanese participants in oriental medicine hospital from Feb. 10 to Mar. 7 in 2011. According to the research, most of them didn't know about oriental medicine but they were interested. They preferred preventive medication through health improvement to medical treatment. When making decisions on which tourism products to use, the quality of medical service came first consideration for them. The most appropriate length of visit was 4~7days and cost per day was 7100~14000 yen. We need to gather more information on their various fields of interest in order to provide customized medical service and more surveys should be conducted henceforth.

An Edutainment Game Prototype for Sasang Constitutional Food Therapy

  • Objective : Recently many kinds of food therapies have sprung up to prevent or manage disease and to promote health. Seeing Korean history, the Korean medical doctors have been applying food therapy based on the thought that the dietary sources were as important as the medicine. Therefore, in this study, we designed a mobile edutainment game prototype with the goal of providing education about healthy food knowledge for users who belongs to different constitutional types. Materials and Method : We adopted the Sasang Constitutional Medicine as the medical background knowledge for our edutainment game design. Based on the user study, we developed the process of edutainment system which is composed of 'My game', 'My constitution', and 'My food'. Among the whole process, we developed a prototype for the core module - the 'My game' part. This prototype used a jumping game for mobile devices that is composed of training, level 1 and level 2 stages. Results : From the target user evaluation, it was proved that 1) in terms of the learning effect of healthy diet, the edutainment game we developed has a significant advantage over the conventional learning media. 2) after playing the edutainment game, the good and bad food identification accuracy based on picture and text format were increased by 44% and 42% respectively, and 3) target users perceived enjoyment while using this prototype, as well as showed positive intention to use this game as edutainment tool in the future. Conclusion : We designed and developed mobile edutainment game prototype to educate healthy food knowledge based on Sasang Constitutional Medicine. Through user evaluation, we proved that our prototype enhanced healthy food knowledge and that user accepted the prototype as a beneficial edutainment tool.

현지 기술 조사활동을 통한 중국의 미병 정책 및 의료서비스 최신 동향 보고 (Current Trend of Mibyeong Health Policy and Service in China through Investigation Activity of Mibyeong Technology -Report of China Technology Research Group-)

  • Objectives : This study aims to report current trend of Mibyeong health policy and service in China from interview of China Technology Research Group. Methods : China Technology Research Group visited Guanganmen hospital, Yanhuang Dongfang Company, Xinjingzhen health center, and Shanghai Shuguang hospital. With an interpreter, We had interviews about Mibyeong health service and policy trend, medical instrument, and research issue. Results :Mibyeong health service was performed based on KY3H system and collaboration with traditional Chinese medicine hospital. Mibyeong health service consists of diagnosis with nine constitutional type, health guide and preventive treatment. Community health center also provide Mibyeong health service, with cooperative treatment of traditional Chinese medicine and western medicine. China's Mibyeong health policy is established by Top-down decision, even though there is not enough evidence for providing health service to consumer. Through constitutional diagnosis, examinations, and treatment, huge data have been stacked; however, assessment and research based on these data are not processed well. Cooperative treatment of traditional Chinese medicine and western medicine is widely provided to patients, and their works are relatively well classified. Conclusions : China plays leading role in Mibyeong service and it seems to be developed more than Korea's. Further study is necessary to establish Mibyeong policy and health service in Korea.

진료수가제도의 헌법적 한계와 정액수가제의 위헌성 -헌법재판소 2020. 4. 23. 선고 2017헌마103 결정을 중심으로- (Constitutional Limits of the Medical Fee Payment System and the Unconstitutionality of Fixed Payment System)

  • 의료보장제도에서 진료수가는 의료보장체계의 근간을 이루는 매우 중요한 요소이다. 국민건강보험법은 진료수가의 결정방식에 관하여 계약제를 채택하였고, 그 계약의 내용은 상대가치점수에 대한 점수당 단가를 정하는 것이다. 그에 따라 건강보험 요양급여비용은 매년마다 물가상승이나 경제 상황의 변화에 따라 조정된다. 반면, 의료급여의 경우, 의료급여법에서는 진료수가의 결정방식에 관한 내용을 규정하지 않고, 모든 사항을 보건복지부 장관에게 위임하고 있다. 그에 따라 보건복지부 장관은 2001년부터 혈액투석 치료에 관하여 정액수가제를 채택하고 있다. 이러한 혈액투석 정액수가제에 대해서 2017년 헌법소원이 제기되었고, 헌법재판소는 2020년 헌법소원 심판 청구를 모두 기각하였다. 이 글에서는, 위 헌법소원 사건을 중심으로 진료수가제도의 의미와 내용을 살펴보고, 이에 대한 헌법적 한계로 3가지 원칙을 제시한다. 그 원칙의 첫째는 법률유보의 원칙, 둘째는 포괄위임금지의 원칙, 셋째는 비례의 원칙이다. 그러한 관점에서 검토해 보면, 혈액투석 정액수가제는 상당히 위헌적인 제도로 판단된다.

의사 환자 간 원격 의료의 의료법상 적법성에 관하여 - 원격 환자에 대한 처방 중심으로 - (On the Legality of the Telemedicine between the Patient and Doctor Under the Medical Service Act - Focused on the Prescriptions to the Distanced Patients-)

  • 원격의료는 원격지에서 영상, 통화 등 기기를 사용하여 환자를 진단, 치료하는 의료의 한 분야이다. 환자를 대면하여 진단, 치료, 처방하는 전통적인 방식에서 벗어나, 원격에 있는 환자에게 의료를 제공하기 때문에, 의료 소외 지역, 거동이 불편한 환자에 도움이 될 것이고, 의사들은 공간적 제약을 벗어나 환자를 볼 수 있다는 장점이 있다. 하지만 의사가 환자를 대면 진료하는 것에 비하면, 진료의 질이 떨어지는 문제가 나타날 수 있어서, 허용 여부와 한계를 정하는 것도 필요하다. 원격의료 유형 중에서 의사가 환자를 원격에서 진료하고 처방전을 발행하는 것을 원격진료라고 정의할 수 있는데, 현행 의료법상 허용되는지에 대하여 법 해석이 일관되지 못하고 있다. 의료법 처방전 조항은 의사의 '진찰' 또는 '직접 진찰' 규정에 의하여 처방전을 발급한다고 규정하고 있는데, 이것을 대면 진료를 요구하는 규정이라고 해석하는 헌법재판소 결정과 일정한 제한 하에서 전화 처방을 인정할 수 있다는 대법원 판결이 대립하고 있다. 또한 의료법상 원격의료 규정에 의하여 명백하게 법상 허용되는 원격의료자문 외에 의사 환자 간 원격진료는 불법이라는 대법원 판결이 있다. 본 논문에서는 의료법 개정 연혁, 개정 이유 및 관련 의료법 조항과의 관련성을 통하여 원격진료에 대한 대법원 판례를 해석하고자 한다. 결론적으로 의료법상 처방전 규정에 의한, 의사의 직접 진찰 후, 처방전 발급 조항은 환자를 진찰한 의사가 처방전을 발급해야 한다는 처방전 발급 명의에 관한 의무 조항으로 해석하며, 의료법 원격의료 규정에 의하여 의사-환자 간 원격진료는 허용되지 않은 것으로 판단한다.
