주민등록번호 변경 방법에 대한 연구 (A Study of the Change Method of Korean Resident Registration Number)

  • The Korean resident registration number has been used since 1962 as a personal identification number. The Korean government assigns this number to each korean citizen and it is not able to be changed. In 2000s, as the Internet was rapidly spreaded out, personal information such as the Korean resident registration number, name, home address, and phone number was leaked. The companies provide diverse internet service while collecting personal information. However, personal information was sometimes leaked because of hacking, poor information management and so on. As s results, some of citizens asked government and court of Korea to change the Korean resident registration number because they suffered material damage and emotional distress. The constitutional court decided to be able to change the number from 2018. In this study, the Korean resident registration number which is possible to change, serial number, public certificate, I-PIN, and My-PIN were analyzed comparatively. In addition, considerations when the Korean resident registration number was changed were discussed. The public certificate and I-PIN were appropriate to the case of on-line Korean resident registration number. The Korean resident registration number, serial number, My-PIN were appropriate to the case of off-line Korean resident registration number. Lastly, it would be efficient to manage the Korean resident registration number separately such as on-line and off-line.

The Role of Transformational Leadership in Building Organizational Citizenship: The Civil Servants of Indonesia

  • For civil servants in the legal sector, the best performance that must be shown is not how they carry out activities following standard operational procedures but what is more important is how they show Organizational Citizenship Behavior (OCB) in daily activities. This study aims to examine what factors influence the formation of OCB civil servants in the legal sector in Indonesia. The study was conducted on 145 civil servant respondents who were involved in secretarial activities, each from the Judicial Commission Secretariat, the Attorney General's Office, the Ministry of Justice, the Supreme Court, the Police Headquarters, and the Constitutional Court. The research methodology used Partial Least Square (PLS) Version 3.0. The empirical findings of the research show that organizational culture has a significant influence in shaping transformational leadership that can build OCB among civil servants in Indonesia. This effect is much larger and more significant than the compensation system, which is widely believed to be the main factor in forming OCB, such as the results of previous studies. The results of this study imply that the formation of an organizational culture with values that can create high work productivity which has an impact on transformational leadership styles in building OCB.

인간다운 생활을 할 권리와 건강권 (The Right to a Humane Livelihood and the Right to Health on Korean Constitution)

  • 이 글은 현행 헌법의 규정과 헌법재판소 결정 그리고 개헌안의 건강권 신설 규정 등을 비판적으로 검토함으로써 건강권의 헌법적 의미를 특히 '인간다운 생활을 할 권리'와의 관련성 속에서 고찰하는 것을 목적으로 한다. 건강은 개인의 일반적인 행위 및 가치실현의 전제가 되는 기본적인 자유로서의 성격을 갖게 되었으며, 국가는 개인의 건강을 보호하여 가장 기본적인 '인간다움'의 조건을 보장하고 자유 실현의 기초를 마련해야 한다. 헌법 제36조 제3항에서 규정하는 보건 보호라는 국가 과제는 인간다운 생활을 할 권리에 관한 헌법 제34조의 구체적 내용으로 이해되어야 한다. 그리고 인간다운 생활을 할 권리를 '사회보장권'으로 이해할 경우, 헌법상 건강권은 '건강에 관한 사회보장권' 내지 '건강보장권'을 의미한다고 할 수 있다. 한편, 헌법재판소는 인간다운 생활을 할 권리에 대한 사법심사에서 소위 '최소한의 물질적인 생활 기준'을 채택함으로써 동 권리의 내용을 협소하게 파악하고 있다. 그러나 인간다운 생활을 할 권리는 '인간의 존엄성에 맞는 건강하고 문화적인 생활을 향유할 수 있는 권리'를 의미하고, 다만 그 보호의 수준이 어느 지점인지에 대한 판단이 일차적으로 입법재량에 맡겨져 있을 뿐이다. 그렇다면 인간다운 생활을 할 권리에 관한 사법심사는 입법재량의 통제 문제로 귀결된다.

물리치료사에 대한 의사의 "지도"의 목적론적 해석 (A Teleological Interpretation of a Doctor's "Guidance" for Physical Therapist)

  • PURPOSE: The law pertaining to medical service technologists does not discuss the scope and limits of doctors' guidelines. My paper aims to discuss these topics. METHODS: This study was based on a review of literature and an analysis of judicial precedents. RESULTS: Physical therapists have often noted the need for independent practitioners in their articles on health care. Their continued discussions on professional and educational differences have centered round this issue, but their ideas have not been accepted. Practitioners have continued to interpret doctors' guidelines in hospitals without discussing their scope. However, the Supreme Court presented a meaningful decision outlining the conceptual limits and the scope of medical practice. The court suggested, basing its interpretation in the goal of clarifying the concept of medical activities smoothly, was to follow a specific judgment on the levels of education, testing, and professionalism. CONCLUSION: The role of physical therapists is expanding in this country, in order to meet the needs of the ultra-aged society. Education is already responding to rising training needs. By dividing the doctors' guidelines into indirect and direct types, if there's no medical risk near or around the health center or hospital, it is a good idea to allow the management of physical therapy partially, while understanding the scope and limitations of these guidelines clearly. A teleological interpretation of the law is especially relevant, and can be implemented immediately by the authoritative interpretation on part of the health authorities without any legal amendments.

SNS를 통한 선거의 자유와 허위사실공표죄 (Through SNS and freedom of election Publicized criminal misrepresentation)

  • 이 논문에서는 헌법재판소의 판결을 통하여 SNS를 통한 선거운동의 자유가 사실상 보장되었음에도 불구하고, 아직도 많은 부분 공직선거법상에서 선거운동의 자유를 제약하는 규정이 존재하여 이것이 앞으로의 선거에서 많은 법적인 문제를 야기할 가능성이 농후하다. 더욱이 그동안의 선거운동과는 차원이 다른 SNS를 통한 선거운동의 과정에서, 무한확산의 가능성이 어느 시점보다 높아지고 있는 시점에서 SNS를 통한 선거운동의 자유와 공직선거법상 허위사실유포의 한계와 관련하여 많은 문제가 발생할 가능성이 높다. 이에 그동안의 공직선거법상 허위사실 유포죄는 유포한 사실이 허위일 뿐만 아니라. 그 유포를 통하여 특정인을 낙선시키려는 목적이 있어야 성립하는 범죄로 규정되어 있음에도 이에 대한 엄격하게 해석하기 보다, 유포된 사실이 허위인가에 대하여 판단하는 형태로 법원의 판단이 이루어져 왔다. 따라서 이 법을 개정 또는 삭제하기 전에 엄격한 해석의 필요성에 대하여 논의하고자 하였다. 입법론상 폐지하는 것이 바람직하지만, 우선 해석학을 통하여 문제점을 지적하였다. 첫째, 보호법익을 본죄의 취지 맞게 제한적으로 해석하고자 하였다. 둘째, 본죄가 목적범이기 때문에 목적범에서 목적은 본죄의 경우 엄격하게 해석할 필요성을 주장하였다. 왜나하면 인터넷 공간에서 이른바 리트윗의 경우에는 팔로워들이 별 의미없이 행해지는 경우도 많을 것이기 때문에 본죄로 처벌하는데 한계가 있을 것이 분명하다. 그리고 모처럼 헌법재판소에서 SNS를 통한 선거운동의 자유를 보장하고 있는 만큼, 우리나라에서 선거의 자유로운 소통의 장을 열어주는 의미에서도 제한적 해석은 필요하다. 이는 표현의 자유를 높게 보장하게 될 것이고 이는 성숙한 시민사회로 가는 첩경이 될 것이기 때문이다.

진료수가제도의 헌법적 한계와 정액수가제의 위헌성 -헌법재판소 2020. 4. 23. 선고 2017헌마103 결정을 중심으로- (Constitutional Limits of the Medical Fee Payment System and the Unconstitutionality of Fixed Payment System)

  • 의료보장제도에서 진료수가는 의료보장체계의 근간을 이루는 매우 중요한 요소이다. 국민건강보험법은 진료수가의 결정방식에 관하여 계약제를 채택하였고, 그 계약의 내용은 상대가치점수에 대한 점수당 단가를 정하는 것이다. 그에 따라 건강보험 요양급여비용은 매년마다 물가상승이나 경제 상황의 변화에 따라 조정된다. 반면, 의료급여의 경우, 의료급여법에서는 진료수가의 결정방식에 관한 내용을 규정하지 않고, 모든 사항을 보건복지부 장관에게 위임하고 있다. 그에 따라 보건복지부 장관은 2001년부터 혈액투석 치료에 관하여 정액수가제를 채택하고 있다. 이러한 혈액투석 정액수가제에 대해서 2017년 헌법소원이 제기되었고, 헌법재판소는 2020년 헌법소원 심판 청구를 모두 기각하였다. 이 글에서는, 위 헌법소원 사건을 중심으로 진료수가제도의 의미와 내용을 살펴보고, 이에 대한 헌법적 한계로 3가지 원칙을 제시한다. 그 원칙의 첫째는 법률유보의 원칙, 둘째는 포괄위임금지의 원칙, 셋째는 비례의 원칙이다. 그러한 관점에서 검토해 보면, 혈액투석 정액수가제는 상당히 위헌적인 제도로 판단된다.

GIS을 활용한 장기 미집행 도시계획시설 재정비에 관한 연구 (A Study on the Reformation of Long-term Unexecuted Urban Plan Facilities using GIS)

  • Many urban-plan facilities were settled by the government in the need of infrastructure due to the rapid urbanization. The Constitutional Court judged that the exclusion of land-owners' private right to use their land did not accord with the Constitution, and the infringement of their right because of currently unexecuted facilities became the urgent task to be solved due to the revision of the Urban plan law revised on January 28, 2000. Accordingly, the government needed to establish a complete plan to review and rearrange the long-term unexcuted urban plan facilities. For this plan to be successful, we have constructed the database of unexecuted urban plan facilities by using GIS analysis technique in this research. Further, we will construct a basic database to manage the unexecuted urban plan facilities by utilizing the database we have constructed, computerized geographical information files of LMIS, urban plan facilities data of UPIS, and other information.

미국 의료개혁법의 의료보험 의무가입 제도에 대한 연방대법원의 합헌결정 (The Constitutionality of Individual Mandate under the U.S. Patient Protection and Affordable Care Act of 2010)

  • The Unites States has been plagued with soaring health care costs and an alarmingly large number of uninsured population. The Patient Protection and Affordable Care Act of 2010 ushered in the most sweeping health care reform in the United States since the introduction of Medicare and Medicaid in 1965 to address these issues. The law's requirement for individuals to purchase health insurance (the so-called "individual mandate"), however, not only caused a political stir but also prompted constitutional challenges. Some questioned whether the federal government, lacking general police power, could require its citizens to buy unwanted insurance based on its enumerated powers under the U.S. Constitution. This paper summarizes the decision of the U.S. Supreme Court on the constitutionality of individual mandate, and explores how the decision relates to Korea's own universal health care.

The Exploratory Study on Prevention of illegal Medical Advertisement in Healthcare Market

  • It is natural that the medical advertisement should be guaranteed as part of the basic commercial activities of medical institutions. However, the general public are non-specialist and they have less informed about medical care than medical specialists, and it is not easy to judge and select medical information. Also, if someone damaged by illegal medical advertising, it cannot be recovered to the original. In this regard, medical advertising has been legislated so that medical organizations can pre - screen the medical laws. However, In December 2015, after the Constitutional Court ruled unconstitutional preliminary censorship, it became virtually impossible to pre-screen. In recent years, illegal medical advertisement have been on the rise, and false and exaggerated medical advertising are increasing the damage to medical consumers. Therefore it is urgent to take countermeasures about this. Thus, this paper try to analyzes the characteristics of general commercial and other medical advertisements and looks for alternatives that can minimize the damage caused by illegal medical advertisements and institutional weaknesses by analyzing the regulatory trends in medical advertising.

우리의 소원은 독립 (Dream of Korean Physical Therapist)

  • Purpose : The objective of this study was conducted to find out solution that physical therapist can get own clinic. Method : This is a literature study with books and reviewing the dismiss a suit of the court of constitutional law. Results : Physical therapist can have own clinic with legislature by the legislation and the Executive activities. Physical therapist is not only head of rehabilitation but all so controller. Physical therapist has different roll for the patient than medical doctor. Conclusion : Physical therapist was educated for the patient‘s activities. Physical therapist can increase task performance of the patient and life of quality.
