현행법상 의료법인의 비영리성과 문제점 (Noncommerciality and problem of a medical corporation under the present law)

  • Under the present law, a medical corporation has the legalistic character of a noncommercial corporation and its commerciality is restricted by public service. In a recent precedent, however, a judgment has considered the service part in medical practice. The tendency of a precedent is that both commerciality of a medical institution and medical corporation are allowed to be pursued under fundamental order-observance. This change is found in china and india, which consider a medical service as national industry. In the case of ours, the now government demonstrate the industrialization or the market of medical service through promotion of commerciality of a medical corporation. This paper deal with the meaning of a medical corporation and the present condition of medical market under the present law and recommends a tendency of law policy through study of foreign's and our precedent for commerciality of medical advertisement and medical corporation.

미용성형수술의 특수성 (Characteristics of Aesthetic Plastic Surgery)

  • Aesthetic plastic surgery rarely has the lifesaving, the medical necessity, and the emergency, because it was executed in order to acquire personal satisfaction in the external features. In addition, aesthetic plastic surgery has the strong commerciality in that it is based on the attraction of a client through medical advertisement and the range of uninsurance. These characteristics cause whether aesthetic plastic surgery is included in medical procedure and the legal contract between physician and client is controversial issue. Also, attention and explanation in aesthetic plastic surgery are more emphasized than those in general medical procedure. According, this document presents the various characteristics of aesthetic plastic surgery, which differs from that of general medical procedure.

  • 국내 문화 예술 산업에서 게임과 관련된 음악 혹은 OST가 드라마, 영화, 애니메이션 등의 타 장르와는 다르게 국내의 미디어 매체에서 언급과 노출이 비교적 적은 편이다. 게임을 소비하는 일부 이용자를 제외한 일반적인 대중은 게임 음악을 접할 기회가 많지 않기 때문에 게임 음악은 여전히 문화 예술이 아닌 게임 음악이라는 틀 안에 갇혀 있다. 본 논문에서는 국내 온라인 게임과 관련된 음악의 상업성에 대해 분석하고 게임 음악이 하나의 음악 장르로 자리를 잡기 위한 방안을 제시하고자 한다.

영리기업으로서 민간경비의 영업활동에 대한 제도적 제약성 고찰 (A Study of Institutional Restrictions for Private Security's Activities as for Profit Businesses)

  • 민간경비엽은 사설영리기업으로서 영리성을 목적으로 하고 있으며 동시에 범죄예방이라는 사회적 공익을 우선하고 있다. 이러한 측면에서 민간경비업에 대한 영리성과 공익성의 문제가 상충되고 있으며 영리기업이면서도 공익에 대한 관리감독을 받고 있다. 영리기업의 설립조건과 영업활동권은 상법에 명시되어 있으며 자연인으로서 국민적 기본권과 직업선택의 자유는 헌법에 보장되어 있다. 그럼에도 불구하고 민간경비업은 공익이라는 사회적 기능을 이유로 경비업볍에 준하여 설립조건이나 영업활동의 제약, 직업선택의 자유 등에서 제약을 받고 있다. 즉, 영리법인이면서도 헌법조항의 기본권이 무시되고 있으며, 상법상 법인설립기준이나 영업활동보장권을 적용받지 못하고 있는 것이다. 경비업법에 따르면 경비업을 영위하고자 하는 자는 반드시 법적절차에 따라 해당기관으로부터 허가를 받아야 하며 회사를 대표하는 임직원들도 결격사유가 있어서는 안 된다. 그러나 상법상 법인설립의 기준은 1명이상, 업종별 규정에 따라 차이가 있지만 기본적으로는 자본금 100원 이상이면 법적제약을 받지 않고 회사설립을 할 수 있고, 헌법에 보장된 노포권에 따라 영리를 목적으로 한 모든 소득활동은 보장된다. 이에 따라 본 연구는 민간경비업의 특수성에서 비롯되는 공익성과 영리성에 대한 법적 제도적 문제점을 살펴보고자 한다.

농식품 플랫폼의 선택속성이 고객만족에 미치는 영향: 공급자신뢰의 매개효과 중심으로 (A Study on the Effect of Selection Attributes of Agrifood Platform on Customer Satisfaction: Focusing on the Mediating Effect of Supplier Trust)

  • 본 연구에서는 농식품 플랫폼 이용자를 대상으로 플랫폼 선택속성이 공급자신뢰를 매개하여 고객만족에 미치는 영향을 분석하였다. 선택 속성의 하위변수로는 다양성, 편리성, 정보성, 상품성 및 상호작용성으로 구분하였다. 수집된 설문지 190부와 SPSS v24.0과 Process macro 4.0으로 실증분석에 사용하였다. 분석결과는 첫째, 정보성, 상품성 및 상호작용성은 공급자신뢰에 정(+)의 방향으로 영향을 미치는 것으로 나타났고 다양성과 편리성은 공급자신뢰에 영향을 미치지 않는 것으로 나타났다. 둘째, 공급자신뢰는 고객만족에 유의한 정(+)의 영향을 미치는 것으로 확인되었다. 셋째, 편리성, 정보성, 상품성 및 상호작용성은 고객만족에 정(+)의 방향으로 영향을 미치는 것으로 나타났고 다양성은 고객만족에 영향을 미치지 않는 것으로 나타났다. 넷째, 공급자신뢰는 선택속성의 정보성, 상품성 및 상호작용성과 고객만족 간을 매개하는 것으로 검정되었다. 이와 같은 결과들은 소비자에게 플랫폼의 정보성과 상품성 그리고 상호작용성이 공급자신뢰를 높임으로써 고객만족을 높일 수 있다는 것을 시사한다.

  • The rail reform in Korea is to separate passenger transportation from freight transportation as a way to vitalize rail freight. The author review the problems rail freight faces, the aims of rail reform, the possibility to introduce competition into the rail freight operation, foreign cases of rail freight and make suggestions about the vitalization of rail freight transportation such as industry structure possible for door-to-door service and low cost operation, freight transportation policy of government, capacity expansion, preparedness for internationalization, mechanism for increasing transparency between users and operators and transfer to commerciality of the carrier.

  • The purpose of this thesis is to investigate the way how the image of Korean costume could be introduced into the world fashion market, and appreciated by foreigners. For this purpose. 1 focus on analyzing the works of Lee, Yong-Hee presented in Pret-a-Porter Paris Collection and interpreting the image of Korean costume in her works. I propose some imperative factors essential to promote the participating of Korean costume into the world fashion market. Firstly. the Korean costume should be reevaluated and moderated in a degree, to be acceptable or accessible to foreigners. Secondly, the commerciality is to be stressed in the light of fashion industry dealing with the practical function of the costume. Thirdly, Our open-mindness to other culture would also make our costume to be more prevalent in world fashion market paradoxically. The Seoul Collection in 2000 fall was opened by Korean government on the recognition that the fashion industry is highly productive and helpful not only in cultural basis but in economics.

  • This study critically analyzes the present situation of the domestic game industry that infringes game nature or diversity, which is the essence of game contents such as copycat, auto play, excessive billing inducement, indiscriminate advertisement developed by focusing on commercial aspect, It suggests the necessity of creative and various game development environment. It suggests development direction for the development of domestic game industry through game case analysis which shows the possibility of game media out of existing success formula and does not concentrate only on commerciality and makes effort to give new fun to users.

Haute Couture에 나타난 John Galliano의 작품세계 -2000년대 C. Dior 중심으로- (The Works of John Galliano in Haute Couture - With a Focus on C. Dior in 20005 -)

  • The purpose of this study is to grasp the world of Galliano works who lead Dior Couture and to make use of this knowledge to comprehension of general trend in Haute Couture and $pr{\hat{e}}t-{\acute{a}}$-porter in the future. The method of research is to search for the characteristic of Haute Couture and the general tendency of Galliano works, and to view the inclination of Dior Couture by Galliano. For sphere of research, 2000s is discussed with focus on Haute Couture, exclusive of ready-to-wear. As a result, Galliano's Couture works were distinguished into four specificities. First, the historicity including historical event, personage and epoch. Second, the orientalism. Third, the pictorial characteristic including synthetic art and public art. Forth, the quality of humor. These subjects bring about a result that break down each boundary, in the method of interpreting, as try out mixing between every elements. Galliano pursue a new domain through the fusion of East and West, past and present, classic and pop, artistry and commercialism, this induce more familiar Haute Couture to the public, breaking the strict form of Couture. It seems that this tendency will be advanced toward extrovert Couture producing the low-age phenomenon in Couture, the mixture of multi-culture and the vitality. This fusion suggest the popularity and the commerciality of Couture, which is predicted decrease the difference between Couture and $pr{\hat{e}}t-{\acute{a}}$-porter.

패션디자이너 역량모델링 구축 (Fashion Designer Competency Modeling)

  • This study started with the need for transition to competency-based education as well as the witness of fast changes in fashion industry's job environment. The goals of this study were (1) to explore fashion designers' competencies that are necessary for a successful careers in global fashion industry, and (2) to establish fashion designer competency model. In-depth individual interviews were conducted with 15 participants who have charged for design department and moreover have shown high performance in national, licence or designer brands in Korea fashion industry. Grounded theory was adopted to analyze data. As a result of analysis, the 4 core competencies emerged: problem-solving, research, inter-personal, and self-development. Each core competency has sub-competencies. Creativity, commerciality, control, decision making were sub-competencies for the problem-solving competency. Information management, innovation understanding & application, trend analysis & forecasting were sub-competencies for the research competency. Consumer, inside company, and outside company relationships were sub-competencies for the inter-personal competency. Self-awareness, self-management, expertise were sub-competencies for the self-development competency. In order to acquire these competencies, knowledge (academic, practical, multi-discipline), skills (sense, analysis, synthesis, communication), and attitude (interest, enjoyment, perseverance, personality) were essential. Based on these findings, implications for university fashion design education and further research areas were suggested.
