항만공사(PA) 운영 활성화를 위한 법률 정비와 지원조례 설치방안 -부산항만공사와 부산광역시를 중심으로- (Managing Legal Issues and Developing Ordinance for the Effectiveness of Port Authority: Focused on Busan Port Authority and Busan Metropolitan City)

  • This study deals with legal issues and solutions for a successful management of the Busan Port Authority(BPA) and proposes Busan Metropolitan City Ordinance for the effectiveness of BPA because the role of BPA is to improve Busan regional economy and to strengthen the competitiveness of Busan Port. In order to prepare the ordinance, this paper suggests that the current legislation related to Port Authority(PA), which empowers central government to control the management of port, should be amended to strengthen the port autonomy by allowing PA and local government to control the management and operation on port independently and enabling the building of cooperative system from the City for BPA.

Analysis of Festival Ordinances of Gyeonggi Province: Focusing on Developing A Representative Festival of Seongnam City

  • Purpose: In Seongnam City, a number of festivals are held in various areas, led by the city and private organizations. The necessity of developing a representative festival of Seongnam City, which can enhance the brand value of Seongnam, a cultural city, and promote a sense of local community and economic effects, is emerging. The purpose of this study is to analyze festival-related ordinances of Gyeonggi-do local governments, and to derive implications necessary for the development of festival support ordinances representing Seongnam City. Research design, data, and methodology: This study used the database of National Legal Information Center of the Ministry of Legislation and the autonomous legal information system to thoroughly investigate the ordinances related to festival support of basic local governments in Gyeonggi-do and the whole country. To do this, descriptive statistics analysis was conducted. Results: As a result of the study, it was found that 168 organizations (68.6%) of 245 local governments nationwide have adopted the festival support ordinance, and there are a total of 231 ordinances. In the case of basic organizations, out of 228 basic organizations, 151 organizations, including Seongnam City, adopted the ordinance on festival support, showing an adoption rate of about 66%. As a result of analyzing the basic organizations that enacted representative festival related ordinances among Gyeonggi-do basic organizations, 9 out of 28 cities adopted 16 representative festival ordinances, based on the legal and institutional basis for supporting representative festivals. Conclusions: In the case of Seongnam City, it is believed that in order to develop a representative festival, an ordinance to support the representative festival must be established. Considerations regarding the composition of the ordinance for the representative festival were discussed.

LID관련 지방정부 조례제정 특성 기초연구 - 서울시, 수원시, 남양주시를 중심으로 - (A Basic Study on the features of LID-related Ordinance Enactment conducted by Local Government - mainly on Seoul City, Suwon City and Namangju City -)

  • 본 연구는 저영향개발(LID)의 전국적 확산을 위해 실질적으로 시설의 설치 및 관리의 주체가 되는 국내 지방자치단체의 주요 제도인 조례를 양적 질적으로 분석함으로써 향후 이를 도입하고자 하는 지방정부에 정책적 방향을 제시하기 위해 작성되었다. 저영향개발(LID)과 연관된 주요 검색어 4개(물의 재이용, 빗물, 물순환, 저영향)를 전문가 자문회의를 통해 추출하였으며, 법제처 사이트 검색을 통해 주요 검색어가 포함된 99개의 관련 조례를 도출하여, 이를 검색어별 지방정부 규모별로 분석하였다. 분석결과 과거 2000년대 중반에 제정된 빗물관련 조례가 물의 재이용 촉진 및 지원에 관한 법률에 의한 조례로 전환되고 있음을 알 수 있었고, 물순환과 저영향이라는 키워드를 포함한 조례가 현재 전국에 3개(서울특별시, 남양주시, 수원시)뿐인 것으로 나타났다. 내용적으로 저영향개발(LID)를 포함하고 있는 3개 지자체를 대상으로 업무 담당자 인터뷰를 실시한 결과 도출된 결과는 다음과 같다. 첫째, 현재 우리나라의 빗물, 물의 재이용 관련 조례는 강우강도 불투수율 등 지역 특성을 고려하기보다 행정자치부가 배포한 가이드라인에 따라 제정되고 있어 내용상 지자체마다 동일하다. 둘째, 현재 제정된 조례가 단순한 기술 시설에 국한되어 있어 토지이용 및 공간을 포함하는 저영향(LID) 개념을 포함할 수 없는 상황이다. 이에 저영향개발(LID)의 의미를 올바로 반영하기 위해서는 서울특별시와 같은 관련 조례 제정 및 강우강도, 불투수율 등 지역별 특성을 반영할 수 있는 새로운 가이드라인이 필요할 것으로 판단된다.

  • 이 연구의 목적은 우리나라 학교도서관 및 독서교육 관련 조례를 분석하여 개선점을 논의하기 위한 것이다. 이를 위해 현재 시 도교육청에서 제정하여 운영하는 관련 조례 건을 분석하였다. 학교도서관 조례, 독서교육 조례, 학교도서관/독서교육 조례로 구분하여 내용 구성요소를 비교하였고, 조례의 내용을 교육감과 교장의 책무, 위원회와 전담부서, 독서진흥 및 독서교육, 학교도서관 등 4개 영역으로 나누어 분석하였다. 이 분석을 토대로 조례의 개선 방향을 실효성 제고, 통합형 조례 운영, 교육과정 연계성 강화, 정보활용교육 원리 반영 등의 측면에서 논의하였다.

춘천시 청소년 노동인권 조례 현황 및 개선 연구 (A Study on the Current Status and Improvement of the Youth Labor Rights Ordinance in Chuncheon City)

  • Purpose - The purpose of this study is to compare and analyze the ordinances of other local governments to propose implications and improvement plans for the ordinances of Chuncheon City. To this end, cases of overseas legislation related to youth labor rights, domestic laws and major policies of the central government were reviewed. Design/methodology/approach - This study mainly utilized literature research methods. In addition, it was based on foreign laws and case analysis, domestic laws and ordinances, and preceding research and data related to government policies. Findings - Chuncheon city ordinances are superior to those of other local governments. However, the details of the establishment of the implementation plan, the actual condition survey, and the establishment of the consultation system are included in the project contents of Article 6, so it is not concrete and clear. And there were no articles related to the labor environment check. Research implications or Originality - It is proposed to make the contents of the establishment of an implementation plan, survey, and consultation system as independent provisions. It is also proposed to establish a new article related to the youth labor environment check. In addition, it is desirable to establish detailed regulations by establishing the ordinance enforcement regulations.

우리나라 용도지역제의 용도순화 및 용도혼합 특성에 관한 역사적 고찰 - 조선시가지계획령에서 도시계획법에 이르기까지 - (Historical Review on the Characteristics of Specialized and Mixed Land Uses of Korean Zoning System - From Chosun Planning Ordinace of 1934 to City Planning Law of 1962)

  • While the zoning system has been developed based on the rationale of separated and specialized land uses to prevent negative externalities in the modern industrial era, the emergence of office-based new industries in the post-industrial era rather encourages mixed land uses to create agglomeration economies. This study aims to find historical basis to justify the reform of zoning system to promote both specialized and mixed land uses. When the zoning system was first introduced in Japanese colonial period by Chosun Planning Ordinance enacted in 1934, Special District within Manufacturing Area, and later within Residential, Commercial, and Mixed Areas respectively was institutionalized for specialized land uses, though it was not actually designated. When City Planning Law was enacted in 1962, Special District was substituted by Exclusive Areas (Exclusive Residential Area, Exclusive Manufacturing Area). Meanwhile Undesignated Area was designated for mixed land uses by Chosun Planning Ordinance, and later it was converted mostly into Mixed Area and partially into Green Area. Finally Mixed Area was substituted by Semi-Areas (Semi-Residential Area, Semi-Manufacturing Area) by City Planning Law in 1962. These demonstrate that Korean zoning system needs to revive the tradition that clearly promoted both specialized and mixed land uses.

우리나라 중소도시의 녹지보전과 녹화추진 방안 - "지방의제 21' 실천을 중심으로 - (Devices for Greening and Conservation of Small City in Korea - Focused on Implementation of 'Local Agenda 21'-)

  • The purpose of this paper is to propose directions for urban greening and nature conservation in small-to-medium-sized cities in Korea for implementation of the Local Agenda 21 (LA 21 hereafter). In this paper, the status of implementation of the LA 21 in both Korea and Japan have been examined. In addition, the green-related plans of both countries have been compared. The cities of Jeonju and Sagamihara were chosen as examples to compare. The result of the research is as follows: 1)With regard to the responsible bodies, in Korea, the implementing plans were initiated by the environment-related authorities of local governments while, in Japan, the plans of action were initiated through consultative committees reflecting opinions from citizens and business entities. 2)Concerning the status of implementation of LA 21, the city of Jeonju has adopted a plan of action and then implemented the plan through a consultative body without adequate legal ground. On the other hand, the city of Sagamihara has enacted a local ordinance to implement the LA 21 It was learned that the newly enacted ordinance has positively been interrelated to existing environmental plans. 3)Regarding urban greening and nature conservation plans, the city of Jeonju has focused on comprehensive measures to preserve and restore ecology while the city of Sagamihara has clearly suggested educational purposes in its plans in addition to preserving and restoring ecology. 4)In terms of support by law or legal system concerned, it has been teamed that, compared with Japan, Korean plans have not been properly supported by law or the legal system to urban greening and nature conservation plans. The same was shown in the city of Jeonju as compared with the city of Sagamihara. As for future directions, the follow are proposed: 1) establishment of a local Committee on Sustainable Development, 2) enactment of relevant and regulations such as the Master Plan of Parks and Green Open paces, 3) establishment of ecological greening plans.

유비쿼터스도시 지능화시설 표준요건에 관한 연구 (Research on Standardization Requirements of Ubiquitous City Intelligence Facilities)

  • A law and enforcement ordinance related to "ubiquitous city" (U-city) has been announced officially in Korea and practical standardization which is connected with U-city is in progress. The U-city defines citywide service over a city providing its infrastructure. The key facilities of U-city include intelligent equipments, networks, and operational facilities. Especially, the main focus of them is the intelligent equipments that are defined as facilities being applied to information technology. However, U-city has not been provided with standards related to actual construction of intelligent equipments so far. In this article, we survey standards for intelligent equipments for existing infrastructure and U-city's services.

  • Most recently, the development and publication of the ordinance and the manual of policy qualify management is spreading the recognition of quality Control in the public sector. The purpose of this study is to introduce of the system quality Control for local government's policy. So we suggested lessons drew from case study(Daegu metropolitan city, Gumi city) on current introduction. To introduce the system quality Control for local government, we have to gain the sympathy of introduction, second prepare of inducement, last manage PQM flexibility.

일본 농촌지역 경관관리 현황과 시사점 - 시가현 오미하치만시를 대상으로 - (The Current Status and Implication of Rural Landscape Management of Japan - Focusing on Omihachiman City, Shiga Prefecture, Japan -)

  • The purpose of this study is to analyze the present situation of the landscape management - which encompasses landscape ordinance, planning, and agreement - in regards to the Shiga prefecture and Omihachiman city to explore sustained landscape preservation and management methods, and to deduce the implications of the establishment of rural landscape planning and landscape administration. The conclusion is summarized as follows. First, the landscape ordinance should be operated so that the practical landscape management is suitable to the characteristics of local governments. Second, landscape management should be based on zoning. The landscape plan should start with defining the types and characteristics of the landscapes at each site and subdividing the landscape areas accordingly. Third, the restriction of conduct and the promotion of autonomous landscape activities should be employed as the two axes of landscape administration. Beautiful and healthy landscapes can be achieved through collective efforts of the community, and this requires voluntary practice amongst individuals and administrative regulations to achieve so. Fourth, meticulous, dimensional and practical landscape plans should be established. In order to effectively preserve, form and manage the essential landscape elements and resources of the area, the starting landscape plan should be more definitively outlined. Finally, it is necessary to change the perception of landscape. In order to relish beautiful and healthy scenery, it is critical to recognize the value of the attentive efforts and dedication of each member of the community that stimulates the objective.
