Construction Cost Segregation Process using Building Information Modeling

  • Cost segregation helps reduce tax liabilities by reclassifying real property to personal property and accelerates tax depreciation of a property. A typical cost segregation study requires much time and high costs. This study proposed a BIM integrated cost segregation process that can be applied to any commercial building project. The proposed BIM-based cost segregation process was verified in a new commercial construction project. It approved that this approach can: (1) increase the cash flow for the owner and provide assistance to tax-paying enterprises; (2) enable the contractor to use it as an added value in the bidding process; (3) realize data sharing in a common platform to improve the cost segregation study efficiency and reduce costs and errors; (4) contribute to the asset management in the life cycle of buildings while filling in the blank of cost segregation process. Future studies will focus on the automation of cost segregation and asset management in building construction's life cycle.

The Effect of Stochastic Taxes on Asset Prices (세금 불확실성 하의 자산 가격 결정)

  • This paper develops an equilibrium asset pricing model with taxation in the economy. The expected excess rate of return on a risky asset is shown to be an increasing function of the covariance of asset return with aggregate consumption rate changes and the covariance of asset return with the tax rates as well. Thus, the expected execss rate of return can be decomposed as the consumption risk premium and the tax premium. The capital asset pricing model derived in the absence of taxes is shown to understate the expected excess rate of return and to have a misspecification error in the economy with taxation.

  • Usually there are two ways in the method of accounting on tax purpose. One is the method of accrual basis accounting, the other is the method of cash basis accounting. Accrual basis accounting is used broadly not only in financial purpose, but also tax purpose. But, that method is not fit at some special case. For example, lawyer, bank, consulting, small business would like to use the method of cash basis accounting because it is more convenient in book-keeping than the method of accrual basis. I insist on regulating this cash basis accounting.

  • Electronic commerce creates serious problems for tax administration because of difficulties associated with the identification of traders, coding of trade activities and so on. The core issue with respect to resolving tax-related problems in electronic commerce is first, the identification of individual transactions through internet and their contents as well as traders. Secondly, it is the ability of tax authorities to secure effectively such data and information as identifying taxpayers, taxable amount and tax evasion on time. The tax authorities are studying the way to resolve tax evasion associated with electronic commerce by using payment system. Above of all, it is imperative to establish a systematic international cooperation in collecting value added taxes for electronic commerce. In order to enhance the effectiveness of tax system, the authorities of different nations should make joint efforts to collect taxes by exchanging such information as identification and registration of business as well as details of transactions among nations of production and consumption.

  • This paper makes a theoretical approach to the differences between transaction tax and capital gains tax when the financial instruments are traded and imposed taxes in K-OTC market, a newly emerging off-board market. Since it is difficult to reduce risk to the level which investors would like to pursue - depending on the taxation methods of portfolio-composed financial instruments - when it comes to forming a synthetic bond to hedge risk, this paper also seeks for effective taxation methods to make this applicable. First of all, to thoroughly review the taxation balance of synthetic bonds, this paper analyzed the effects of the transaction tax and capital gains tax imposed upon synthetic bonds according to the changes in final stock price and strike price in K-OTC market, and analyzed after-tax profit differences among them depending on whether income tax deduction took place or not. As a result of the research upon the tax gap in transaction tax and capital gains tax according to the changes of final stock prices, it was shown that imposing transaction tax is more likely to be effective for some level of risk hedging with replicating portfolio considering taxation policies and financial markets, since the effect of the transaction tax has a much lower tax gap than that of capital gains tax. In addition, in relation to whether income tax deduction was permitted or not, it was proved that the effect of the transaction tax and the capital gains tax vary depending on the variation in the strike price. Above all, it was shown that if the strike price is lower than the stock price, the transaction tax will be less affected by the existence of income tax deduction than the capital gains tax, while both will be equally affected by the existence of income tax deduction if the strike price is higher than the stock price. Further study would be to demonstrate the validation of this in the K-OTC market with actual financial instruments and, also, to seek for a more systematic hedging method by using a ratio analysis approach to the calculation of the option transaction tax

Agglomeration Effects and Foreign Direct Investment Location Choice: Cross-country Evidence from Asia

  • Purpose - This study examines the determinants of foreign direct investment (FDI) location choice for Chinese firms, focusing on the agglomeration effect for firms of the same nationality. Design/methodology - The empirical data are China's inward FDI from the top 19 economies (excluding tax havens and Taiwan) in terms of FDI during 1997-2015 and China's outward FDI from the top 18 economies (excluding tax havens). This study uses a random effects generalized least squares model for panel data analysis. Findings - The results confirm that both host countries' costs and market conditions and the degree of agglomeration affect these countries' attractiveness for FDI inflows. Specifically, agglomeration has a significant effect on China's inward and outward FDI. This study confirms that the agglomeration of firms of the same nationality has predictive power for multinational enterprises' FDI location choices. The host countries' real GDP and trade openness also positively affect FDI inflows. Interestingly, however, China's production cost has a positive effect. Thus, inward FDI aimed at entering the Chinese market is increasing in recent years relative to the previous efficiency-seeking FDI. Inward FDI in China is therefore the market-entry type, whereas outward FDI by Chinese firms is the market-oriented type. Originality/value - These results suggest that the effects of the potential determinants of Chinese outward FDI are similar to those of inward FDI as China's trade liberalization progresses.

  • 현대 복지국가에서는 의료와 교육 분야에 대해 지대한 관심을 가지고 있다. 이런 측면에서 유럽 및 미국 등에서는 특히 의료분야에 대해 정부가 직접 운영하는 비율이 높고 또한 각종 조세특례를 통해 민간을 지원하고 있다. 이 점에서 이 논문에서는 우리나라가 의료기관에 대한 조세체계와 조세특례를 어떻게 개선해야 할 것인가에 대해 연구하였다. 이 연구결과 의료기관에 대한 조세체계 및 조세특례제도에 대한 개선방안으로 여러 가지를 제시하고 있으나, 주요골간은 첫째, 우리나라의 경우 의료법인을 의료법에서는 비영리법인으로 보고 있으나 세법에서는 기본적으로 영리사업으로 보아 과세하는 것을 원칙으로 하고 조세특례규정은 아주 제한적으로 인정하고 있어, 의료서비스의 질적 향상에 도움을 주고 있지 못하므로 이를 개선하고, 둘째, 교육과 의료는 중요한 공공재로서 정부가 대등한 입장에서 정책을 수립하여야 함에도 차등 과세되고 있는 점을 개선할 필요가 있으며, 셋째, 같은 의료서비스에 대해서 운영주체에 따라 각종 조세특례를 다르게 규정해서는 안된다는 점을 지적하였다.

  • The Comprehensive Measures for a soft landing of Household Debts affecting the credit service of Fisheries Cooperative (FC) have been known to the public in June 2011. Its essential points are as follows: 1) Abolition of Tax-free Regulation, 2) Set limit of loans, etc. per person, 3) Introduce leverage regulations for credit-specialized financial sector i. e. FC, 4) Gradually strengthen loan-loss reserve requirements for card-loan and other credit loans. However, the Financial Policy Measures seem to pay no attention to the Cooperative's Values, Principles and Identity. In this paper, emphasis is be placed on the task of the regulators i. e. Financial Services Commission and Financial Supervice Service to lift the Financial Measures negatively affecting the operation of fund of FCs, and on the establishment of Cooperative identity in order to further develop FCs.

The Boundaries of MM2: An Exploration of Equity Value Indeterminacy

  • The Modigliani-Miller Proposition II (MM2) is a cornerstone in the field of corporate finance, positing that in a frictionless environment with perfect capital markets, the cost of equity capital is linearly related to a firm's leverage. This paper critically re-evaluates this proposition, particularly examining the determination of the cost and value of equity. We find that under specific circum-stances, especially when the value of a tax shield is influenced by endogenous variables, the cost and value of equity may be ambiguous. This calls into question the universal applicability of MM2. Our research offers new perspectives on the theoretical underpinnings of financial management and underscores the significance of situational factors in the practical application of these theories.

A Study on the Relevance between Voluntary Information Disclosure and Effective Tax Rate (자발적 정보 공시와 유효법인세율 간의 관련성 연구)

  • This study examines the relationship between voluntary information disclosure and the effective tax rate using Investor Relation (IR) as the proxy for the level of the firm's voluntary information disclosure, and effective corporate tax rate as the proxy for the level of tax avoidance. This study considers sample data from 1,396 firms listed on the Korea Composite Stock Price Index (KOSPI) from 2011-2014. The results of this study are as follows: Investor Relation (IR) had a positive correlation with effective corporate tax rate. This result got on with the result of additional analysis using extra measurement of effective corporate tax rate. According to these results, we expect that firms featuring greater voluntary information disclosure report enhanced business performance. This study contributes understanding how Investor Relation (IR) affects tax avoidance. We hope that this study can promote the development of capital markets and provide good news to investors for firms that have greater information disclosure.
