A Study on the Binding Power of Interim Measures and the Effect of Interim Measure Non-Compliance in ICSID Arbitration (ICSID 중재의 임시적 처분 구속력과 미준수 효과에 관한 연구)

  • This study focuses on the binding power of the interim measures of the arbitral tribunal in ICSID arbitration and the effects of non-compliance. Upon consideration of the intentions of those who made these rules, given the interpretation of the provisions of Article 47 of the ICSID Convention and Article 39 of the ICSID Arbitration Rules, it was found reasonable to consider that the interim measures made by the arbitral tribunal in ICSID arbitration were not binding. However, in actual ICSID arbitration, most arbitral tribunals approve the binding power of the interim measures based on the purposes and the characteristics of the interim measures. As such, there is a certain distance between the legislative intention for interim measures in ICSID arbitration and the judicial practice, but considering the demand for maintaining the integrity of the arbitration procedure, it is reasonable to consider that the interim measures are binding. In addition, the fact that the interim measures have binding power can increase the possibility that the party will comply with the interim measures. Thus, the binding power of interim measures not only encourages voluntary compliance to the interim measures of the party, but can also cause negative consequences for the party if it is not met. In other words, the arbitral tribunal will be able to form negative inferences against the party who does not comply with it in a procedural side, and in the practical side, the party who does not comply with the interim measures will be compensated for the additional damages for non-compliance.

  • Some gate valves are susceptible to pressure locking and thermal binding which prevent the safety function. The safety related gate valves susceptible to pressure locking and thermal binding shall be identified and taken preventive actions to ensure the safety function. The identification of the gate valves susceptible to pressure locking and thermal binding needs the evaluation of system design, valve and piping arrangement, test requirements, and operating conditions. Application of preventive methods should consider the system safety function, applicability, effectiveness, interface with system design, and cost. The selection procedure of valves susceptible to pressure locking and thermal binding can be effectively used in industry including nuclear power plants. In order to prevent the pressure locking, the hole can be drilled through the one disc of upstream side or down stream and the external equalizing line can be installed from bonnet to downstream or upstream. The double disc parallel seat valve type can be used instead of flexible wedge gate valve to prevent the thermal binding. The identification of gate valves susceptible to pressure locking and thermal binding, and preventive actions will meet the regulatory requirements and enhance the availability and safety of plants.

Searching for the SCM Improvement Directions through the Power Attribute and Partnership (파워 유형과 파트너십 연계를 통한 공급사슬관리 개선방안 모색)

  • It is required to derive various conclusions by identifying the type of power and the relationship between SCMs and presenting practical implications. Thus, we can identify the differential effects of each type of power on SCM performance. We can contribute to develop the practical implications at more sophisticated multi-dimension by comparing results of this study with various SCM theories. Through previous studies, the source of power is largely divided into binding power and non-binding power. Binding power is classified into behavior coercion, binding reward and relationship legitimacy. Non-binding power is classified into work expertise, information superiority and value compliance. Enterprises should fully understand and recognize partners within supply chains including understanding of the source of power, imbalance and results. Thus, we look into types of power and effects on trust and commitment, and identify a causal relationship leading to collaboration and SCM performance. Specific research results are as follows. First, the binding power did not give a significant effect to the trust. However, the binding power gave a positively(+) significant effect to the commitment. Second, non-binding power showed a significant effect on both trust and commitment. As a result of analysis on total effects, it was shown that non-binding power gave indirect effects to collaboration and SCM performance. Third, it was shown that both trust and commitment significantly affected collaboration. From the perspectives of social exchange theory and trading cost theory among inter-organizational relationship theory, it may lead to SCM performance of trust, commitment and collaboration. Moreover, it was found that association of each attribute of power led to the significant result. Fourth, it was shown that trust and collaboration significantly affected SCM performance. However, commitment did not directly affect SCM performance, but it indirectly significantly affected SCM performance through collaboration. Proper use of this power can firmly build partnerships between members of the supply chain and induce the improvement on supply chain performance and satisfaction of members.

  • In this study, repression of the body is defined as a restriction on natural developments or movements and a modification either temporarily or permanently of the human body in shape, color, texture and odor. In addition, it involves physical and (or) mental pain. Chinese foot-binding and the Western corset are extreme examples of female body's being repressed in the history of fashion. The analysis of this type of repression will be based on historical research and theoretical concepts such as Darwin's (1809-1882) survival condition, Freud's (1856-1939) renunciation of desire, Weil's (1909-1943) privilege, and Foucault's (1926-1984) L'Usage des Plaisirs(the use of pleasure). Chinese foot-binding symbolically represents ideal beauty, the distinction of an ethnic group, and a desire for improved social status in the struggle for political power. It also represents psychology and a esthetics of eroticism and fetishism that originate from a man's desire and his individual taste. Symbolically, the Western corset represents abundance and fecundity, obedience and devotion to religion, the sanctity of God and ideal beauty as defined by political power. It also represents psychology and aesthetics of eroticism and fetishism as man's desire and a fashion icon. In conclusion, Chinese foot-binding was pursuit of power in male ideology but Western corset was a power struggle between God and mankind.

  • Hierarchical Mobile IPv6 improves performance of Mobile IPv6 by managing Binding Update in terms of location, With improved handover delay, realization of delay-sensitive services (e,g, VoIP or video streaming) has become more persuadable, Comparing with Mobile IPv6, however, Hierarchical Mobile IPv6 brings security threats related to Local Binding Update to mobile network, In the RFC 4140, specific methods to authenticate Local Binding Update message are not explicitly presented. It is essential that design secure architecture to address problems related to authenticating Local Binding Update, Many secure suggestions for Local Binding Update, however, concentrate on infrastructure-based solutions such as AAA PKI. These approaches may cause scalability problem when the suggested solutions are applied to real network. Therefore we suggest authentication method that doesn't require infrastructure, In addition to authentication of Local Binding Update, our method also provides mobile node with power saving ability.

  • DCS has many processing components and various communication elements. And its communication delay characteristic is affected diverse operating situation and context. Especially, binding signal which traversed from one control-node to another control-node undergo all sort of delay conditions. So its delay value has large deviation with the lapse of time, and the measurement of delay statistics during long time is very difficult by using general oscilloscope or other normal instruments. This thesis introduces the design and implementation of PC-based BDAS(Binding Delay Analysis System) System developed to overcomes these hardships. The system has signal-generator, IO-card, data-acquisition module, delay-calculation and analyzer module, those are implemented on industrial standard PC/Ethernet hardware and Windows/Linux platforms. This system can detect accurate whole-system-wide delay time including io, control processing and network delay, in the resolution of msec unit, and can analyze each channel's delay-historic data which is maintained by realtime database. So, this system has strong points of open system architecture, for example, user-friendly environment, low cost, high compatibility, simplicity of maintenance and high extension ability. Of all things, the measuring capability of long-time delay-statistics obtained through historic-DB make the system more valuable and useful, which function is essential to analyze accurate delay performance of DCS system. Using this system, the verification of delay performance of DCS for nuclear power plants is succeeded in KNICS(Korea Nuclear Instrumentation & Control System) projects

The Effect of Power Type within Supply Chain on the Information Capability: Perspective of CSV Value Creation (공급사슬 내의 파워유형이 정보역량에 미치는 영향: CSV 가치창출 관점)

  • Purpose The purpose of this study is to attempt to incorporate power theory to evaluate information capability of SCM adopters. Therefore, this study focuses on the relationship of information sharing, partnership quality, and information capacity according to the power intensity of the variables of SCM. and CSV value creation. Design/methodology/approach The questionnaire of SCM builder was conducted and 302 samples were analyzed. Based on the theoretical background of power and information capacity, we set up a structural equation model. Hypothesis testing and statistical analysis were done through AMOS and SPSS. Findings First, it shows that the compensation power among the constrained power has a positive effect on the partnership quality, and the legitimacy power has the positive influence only on the information sharing. Compulsive power, compensation, and legitimacy, which are generally restrictive powers, may reduce the quality of information sharing and partnership, but the results of this study are rather higher. Second, both non-binding power expertise and criterion have a positive effect on information sharing and partnership quality. Third, information sharing has a positive effect on partnership quality. Supporting a number of research results, it is well reflected in SCM attributes where interdependence is important. Fourth, information sharing and partnership quality have a positive effect on information capacity. Information literacy has become an essential element in modern management. Fifth, the enhancement of CSV value creation plays a role of a controlling variable to further strengthen information sharing through non - binding power attribute, expertise and conformity. In addition, the strengthening of CSV value creation has been shown to play a role as a controlling variable to further strengthen the quality of partnership through the non-binding power attribution, but expertise has been rejected.

  • In this paper, a RTL binding technique and low power technology mapping consider CPLD is proposed. Allocation processing selected module consider the module calculation after scheduling process for circuit by HDL. Select CPLD for constrain after allocation. A Boolean equation is partitioned for CLB by allocated modules. The proposed binding algorithm is description using optimum CLB within a CPLD consider low power. The proposed algorithm is examined by using 16 bit FIR filter. In the case that applicate the algorithm, the experiments results show reduction in the power consumption by 43% comparing with that of non application algorithm.

  • Optimal Power Flow (OPF) solution by the Newton's method provides a reliable and robust method to classical OPF problems. The major challenge in algorithm development is to identify the binding inequalities efficiently. This paper propose a simple strategy to identify the binding set. From the mechanism of penalty shifting with soft penalty in trial iteration, a active binding sit is identified automatically. This paper also suggests a technique to solve the linear system whore coefficients are presented by the matrix. This implementation is highly efficient for sparsity programming. Case study for 3,5,14,118,190 bus and practrical KEPCO 305 bus system are performed as well.
