Impact of Corporate Characteristics on Personal Information Breach Accident (기업의 특성이 개인정보 유출 사고에 미치는 영향)

  • Not only does it cause damage to individuals and businesses due to the occurrence of large-scale personal information leakage accidents, but it also causes many problems socially. Companies are embodying efforts to deal with the threat of personal information leakage. However, it is difficult to obtain detailed information related to personal information leakage accidents, so there are limitations to research activities related to leakage accidents. This study collects information on personal information leakage incidents reported through the media for 15 years from 2005 to 2019, and analyzes how the personal information leakage incidents occurring to companies are related to the characteristics of the company. Through the research results, it is possible to grasp the general characteristics of personal information leakage accidents, and it may be helpful in decision making for prevention and response to personal information leakage accidents.

A Study on the Gradual Brench of Earth Dam (흙댐의 점진적 파괴에 관한 연구)

  • Gradual failure of an earth dam is caused by piping or overtopping. In this gradual failure, a breach will form and grow gradually under the erosive action of the waters. The process involved during an earth dam failure is very dynamic and complicated. The physical model of Fread and mathmatical model of Singh and Scarlatos are verified and compared in this study. Fread's model(BREACH) simulates dam failure well when sufficient data are given, and Singh and Scarlatos' model simulates it appoximately with a few simple data.

A Study on the Bank's Breach of Contract to keep the Business Secrecy in Transferable Credit Transactions - with a Special Emphasis on the English Case Law, Jackson v. Royal Bank of Scotland - (양도가능신용장거래에서 은행의 영업상 비밀 유지의무위반에 관한 연구 - Jackson v. Royal Bank of Scotland 사건에 대한 영국법원의 판결을 중심으로)

  • This article aims at analysing the reality of banks' liability resulting from the breach of contract on its part to keep the business secrecy with the supplier in the transferable credit, focusing on a English decision, Jackson v. Royal Bank of Scotland [2005] UKHL 3. In this case, the applicant, 'Econ', had purchased various varieties of pre-packed dog chews in bulk through 'Sam'(lst beneficiary) from 'PPLtd'(2nd beneficiary) in Thailand, using a transferable letter of credit issued by 'RBank'. 'Sam' charged a tremendous amount of mark-up on each transaction and it had not been disclosed to 'Econ', although the identity of 'PPLtd' was revealed to 'Econ' by various documents. However, 'RBank' made an unfortunate error to send an completion statement and other documents including 'PPLtd.'s invoice to 'Econ' instead of to 'Sam'. The effect of the Bank's error was to reveal to 'Econ' the substantial profit that 'Sam' was making on these transactions. CEO of 'Econ' was furious and, as a result, decided to cut 'Sam' out of its importing system and terminated their relationship. 'Sam' sued 'RBank' for damages to recover the loss of profits which could have been possibly made, if the information on the mark-up would not have been exposed to 'Econ'. The House of Lord held that 'RBank' was in breach of its duty of confidence, so 'Sam' was entitled to recover damages on a decreasing scale over 4 years, since there was no specific undertaking from the letter of credit.

  • This article deals with the relationship between arbitration and state court in each procedural stage. As most legal systems over the world respect arbitration agreement, the relationship between arbitration and state courts puts emphasis on party autonomy and provides the independent power of arbitration agreement tribunal (Kompetenz-Kompetenz). Most institutional arbitration rules the arbitral tribunal to rule on its own jurisdiction. Modern national laws have similar provisions based on Art. 16 UNCITRAL Model Law. In this regards the author throws a question in Chapter II, whether the doctrine of Kompetenz-Kompetenz, namely the ability of the tribunal to decide upon its own jurisdiction is worth while persisting, and whether the Kompetenz-Kompetenz-agreement should be regarded as valid, with the conclusion, that this doctrine should concede to the power of state court and that Kompetenz-Kompetenz-Klausel is invalid. In Chapter III the author discusses the issue of whether the breach of an arbitration agreement could lead to the compensation of damage. Although the author stands for the procedural character of arbitration agreement, he offers a proposal that the breach of an arbitration agreement bring about the compensation of damage. The issue of anti-suit injunction is discussed also in this Chapter. He is against the approval of anti-suit injunction based on an arbitration agreement resisting the other party from pursuing a lawsuit in a foreign country.

Estimation of Break Outflow from the Goeyeon Reservoir Using DAMBRK Model (DAMBRK 모형을 이용한 괴연저수지 붕괴유출량 추정)

  • Several reservoirs that were managed by local governments and the Korea Rural Community Corporation have recently collapsed. One of them is the Goeyeon reservoir in Yeongcheon-si, Gyeongsangbuk-do that collapsed mainly around the spillway due to heavy rain at 9 O'clock, on 21 August 2014. The Goeyeon reservoir was an aging agricultural reservoir over 70 years since it was built. In this study, the collapse situation of the reservoir was reproduced through the DAMBRK model. Flood inundation maps were reconstructed for the breach outflow of the dam analyzed by the DAMBRK model. We estimated the breach duration and outflow of the reservoir as compared with the inundation image taken by the Unmanned Aerial Vehicle (UAV) at the time when the Goeyeon reservoir collapsed. The results of this study are expected to be useful for predicting damage in the downstream inundation area when a reservoir collapses.
