A Brief Sketch of Architectural Works Copyright with the United States Cases: Analysis based on Thomas Shine v. David M. Childs and Skidmore Owings & Merrill, LLP Case

  • These days the copyright plays a significant role in various fields of creative works and it has expanded dramatically into unprecedented ways. In Korea, architectural works copyright cases are rare due to the lack of information and understanding of the architectural works copyright. Architectural works copyright can promote architects' creative activities and enhance the quality of architectural works as art. Nevertheless, there is little effort to advance the studies of architectural works copyright in the architectural design area. Under these circumstances, this research attempts to share the basic case laws and remedies for various architectural works copyright issues in the U.S. cases. This Article examines the Thomas Shine v. David M. Childs and Skidmore Owings & Merrill, LLP Case which is the most recent case as I could reach. This case is about a story between two architects, one is from a very prestigious architectural design firm and the other, once Yale Architectural student, now practices his design work as an up-and-coming architect. A close examination of this case will provide a legal and architectural spectrum of copyright. That is, it will make it more specific how to solve the copyright infringement. Artistic and technological contexts are overlapped in Architectural works copyright as its inherent characteristics. Therefore, different ways from other copyrighted works are needed to access the untangled equations of the architectural works copyright protection. In addition, more comprehensible and specific regulations that can impose a remedy more suited to the architectural works copyright violations are needed and they should enable architects to fulfill their architectural activities under wide range of copyright protection. Moreover, in prior to all efforts to handle those equations, fundamental knowledge of architectural works copyright is required to improve the copyright protection in the architectural design area as well as to provide for the globalizing design practice. Ultimately, all of these efforts will be rewarded when constant researches based on Korean and other countries' architectural copyright cases can support them and it would be great if this research can set the stage for resolving expected copyright conflicts within the architectural design area.

  • The purpose of this study is to understand Archigram's architectural works by analysing Archigram, which was a little magazine issued from 1961 to 1974. Studies on the Archirgam's architectural works have been mostly focused on their projects themselves, not within the context of the medium, Archigram (little magazine). However, Archigram as a little magazine worked as a platforms where ideas and projects could be developed and communicated among the members. Therefore, this study focused on the distinct features of Archigram's architectural works which were influenced by its little magazine, Archigram. The major conclusion of this study is that Archigram's architectural works worked as media themselves; Archigram's architectural works are open-end conclusions which can be transformed and developed by other members; Archigram members created new temporality, creating 'up-to-the-minute' architecture.

  • This study is conservation works trend since 1900. Objects for study are National Treasures and Treasures in Buddhism, in wooden architecture. And researched about the factor of conservation works, roof and tile, painting and dissolution conservation works cycle by dissolution, timber change ratio. The factor of conservation works is the most, roof and tile. Conservation works cycle by dissolution is 12.8 years. Painting cycle is 16.3 years. There are two concepts of conservation works, that is restoration and preservation. There are many restoration before 1960's. To 1960's the preservation to be many to 1970's many Restoration. And since the end of 1970's is Preservation. These reasons are conservation works history of object, the rule for Heritage protection, people on works, and study of architecture. history.

  • Located in Dornach, Switcherland Eurythmeum Anbau zu Haus Brodbeck (Rudolf Steiner-Halde, Eurythmeum Anbau zu Haus Brodbeck, 1923-1935) is one of the architectural works created by Rudolf Steiner (1861-1925) who has studied and established the cognitive and spiritual aspects of a human being, and is often cited as being the founder of anthroposophy. In fact, Eurythmeum Anbau zu Haus Brodbeck is not as well known as Steiner's other works, and it is perceived as less important than his major works of architecture including "Goetheanum", "Modellbau zu Malsch", and "Rudolf Steiner Haus Stuttgart". Nonetheless, this study is meaningful in itself since it is an important piece of architecture to gain an understanding of the characteristics of Steiner's late works, and the architectural characteristics of the Waldorf School where various active educational activities are taking place around the world. Eurythmeum Anbau zu Haus Brodbeck clearly exhibits the characteristics of the architectural space based on Steiner's anthroposophy as well as provides a window into promoting space efficiency by extending an existing building. Moreover, it provides a good learning opportunity to find out about how Steiner's architectural disposition has changed and developed with the use of new materials. With these points as a backdrop, the study aims to develop an understanding of the architectural characteristics of Eurythmeum Anbau zu Haus Brodbeck. Another important objective of this paper is to gain insight into the architectural implications in connection with the influence Eurythmeum Anbau zu Haus Brodbeck has had on Steiner's later works, by comparing his early works of architecture with those of his late works.

A Study of Design Trends in Contemporary Korean Landscape Architectural Works* (현대 한국 조경작품의 설계 경향에 관한 연구)

  • This study Is about the situation of contemporary landscape architecture design in Korea. The conceptual framework of interpretation for landscape architectural works is formulated to define the design trends of today′s professional works The study′s analytical method is composed of the survey of attitudes questionnaire, the analysis of design composition techniques and conclusions drawn from the comments of contemporary landscape architectural critics. Among 975 members of the Korean Institute of Landscape Architecture, 318 professionals responded to the survey questionnaire. The survey revealed that landscape architects in Korea are concerned about the profession′s reduced contributions to the sharping of the built environment. However, they are optimistic about its future. Ten top design works were selected from the surveys′ answers and were analyzed for the design characteristics which could best represent the trends of the last thirty years. Several design critiques and comments about the professional works were cited to reinforce the outlined "-ty" of the contemporary design phenomena. The study identified the following distinguished design trends of contemporary Korean landscape architectural works They are as follows: Themelessty, Powerity, Traditionality, Monumentality, Non-contextuality and Over-designity. These trends identify the overall prevailing conditions of Korean landscape architectural design over the past thirty years.

The Spatial Characteristics and Light presented in the Works of Laurant Beaudouin (로랑 보두앵 건축의 공간 특성과 빛)

  • Purpose: This paper tried to understand the architectural philosophy of Laurant Beaudouin who is one of Neo Corbusian architects. They were in succession to Le Corbusier's principles of modern architecture, and developed his concept of modern architecture with their own creative architecture, and formed a big achievement in the contemporary architecture. As a representative Neo Corbusian architect, the design concepts and principles of Laurant Beaudouin were analyzed in relation of nature, light and space. Method: Three step study was conducted for the paper; Firstly, investigated significant his architectural characteristics as a neo corbusian architect in the point of view of plan libre, architectural promenade and light; Secondly, analyzed his architectural philosophy on light, gravity and color, Finally, deducted relation light and space through analysis 5 works of Beaudouin. Results: According to the results of the study, Laurant Beaudouin has greatly developed of Corbusier's principles and philosophy of modern architecture, and then, created his own originative architectural works by combining nature, light and space and presented architectural promenade with the change of time.

A Study on Kuma Kengo's Architecture Works on Circularity - Based on Connectivity with Japanese Metabolism Movement's Circularity - (쿠마 켄고 건축의 순환성에 관한 연구 - 일본 메타볼리즘 운동의 순환성과 연계를 중심으로 -)

  • The purpose of this research was influenced by the historical background of Japanese modern architecture by the circulation of Kuma Kengo's architectural works and he wanted to look at the values and directions he was pursuing and how they were expressed in his works. The results of the review are summarized as follows. First, metabolism was developed as a reaction of modernism in modern architecture, focusing on growth through infinite reproduction by looking at architecture and cities as organisms and by using unit space as cells. Kuma Kengo, on the other hand, argues that focusing on the possibility of decimation of unit members by sequencing the elements that make up the space smaller than the unit space is closer to an ecological architecture. Second, what Kuma Kengo says is "erase the architecture" that is naturally related to the environment and disappears when its use is exhausted. His argument is expressed in individual architectural works through 'visual erase', 'particle painting of materials' and 'independence through dependency.' Through this, Kuma Kengo's ecological architectural languages were influenced by the ecological causes of metabolism, but they differed from the perspective of seeing architectural circulation as an organism. If metabolism was intended to realize circulation with growth potential based on the module of unit space, Kuma Kengo sought to implement circulation with the extinction of the unit members of space.

  • The purpose of this study is to analyze common features and methodological differences of PN-spatial characteristics found in architectural theories and works of contemporary young architects in Japan, such as Sou Fujimoto, Yo shimada, Keisuke Maeda and Junya Ishigami. These architects have paid attention to space between nature and inner space and have tried to establish their own architectural theory on that. Such space is ambiguous and PN-spatial in a way that it has features of both nature and inner space. Ambiguousness is a characteristic of modern architecture and PN-spatial characteristics are one of the features of Japanese architecture. This study aims to analyze the architectural theories and works of contemporary young architects in Japan from the perspective of PN-space and to draw methodological differences and common features. Their theories and works have common features in terms of 'ambiguous spatial boundary', 'unregulated spatial territory', 'detoured circulation' and 'architectural motifs', but each has their own methodology. To sum up, the works and theories of the Japanese young architects contain the philosophy and discourse of modern architecture in general. To be sure, they clearly have characteristics of Japanese architecture, which needs to be studied constantly.

A Study on the Tendancy of Architecturalizing in lighting for a Residential building - Focus on the Interior Magazine from 2000 to 2009 - (주거공간조명의 건축화에 관한 연구 - 2000년부터 2009년까지 인테리어잡지를 중심으로 -)

  • Based on the trend of architectural lighting of residential building, this study is to examine architectural lighting for residential buildings, and deduce the value and significance of architectural lighting by analyzing architectural lighting and characteristics of residential building through the analysis of works according to the types of works and by analyzing discourse relating to works of architectural lighting of residential building. First, architectural lighting for residential buildings can be categorized according to continuity and extensibility, lighting method and lighting factor. Second, architectural lighting of residential building has come into play since 2000 due to diversified activities at home. Third, architectural lighting had been introduced for living room and used in the form of structure or foundation up until early 2000s, but since mid 2000s, it has been used in intellectual and abstract form using various shapes, finishing material or objects. Fourth characteristic is a space of changing functions overcoming limited space, suggesting an alternative space, and using finishing material and object.

The Field Operation and Policies of Repair Works for Architectural Treasures in Late Japanese Colonial era based on Repair Works of Hwaumsa Kakhwangjeon (화엄사 각황전 수리공사를 통해 본 「보존령」 제정 이후 일제강점기 보물 건조물 수리공사의 현장운영과 수리방침)

  • The purpose of this study is to examine the circumstances of repair works after enacting "Low for Conservation of Joseon Treasure, Historic Site, Scenic Beauty & Natural Monument (朝鮮寶物古跡名勝天然記念物保存令)". For this purpose, the official documents produced by the Government-general Museum of Joseon were analyzed. They included the contents of repair works of Hwaumsa Kakhwangjeon(華嚴寺 覺皇 殿). As a result, this study reveals that the repair work of Hwaumsa Kakhwangjeon had become a momentum of introducing specific guidelines such as "Guidelines for Architectural Treasure's Repair 寶物建造物修理施行準則", "Regulations for administration of Hwaumsa Kakhwangjeon's repair work 華嚴寺覺皇殿修理工事取扱手續)". The guidelines and regulations systematized the planning phase of the repair works and provided to organize the field office formed by experts. In spite of these positive changes, the repair works were controlled by the central government to the certain extent, and the Japanese repair techniques were mingled with traditional techniques recklessly.
