유엔해양법 협약 (UNCLOS)이 1994년 11월16일자로 발효됨에 따라 국제해양어업은 새로운 질서에 의하여 개편되고 있다. 이에 따라, 해양생물자원의 관리에 있어서는 새로운 제도들이 채택되고 있다. 유엔해양법에서는 배타적경제수역 (EEZ) 설정시 총허용어획량 (TAC)에 의한 어업관리의무를 규정하고 있으며, 책임어업 (Responsible Fisheries)에 관한 Cancun 회의와 유엔환경개발회의 (UNCED)의 Agenda 21, UN Fish Stocks Agreement등은 전통적인 어업자원 이용방식의 변화를 요구하고 있다. 본 고에서 한국 해안 해양공학회의 근년의 국제활동에 대한 서술과 21 세기를 맞아 한반도 주변 해역의 해안 해양공학적 문제와 지속적 개발, 해양환경보전 등의 전구적 문제해결의 실마리를 찾기 위한 초석이 되는 연구방향을 제시하여 한국의 해안 해양공학연구의 국제적 위상정립과 더불어 현실적 응용을 위한 현업과 학술연구의 격차를 해소키 위한 노력을 시도한다.

어업에서는 어획대상 이외의 어종이 어획되는 이른바 혼획이 일어나며, FAO의 보고서(Alverson et al. 1994)에 의하면 전세계 어획량의 약 25%가 법률적 또는 경제적 이유로 인하여 선상에서 투기되고 있다. 따라서 UN환경개발회의(1992)에서 선언된 "Agenda 21(21세기를 향한 행동지침)"에서는 어업이 지구환경에 영향을 주는 산업으로 인지되었으며, FAO 총회(1995)에서 채택된 "책임있는 수산업 규범"에서는 세걔의 각 어업국에 비목표 어종의 혼획 및 미성숙 소형어의 투기 감소를 촉구하고 있다.(중략) 투기 감소를 촉구하고 있다.(중략)

지금까지 인류가 창안해 낸 가장 훌륭한 대안적 개발 패러다임은 '지속가능한 개발'이라 할 수 있다. 어젠다21(Agenda 21) 등 국제기구에서 논의되는 지속가능한 개발의 개념은 '미래 세대의 욕구를 충족시킬 수 있는 환경과 여건을 저해하지 않으면서 현 세대의 욕구를 충족시키는 개발'이다. 그리고 이 지속가능한 개발은 세 가지 핵심적 요소를 포함하고 있는바 이는 환경적 가치, 미래 지향성, 그리고 형평성이다. 이와 관련한 지속가능한 도시개발에 대해 알아보자.

과거 경제도약기에는 개발을 위한 자연훼손의 문제점이 크게 부각되지 않았으며, 연안개발의 경우도 마찬가지이었다. 그러나 선진국들은 1970년대부터 자국의 자연환경보호를 위한 구체적인 행동을 취하기 시작하였으며, 1992년 우리나라를 비롯한 178개국이 참석한 유엔환경개발회의 (UNCED)에서 '환경이 감당할 수 있는 범위 내에서의 지속 가능한 개발, ESSD(Environmentally Sound and Sustainable Development)'를 위한 '의 제 21 (Agenda21)' 이 채택되었다. (중략)

Public policies are subject to the general strategies and agendas of the state and the enactment of law is subject to the superior laws. This paper will clarify in a practical way how the strategies and agenda of an Islamic state and the superior law (the primary sources of Sharia law) affect the mechanism of enacting laws and creating policies in an Islamic government.
