Arbitration is a creature of contract. The parties agree that selective dispute resolution clause provides them with a choice to litigate or arbitrate certain disputes. Under the agreements, the parties had the option in the action. In the event any dispute arises between the parties concerning our representation or payment of our fees and disbursements which cannot be promptly resolved to our mutual satisfaction, you agree that dispute will be submitted to arbitration. Arbitration is a matter of contract and a party cannot be required to submit to arbitration any dispute which he has not agreed so to submit. The selective arbitrations clauses are to be construed as broadly as possible, and arbitration will be compelled unless it may be said with positive assurance that arbitration clause is not susceptible of an interpretation that covers the asserted dispute.
In common approaches, bridge dynamics under wind action is analyzed by modeling the interaction between fluid and structure by means of transient wind loads acting over the structure itself. Amid various possible manners to describe such types of loads, a representation based on families of 'indicial functions' is adopted here. The aim is to investigate its flexibility to capture the main features of wind-bridge interaction. A set of coefficients is involved in indicial functions. The values that one may attribute to them suffer uncertainties coming from experimental errors affecting data. Here, the sensitivity of a 2-DOF schematic model to the variations of these coefficients is investigated at fixed values of dynamic derivatives and for various types of indicial functions. It is shown how parameter variations influence phase portraits.
This paper was made for the purpose of examining middle school student's conception about force and motion. Using questionaire method. this research was executed to 180 students at a middle school in Seoul. Questions were as following; 3 questions about relation of the direction of force and that of motion in case of throwing a ball up, 2 questions about parabolic motion. 1 question about inertia. and 1 question about action and reaction. The way of answering was both selecting and explaining the students' thought about questions. Network analysis was used for analyzing students' various responses. Through the analysis. some types of students' thought were revealed. As a result the representation of their response was motion implies force which had been discovered by earlier researchers. Even though students had learned about force and motion in the classroom. their ideas were unchanged or even reinforced wrongly in some case.
This paper proposes a novel semantic feature detection (SFD) method for real-time image transmission of sign language and finger spelling. We extract semantic information as an interlingua from input text by natural language processing, and then transmit the semantic feature detection, which actually is a parameterized action representation, to the 3-D articulated humanoid models prepared in each client in remote locations. Once the SFD is received, the virtual human will be animated by the synthesized SFD. The experimental results based on Japanese sign langauge and Chinese sign langauge demonstrate that this algorithm is effective in real-time image delivery of sign language and finger spelling.
The purpose of this survey-based study was to investigate high school students' perceptions of mathematics teachers' implementation of Universal Design for Learning (UDL)-based practices and technology in their mathematics classes in 2017. A total of 303 high school students in South Korea participated in this online survey on teachers' use of technology for instructional practices, the frequency of technology tool use, and the meeting of UDL guidelines in mathematics instruction. According to frequency analysis, high school students generally perceived their teachers' mathematics teaching as somewhat positive in providing multiple means of representation, action and expression, and engagement. However, mathematics teachers' implementation of technology tools in their mathematics classes was generally limited. This study indicated significant and positive relationships between variables regarding the use of technology tools and teachers' efforts to follow the UDL guidelines. Applying the Chi-squared test, we further examined how each survey result differed according to high school students' academic achievements and grade levels.
Why do religions emphasize good deeds like charity or love? What kind of relation are there between good deeds and salvation? Early Buddhism stresses that the deed of mortal cannot escape retribution. And deeds are intentional act, so those are representation of mind. Therefore an issue of mind raises its head before action. The extinction of ignorance and thirsty gives rise to good mind, and the good mind produces good deed. Mahāyāna Buddhism accentuates charity. It signifies that the mind of oneself sympathizes the mind of others. That is impossible unless one throws away attachment to oneself. The alms deed makes that possible. In Roman Catholicism Ten Commandments assert absolute worship to god. The transcendental merits devaluate worldly ones, so the mind can obtain calmness. Protestant claims the one can acquire salvation only by faith. And the salvation leads human to good deed. In conclusion good deeds are not ways and means to mokṣa or grace, but identical with them in Early Buddhism and Mahāyāna Buddhism, and Roman Catholicism and Protestant.
This paper aims to investigate modeling scripts based on the mode of group interaction in a computer-supported collaborative learning environment. Based on a literature review, this paper assumes that group interaction and its mode would have strong influence on the online collaborative learning process, and furthermore lead learners to create and share significant knowledge within a group. This paper deals with two different modes of group interaction- distributed and shared interaction. Distributed interaction depends on the external representation of individual knowledge, while shared interaction is concerned with sharing knowledge in group action. In order to facilitate these group interactions, this paper emphasizes the utilization of appropriate CSCL scripts, and then proposes the conceptual framework of CSCL scripts which integrate the existing scripts such as implicit, explicit, internal and external scripts. By means of the model regarding CSCL scripts based on the mode of group interaction, the implications for research on the design of CSCL scripts are explored.
