  • English contract law has traditionally taken the view that it is not the duty of the parties to a contract to give information voluntarily to each other. In English law, one of the principal distinctions between insurance contract law and general contract law is the existence of the duty of disclosure in insurance law. This article is, therefore, designed to analyse the scope or extent of the duty of disclosure and the remedy for breach of the duty in English marine insurance law. The main purpose of this article is also to seek the alternative remedy for the breach. The results of analysis are as following : First, the scope of the duty of disclosure is closely related to the test of materiality and the concept of a hypothetical prudent insurer. The assured is required to disclose only material circumstances subject to MIA 1906, s. 18(1). The test of materiality, which had caused a great deal of debate in English courts over 30 years, was finally settled by the House of Lords in Pan Atlantic and the House of Lords rejected the 'decisive influence' test and the 'increased risk' test, and the decision of the House of Lords is thought to accept the 'mere influence' test in subsequent case by the Court of Appeal. Secondly, an actual insurer is, in order to avoid contract, required to provide proof that he is induced to enter into the contract by reason of the non-disclosure of the assured. But this subjective test of actual inducement is somewhat meaningless in sense that English court takes the test of materiality as a starting point and assumes the presumption of inducement even in case of no clear proof on the inducement. Finally, MIA 1906, s. 18 provides expressly for the remedy of avoidance of the contract for breach of the duty of disclosure. This means rescission or retrospective avoidance of the entire contract, and the remedy is based upon a fairly crude 'all-or-nothing' approach. The remedy of rescission is too draconian from the point of view of the assured, because he can be deprived of all cover despite he is innocent perfectly. An inadvertent breach from an innocent mistake is as fatal as wilful concealment. What is, therefore, needed in English marine insurance law with respect to remedy for the breach is to introduce a more sophisticated or proportionate remedy ascertaining degrees of fault.

  • Purpose: A modern greenhouse consists of various Information and Communications Technology (ICT) components e.g., sensor nodes, actuator nodes, gateways, controllers, and operating softwarethat communicate with each other. The interoperability between these components is an essential characteristic for any greenhouse control system. A greenhouse control system could not work unless the components communicate via common interfaces. The TTAK.KO-06.0288 is an interface standard consisting of four parts. Notably, TTAK.KO-06.0288-Part3, which describes the interface between a greenhouse operating system (GOS) and a greenhouse control gateway (GCG), is the core standard of TTAK.KO-06.0288. The objectives of this study were to analyze the TTAK.KO-06.0288-Part3 standard, to suggest alternative solutions for identified issues, and to develop a library as a proof of the alternative solutions. Methods: The "data field" was analyzed using a comparative analysis method, since it is a data transmission unit of TTAK.KO-06.0288-Part3. It was compared with other parts of TTAK.KO-06.0288 in terms of definition, format, size, and possible values. Although TTAK.KO-06.0288-Part1 and TTAK.KO-06.0288-Part2 do not use a "data field," they have a similar data structure. That structure was compared with the "data field" of TTAK.KO-06.0288-Part3. Results: Twenty-one issues were identified across four categories: inter-standard issues, intra-standard issues, operational issues, and misprint issues. Since some of the issues can raise interoperability problems, 16 alternative solutions were suggested. In order to prove the alternative solutions, an open-source communication library called libtp3 was developed. The library passed 14 unit tests and was adapted to two research. Conclusions: Although TTAK.KO-06.0288-Part3 is an interface standard for communication between a GOS and a GCG, it might not communicate between different implementations because of the identified issues in the standard. These issues could be solved by the alternative solutions, which could be used to revise TTAK.KO-06.0288. In addition, a relevant organization should develop a program for compatibility testing and should pursue test products for smart greenhouses.

  • Now the world will regulate the CO2 emission due to environmental issues. For an alternative plan photovoltaic system is watched. So, photovoltaic system is trend of big city and it is mandatory for renovation of construction. Oil & gas filling station existed in city is suitable to found the photovoltaic system. But the general photovoltaic system in oil & gas filling station is difficult to found because it is classified into hazardous area. This paper evaluates intrinsic safety evaluation of solar cell for making basic data to found for the photovoltaic system on hazardous area. The intrinsic safety characteristic is evaluated by short-circuit ignition test using IEC type spark ignition test apparatus and temperature rising test. The result of short-circuit ignition test, propane-air mixture gas is exploded on condition that 4 solar cells(9[V], 90[mA]) are connected serially under insolation 800[W/$m^2$]. So, if a larger solar module will be used at oil & gas filling station than we were tested, it needs explosion proof. As the result of rising temperature test, the temperature rising due to short circuit is not so much, but when the temperature rises due to radiant heat, it demands careful consideration for environmental influence.

  • This paper aims to propose a new steps of hypothesis testing using analysis process and improvement process in the six sigma DMAIC. The six sigma implementation models proposed in this paper consist of six steps. The first step is to establish a research hypothesis by specification directionality and FBP(Falsibility By Popper). The second step is to translate the research hypothesis such as RHAT(Research Hypothesis Absent Type) and RHPT(Research Hypothesis Present Type) into statistical hypothesis such as $H_0$(Null Hypothesis) and $H_1$(Alternative Hypothesis). The third step is to implement statistical hypothesis testing by PBC(Proof By Contradiction) and proper sample size. The fourth step is to interpret the result of statistical hypothesis test. The fifth step is to establish the best conditions of product and process conditions by experimental optimization and interval estimation. The sixth step is to draw a conclusion by considering practical significance and statistical significance. Important for both quality practitioners and academicians, case analysis on six sigma projects with implementation guidelines are provided.

  • Quantitative condition assessment of structures has been traditionally using proof load test leading to an indication of the load-carrying capacity. Alternative approaches using ultrasonic, dynamics etc. are based on the unloaded state of the structure and anomalies may not be fully mobilized in the load resisting path and thus their effects are not fully included in the measured responses. This paper studies the effect of the load carried by a reinforced concrete beam on the assessment result of the crack damage. This assessment can only be performed with an approach based on static measurement. The crack damage is modelled as a crack zone over an area of high tensile stress of the member, and it is represented by a damage function for the simulation study. An existing nonlinear optimization algorithm is adopted. The identified damage extent from a selected high level load and a low load level are compared, and it is concluded that accurate assessment can only be obtained at a load level close to the one that creates the damage.

  • This paper presents the results of a pilot study and verification of a concept of a novel methodology for damage detection and assessment of water distribution system. The unique feature of the proposed noninvasive methodology is the use of accelerometers installed on the pipe surface, instead of pressure sensors that are traditionally installed invasively. Experimental observations show that a sharp change in pressure is always accompanied by a sharp change of pipe surface acceleration at the corresponding locations along the pipe length. Therefore, water pressure-monitoring can be transformed into acceleration-monitoring of the pipe surface. The latter is a significantly more economical alternative due to the use of less expensive sensors such as MEMS (Micro-Electro-Mechanical Systems) or other acceleration sensors. In this scenario, monitoring is made for Maximum Pipe Acceleration Gradient (MPAG) rather than Maximum Water Head Gradient (MWHG). This paper presents the results of a small-scale laboratory experiment that serves as the proof of concept of the proposed technology. The ultimate goal of this study is to improve upon the existing SCADA (Supervisory Control And Data Acquisition) by integrating the proposed non-invasive monitoring techniques to ultimately develop the next generation SCADA system for water distribution systems.

  • Biocompatible capsules have recently been highlighted as novel delivery platforms of any "materials" (e.g., drug, food, agriculture pesticide) to address current problems of living systems such as humans, animals, and plats in academia and industry for agriculture, biological, biomedical, environmental, food applications. For example, biocompatible alginate capsules were proposed as a delivery platform of biocontrol agents (e.g., bacterial antagonists) for an alternative to antibiotics, which will be a potential strategy in future agriculture. Here, we proposed a new platform based on biocompatible alginate capsules that can control the movements as an active target delivery strategy for various applications including agriculture and biological engineering. We designed and fabricated large scale biocompatible capsules using alginates and custom-made nozzles as well as gelling solutions. To develop the active target delivery platforms, we incorporated the iron oxide nanoparticles in the large scale alginate capsules. It was found that the sizes of large scale alginate capsules could be controlled via various working conditions such as concentrations of alginate solutions and iron oxide nanoparticles. As a proof of concept work, we showed that the iron oxide particles-incorporated large scale alginate capsules could be moved actively by the magnetic fields, which would be a strategy as active target delivery platforms for agriculture and biological engineering (e.g., controlled delivery of agriculture pesticides and biocontrol agents).

  • This work continues a trend of developments aimed at exploiting the physical layer of the open systems interconnection (OSI) model to enhance wireless network security. The goal is to augment activity occurring across other OSI layers and provide improved safeguards against unauthorized access. Relative to intrusion detection and anti-spoofing, this paper provides details for a proof-of-concept investigation involving "air monitor" applications where physical equipment constraints are not overly restrictive. In this case, RF fingerprinting is emerging as a viable security measure for providing device-specific identification (manufacturer, model, and/or serial number). RF fingerprint features can be extracted from various regions of collected bursts, the detection of which has been extensively researched. Given reliable burst detection, the near-term challenge is to find robust fingerprint features to improve device distinguishability. This is addressed here using wavelet domain (WD) RF fingerprinting based on dual-tree complex wavelet transform (DT-$\mathbb{C}WT$) features extracted from the non-transient preamble response of OFDM-based 802.11a signals. Intra-manufacturer classification performance is evaluated using four like-model Cisco devices with dissimilar serial numbers. WD fingerprinting effectiveness is demonstrated using Fisher-based multiple discriminant analysis (MDA) with maximum likelihood (ML) classification. The effects of varying channel SNR, burst detection error and dissimilar SNRs for MDA/ML training and classification are considered. Relative to time domain (TD) RF fingerprinting, WD fingerprinting with DT-$\mathbb{C}WT$ features emerged as the superior alternative for all scenarios at SNRs below 20 dB while achieving performance gains of up to 8 dB at 80% classification accuracy.

  • Objectives Even though the various alternative herbal medicine has applied for osteoarthritis (OA) treatment, its scientific proof remains uncertain. The aim of the present study evaluates the effects of Chulbu-tang on inflammatory responses in a monosodium iodoacetate (MIA)-induced osteoarthritis rat model. Methods OA rat model was established by MIA injection in intra-joint of rats. 7 days after, OA rats except OA control rats were administrated Chulbu-tang (100 or 200 mg/kg) or Indomathacin (5 mg/kg) once a day for 14 days. The weight-bearing ability of hind paws were measured when group isolation 0, 7, and 14 days. Western blotting was performed to examine the knockdown/overexpressing efficiency of Chulbu-tang. In addition, cartilage destruction was measured histologically. Results Chulbu-tang treatment significantly reduced the protein expressions of inflammatory mediators such as inducible nitric oxide synthase and cyclooxygenase 2, and inhibited inflammatory cytokines including tumor necrosis factor alpha, interleukin (IL)-1β, and IL-6 through nuclear factor-kappa B (NF-κB) inactivation. Moreover, anti-oxidant enzymes such as superoxide dismutase and glutathione peroxidase-1/2 through nuclear factor-erythroid 2-related factor 2 (Nrf2) pathway significantly increased. Our findings indicate that Chulbu-tang has the potential therapeutic effect on OA through inhibiting the inflammatory responses via inactivating NF-κB signaling pathway. In addition, upregulation of Nrf2 led to anti-oxidant effects. Conclusions Taken together, Chulbu-tang is believed to have antioxidant, anti-inflammatory effects, and cartilage protection for arthritis-causing rats.
