Environmental Impact Assessment and Mediation (독일에서의 환경영향평가와 분쟁조정)

  • During the last years it became more and more difficult to deal with environmental conflicts using traditional political instruments in industrialized countries. One reason for the occurring problems might be the citizens' awareness of scarceness of nature. Another reason might be the changing legislation with the introduction of the environmental impact assessment (EIA) as an integral part of a project's licensing procedure. The EIA offers new possibilities for citizens to interfere in decision processes and to obstruct projects. The changing situation requires new instruments for conflict solving. Mediation may be considered an alternative or completion to the traditional political instruments. It is a systematic strategy for conflict treatment and. with the support of an independent mediator, allows to reach an agreement among all parties involved. Mediation may be introduced in the EIA One possibility offers the scoping date, which, if the participation of the public is assured, might avoid heavy disputes in the further process. Another connection between the instrument of mediation and the EIA could be the use of the environmental impact study (EIS) as information background for a mediation process. EIA would then be source of information about all environmental aspects. Thus the role of EIA would be extended to being a part of conflict analysis in the alternative dispute resolution process.

Comparative Evaluation between Environmental and Media ADR in terms of Legal Reservation of Compensation Clause (배상 규정의 법률유보 관점에서 환경과 언론 ADR 비교)

  • Media ADR is currently emerging as one of successful cases in South Korea while environmental ADR was known not to satisfy both defendants and offenders. Thus, this paper is intended to present proper remedies for typical compensation schemes of environmental ADR by comparing the two ADRs regarding legal reservation of compensation clause. It was found that the media ADR helped clients achieve a more fast and easy dispute resolution by providing compensation standards based on various categories such as types and scopes of compensation. However, the compensation scheme of environmental ADR brought out public complaints and inadequate services due to inconsistency and instability in terms of legal reservation. The results indicate that the compensation clause based on the reservation of laws in media ADR could be used not only as a checklist to confirm limitations of environmental ADR, but also as realistic evidences to adjust the compensation standard systematically that is under development and requires remodelling. As a result, the research findings have opened the new possibilities of "the quality assurance of environmental ADR based on the domestic legislation", proposed as an initial aim of this paper.

  • 최근 우리 나라에서도 경영합리화와 생산성향상의 문제가 활발하게 논의되고 있고, 또한 이와 동시에 기업을 경영하는데 있어서 계획 및 관리의 필요성이 강조되고 있다. 이와 같이 기업환경의 급속한 구조 변화에 대비하여 본론에서는 생산성향상을 위한 가장 중요한 경영관리 기법중의 하나인 I.E(Industrial Engineering)에 대하여 소개하고저 한다. 본래 I.E는 그 수법이나 대상에 있어서 자연과학이나 사회과학분야에서 활용되고 있었으나 미국의 F.W.Tayler 박사가 이를 최초로 경영학적 측면에 도입, 적용하였다. 1890년대에 미국은 공업생산국으로서 산업근대화에로의 발전과정에서 경영자측은 기술이나 방법에의 개선에 의한 산출량 증가로서 노동자의 임금절하를 기도하고 있는 노동자측은 태업으로 임금문제를 해결하려고 하였다. 따라서 F.W.Taylor 는 산업발전에 최대의 장벽인 임금문제의 기술적인 해결에 주력하여 노사간의 분쟁을 $\ulcorner$성과급임금제도$\lrcorner$로서 조정하기 위해 $\ulcorner$과학적 관리법$\lrcorner$(The Scientific Management)을 체계화시키기 위한 일련의 작업에 착수하였다. 이외에도 테일러는 임금문제에 관련된 생산성 향상 문제까지도 연구발전시켜 생산계획$\cdot$공장관리$\cdot$작업조직$\cdot$자재관리$\cdot$공정관리 등의 전반적인 공장관리 문제를 해결하기 위하여 $\ulcorner$공장관리$\lrcorner$(Shop management)를 발표하여 I.E의 체계를 확립시키는 계기를 마련하였다. 이와 같이 I.E는 미국을 중심으로 발생한 것이지만 그간 우리나라에서도 도입 적용되어 발전되고 있음을 감안할 때 한국양회공업협회가 본기법에 대하여 관심을 갖고 일련의 조사활동을 시작한 것은 매우 의의있는 일이라 할 수 있다.

Analysis Method of the Damages to Rights of Light due to the Construction of the Bridge in Rural Areas (농촌지역에서 교량건설에 따른 일조 피해 분석 방법)

  • Recently, construction of bridges in rural areas has been increased to preserve the natural environment. However this brings forth the disputes over rights of light in farmland. In urban areas, the disputes over rights of light have been settled on the authority of the national architectural law and only sunshine hours for winter solstice are considered. Basically, the point at issue is different between each case. The main issues of the dispute in rural area were the reduction of the crop cultivation and the increase of the heating cost in winter. The purpose of this study is to review the mediation process in national environmental dispute resolution commission to resolve these issues, and to set up the analysis method of rights of light and modelling equation of solar position. Furthermore, we aimed at analyzing the damaged hours of daylights in rural housing and the infringement rate of daylight in farmland through the case study. In conclusion, we estimated the sunshine hours during the whole damaged periods according to the elements of bridges, and presented the solution process of dispute over rights of light due to the construction of bridge in rural area.

Analysing Optimum Tugboat Capacity in Ulsan Port by Simulation Technique (시뮬레이션 기법을 활용한 울산항의 적정 예선 척수 분석)

  • The use of tugboats for the safe berthing/unberthing of ships is the most crucial factor in the safe and efficient operation of the harbor. However, the adequate number and size of tugboats that should be held based on the characteristics of the port have not been investigated in detail, which causes disputes between involved parties. Therefore, the suitable number of tugboats and the ratio of the tugboat horsepower were determined in this study using simulation techniques, with focus on Ulsan Port. First, the ship and tugboat-operating models were designed for simulation application. Next, the input variables defined in the model design were standardized in an inputtable form using ARENA software. In addition, the arrival and division process of the ship was designed and simulated as an ARENA model. Finally, the simulation results for six scenarios showed that an effective tugboat operation could be achieved when 42 tugboats were held at Ulsan Port.

  • As Chinese insurance market grows rapidly due to market reforms, China got recognition as second-largest insurance market in the world in 2016. However Korean insurance companies have had difficulties to grow in Chinese insurance market despite Chinese participation in the World Trade Organization (WTO) and the growth of chinese insurance market. The reason for the decline in Korean insurance companies is economic retaliation due to the deployment of THAAD in Korea. However, this is not a fundamental reason. The underlying cause of the effects of economic retaliation is the result of insufficient negotiations in Korea-China FTA services sector. In Service sector of Korea-China FTA, the level of concession between Korea and China differs greatly, when comparing China and South Korea's FTA. In addition, it has only been a few years since China collected the position of the WTO Doha Agenda, which currently deals with concessions on intellectual property rights and services. More important is that the Korea-China FTA service sector, as it stopped short of being protected by the most-favored-nation state treatment level when Korean insurance companies entered China. Further negotiations to supplement the weak points in the Korea-China FTA service sector were promised in December 2017, but international tensions over THAAD deployment made it impossible to hold such negotiations. However, due to changes in international affairs in 2018, the first additional negotiation was decided and held. This paper implicates strategies of further negotiation between Korea and China for service and investment chapter. Consequently, the aim of this paper suggests directions how to re-enter Chinese insurance market to Korean insurance companies.

Standards of Protection in Investment Arbitration for Upcoming Climate Change Cases (기후변화 관련 사건에 적용되는 국제투자중재의 투자자 보호 기준)

  • Although climate change is a global scale question, some concerns have been raised that principles of investment arbitration may not adequately address the domestic implementation of climate change measures. A recent ICSID investment arbitration of Vattenfall v. Germany with regard to the investor's alleged damages from the phase-out of nuclear plants is a salient climate change case. The 2005 Kyoto Protocol was made to reduce greenhouse gas emissions and it provides a number of flexible mechanisms such as Joint Implementation (JI) and Clean Development Mechanism (CDM). Implementation of the Kyoto Protocol allows dispute settlement through investor-state arbitration. Any initiation of stricter emission standards can violate the prohibition on expropriations in investment agreements, regardless of the measures created to reduce greenhouse gas emissions. The effect-based expropriation doctrine can charge changes to existing emission standards as interference with the use of property that goes against the legitimate expectation of a foreign investor. In regulatory chill, threat of investor claims against the host state may preclude the strengthening of climate change measures. Stabilization clauses also have a freezing effect on the hosting state's regulation and a new law applicable to the investment. In the fair and equitable standard, basic expectations of investors when entering into earlier carbon-intensive operations can be affected by a regulation seeking to change into a low-carbon approach. As seen in the Methanex tribunal, a non-discriminatory and public purpose of environmental protection measures should be considered as non-expropriation in the arbitral tribunal unless its decision would intentionally impede a foreign investor's investment.

  • The study aims at providing an electronic transaction records management system based on the third party repository which do not have any interest in electronic transactions. This study reviews various articles and standards. It also discusses theoretical issues about electronic transactions and electronic transaction records. Complex characteristics of electronic transaction records are explored and management procedures are analyzed and divided into 5 stages by the life cycle and management bodies. Based on these discussions the study affirms that trustworthy third parties' interventions are essential to prevent and control potential conflicts of electronic transactions. It proposes a trustworthy electronic transaction record management system with the third party repository. Futhermore, it discusses evidence and management environment of electronic transaction records and provides cases of TTPR based on contract transaction and exchange transaction.

  • 본 연구의 목적은 물거버넌스 개념과 1997년, 2006년 물관리기본법안 분석을 통해 한국의 새로운 물관리 체제를 모색하는 것이다. 물거버넌스는 물관리정책과 계획의 수립, 시행, 평가에 있어 정부뿐만 아니라 일반 기업, 시민, 환경단체, 전문가 등 여러 이해당사자를 참여시키는 것을 핵심으로 한다. 거버넌스란 기존의 정부 주도의 정책 계획, 수립, 시행이 아닌 비정부 조직과의 타협, 협의, 논의를 통한 양방향 정책결정 과정을 뜻한다. 따라서 물거버넌스의 가장 중요한 원칙은 다양한 이해당사자 참여를 통한 정책결정의 복수화 과정이다. 한국의 물거버넌스를 시행하기 위해 가장 필요한 요건은 이해당사자 참여를 우선 중앙, 지방정부에서 그 필요성을 인식하고 법, 제도 등을 통해 제도화하는 것이다. 환경부 주도로 입안된 1997년 물관리기본법안은 물관리일원화, 적정사용, 유역관리, 비용부담, 균형배분의 5원칙을, 2006년 물관리기본법안은 물관리일원화 대신 통합물관리, 적정사용 대신 수요관리를 삽입하여 5원칙을 제시하였지만 이해당사자 참여는 원칙에 포함시키지 않았다. 이해당사자 참여 원칙의 제도화가 없이는 위의 두 법안이 제시한 원칙의 적용과 시행이 어려움에 봉착할 가능성이 높다. 왜냐하면 다른 원칙은 다양한 이해당사자 참여를 통한 사회적 합의 없이는 시행이 쉽지 않은 정치적으로 민감한 사항들이기 때문이다. 예를 들어 물의 균형배분 원칙 관련, 만약 상류와 하류 주민 간의 합의가 없이 어느 한 이해당사자의 일방적 행위가 있을 경우 큰 갈등을 유발할 수 있다. 물거버넌스을 실행하기 위해 중앙에 필요한 조직은 물이용 관련 물분쟁 발생 시 이를 조정하고 국가물관리계획을 수립하며 물관리 문제 전반을 총괄하는 조직이다. 1997년, 2006년 기본법안은 국가물관리위원회 설치를 제시하였고 2006년 기본법안에서 보다 구체적으로 위상, 운영, 역할 등에 대해 언급하였다. 하지만 국가물관리위원회는 물관련 중앙부처의 장, 지방행정조직의 장만을 포함하여 유역관리를 책임질 유역관리조직의 장에 대한 언급이 없다. 물거버넌스 실현을 위한 유역관리 시행이 바람직하기에 유역관리조직의 장도 국가물관리위원회에 참여하는 것이 바람직하다. 또한 두 기본법안 모두 국무총리실 산하에 위원회를 속하게 하였는데 이를 수정하여 대통령 직속기구로 규정하는 것이 국가물관리위원회가 정치, 행정, 재정적 압력에서 벗어나 일관성 있는 정책을 펼 수 있는 지름길이 될 것이다. 또한 지방의 물문제를 물관리계획에 적절히 반영하고 대응방안을 수립, 시행하기 위해서는 정부 관료뿐만 아니라 지방의회 의원, 환경단체, 기업, 시민, 전문가 등의 다양한 이해당사자가 참여하는 유역위원회가 필수적이다. 또한 유역 관련 물관리계획을 수립하고 사업을 추진하는 유역관리청도 필요하다. 유역위원회와 유역관리청은 유역 내 여러 이해당사자들이 물관리에 대해 다양한 의견을 개진하고 토론하며 합의점에 이르는 거버넌스를 수립할 수 있는 중요한 조직이다. 두 기본법안은 유역관리 원칙을 제시하긴 하였지만 유역관리 시행 관련 조직, 역할, 운영 등에 대해서는 언급이 없었다. 한국의 물관리는 소득, 문화 수준 향상으로 인한 양질의 물공급에 대한 요구, 시민사회의 발전, 지방분권화 등 정치, 경제, 사회의 변화를 수용하고 발전해 나가기 위해서는 여러 이해당사자의 참여와 합의에 바탕을 둔 물거버넌스 수립이 무엇보다 중요하다. 또한 이를 시행하기 위해서는 물관리기본법을 하루 속히 제정하여 제도적 기반을 갖춰 보다 효율적인 물관리시스템을 수립해야 한다.

Periodic Characteristics and Implications of Programs and Policies for Brownfield Management in the U.S.A. (미국 브라운필드 관리 프로그램과 정책의 시기별 특성과 함의)

  • Brownfield sites are beginning to be considered as potentially useful areas for landscape design and planning, with post-industrial areas such as water treatment facilities and military training bases being converted into useful landscapes such as parks and recreation areas. These redevelopments bring broad benefits through revitalizing communities and increasing property values, thus, increasing the demand for comprehensive management and planning policies. This study examines changes in U.S. brownfield policies and programs and, identifies their periodic characteristics over the thirty years since the Superfund program was introduced in 1980. A descriptive and interpretive approach was utilized, focusing specifically on a time sequential analysis of the data gathered from the overview of the Environmental Protection Agency's web-based documents and related literature. The primary changes in and characteristics of programs and policies were analyzed and divided into three periods : environmental protection, remediation and reuse, and comprehensive planning. Four major features were identified: relaxation and readjustment of regulation, diversification of support programs, a mix of top-down and bottom-up approaches, and database system building. The study examines how common brownfield problems such as site identification difficulties and assessment and remediation cost have been dealt with in the regulatory context and has implications for future policies and programs for effective brownfield planning and management in Korea.
