글로벌화 시대의 도래에 따라 국내외에 사학연금 가입자의 국제적 이동이 급증하고 있다. 이에 따라 국내외 사학연금 가입자의 사회보장협정 체결에 관한 필요성이 증가하고 있다. 국민연금은 제도 도입 초기부터 해외 국가와 사회보장협정을 통하여 보험료 이중적용의 면제와 가입기간 합산을 통해 각국 연금제도에 기여한 기간에 따라 양국에서 각각 연금을 수령하고 있다. 그러나 사학연금은 국민연금에 비하여 해외 사학연금 가입자에 대한 정책적인 고려가 되고 있지 아니하다. 본 연구에서는 이와 같은 상황을 감안하여 해외 사학연금의 사회보장협정 체결의 필요성과 타당성 및 체결효과에 대하여 분석하고자 하였다. 본 연구는 사학연금이 독자적으로 사회보장협정을 체결하는 방안보다는 국민연금에서 체결한 사회보장협정을 준용하여 사학연금의 사회보장협정 방안을 제시하였다. 본 연구의 주장은 다음과 같다. 첫째, 국민연금이 체결한 사회보장협정의 내용을 토대로 사학연금이 사회보장협정 체결을 시도할 필요가 있다. 둘째, 사회보장협정 체결을 위한 제반 규정 및 시스템을 마련할 필요가 있다. 본 연구는 사학연금의 사회보장협정 체결의 필요성 및 근거 자료를 제공함으로써 사학연금의 사회보장협정 체계를 추진하는 방안을 제시하였다는데 의의가 있다.

국제연합무역개발회의(UNCTAD)가 1976년 제4회 나이로비 총회이후, 추진해온 일차산품 종합계획 중 천연고무에 관한 교섭은 79년 10월초에 정리되어 정식으로 천연고무 상품협정이 발족하게 되었다. 동협정은 80년 1~6월간에 제네바에서 각국이 서명하고, 7~9월에 각국에서 비준하여 10월에 발족될 전망이다. 완충재고를 중심으로 한 동협정은 UNCTAD의 18개품목의 협정 중, 경제조항과 의무분담을 골자로 한 협정으로서는 처음 있는 일로서 주목되고 있다. 동협정은 천연고무가격의 안정과 공급안정을 목적으로 한 것이나, 동협정이 발효되더라도 현재에는 최고가격인 270싱가포르센트 이상으로 되어 있으므로 당분간은 아무런 효과도 거두지 못할 것으로 보인다. 고무업계에서는, 「천연고무가격이 안정되는 것은 환영하고 있으나 고가안정으로 (주석협정과 같이) 될 두려움마저 있다」고 평하고 있으며, 원재료앙등에 고심하고 있다. 전문 68조로 된 천연고무 국제협정의 내용은 다음과 같다.

사적 경쟁제한행위에 대한 효과적인 규제 없는 통상협정은 그 소기의 목적을 달성하기 힘들다. 통상협정은 근본적으로는 협정 당사국에 대한 시장접근(market access)을 높이기 위한 것이다. 그런데 협정을 통하여 공적 장벽을 없앤다고 하더라도 해당국가에 예컨대 고질적인 수직적 거래제한(vertical restraints)이 만연해 있어서 외국기업이 자국의 소비자에게 접근할 수 없다면 통상협정을 통하여 달성하고자 하는 시장접근은 공염불이 될 것이다. 한미 FTA협상에도 통상협정과 경쟁정책과의 이러한 상호보완적인 관계에 대한 깊이 있는 성찰이 있어야 할 것이다.

The FTA conventional tariffs shall be applied that the imported goods are subject to the conventional tariffs under any agreement, and the origin of the good is the contracting state in accordance with the criteria for determination origin under any agreement. An importer who intends to be eligible for the application of a conventional tariff shall file a request for the application of a conventional tariff with the head of the competent customs house before the relevant import declaration is accepted. The purpose of this study is to examine the legal standard and verification cases for the judgement of the tax tribunal of FTA conventional tariffs. Through this study, this paper is to provide several implications for companies seeking the benefits of FTA conventional tariffs. The Korean companies to do the following: confirm the effective requirements for direct transport of goods through non-parties under the Korea EU FTA, confirm the criterion for application of conventional tariffs such as certificate of origin and claims for ex post facto conventional tariffs under the Korea US FTA, confirm the issuer of origin declaration and the recognition of origin declaration of bill of lading under the Korea EU FTA, utilize the tax appeal system by denial of FTA conventional tariffs, and prepare the discrepancies in interpretation of legal standard under FTA and FTA Special Customs Act.

This paper evaluates Korea's achievements in implementing the WTO Information Technology Agreement (ITA1), which has been referred to as one of the most successful stories in trade liberalization. ITA1 and other agreements for trade liberalization were evaluated based on quantative statistics, and the implication that is not shown as numbers has often been ignored. Based on in-depth interview methods, results of this paper provides academic importance in filling the gap in knowledge regarding the success of trade liberalization from a qualitative perspective. As well, it has practical importance in exploring implications for continuing the success in implementing the ITA2 and further implementing other agreements for trade liberalization.

This paper conducts a comparative analysis of the KORUS FTA and the TPP Agreement to assess the current state of affairs in international trade rules for the pharmaceutical industry. Intellectual property rights as well as public health related regulations have evolved to strengthen the position of innovator drug companies. In particular, the TPP Agreement which adopted data exclusivity for biologics for the first time, will set the standard for the future. Apart from this however, the TPP Agreement has not gone further than the KORUS FTA and in some respects, even contains greater policy flexibilities and provisions for market access than the KORUS FTA. Korea should take advantage of such differences when and if she must engage in negotiations to join the TPP Agreement or a renegotiation of the KORUS FTA.

국제 원자력 협력이 증가함에 따라 양자간의 협력을 위한 법적 근거가 되는 원자력협력협정의 중요성이 정차 커져가고 있다. 본 논문에서는 미국의 원자력협력협정과 관련된 정책을 분석하기 위하여 우선 미국 원자력법 상의 관련 규정을 파악하고 미국 원자력협력협정이 체결 또는 개정되는 절차 등을 분석하였다. 또한 이들 절차가 실제 적용되는 사레를 파악함으로써 우리에의 시사점을 도출하였다.

There is growing concern about landscape agreement with regard to a variety of activities within resident-based agreements in Korea. This study aims to investigate the communication method of the agreement contacting process and its essential role as a bottom-up resident-based process. The study site is Gobuk Market in Suwon city, where a resident-based landscape agreement was successfully made. In this study, the author implemented in-depth interviews and a literature review to understand the meaning of the agreement contracting process and participants' opinions regarding the Gobuk Market case. During the landscape contracting process, the level of participation of residents, experts and the government changed. The study found that diverse communication methods, such as training, agreement information sessions and seminars were conducted during the process of the resident-based landscape agreement and it is crucial to construct healthy relationship among stakeholders. Furthermore, the experts' role is crucial in establishing agreement among residents initially. However, as local empowerment and the willingness of local people grow, each stakeholder's role is changed by stage. Therefore the Central and Local Government have the necessary task of providing institutional strategy. This study has offered practical information on how each stakeholder played their individual role within the landscape agreement.

전시 접수국 지원(WHNS) 협정의 개념은 '80년대초 이후 미국이 NATO의 중.장기 방위증강을 추진하는 과정에서 발전,구체화된 것으로서 현재 미국은 벨기에, 서독등 10개의 NATO 회원국들과 WHNS 협정을 체결하고 있다. 우리나라와 미국간의 WHNS 협정은 지난해 서울에서 개최된 제23차 한.미 연례안보협의회의(SCM) 기간중(1991년 11월 21일) 체결되었다. 이 협정은 외부침략등 유사시 미국과의 연합전쟁 수행을 전제로 미국 증원부대의 전개를 보다 신속히 하고, 증원군이 필요로 하는 군수지원 사항을 사전에 규정해 둠으로써 유사시 대응태세를 강화하는데 목적이 있으며 주한미군의 단계적 감축에 대비한 보완책으로서 그 필요성이 크다고할 수 있다. 이 협정의 체결을 계기로 한.미 양국은 수평적 안보협력관계를 발전시켜 나가는 기반을 조성하였으며, 기존의 지원사항 및 협력체계의 재정비와 한.미 연합방위능력의 향상이 기대된다
