이번의 손해배상제도 개편은 사법적 구제의 확대를 통한 경쟁법 집행구조의 근본적 개편을 위한 하나의 계기에 불과하다. 이번 개정안에서 반영되지 아니한 금지청구제도 도입, 독일법제에서 보는 바와 같은 불공정거래행위 사건의 순수한 민사사건화와 같이 공정거래법 위반사안의 성질과 효과를 감안한 민형사 및 행정적 구제수단의 차별화, 공정거래법 위반사건에 대한 검찰의 원고 적격 부여 등은 시장에 미칠 충격을 감안하면서 지속적으로 검토되어야 할 남은 과제라고 할 것이다.

대법원이 2011년 6월에 선고한 공정거래 관련 판결 중 지면 관계로 지난 호에 미처 소개하지 못한 것들과 2011년 7월부터 8월까지 사이에 선고한 공정거래 관련 판결 중 주요한 것들을 소개한다. 이 사이에 대법원은 행정, 민사, 형사 전 분야에 걸쳐 상당히 의미 있는 판결들을 많이 선고하였다. 그 중 배타조건부 거래행위와 관련된 대법원 2011. 6. 10. 선고 2008두 16322 판결, 지로수수료 인상 합의와 관련된 대법원 2011.6.30. 선고 2009두 18677 판결, 군납유류 담합 입찰에 기한 국가의 손해배상청구와 관련된 대법원 2011.7.28. 선고 2010다18850 판결 등이 특히 중요한 의의를 가지고 있는 것으로 보인다.

21세기는 사이버공간의 확대, 선점이 곧 국가와 기업 그리고 개인의 생존경쟁력의 바로미터가 될 것이다. 그러나 사이버공간에서 발생되고 있는 정보화의 역기능들은 갈수록 빈번하고 지능화되고 있어 심각한 사회적 혼란과 국가의 전략적, 행정적, 경제적으로 막대한 손실은 물론 군사활동마저 마비시키고 있는 실정이다. 따라서, 본 글에서는 사이버 광간에서의 범죄행위를 예방하고 차단시킬 수 있는 정보보호기술과 패러다임을 조사 분석하여 정보보호산업의 현황을 알아본 다음 정보보호기술의 측면에서 활성화 방안을 제시한다.

도시가스 시공은 특수분야로서 경험이 없으면 시공하기 힘들다. 또한 가스 시공은 국민의 재산보호와 직결되어 있으므로 시공 과정에서 많은 서류가 필요하고 인허가 및 안전점검이 특히 요구된다. 대한설비건설협회 가스설비공사협의회(위원장 이효련)는 지난해 한국도시가스협회와 협의를 통해 도시가스 사용자공급관(공동주택 등)의 행정절차 및 제출서류 간소화 및 표준화와 함께 현장에서 만연하고 있는 도시가스사의 부당행위를 강력하게 건의한 결과 이를 시정조치하여 가스시설시공업 회원사의 경영환경을 크게 개선했다. 본지는 도시가스 사용자 공급관 업무처리 절차를 살펴본다.

유비쿼터스 환경은 조직의 구조와 개인의 행위를 변화시킬 뿐만 아니라 기업의 경쟁 패러다임 자체를 변화시킬 것으로 전망하고 있다. 또한 유비쿼터스 컴퓨팅의 기술이 경영경제, 행정, 교육, 문화, 의료등 사회 전반에 걸쳐 도입되고 있으며, 이에 따른 비즈니스 모델에 대한 중요성이 증대되고 있다. 기술에 관련된 RFID, USN, 표준화, 보안등에 대한 연구가 활발히 이루어지고 있으나, 비즈니스 모델에 관련된 연구는 미흡한 실정이다. 본 연구에서는 유비쿼터스 컴퓨팅에 대해 알아보고 비즈니스 모델 사례 검토를 통해 유비쿼터스 컴퓨팅 시대의 비즈니스 모델과 발전 방향 및 혁신 전략을 제시하고자 한다.

약할기반 접근통제는 현재 가장 많이 사용외는 임의적 겁근통제 및 강제적 접근통제에 비하여 유연성을 제공하며 접근통제 기법이 정교하다. 따라서, 역할기반 접근통제는 금융 및 기업 등과 같은 상업적 분야 및 행정적인 분야에서 많이 사용될 것으로 예측된다. 본 논문에서는 기존에 제안된 역할기반 접건통제 메커니즘에 역할의 속성을 정의하여 새로운 형태의 역할기반 접근통제 메커니즘을 제안하였다. 제안된 역할기반 메커니즘은 기존의 역할기반 메커니즘이 실생활에 잘 적용되지 않는 단점을 극복하였으며, 특히 살라미 공격, 내부자의 부정행위 방지에 효과적으로 적용 가능하다. 또한 역할을 부여받는 사용자의 역할 중복 방지를 위하여 차이 연산자를 정의하였다.

We report and analyze the Korean physicians' recent general strike over the implementation of the Separation of Prescribing and Dispensing Practice (SPDP) in which more than 18,000 private clinics and 280 hospitals participated. Utilizing game-theoretic models of bargaining we explain why the Korean physicians were so successful in organizing intense collective action against the government and securing very favorable policy outcomes. In particular, we highlight the role of distributional conflict among social actors in shaping the details of institutional reform. The introduction of the SPDP was a necessary first step in the overall reform of health care system in Korea. However, the SPDP was perceived to be a serious threat to the economic viability of their profession by the vast majority of Korean physicians who had long been relied on the profits from selling medicines to compensate for the loss of income due to the low service fee under the previous health care system. The strong political coalition among heterogeneous physicians enabled them to organize an intense form of collective action, the general strike. Thus, physicians were successful not only in dragging the government to a bargaining table, but also winning in the bargaining and securing an outcome vastly favorable to them. On the other hand, the lack of an overall reform plan in the health care policy area, especially the finance of the National Health Insurance and the need for maintaining an image as a successful reform initiator, motivated the government to reach a quick resolution with the striking physicians.

The impact of regulations on industrial activities is significant. Because the food industry has to observe given obligations and bear costs and expenses resulted from complying with applicable food safety regulations. Meanwhile, A government drafts the regulatory impact analysis report prior to enactment, amendment or reinforcement of any regulations. The analysis powered by objective and scientific methodologies enable a government to judge whether a particular regulation will be good or bad for the society. An effective policy implementation in practice and cost-bearing is entirely up to industries. Moreover, opportunity cost and actual cost relating to or arising from regulatory compliance will be estimated only by the respective industries. Therefore, the food Industry needs to collect and accumulate the said information and also to disseminate their hardships and financial burdens. Objective and practical information will encourage a government to set out regulatory frameworks that rational policy making.

A cost analysis for hospitalized patients was performed based on the RBRVS in order to determine an appropriate nursing fee schedule. The study was conducted through three phases as follows: 1) Nursing activities provided for the inpatients currently in Korea were identified and classified using a taxonomy which was developed by our research team through the Delphi process. 2) The resource-based relative points for every nursing activity according to nursing time, mental effort and judgement, technical skill, physical effort and stress were determined through a survey of 300 clinical RNs working at 5 tertiary hospitals from May 25 to July 25. 1998. 3) The nursing cost of every nursing activity for hospitalized patients was estimated based on the RBRVS. As a result, 136 nursing activities were identified and classified by nursing processes and nursing domains. However, our classification system of nursing activities should continue to be refined, and all nursing practices should be standardized. The nursing activities were given resource-based relative points ranging from 100 to 400 points, then each nursing activity was assigned a value for the RBRVS, which was determined by the exponential function of 2resource-based relative point/100. Thus, a value of 2 was calculated for 100 points, 4 for 200 points, 8 for 300 points, and 16 for 400 points. Meanwhile, the unit cost of nursing was calculated as 170 Won. The nursing cost of 136 nursing activities was estimated using the RBRVS as shown in
