A Study on Evaluation of the Priority Orders for the Establishment of Maritime Courts Using Maritime Casualties Counts Based on Integrated ELECTRE-CRITIC-ISM (통합 ELECTRE-CRITIC-ISM법 기반 해양사고 발생건수를 이용한 해사법원 설치 우선순위 평가에 관한 연구)

  • In those day, Incheon and Busan local government are arguing about establishment of a maritime court. This study aims to develop a model that evaluates the priority orders for the establishment of maritime courts using maritime casualties counts based on the integrated ELECTRE-CRITIC-ISM technique, as well as to verify its usefulness in the establishment of maritime courts in Korea. For this purpose, a total of 22 ports, excluding nine ports where maritime accident data were integrated and managed among the 31 international trade ports, were matched with the jurisdiction of six alternative high courts. Second, the CRITIC method was used to calculate the weights of the number of maritime casualties during a 5-year period that were evaluation factors and combine with the ELECTRE method. Finally, the ELECTRE&ISM method was used to analyze the concordance and discordance between high courts and evaluate the priority orders considering the fluctuations of maritime casualties counts. As the final evaluation result considering the mean values in fluctuations of maritime casualties counts, the Busan High Court ranked first, the Gwangju high court second, the Seoul high court third, the Daejeon and the Daegu high court forth (equal), and the Suwon high court sith. Therefore, it is necessary to preferentially establish a maritime court in the jurisdiction of the Busan High Court.

A Study to Improve the Vessel Navigation Suspension Order System (항행정지명령 제도의 개선방안에 관한 연구)

  • With the introduction of the maritime safety supervisor system in Korea following the passenger vessel Sewol accident, the safety control system for coastal vessels has been reinforced. A maritime safety supervisor performs marine accident prevention activities by offering periodical or occasional guidance and supervision. When a deficiency is found during guidance or supervision sessions, an order for improvement is issued to rectify the problem by such measures as supplementation or replacement of vessel facilities, improvement of work hours and working conditions for employees, educational and training programs for executives and employees, or the improvement of other affairs relating to maritime safety control. However the present order for navigation suspension by a maritime safety supervisor is limited solely to supplementation or replacement. For this reason, orders for navigation suspension against other facilities is impossible, even if a serious deficiency that could lead to a marine accident such as poor cargo loading conditions or unqualified crew is identified. Therefore, the order for vessel navigation suspension to secure seaworthiness should be expanded to include cargo loading/unloading operations, certificates and documentation, maritime safety management systems, and human elements including emergency drills and working conditions, in addition to the supplementation or replacement of vessel facilities that exists.

A Study on the Standardization Scheme for Aids to Navigation & the Related Marine English (항로표지와 관련해사영어의 표준화 방안)

  • With today's continuous increase of both seaborne trade and foreign crew boarding ships, it is necessary to study the standardization of Marine English with respect to Aids to Navigation(AtoN) for the safety of ships. After reviewing the organization of the standard council of the equipment and article of AtoN, the standardization of various types of AtoN was not capable of meeting by the only existing council's activities. For on-the-job progress, it was necessary for the subcommittee to be composed by types of AtoN. It is thus desirable to the integrated approach to the combination of the civil, the public, academic circles and research institutes, which harmonized the council's flexibility and professionalism in the composition of the members. Subjects, levels and targets in each course were presented from results of the study on the standardization scheme of Marine English related to AtoN. The ET steps were classified by the difficult degree to which the principles of interpretation and communication were applied. This study contributed to the scheme that was firstly established to solve the problem of the audiovisual English ET due to the lack of the professionalism of the existing marine affairs by presenting the standardization scheme of Marine English prior to the institutional reform related to AtoN.

A Proposal for the Invigoration of Maritime Arbitration (해사중재 활성화를 위한 전제조건에 관한 논의)

  • In Korea, although nearly all maritime arbitration cases are dealt with by the Korean Commercial Arbitration Board (KCAB), the total number of cases that are referred to the KCAB is relatively small compared with the total number of maritime cases that occur in Korea. There may be reasons why maritime arbitration is not utilized more in Korea. However, of the above reasons, the superseding one may be that there is still a lack of confidence in the credibility and foreseeability of maritime arbitration in Korea. To expand the use of maritime arbitration in Korea, it is essential that the base surrounding maritime arbitration be expanded. In addition, it is also necessary that specialists receivetraining in maritime law. In this context, it is strongly recommended that maritime and admiralty law be taught in law schools and be included as a regular subject on the Korean bar exam. Additionally, to promote maritime arbitration, a rule should be introduced allowing for shortened arbitration proceedings in Korea. Although Chapter 8 of the KCAB Arbitration Rules provide for "Expedited Procedure," this process alone is not because the rules for Expedited Procedure generally apply in arbitration cases where both parties have agreed in a separate agreement to follow the procedures provided or in any domestic arbitration valued atless than 100,000,000 Korean won. Therefore, the KCAB Arbitration Rules for Expedited Procedure must be reformed to encompass international arbitrations. Additionally, experts who are experienced in the maritime sector should be elected as arbitrators. Given the factthat a fair number of arbitration cases can be characterized as international, it is important that businesspersons who are very fluent in English be appointed as arbitrators in order to increase the reliability of maritime arbitration in Korea and save costs. Meanwhile, because lawyers and scholars constitute a considerable portion of KCAB arbitrators, commercial persons from relevant industries should be enlisted as arbitrators. Even though there are arguments for the establishment of an independent maritime arbitration board in Korea, establishment of a separate maritime arbitration board will not directly guarantee the prosperity of maritime arbitration in Korea. Instead of instituting a new maritime arbitration board, it is better that a reorganized KCAB modify existing arbitration proceedings to make them faster and more economical if maritime arbitration is to prosper. In this regard, ad-hoc arbitration would be an option for speedy and thrifty maritime arbitration. Finally, to gain the confidence of domestic and foreign parties, we cannot ignore the importance of advertising the specialties and qualifications of the KCAB and its personnel among business entities.

  • 해상교통안전진단은 해사안전법에 의해 시행되는 법적인 사항이다. 해상교통안전진단에서는 안전취약요소를 도출하고 취약요소에 대한 조치사항, 사업자의 의견 및 조치사항에 대한 시행주체를 정해야 한다. 안전취양요소에 대한 조치사항 중에는 사업자가 감당할 수 없는 사항이 다수 존재하지만 사업에 대한 심의, 승인 등의 권한을 갖는 처분기관과의 종속적인 관계로 인해 사업을 진행하기 위해 사업자가 그 부담을 지는 사례가 발생하고 있다. 이 연구에서는 VTS를 중심으로 그 사례를 소개하고자 한다.

국제기구에서 바라보고 있는 e-Navigation PNT의 역할과 요구성능

  • e-Navigation은 해사안전과 관련하여 국내외에서 가장 주목받고 있는 주제임에 분명하다. 본 논문은 e-Navigation에서 주요한 요소로 다루고 있는 PNT(Position, Navigation, Timing)의 중요성과 역할에 대해서 설명한다. 그리고 국제기구에서 논의되고 있는 PNT 관련 쟁점 사항들을 주제별로 분류하고, 각각의 주제가 해결하고자 하는 문제를 정의한다. 더불어 본 논문은 최근에 국제기구가 요구하고 있는 PNT 성능이 정의한 문제와 어떠한 상관관계가 있는지를 보인다. 마지막으로 e-Navigation에서 목표로 하는 PNT 성능을 구현하기 위한 주요 선진국의 대응 현황에 대해 알아보고, 향후 발전방향에 대해 전망한다.

  • At maritime safety committee 78th of IMO, the Norway suggested the development of provisions for installation and operation of gas fuelled internal combustion engine with the exception of LNG carrier. At first, this document decribes gas fuelled internal combustion engine, describes IMO's tredency under FP sub-committee, DE sub-committee and BLG sub-committee's purview. Furthermore, this paper proposes actions requested the development of this provisions in Republic of Korea.

  • 호황기에 정기선업계가 미처 생각하지 못했던 북미 서안항만의 혼란은 어디에서 비롯된 것일까? 로스엔젤리스(LA)·롱비치(LB)항의 피크(peak)시 80척 이상의 체선현상도 12월 중순에는 거의 해소됐다. 그러나 항만 노동력의 부족, 환경 문제, LA·LB 양 항만으로의 과도한 집중, 대체항의 부족 등의 많은 문제들이 가로놓여 있는 상태이다. 일본해사신문 편집부 기자가 LA·LB 등 미 서안지역을 직접 방문하여 혼란스런 미국의 관문(gateway)을 둘러보았다. 다음은 일본해사신문이 5회에 걸쳐 게재한 기사내용을 정리한 것이다.(편집자 주)
