The Supreme Court's en banc decision on December 12, 2022 (docket number 2016Do21314) presented a new standard for determining whether the use of diagnostic medical devices by Korean medical doctors constitutes oriental medical doctors constitutes unlicensed medical practice. Based on this standard, it was determined that the use of ultrasound by Korean medical doctors was not an unlicensed medical practice. Supreme Court's Decision 2016Du51405 on August 18, 2023, is the first case in which a new standard was applied to determine that an Korean medical doctor's use of electroencephalography to diagnose Parkinson's disease and dementia was not an unlicensed medical practice. The Supreme Court abolished the previous standard that Western medical knowledge and technology should not be required for Korean medical doctors to use medical devices. However, it was unclear whether Western medical diagnosis of Korean medical doctors using diagnostic medical devices would be viewed as an an auxiliary method of diagnosis. Parkinson's disease and dementia are Western medical diagnoses. The Supreme Court judged that the Western medical diagnosis of Korean medical doctors was not an unlicensed medical practice. This clearly explains what an auxiliary method of diagnosis means. In addition, the Supreme Court excluded the principles of development and production of electroencephalography from its judgment criteria. Automatic extraction and automatic reading of test results were also excluded. The criminal court's view that the meaning of oriental medical practice should be clearly and strictly interpreted from the perspective of an oriental doctor, and it was clarified that diagnostic medical devices were excluded from criminal punishment unless it was clear that they were not related to the principle of oriental medical practice. As a result, the Supreme Court made it clear that the use of diagnostic medical devices is excluded from criminal punishment unless it is clear that they are not related to the principles of Korean medicine.

여러 약재의 복합적인 작용으로 치료를 행하는 한의학의 특성으로 여러 처방과 약재 조합들을 기억하고 있어야 하는 한의사의 어려움을 줄이고 환자에게 보다 높은 질의 의료 서비스를 제공할 수 있는 환경을 만드는 것이 목적이다. 다양하고 복합적인 약재의 조합으로 증상을 치료하는 한의학의 특성 때문에 셀 수 없이 많은 약재의 조합이 존재하며 한의사가 이 모든 조합을 기억하기는 어렵기 때문에 한의사들이 환자를 처방함에 있어 조금이라도 보탬이 될 수 있는 처방 지원 시스템을 개발할 필요가 있다. word2vec을 이용하여 처방과 약재의 조합을 추천해주며 분석을 통해 산출된 약재의 조합과 그 조합이 실제 의서에 존재하는지의 여부를 함께 알려주어 한의사가 보다 더 주의하여 환자에게 처방할 수 있다.

한의학에서 혀는 인체 내 생리, 병리적 변화를 반영하여 진단에 있어 중요한 지표자료로 사용하고 있다. 하지만 설진은 진단환경에 의한 영향을 많이 받게 되어 객관적이고 정량화된 결과를 얻기 힘들며, 그로 인해 한의사의 진단에 대한 신뢰성도 낮아 널리 활용되지 못하고 있다. 이를 해결하기 위해 본 연구에서는 제한된 측정환경을 제공하는 디지털 설진 시스템을 통해 한의사로부터 황태라 진단받은 48명과 백태라 진단받은 14명의 설 영상을 획득하고, 설태의 컬러벡터값을 구하여 백태와 황태를 구분하는데 유의한 변수를 도출하였으며, 이를 이용하여 한의사의 설태 진단과 일치율이 높은 판별함수를 도출하였다. 이와같은 연구방법은 백태, 황태 뿐 아니라 회태나 흑태 또는 후태나 박태를 구분하는 데에도 유용하게 쓰일 수 있을 것이며 앞으로 한의사의 설진과정을 객관화, 과학화하는 과정에 기여할 수 있을 것이다.

한의학에서는 사상체질(태양인, 태음인, 소양인, 소음인) 구분을 위해 손등피부의 특징 중 하나인 거침/미끄러움을 이용하여 한의사의 주관적인 판단으로 사상체질을 구분해 왔다. 한의사의 손등피부 거칠기의 주관적인 촉진을 정량적 및 객관적으로 진단하기 위하여 피부마찰력진단기기를 개발하였다. 피부마찰력진단기기는 3축 로드셀 센서를 이용하여 한의사가 손등피부를 만지는 것과 같은 움직임으로 측정하며, 측정된 물리량 중 피부의 거침/미끄러움으로 계산되는 운동마찰계수 값을 이용하여 손등피부의 특성을 나타내었다. 본 연구에서는 피부마찰력 진단기기를 이용하여 객관적으로 손등피부의 특성을 측정해 보고 사상체질 진단의 객관적인 지표를 찾는 것을 목표로 한다.

한의사의 복진을 모사하는 진단기기와 이를 이용하여 질환과 변증을 분류하는 알고리즘을 개발하는 연구가 진행되고 있다. 진행되는 연구에서 열화상에서의 복부 냉감 영역 검출 방법이 제시되었다. 이 연구에서 열화상을 획득하고, 한의사의 촉감 데이터를 획득하여 이를 비교하여, 딥러닝 알고리즘을 적용하여 열화상을 가지고 복부 냉감 영역을 찾는 방법을 제시하였다. 배경, 복부, 냉감 영역의 IOU 결과로 95.6%, 70.3%, 36%의 일치도를 보여주었다. 이는 신뢰성 있는 복진기기로 가는 필수적 경로이다.

South Korea's medical system has dual systems-that is, Oriental and Western Medicine. Both are different from method for diagnosis or treatment of diseases and Scientific principle. Of the characteristics of Oriental medical practice in comparison with Western medical practice, notably, it is difficult to acknowledge specific constitutions, Oriental medical doctors' discretion is broad, and Oriental medical practice has a low invasiveness. Thus, it is difficult to acknowledge human specific constitutions when grounded on Oriental medical principles, thereby making it difficult for Oriental medical doctors to argue such specific constitutions as a means of defending against their medical negligence. And, it is difficult to prove Oriental medical doctors' negligence because Oriental medical doctors' scope of discretion is broad. Collaboration of Oriental medicine and western medicine can diagnose and treat the patient's diseases from a different viewpoint, making both medicines complementary. Oriental medicine and western medicine are independent of each other, equal, thus making them divided horizontally. Horizontal medical service division involves the principle of trust, but the principle of trust does not always apply to Oriental medicine and western medicine, because if patients shift from one area of medicine to another, the scientific principle, diagnostic method and treatment method of that medical area should be different. Application of the principle of trust to both of them needs to be analyzed according to types of medical institutions where transfers occur, and to the scope of work division between them.

본 연구에서는 환자와 한의사, 방사선 전문의 간에 초고속 통신망을 이용하여 원격으로 환자의 질환 상태를 파악하고 이에 따른 처방전을 내릴 수 있도록 하는 한방 원격 검진 시스템에서 환자의 X-ray 사진, CT 사진 등의 방사선 이미지들을 DICOM 프로토콜에 의거하여 저장하고 검색할 수 있도록 해주는 시스템을 구현하였다. 본 연구에서는 이미지 처리 및 관리 모듈을 Java 언어를 이용하여 구현함으로써 방사선 전문의와 한의사들이 컴퓨터의 기종에 관계없이 웹브러우저를 사용하여 환자의 X-ray나 CT 등의 방사선 사진을 살펴볼 수 있도록 하였다.
