On July 23th, 2009, the newly-revised copyright law was reflected the free trade agreement which occurred between the United States and the Republic of Korea. The agreement is expected to have positive effects such as competition as well as the social efficiency in the field of intellectual property. Nevertheless, Korean government should pay much costs, Therefore, we should minimize the cost in a short run and maximize the benefits we could obtain out of the agreement in a long run. However, we are not prepared to improve economic value of the intellectual property rights. Specifically, it should be noted that the aspects of law execution to protect not only the intellectual property rights. If we manage to get the utmost out of the agreement, we could be going through the transition from a consumer nation of intellectual properties to a producer nation.

지난 반세기 동안 주한미군은 한반도 안보에 결정적 역할을 수행해 왔따. 그러나 변화하는 안보환경은 국민의 주한미군에 대한 인식에 영향을 미치고 나아가 주한미군의 주둔과 관련 문제들에 영향을 미치고 있따. 한국측에서는 주한미군의 지위를 법적으로 규정하고 있는 '한미행정협정(SOFA)' 의 주한미군 범죄, 환경, 한국인 근로자 노무 규정 등과 관련하여 다양한 불만의 목소리가 나오고 있다. 또한 주한미군측 역시 나름대로 한국 주둔에 따르는 불편함을 호소하고 있는데, 그 대표적인 것이 '주택문제'이다. 이러한 문제들은 단시일 내에 해결되기 어려운 특성을 지니고 있으나 주한미군의 안정적 주둔을 위해서는 반드시 해소되어야 될 과제로 여겨진다.

주한미군의 중요성에 기인하여 '미래 주한미군의 모습은 어떠할 것인가' 역시 많은 관심을 모으고 있다. 일부에서는 주한미군의 철수를 이야기하고, 그 반대편에서는 통일 후 주한미군의 필요성을 역설하고 있다. 그러나 이와 관련해서는 아직 확정된 정책 방향이 없으며, 의견 제시 차원에서 다양한 논의가 오가는 실정이다. 다만, 최근 한.미간에 합의된 '연합토지관리계획(LPP)'은 미래 주한미군 주둔과 규모의 축소를 염두에 두고 작성된 것으로 보여진다. 이상과 같은 주한미군의 현재 및 미래와 관련된 제반 문제들은 변화하는 안보환경 속에서 주한미군의 위상 재정립 차원에서 반드시 검토되어져야 할 것이며, 이 글에서는 이를 '한미행정협정'과 '연합토지관리계획'을 기반으로 살펴보았다.

The purpose of this study is to examine the historical facts about the negotiation process between Korea and the U.S. over the launch of AFKN-TV's color broadcasting in 1977, which can be evaluated as the first time that the government raised the issue of broadcasting sovereignty against the U.S. government. More specifically, through literature research on archive documents stored in the Korean National Archives and Diplomatic Archive of Korea National Diplomatic Academy, this study examined the arguments, perceptions, and actions of the two governments by dividing three phases of the negotiation process. As a result of the study, the negotiations with the U.S. government over the unilateral color broadcasting of AFKN-TV in early 1977 and the conflict between the two countries led to a new perspective of broadcasting sovereignty. The Korean government's commitment to broadcasting sovereignty targeted the U.S. government in the 1980s once again.

The purpose of this study is to empirically analyze the determining factors (economy, security, domestic politics, administration, and international politics) that affect the ROK-US defense cost sharing decision. Through this, we will gain a deeper understanding of the defense cost sharing decision process and improve the efficiency of defense cost sharing calculation and execution. The scope of the study is ROK-US defense cost sharing from 1991 to 2021. The data used in the empirical analysis were various secondary data such as Ministry of National Defense, government statistical data, SIPRI, and media reports. As an empirical analysis method, multiple regression analysis using time series was used and the data was analyzed using an autoregressive model. As a result of empirical research through multiple regression analysis, we derived the following results. It was analyzed that the size of Korea's economy, that is, GDP, the previous year's defense cost share, and the number of U.S. troops stationed in Korea had a positive influence on the decision on defense cost sharing. This indicates that Korea's economic growth is a major factor influencing the increase in defense cost sharing, and that the gradual increase in the budget and the negotiation method of the Special Agreement (SMA) for cost sharing of stationing US troops in Korea play an important role. On the other hand, the political tendencies of the ruling party, North Korea's military threats, and China's defense budget were found to have no statistically significant influence on the decision to share defense costs.

Papers in FTA research have mostly focused on the legal interpretation of the FTA treaties. In this research, more focus was put on the customs laws and related cases delivered in the U.S. federal courts, by which we can analyze the Korea-U.S. FTA in more practical manner to derive the enterprises' solutions to cope with the disputes of FTA preferential duty. The Tariff Act of 1930 is the U.S. customs law to govern FTA preferential duties. The administrative practices with customs duties are coordinated with the FTA rules. The most controversial issue in the U.S. customs law lies in the classification of imported goods for imposition of the customs duties, based on Harmonized Tariff Schedule of the United States. It was found that the U.S. federal courts had been quite favorable to the CBP(U.S. Customs and Border Protections) in litigation with the private importers and exporters. The reason seems to be that the CBP has been dealing with the customs cases so many times, accumulating much experience in execution of the U.S. customs laws, which is likely to make their decisions on customs duties almost free of errors. Therefore, the Korean exporters need to collect the CBP's past cases on the denial of preferential treatment on imported goods and be fully informed of the CBP's policies on the FTA preferential duty treatment.
