The view of not fully denying the application of accomplice regulations to non-punishable opponents has fallen into a formal and logical circular argument that only provides formal grounds for non-punishment and has failed to provide practical grounds. In addition, it can be said that it has a criminal policy problem contrary to the legal sentiment of the general public by not punishing the active government travel activities of non-punishable accomplices. Therefore, in order to solve this problem, it is necessary to respect the legislator's intention that general non-punishment accomplices can be punished if they exceed the 'minimum government travel commission'. Therefore, if an unpunishable accomplice acts at least within the act required to realize the constituent requirements, the application of the accomplice regulations shall be excluded, and the accomplice regulations shall be applied only if they exceed that extent. In addition, if the indispensable counterparty is a protected person or has no responsibility (possibility of expectation), it can be said that it has provided a practical basis for the inability to punish, so it can be understood as impossible to punish. This interpretation method is thought to be able to present concrete validity in marginal cases where the counterparty is more responsible by substantially presenting the basis for an unpunishable accomplice.

최근 인터넷기술이 발전하면서 교육환경에서 멀티미디어 기술을 활용한 패러다임 전환이 이루어지고 있고, 이 전환에 가상대학에서 사용되어 지고 있는 문서의 역할의 중요성은 크게 주목을 받고 있다. 문서의 표준화를 위하여 구조적인 문서 처리가 가능한 XML이 대두될 것이다. XML에서 논리적 구조를 표현하는 방법은 사용자 정의인 문서타입(DTD)과 XML Schema의 두 가지 방식이 있으며, 향후 멀티미디어를 활용한 XML 문서에서 Paser의 역할이 중요하게 될 것으로 예측되어진다. 이에 따라 본 논문에서는 멀티미디어를 활용한 XML 문서에 필요한 자료들을 분석하고 가상대학에서 발생되는 문서행정업무를 효율적으로 지원하는 방안을 제안하는 XML 문서에서 Paser의 역할을 제시하고자 한다.

Cyber 대학의 활성화에 따른 연구는 강의 교재의 개발 등 효과적인 학습법 개발에 치중되고 있다. 하지만 Cyber 대학의 성패를 좌우할 수 있는 또 다른 주요 요소는 행정적인 뒷받침이라 할 수 있다. 본 연구는 Cyber 대학의 행정시스템을 설계 구현하였다. 특히 Cyber대학에서 필요로 하는 멀티미디어 문서를 효율적으로 관리하고 프리젠테이션 할 수 있는 XML문서관리시스템을 계층구조로 구성하였다. 전체 구성도는 XML을 기반으로 한 문서생성, 저장, 검색시스템으로 구성하였으며, 사용자측 구성에서는 문서의 등록, 수정 삭제를 수행하는 문서작성과 검색을 주요 기능으로 하는 일반사용자로 구성하였다. 연구자가 제안한 본 논문의 행정시스템 구현 환경에서는 문서를 등록하고 결재 및 열람하는 사용자로 구현하였다.

Nowadays, according to the change of educational environment, an alternative educational system, called cyber university system, is appeared. The appearance of the new system requires the new executive supports for administrative purposes. From this point of view, this paper tries to design and develop an XML-based document management system for the cyber university system. In order to manage and present the multimedia documents for Cyber university effectively, the proposed document management system is divided into 3 hierarchy structures: Generation of Documents, Storage of Documentation, and Search of Documentation. Based on our proposal for the system, the actual implementation is done for the demonstrative purpose. Both the construction of document manage system for the cyber university and modules for portal page are implemented using XML.
