Prediction Survey on Construction Guarantee Market Due to the Restructuring of the Construction Industry's Production System (건설산업 생산체계 개편에 따른 건설보증시장 변화 예측 조사)

  • The construction guarantee market is a rear market affected by changes in the construction industry and market. As the restructuring of the construction industry's production system is being carried out, such as the abolition of regulations on business field between general and specialty contractors, major changes are expected not only in the construction market but also in the construction guarantee market. In construction guarantee market, there are currently three Contractor Financial Cooperatives, which are divided based on business field and business type(General, Specialty and Plant & Mechanical). The abolition of business field regulation will have various effects on construction guarantee market, such as forming a competitive structure among the three Contractor Financial Cooperatives. Therefore the role of the construction guarantee institutions are also required to change. This study predicted the changes in the construction guarantee market after the restructuring of construction industry and analyzed the ripple effect on the market. This study reviewed the details of the reorganization plan on the construction industry, policies and statistical data related to construction guarantee, and lastly conducted the survey on each member of the three Contractor Financial Cooperatives to analyze the usage behavior in the future guarantee market. Based on the result of this study, the members of both the General Contractor Financial Cooperative and Specialty Contractor Financial Cooperative are not willing to change the existing institutions, but a lot of them are expected to use other institutions in duplicate. The members of the Plant & Mechanical Contractor Financial Cooperative are most willing to use other guarantee institutions.

  • 올해부터 건설현장의 직접시공 및 하도급 위반 여부에 대한 발주기관 점검이 강화될 전망이다. 국토해양부는 이를 위한 '발주자 현장점검 조치요령'을 마련해 전국 지자체 및 발주기관에 통보, 시행한다고 밝혔다. '발주자 현장점검 조치요령'은 개정 건산법령상 건설공사 점검 및 확인사항을 발주기관이 알기 쉽게 조치할 수 있도록 짜여졌다. 국토부 관계자는 "발주기관이 점검사항을 정확히 파악해 충실히 조치할 수 있도록 한 가이드라인"이라며 "최근 바뀐 건산법령에 따라 의무하도급 등 폐지된 내용을 빼고 직접시공의무제, 동일업종 간 하도급금지 의무 등을 새로 담아 점검과정의 혼선도 없앴다"고 설명했다.   • 본 논문에서는 시큐리티 민간경호경비 현장의 현실적인 문제점을 도출하고 개선방안을 찾아내기 위한 조사를 위해 민간경호경비의 개념과 특성, 다양한 경비원의 고용형태를 알아보고, 경비업법상 민간경호경비현장의 효율적인 운영과 경비산업의 질적 향상을 위해서 민간경호 경비현장과 가장 직접적인 법률인 경비업법 내에서 정의하는 경비업, 집단민원현장의 개념, 경비업의 개정이유, 경비업허가, 배치 및 폐지신고, 경비원 교육의 내용을 연구할 것이다. 또한 현장에서의 기준성의 법적, 절차적 문제점 등을 관할하는 관할 경찰관의 경우 개인의 법적 해석 기준과 실정법에서 정하는 처벌의 해당요건에 따라 업무를 처리하고 있어 유관기관 협력체계가이루어지기 어려운 상황에 처해있다. 또한 관련된 선행연구를 통하여 각 학자들이 제시하고 있는 문제점과 이유, 개선방안의 타당성 등을 검토 하고, 나타난 문제점과 개선방안들이 현실성을 반영하고 있는지 기관, 학계, 협회 등 다양한 관점에서 이를 연구할 것이다.

  • 정부는 그동안 건설업계에 부담으로 작용해 오던 규제인 '주기적 신고제도'를 폐지하고, 건설업 분야의 공정한 거래 질서 확립을 위해 공공 발주기관의 경우 하도급대금 및 건설기계 대여대금 지급보증서의 발급 여부 확인을 의무화 했으며, 추정 및 발주자 등의 불이익 행위 금지 제도를 도입했다. 한편 지난해 8월 11일 개정된 법률의 후속조치로 추가 변경공사 시 원도급자 서면요구 방법 결정 및 하자담보책임기간 설정 방법 결정 등의 시행령을 개정했으며, 시공능력평가 시 신인도평가액 산정방법 조정에 대한 시행규칙을 개정했다.

  • As social and political paradigms change, public institution tasks and structures are constantly created, integrated, or abolished. From an effective record management perspective, it is necessary to review whether the previously established record classification schemes reflect these changes and remain relevant to current tasks. However, in most institutions, the restructuring process relies on manual labor and the experiential judgment of practitioners or institutional record managers, making it difficult to reflect changes in a timely manner or comprehensively understand the overall context. To address these issues and improve the efficiency of record management, this study proposes an approach using automation and intelligence technologies to restructure the classification schemes, ensuring records are filed within an appropriate context. Furthermore, the proposed approach was applied to the target institution, its results were used as the basis for interviews with the practitioners to verify the effectiveness and limitations of the approach. It is, aiming to enhance the accuracy and reliability of the restructured record classification schemes and promote the standardization of record management.

  • Rapid developments of IT technology has been creating new security threats. There have been more attacks to get patients' sensitive personal information, targeting medical institutions that are relatively insufficient to prevent and defend against such attacks. Although the government has required senior general hospitals to get the ISMS certification since 2016, such a requirement has been burdensome for small and medium-sized medical institutions. Therefore, this study was designed to draw measures to identify and improve the privacy status of the medical institution by dividing it into management, physical and cyber areas for small and medium-sized medical institutions. The results of this study showed that the government should provide financial support and managerial supervision for the improvement of personal information protection of small and medium-sized medical institutions. They also suggested that the government should also provide medical security specialists, continuous medical security education, disaster planning, reduction of medical information management regulations not suitable for small and medium sized institutions.

Efficient Management and use of Records from the Truth Commissions (과거사위원회 기록의 효율적인 관리와 활용방안)

  • Investigations have been started to set the modern history and national spirit to rights after Commissions were established. Those Commissions are established and operated with time limit to finish its own missions. They creates three kinds of records as acquired materials which acquired or are donated for investigation; investigation records as investigation reports; and administrative records that created while supporting organization's operation. The Commissions use more past records to do special tasks asnation's slate clean and uncovering the truth than other agencies. In other words, the commissions take the most advantages of well-managed records, however, their record management environment and operation systems are relatively loose than other permanent machineries. It has three reasons that; first, there is no record management regulations and criteria for machineries that have time limit. This affected each commissions 'systems and 6 Truth Commissions' record management systems are built separately and on the different level; Second, members lack responsibility from frequent sending, reinstatement, change, and restructuring and that makes troubles to produce and manage records; Third, central archives pay less attention to machineries that operated limited period as the truth commissions. The Commissions rather need more systematic control because its records have historical value. To solve these problems, record management regulations have to be prepared first with features of organizations running limited time and commissions' records as acquired materials or investigation records. Furthermore, building up standard record management system for the Commissions, standardizing transfer data, imposing professional record personnel, and setting limits frequent personnel changes would finish practical problems. Besides, those records created to reveal the truth should use for education and research because Truth Commissions are established to set unfortunate history right and not to repeat it again. The records would serve as steppingstone for establishment of the Truth Record Center that does education, information work, publication, and research with the records. The record center would help using the records efficiently and improving knowledge for its people. And, the center should devote people to recognize importance of the records.
