A Study on Building a Well-organized, Open and Integrated Counter-terrorism System in South Korea (개방·통합형 한국 테러대응시스템 모델 구축 방안)

  • How will South Korea design well-organized, open, and integrated counterterrorism system? Does this system work well in the emergent situation? These are very significant issues. It is likely that this system would give the solution. A legal basis needs to be established to have a well-organized, open, and integrated counterterrorism system. The core part of a well-organized, open, and integrated counterterrorism system is to minimize and eliminate damage caused by terror through preventiveness, preparation, action, and restoration. For having this system, they need to be divided into two section: an open one and an integration one. In this study, there will be a discussion on a new and appropriate counterterrorism system fit in South Korea a subordinate system: legal, organized, civil aspects need to be provided on the basis of an well-organized, open, and integrated counterterrorism system and an analysis on the current system of the States, England and the following implications.

  • This study looks at plans for the efficient functions of the current terror response system in Korea. The results are derived from by comparing and analyzing American, British, German, Japanese, and Korean terror response systems. It focuses especially on addressing some problems with Korea's terror response system and how to operate it effectively. The study will systematically compare and analyze each nation's terror countermeasure studying organizational, functional, and legal aspects as standards. This study shows that there is not an exclusive terror response center in Korea compared with other nations such as America, the United Kingdom, Germany, and Japan. Also it is difficult to expect effective and vigorous operations due to weak cooperation across the relevant organizations. The presidential directive of the state's anti-terrorism action guidelines is legally ineffective. This means that on legal grounds, it is difficult to take actions to prevent the terrorism. Therefore, keys to counteracting terrorism derived from this study are summarized below. In the first place, an integrated terror response system should be set up for expansion of information sharing which leads to emergence effect. In the second place, the superior legislative systems should be made for the cleardefinition and extent of what the terror is, rigid enforcement of investigation, immigration, and keeping an eye on the funds raised by terrorists and tracking down the terrorists, the plan for eco-terrorism. In the third place, to augment security of vital facilities and peoples' awareness of terrorism safety should be emphasized and a cooperative system between civil and government organizations need to be built. In the fourth place, system for crisis management must be provided in an effort to maximize management system of terrorism and unify a decentralized emergency countermeasures effectively.

  • 본 논문은 복잡다단한 환경변화에 효과적으로 대응하기 위하여 오늘날 여러 학문 분야에서 주로 이용되고 있는 복잡계 이론의 사고와 방법론을 기반으로 테러대응을 위한 분야별 제 접근에 대하여 논하는데 그 목적이 있다. 우리는 수많은 테러조직 및 테러환경 요인들과 연결된 복잡한 시스템 속에서 활동하고 있기 때문에 이 모든 것을 이해하고 통제하며 예측하면서 대응한다는 것은 사실상 애초부터 불가능한 일일지도 모른다. 테러대응 역시 테러대응 관계 기관간, 관계 기관 전담 부서 내의 구성원들의 상호작용뿐만 아니라 넓게는 정부, 민간단체, 산업체, 학계, 언론 등 나아가서는 국가간의 이해 관계자, 국제기구 등 테러대응 분야의 다양한 조직들의 참여하에 이들의 상호작용으로 공식적, 비공식적 의사 결정을 통한 방안들을 모색하는 것이 필요할 것이다. 이에 따라 초기조건의 민감성, 프랙탈과 자기유사성, 자기 조직화, 창발, 공진화, 혼돈의 가장자리의 복잡계 이론을 통하여 테러대응 분야의 적용가능성을 은유적으로 탐색할 수 있을 것이다.

A Comparative Study on Each Nation's Counter terrorism Organization and Function (각국의 테러대응 조직과 기능의 비교 연구)

  • This study is to present effective and rational strategies by comparing and analyzing plans of some nations such as the United States, Britain, Germany and Japan against terrorism. Nations mentioned above have made alliance to prevent the possible terrorism after 9.11 attack and performed various tasks efficiently. The result of this study is summarized as follows. First, it is required that there should be an integrated system which works properly. Each nation has not distinguished natural disaster from man-made one based on the damage and the abilities of authorities to deal with. On the other hand, South Korea tells two disasters according to causes and runs distributed systems in which each government division performs its duties to manage each disaster. Accordingly, in economic terms, it is much more effective to provide integrated counter terrorism, not distributed one. Second, information sharing must be stimulated. To take actions quickly when an accident occurs, the government needs to have united and integrative systems, which make it prepare for various types of terrorism well. In addition, it is necessary for a government-related organization to tie up with other channels for collecting, analyzing and sharing information. For this, integrative systems for terrorism should be taken into consideration.

  • A sudden change of social structure makes the nations have experienced terrorism to establish an anti-terrorism law and associate with international agreements to protect themselves from terrorism. Korea is exposed to terrorism as it has grown in stature by holding the international occasions and has been easy to travel abroad since 1980. Korea regulates the terrorist by a guideline which was established in 1982 by the presidential instruction and other criminal law. However, the majority of people doubt the propriety of overinterpretation of the law and punishment for terrorism. To cope with the situation strongly, it is better to establish an anti-terrorism law to block terrorism and apprehend the terrorist beforehand. Also we should realign an anti-terrorism organization that should be organized by the type of terrorism. In addition, we can expect to avoid waste of a budget and human efforts if we introduce terrorism warning system and face with each stage of situation. Lastly it is possible to prevent terrorism if we build up preventive actions along with the local residents.

Comparative Study on Major Nations's Related Legislation for Counter-terrorism (테러대응 관련 법제의 국가별 비교 연구)

  • As a result of comparing and analyzing the related legislation of each nation, more superior legislative systems should be made to cope with a number of terrors effectively. And also it is required to devise some concrete regulations such as the following in superior legislative systems. First, because it is hard to collect information on terrorism and watch over suspects according to Communication Privacy Protection Law. More in-depth discussion into the issue of surveillance is needed for the protection of lives and property, although public concerns of privacy are a valid point of contention. Second, it is necessary to take complementary measures on immigration as surveillance, since the current Immigration Control Law has restrictions in many ways to hinder efforts to root out terrorists. Third, under the current law on financial activities, it is impossible to block influx of terror financing. Therefore it is necessary to come up with ways of making the punishment procedures. Fourth, considering that convicted terrorists get punished under the standard procedures and precedents, it is required to clearly differentiate between what the terror acts are and what terrorist groups are. Fifth, it is necessary to make use of the private security system to enhance the security system of national facilities.

Proposal on for Response System to primary leaders' Terrorism (국가요인 테러리즘의 대응체제 구축방안)

  • Various terrorism in modern society against nation's dignitaries are constantly existing. They damage severely to the society and the nation's security, and they cause disorganizations of social and national rule orders. In order to provide the key figures' perfect protection, the threatening terroizing environment for primary leaders and the route of terrorism should be intercepted. Effective methods of these are summarized as follow. First, recent terrorism against the primary leaders are mostly assassinations, bomb attacks, and suicide bomb attacks, which terminate in a moment. Therefore, security service agents should keep in mind that protection is the best, and government's anti-terrorism agencies should develop policies and set the directions within a new paradigm to the advance anti-terrorism. Second, advance prevention activities against nation's VIP terrorism should be strengthened, such as strengthening security informational activities, constructing cooperative systems of domestic and international facilities, considering continuous system to prevent terrorism, and intensifying safety counterplans of human and material weak points. Third, international cooperative system should be set to apply economical and political sanctions to nations which support terror organizations in direct or indirect ways, and this system needs to strengthen the punishment against terrorists. Fourth, security systems to protect nation's primary leaders should complement, and developing programs for coping with the terrorism and establishing laws for anti-terrorism should be made. Also, educational training of agents who perform anti-terrorism duties should be strengthened, and scientific techniques and equipment for security should be made to protect primary leaders from terrorism.

A Study on Rethinking the Operating of Counter-terrorism Systems in South Korea (한국 대테러시스템 운영의 재모색)

  • The purpose of this study is to rediscover the operation of anti-terrorism system focusing on the system approach and crisis management approach for counter terrorism in Korea. According to the results of this study, it is required to establish a link between open systems and integrative system focusing on functional linkage of counter-terrorism systems, and cooperative measures with private sectors in the dimension of governance activation. Further, it is necessary to prepare legal foundations for the cooperation with private sectors and then promote open consciousness transformation through the partnership with private security for anti-terrorism activities. In addition, in its preventive stage, it is required to prepare legal systems related to biochemical terrorism for stronger regulations through crisis-managerial approach. Next, in its preparatory stage, it is necessary to prepare education and enact named Terror Prevention Day for increasing terror safety consciousness, and then extend citizen reporting reward systems to enable citizens to participate and become interested voluntarily in terror prevention. Also, it is essential to establish the substantial training system for preparing for terror occurrence. Moreover, in its response stage, it is urgent to construct networks between related institutions to manage field and spot responses with integrative management systems through information sharing. Furthermore, in its restoration stage, it is indispensible to prepare long-term management systems for injured persons and families of the deceased from terror incidents.

  • 인터넷 및 컴퓨터 시스템의 급격한 발전으로 인해 네트워크를 통한 서비스 제공이 금융, 교통, 산업, 방송, 의료 등 사회기반에 전반적으로 사용되고 있다. 이와 함께 네트워크의 취약점을 악용한 사이버 공격이 증가하고 있어 사회 전반적인 부분에 피해를 입힐 수 있는 중대한 위협요인으로 등장하고 있다. 이와 같은 사이버 공격이 테러리즘 등 특정 목적과 결부될 경우 국가 안전보장에 대한 위기를 초래하는 등 심각한 문제가 될 수 있다. 따라서 본 논문에서는 사이버테러의 개요 및 국내 외 사이버테러 동향에 대해 알아보고, 각 국가별 대응방안에 대해 알아본다.

  • 본 논문에서는 미국·영국의 사례를 통한 정책적 함의를 제시하는 데 그 목적이 있다. 미국의 경우 초기 대응자로서 민간 부문의 중심적인 역할, 공공과 비영리 그리고 민간 부문 조직들의 협력적 대응, 자원봉사자들의 적극적인 참여, 평소 민간 부문에 대한 훈련, 민간 기업의 기민성과 영국의 경우 위기관리를 위한 언론의 협조자 역할, 정부의 언론을 통한 위기관리의 중요성 인식 등은 우리에게 시사하는 바가 크다. 요컨대, 미국·영국의 경우 전 국가적 차원에서의 대테러활동을 위한 민·관 간의 협력적 운영이라는 사실과 더불어 우리나라 대테러 관계기관 실무자들의 민·관 협력 기능의 필요성에 대해 시민의식의 향상, 시민단체와 민간 기업의 사회적 공익 분야 강조, 언론의 역할 정립에 대한 인식이 높아지고 있는 시점에서 대테러시스템 운영을 위해 이들의 역할과 기능이 더욱 확충되는 방안을 모색해야 할 것이다.
