  • 소프트웨어 및 콘텐츠의 불법복제 문제는 비단 어제오늘의 일이 아니다. 하지만 지난 4월말 불법복제에 있어 무풍지대(無風地帶)로 알려졌던 모바일콘텐츠까지 불법복제 문제가 터지면서 디지털콘텐츠 업계에는 초비상이 걸렸다. 10여년전 국내 게임시장을 주도했던 PC 패키지 게임 산업이 지금은 흔적을 찾아볼 수 없을만큼 무너졌던 아픔이 업계 관계자들의 기억 속에 고스란히 남아 있기 때문이다. 국내 디지털콘텐츠 산업 전반에 퍼져있는 불법복제 현황을 살펴보고 최근 강화된 업계의 대응방식을 점검해 봤다

  • 소프트웨어와 음악파일, 영화 등의 불법복제로 인한 사회적인 문제가 대두되어 왔다. 온라인디지털콘텐츠의 산업규모와 중요성이 증대되고 있는 시점에서 동일하게 불법복제로 인한 피해규모와 이용자들의 불법복제 행동이 만연해 있다. 이 연구는 계획된 행동이론(TPB)를 통해 개인의 온라인디지털콘텐츠의 불법복제 행동에 대한 모형을 검증하고 불법복제에 영향을 미치는 요인을 검증하고 인과관계를 확인하고자 한다. TPB의 확대모형을 제안하고자 하는데 단속, 교육 및 홍보, 이전경험, 자기효능감이 불법복제 행동의도와 의도에 영향을 미치는 태도와 주관적 규범에 어떠한 영향을 미치는지 검증해보고 한다. 단속과 교육 및 홍보가 개인의 인식과정을 통해 태도와 내적인 자기 규범에 어떠한 영향을 미칠 것인지는 정책적 전략적 시사점을 얻는데 중요한 요인이 될 것이다. 파일럿 테스트 결과 기존 TPB 모형은 온라인디지털콘텐츠 영역에 있어서도 적합한 모델임이 검증되었고, 단속과 교육 및 홍보가 태도와 주관적 규범에 유의한 영향을 미침을 나타내었다.

법제코너-디지털콘텐츠의 저작권 문제 ⑤

  • 국산 캐릭터업체 10개 업체중 4곳이 불법복제로 골머리를 앓고 있는 것으로 나타났다. 문화관광부와 한국문화콘텐츠진흥원이 발간한‘대 한민국 캐릭터산업백서 2004’에 따르면 캐릭터업체 42.3%가 불법복제에 피해를 불법복제 피해경험이 있다고 응답했다. 매출액별 불법 복제 피해 경험으론 매출액 5억원 미만 업체는 38.3%, 5억,50억원 업체 37.5%, 50억원 이상 업체 65.2%로 인기 캐릭터를 중심으 로 한 불법복제현상이 뚜렷한 것으로 나타났다. 불법복제로 인한 추정 피해액으로는 국산 업체당 4억1,320만원인 것으로 조사됐다. 이처 럼 캐릭터로 인한 피해가 국내에도 크게 늘고 있어 심각한 산업 문제로 대두되고 있다. 이에 이번 호에는 디지털콘텐츠 산업 중에서도 온 라인을 통해 유출되고 있는‘캐릭터’를 중심으로 법적 문제를 다루고자 한다.

A Study on Effects of Relative Benefits and Costs of Piracy of Digital Contents on Attitudes and Behaviors of Illegal Duplication (디지털콘텐츠 불법복제의 상대적 편익과 비용이 불법복제태도 및 행동에 미치는 영향)

  • The purpose of this study is to identify factors affecting piracy of online digital contents, focusing on relative awareness of illegal duplications, compared to legal duplication. To do this, the current study integrates factors proposed in existing literature and the previous studies based on the theory of planned behavior and accesses them from cost-benefit point of view. Main findings are summarized as followed;- First, with regard to relative benefits gained by illegal duplication, it is shown that monetary and psychological utility have positive effects on attitudes and behaviors of illegal duplication. Particularly, it is found that monetary incentive is the main cause of illegal duplication as monetary gains are major factors affecting illegal duplication behaviors. Second, it is suggested that ethical cost is a definitive factor that has negative effects on illegal duplication behaviors while technological cost has also significant effects on illegal duplication behaviors. Third, it is confirmed that there is a significant relationship between attitudes and behaviors of illegal duplication. This result shows that an attitude to illegal duplication is antecedent of behaviors as the belief and the value regarding illegal duplication can lead actual behaviors.

  • This paper is concerned with identifying the determinants of committing digital piracy in university settings. Using a theoretical model based on Theory of Reasoned Action, the causal relationship among the research variables, including intention to commit digital piracy, attitude, subjective norm and fear of legal consequences, is developed. Results from 295 survey responses indicate that fear of legal consequences affect the subjective norm and the attitude, which in turn influence the intention to commit digital piracy. In addition, relativism based on EPQ(Ethics Perception Questionnaire) is introduced as a moderating variable. The relative influences of path coefficients are investigated and implications from findings are also discussed.

Effects of Regulation against Unlicensed Contents Sharing on the Contents Producers' Profit (불법복제에 대한 규제가 콘텐츠 제작자의 수익에 미치는 영향)

  • As software producers have tried to keep their profit against illegal piracy, contents producers also want to protect their contents from unlawful sharing among users. Some researchers uncovered that the regulation on the unlicensed contents is not the best policy to maximize their profit mainly due to network effect but this issue has been still controversial. In this paper, we develop a model to investigate the effect of regulation against unlicensed contents sharing on the profit of contents producers and present the optimal condition to maximize profit of contents producers under the regulation and non-regulation of unlicensed contents. As a result, we analyzed that the firm's payoff under the regulation on unlicensed contents is not always greater than the payoff under the non-regulation because of network externality. If the additional utility from off-line purchase of type P consumers (who enjoy the additional benefit of off-line purchase) is large enough, then the firm's payoff is maximized without regulation.

  • 디지털 콘텐츠는 영상, 소리(음향ㆍ음악)문자 등 다양한 요소로 이뤄져 있다. 이런 디지털콘텐츠가 온라인을 통하여 유통되는 데에는 여러 가지 요소가 융합되어야 가능하다. 일단 구매가 된 다음에도 디지털콘텐츠는 복제가 가능해 불법적으로 유통되는 단점이 있다. 이 때문에 디지털콘텐츠의 보호기술이 등장하게 되었다. 물론 법적으로 보호장치가 있긴 하지만 일일이 단속할 수 없고 단속이 불가능하기 때문에 불법복제 자체를 방지하는 기술이 등장하게 된 것이다. 이에 디지털콘텐츠 보호기술에 대하여 살펴보기로 한다

The Study on Countermeasures Against the Infringement of Rights of the Transmission and Reproduce on the Han Wave Contents in the China Market (중국 시장 내 한류 방송 콘텐츠의 전송권 및 복제권 침해 대응 연구)

  • The purpose of this study is to analyze how China, which is the largest consumption area of Hallyu broadcasting contents but the most illegal copy market infringe the rights of domestic broadcasters and what of the policy of regulatory authority in this illegal market. To this end, this study investigate the most common types of paths and methods of copyright infringement in the Internet and mobile multi-platform environments, and investigated how broadcasters responded to them with in-depth interviews. As a result of research, the most frequent type of infringement of rights of reproduction were to use links with web and apps and TV pads. In this regard, it was not easy to solve the problem of illegal copy in China in the way that domestic companies responded to individually, and it was very rare that the lawsuit was filed. In the future, the government will need to provide side support for Korean Wave broadcasting contents through steady monitoring as well as market research for eradication of illegal copy.

  • The rapid development of information and communication technology has made it for people to pirate digital contents easily and quickly. Although many studies have investigated the underlying factors that lead to an individual engaging in digital piracy, few studies have provided holistic and integrative view on this issue. Therefore, this study attempts to build integrative research model based on theory of planned behavior (TPB), norm activation model (NAM), and habit. For this purpose, this study develops nine hypotheses that explain the relationship between attitude, personal norm, habit, and behavioral intention, and tests them with survey data collected from 337 participants. The results of this study show that attitude, perceived behavioral control, personal norm, and habit have impact on behavioral intention of digital piracy while subjective norm does not affect behavioral intention. This study contributes to expand existing studies by identifying the relationship between attitude, personal norm, habit and behavioral intention.
