  • 최근 전자산업의 발달로 첨단기술의 농업적 응용에 필요한 각종 센서가 개발되고 있어 이를 이용한 농산물의 각종 품질을 비 파괴적으로 측정할 수 있는 연구가 활발히 진행되고 있다. 여러 농산물 중과실의 경도와 같은 물성 인자는 그 중요성에도 불구하고 비 파괴적으로 측정할 수 있는 기술이 개발되고 있지 않고 있다. 레이저 분광법의 경우 표면의 광 산란현상을 이용하여 경도를 비교적 정확하게 측정할 수 있으나 아직까지는 시스템의 가격이 고가이며 사용에 많은 제약이 따르며 근적외선 분광분석법을 이용한 경도 측정은 현재까지 그 정확도가 낮다. About Insurance Benefits Restriction Condition of National Health Insurance Act Article 48 Paragraph 1: 'When He has Through Gross Negligence Caused a Criminal Conduct' (국민건강보험법 제48조 제1항 제1호 보험급여 제한 요건 '중과실에 의한 범죄행위로 기인한'에 대한 소고)

  • National Health Insurance Act has been enforced all over the People as part of the effort to assure the minimum constitutional human worth and dignity in the aspect of the right to pursue health for preventing misfortune that comes to death without even a chance to be received treatment for illness or injury. Meanwhile auto insurance is compulsory in certain parts in order to promote benefits of everyday life and the rapid recovery of the damage caused by traffic accident when one have negligently driven a car which has become the necessities in daily life. Any injured driver in a traffic accident can be treated by National Health Insurance without getting an auto insurance in various circumstances, but Article 3 paragraph 2 of Traffic Accident Act don't allow exception of criminal punishment when he has driven a car without license, drunken, or tresspassing the centerline, etc. When the injury occured by his own certain negligence is judged to 'when he has intentionally or through gross negligence caused a criminal conduct or intentionally contributed to the occurrence of an accident' of National Health Insurance Act, insurance benefits can be restricted. Such a restriction could harm the right to pursue happiness and health of People by depriving the poor, who cannot afford to pay, of chances to get treatment. Here we will see benefit restriction by 'gross negligence' of National Health Insurance Act Article 48 paragraph 1, which has largest portion of such restriction. It is desirable to delete 'gross negligence' clause from above paragraph and to interpret 'when' clause restrictively for diminishing confusion of interpreting and guaranteeing the right of health.

  • 해상교총관제는 해상운송에서의 운영적 ${\cdot}$ 환경적 위험을 강소시키기 위한 수단으로써 전 세계 여러 주요 항만과 수역에서 이용되고 있다. 현재 각 국에서는 자국연안에서의 선박통제제도를 적극적으로 실시하고 있으며, 해운의 활성화와 더불어 항만의 안전성 확보를 위하여 각국은 VTS에 관한 국내법을 제정하여 이를 시행하고 있다. 우리나라도 VTS와 관련하여 여러 규정들을 두고 있으나 각 개별입법 내에 산재해 있는 실정이며, VTS를 운영하는 관제요원의 책임과 권한을 명확하게 규정하고 있지 아니하다. 이에 향후 VTS 운영과 관련한 법제의 정비에 관한 논의를 촉진시키는 선행연구로써 현행 VTS 운영과 관련한 법적 문제점을 지적하고 개선방향을 제시한다. 우선 VTS 관제범위에 관한 논의는 국제법적 측면의 법리 정토가 필요하리라 생각되며, VTS 관제요원의 권한과 책임에 있어 적극적 관제에 대한 개념의 정립과 더불어 관제요원의 재인책임과 중과실 경과실에 대한 해상고유의 특성을 반영한 해석이 되어야 할 것으로 생각된다.

The Protection of Third Parties of the Transactions Made by the Representative Director without Resolution Adopted by the Board of Directors (대표이사의 이사회 결의를 흠결한 거래행위와 제3자의 보호)

  • The purpose of this study is to examine the protection of third parties of the transactions made by the representative director without resolution adopted by the board of directors. The legal effect of a transaction conducted by a representative director without board resolution in violation of internal restriction or statutory restriction is at issue. The Supreme Court of Korea('SCK') made a new ruling that revised the prior case law(Supreme Court en banc Decision 2015Da45451, Feb. 18, 2021). The SCK in the subject case proclaimed a legal doctrine that 'a third party acting in good faith' shall be protected according to Article 389(3) and 209(2) of the Korean Commercial Act, except that 'a third party with gross negligence' is considered as 'a person acting in bad faith' and thus is excluded from protection. The subject case law can be evaluated as broadening the scope of protection of the third party. In addition, the subject case is meaningful in that it is balance with the related SCK ruling, which considered a third party with gross negligence as a person acting in bad faith while protecting a third party with ordinary negligence in the case of transactions involving apparent representative directors, etc.

  • By e-Financial Transactions Act enacted in January 2007, the financial institutions are responsible for indemnifying user's damage to ensuring security of the electronic financial transactions and to protecting financial users when suffering from electronic financial accidents. However, when occurring unauthorized financial transactions or electronic financial accidents by user's moral hazard, it is difficult to determine where the accidents happened at and whether caused by the intention or gross negligence of users. To protecting financial parties and ensuring the security and reliability of electronic financial transactions, this paper attempts to propose the means, what enhance the notification process about financial transactions and to strengthen IT regulatory compliance by using area information about electronic financial transactions, to protect risk of the financial accidents.

  • Beim Luftfahrtunfall kann nach den Interessen der Betroffenen oder nach der Stellungsnahme von den f$\ddot{u}$r die Unfall-Untersuchung zust$\ddot{a}$ndigen Personen der Wahrheitsgehalt get$\ddot{a}$uscht werden. Um diese Sachverst$\ddot{a}$ndnis zu verhindern, ist bei der Untersuchung des Luftfahrtunfall ist de lege lata gefordert, die technische Untersuchung und die rechtliche Untersuchung sich zu trennen. Jedoch ist es umstritten, wie es wirksamvoll ist. Also neben der Garantie auf die Sicherheit als Prevention des etwaigen Unfall in Futur muss die strafpolitische Seite beachtet werden. Damit ist es erforderlich, dass das bestimmte Mittel bereitstellt und damit den Betroffenen ihre Verantwortung erlassen k$\ddot{o}$nnen, wenn sie beim Unfall-untersuchung dienen. Und die Folge der technischen Untersuchung $\ddot{u}$ber den Unfall soll eine kurze Weile insofern nicht ver$\ddot{o}$ffentlichen, als ein gesetztiichcr Urteil noch nicht festgestellt wird. Jedoch wird diese Nicht-ver$\ddot{o}$ffentlichkeit Vorwurf wegen der langfristigen Verhinderung auf die Informationen gemacht, in den man die Elemente von der Gefahr ergreifen kann. Deswegen wird Vorwurf gemacht, da${\beta}$ diese Verhinderung auf die Infonnationen wider das Wesen von dem Gesetz zur Luftfahrtunfallgesetz ist.

Human-based aviation accidents with air traffic controller torts (항공기 사고와 인적요인 -관제사의 불법행위를 중심으로-)

  • Throughout the history of the aviation industry, from its origins in the $20^{th}$century to the present, accidents have always occurred. This paper deals with the legal liability of air traffic controllers, who represent one of the human factors causing these accidents. Though controller negligence turns out to be a main cause of the accident, Korea does not have additional judical case, since it was firstly declared that controller negligence was accountable for the air traffic accident in 1971. As such, we examine the liability of air traffic controllers as public officers. This paper looks not only at the role of air traffic controllers and pilots in accidents, but also at the applicability of controller liability in the context of Korean law. We determine that despite the high-stress environment, air traffic controllers must share in the responsibility to provide safe air navigation. Therefore, they cannot avoid legal liability.

Risk Factors Affecting the Injury Severity of Rental Car Accidents in South Korea : an Application of Ordered Probit Model (순서형 프로빗 모형을 이용한 렌터카 사고 심각도 영향요인 분석)

  • Over the past five years (2010-2014), the total number of traffic accidents has decreased from 226,878 to 223,552 with decrease of 0.37 percent each year. The death toll has also decreased from 5,505 to 4,762. However, the number of rental car accidents and fatalities has been steadily increased. Despite of its growth, no previous study has been conducted on rental car accident severity. This study analyzed data of 18,050 rental car accidents in South Korea collected from 2010 to 2014 and then processed in order to identify which factors could affect the accident severity. Seventeen factors related to rental car accident severity were grouped into four categories: driver, vehicle, roadways and environment. As a result of the ordered probit model analysis, fourteen variables excluding age, intersection, and day of week were found to affect the severity of rental car accidents. The results of the study summarized as follows. First of all, violation of traffic regulations such as speeding increase the severity of rental car accidents. Secondly, rental accident severity is higher at curved sections of complicated roadway, which the driver's field of view is impaired. The results of this study can be used to reduce the severity of rental car accidents in transportation safety.
