  • 우리나라는 2000년에 제조물책임법이 제정하여 2002년 7월 1일부터 시행하였으며, 제조물의 제조, 설계, 표시등의 결함으로 인하여 발생한 손해에 대한 제조업자 등의 손해 배상책임을 규정하고 소비자의 결함 입증부담 경감과 피해자의 보호를 도모하자 하고 있다. 제조물의 표시등의 결함은 지시결함이나 경고결함에 관한 것으로 제조자는 그 위험에 의한 사고를 방지 회피할 수 있도록 소비자에게 정보를 제공하여야 하나 이를 이행하지 않아 발생된 결함이다. 본 논문에서는 A사(社)의 공기정화기 B모델 사용설명서에 나타난 정보제공사항을 주의 경고표시 가이드 등에 따라 검토하였으며, 그 결과 일부 지시 및 경고사항에서 보완해야할 사항이 발견하였다. 보완사항은 제안사항으로 기업내부 에서 처리하되 전문성이 부족한 분야는 외부의 PL전문가의 협력하에 바람직한 개선안이 도출될 수 있을 것이다.

An Artificial Neural Network Approach for the Prediction of Unlawful Company in Defense Procurement (인공신경망을 이용한 국방조달 부정당업자 예측모형 개발)

  • The contractor management is one of the important factors for the modem defense acquisition program. The occurrence of unlawful company causes the reason in which defense acquisition program is unable to be reasonably fulfilled and setback to the deployment of defense weapon system. In this paper, we propose the Artificial Neural Network to develop a prediction model for the discrimination of unlawful company in defense procurement. The data which are used in analysis, are obtained targeting domestic small & medium manufacture enterprises. It is expected that our model can be used to improve the program management capability for defense acquisition and contribute to the establishment of efficient procurement procedure through entry of the reliable domestic manufacturer.

  • In pursuing carbon emission reduction efforts, companies have focused for the most part on reducing emissions due to the more efficient equipment and facilities. However they overlook a significant source of carbon emissions, one that is driven by operational policies. Currently companies are looking for solutions to reduce carbon emissions associated with their operations. Operational adjustments, such as modifications in order quantities could an effective way in reducing carbon emissions in the supply chain. Also, Cap-and-Trade mechanism is generally accepted as on of the most effective market-based mechanism to reduce carbon emissions. In this paper, we investigate a supply chain with single manufacturer and multiple retailers multi-product inventory model under the cap-and-trade system incorporating the carbon emissions caused by transportation and warehousing activities. Also, we provide an iterative solution algorithm and derive the common order interval and the number of intervals for each product. We show by numerical example that the inventory model incorporating cap & trade mechanism can reduce total cost and carbon emissions compared to the classical inventory model. Using the numerical examples, we also investigates different carbon price on the performance of the inventory model.

제조물 책임과 보험에 관한 연구

  • 최근 제품으로 인한 각종 피해에 대해 피해자 구제의 견지에서 피해자가 간편하고도 용이하게 손해배상 청구를 할 수 있도록 피해입증부담을 경감하고, 제조업자를 포함한 제품공급자측에 보다 엄격한 책임을 물을 수 있도록 규정한 '제조물 책임(product liability: PL)'에 대한 법률이 필요하게 되었다. 본 논문에서는 PL과 보험간의 관계를 고찰하여 우리 나라의 최근동향 및 대응방안을 살펴보는데 그 목적을 두고 있다. 미국에서는 손해보험회사의 급격한 수익악화로 인하여 각 사가 일제히 기존의 보험계약 인수를 거절하여 보험요율과 보험료를 대폭적으로 인상하여 기업들이 배상책임보험을 부보할 수 없는, 소위 '보험위기'라는 상황을 경험하고 있다. 과거 두 번에 걸친 심각한 보험위기의 교훈으로 미국에서 세 번째의 보험위기의 발생유무는 제2차 보험 위기의 원인이었던 미국의 불법행위법 불법행위제도의 개혁여부에 달려 있다고 할 수 있다. 한편 우리 나라에서는 제조물에 대해 피해자 구제를 규율하는 PL법이 제정되어 있지 않다. 향후에 우리 나라가 PL법을 제정하여 실시할 경우에는 미국과 같은 혼란된 상태에 빠지는 문제가 발생하지 않도록 주의를 기울여야 할 것이다. 또한, 피해자 구제와 기업이 안전 제품의 생산에 자극을 줄 수 있도록, 조속한 시일 내에 우리나라에도 PL법을 제정해야 할 것으로 생각된다.

An Exploratory Study on the Slow Adoption of Vendor managed Inventory in Manufacturing Firms (제조업체의 VMI 시스템 도입 부담요인에 관한 탐색적 연구)

  • Vendor Managed Inventory(VMI) is a distribution channel system where the inventory at the retailer is monitored and managed by the manufacturer or vendor. By pushing the decision making responsibility further up the supply chain and centralizing the replenishment decision, the vendor can help the entire supply chain be more competitive. The purpose of this research is to explore the factors influencing the adoption of VMI by Korean manufacturers. This research proposes the IT readiness, operating cost, and information sharing as antecedents of burden for VMI, and collected the survey responses from the small-to-medium manufacturers. The statistical results indicate that only the operating cost has a significant impact on the adoption of VMI. However it has also been found that the IT readiness and information sharing have a significant effect on the operating cost. Thus indirectly influence the adoption of VMI. As a conclusion, the academic and practical implications of these findings are discussed.

  • Plastic injection products have been widely used in various electronic appliances and high-tech commodities. However, plastic injection product manufacturers have to spare no efforts to shorten new product development period to introduce new products into the market ahead of other competitors, gaining competitiveness and satisfying customers. The manufacturers cannot only get big target market share rapidly but also the advantage of leading the product price in order to survive in highly competitive market. This paper proposes the cost estimation approach of feature-based plastic injection products by using hybrid artificial neural network and genetic algorithm. The proposed method is to dramatically simplify and shorten the complex conventional cost estimation procedures and the requested computation parameters of plastic injection products. The case study demonstrates the efficiency and effectiveness of the proposed model in solving the cost estimation problem of plastic injection products at the development stage.

The Study on U.S. GARA and Aircraft Products Liability (일반항공에서의 제조물책임에 관한 연구 - 미국 일반항공진흥법(GARA)을 중심으로 -)

  • The U.S. General Aviation Revitalization Act of 1994 (the "GARA") created a statute of repose that bars any claims arising from an aviation product or component more than 18 years after its date of delivery. The statute was enacted to protect general aviation aircraft manufacturers from the excessive product liability costs. The GARA included four exceptions: (a) medical emergency patients, (b) those not on the aircraft, (c) those based on written warranties, and (d) those causally related to a "knowing misrepresentation" made by the manufacturer to the FAA. The GARA also incorporates a provision for revised starting point of reckoning to which any repairs or replacements of an aviation product. This note aimed to discuss General Aviation and GARA in depth including the meaning of statue of repose, its exceptions. The various precedents about GARA were also reviewed in here as well. From the GARA, as a comparative legal issue in aviation product liability, there can be some suggestions for revision of Korean Products Liability Act. First, it seems to be reasonable to regulate the specific statute of repose provisions for various category of products. In GARA, the period of 18 years is reasonable concerning to the average aircraft life. Second, in order to avoid exhausting debate and for the judicial economy, it needs to clarify when the statute begins to run. GARA's 18 year limitation period begins to run on the different date whether it was delivered to its first purchaser or a person engaged in the business of selling the aircraft. Last but not least, proper exceptions should be added into the law for equity matter of the statute of repose does not apply. For example, a manufacturer is not protected by GARA if it knowingly misrepresents certain safety information to the FAA.

  • 대전입자형 디스플레이에서 화상을 표시하는 대전입자의 크기와 입자층은 구동뿐만 아니라 광학특성에도 큰 영향을 주며, 그 평가를 통해 향상된 특성을 가지는 입자의 제조 및 충전방법을 제안할 수 있다. 본 연구에서는 대전업자의 사이즈와 입자층의 변화에 따른 반사율을 평가하고 업자의 구동시 전극에서 차지하는 면적값을 현미경프로그램으로 측정하고 이들의 비교를 통해 반사율과의 상관관계를 분석하였다.

  • Automobile industry has several characters such as high level of specialization, large volume of production, which plays a big barrier to entry of the industry. Therefore logistics outsourcing of automobile manufacturing company tends to make long-term contract with logistics service provider which also makes it difficult to outsource their logistics business to many different types of companies. Some vehicle manufacturing companies tend to outsource their several logistics to several companies while others outsource very limited number of logistics companies even only one company exclusively. This study aims to investigate various type of logistics outsourcing in terms of advantages and disadvantages and then carry out case study for Hyundai Glovis which is a global logistics company managing logistics service of Hyundai car maker in Korea. The focus is on how it can provide innovative and efficient logistics service with integration of global supply chain of Hyundai Automobile company.

A Survey on the Outsourcing Usage of Logistics Service Users in China -Focused on Area of Shanghai- (중국 물류서비스 이용자들의 아웃소싱 관행에 관한 조사연구)

  • This paper analyses the results of the survey questionnaires which are made for logistics services users in Shanghai, China. Based an 158 valid users' responses, the study results show that the typical outsourcing logistics users prefer to set up long term relationship with providers and buy services from multiple providers. Most users are satisfied with their providers and believe that outsourcing logistics services has led to positive impact on their customer satisfaction, logistics service levels and revenue improvement. Price levers, core competences, reputation are critical in the selection of an outsourcing logistics provider for users in this study. This study indicates that the market for 3PL services in China has a reasonable potential fur further development, though 3PL practices are still at a nascent stage in China. This paper presents full details and implications of the results of th£ survey and then provides some helpful suggestion for th£ development of Chinese logistics industry and Chinese logistics companies.
