The Liability on the Damage of Soil Pollution (토양오염의 피해에 대한 책임)

  • Soil is polluted by an agricultural chemicals, the effluence of a crystal and sewage sludge, illegal discharging of waste water or waste matter and so on. Soil pollution that accompanies a groundwater and the crops contamination has a large effect on people's living. By polluters pay principle, when a soil was polluted, polluters take the responsibility of clean-up and compensation for damages. The character of the responsibility is a strict liability. When joint polluters exist in a soil pollution, they bear collective responsibility. But they are exempted from obligation in case of a natural calamity and war. The polluters who are poor contribution of pollution take a partition responsibility but it is not easy to prove that. The concerned parties of purification liability in a soil pollution are polluter, an owner or occupant of a contaminated site, and a grantee. But when we do not appoint the polluter or he cannot do a cleanup, municipal must put in effect the purification. In such a case, another parties who are related to the contamination should take upon themselves a liability. The province of responsible parties, therefore, is required to extend to an owner or operator of a facility, a carrier and lender.

  • 본 연구에서는 네덜란드에서 시행하고 있는 토양환경정책을 정리하고, 국내의 적용성에 대해서 검토해 보았다. 네덜란드의 토양환경관리의 목표점은 토양의 다기능성을 유지시키고자 한 것으로서 다기능성의 회복에 토양정화의 주목적이 있다. 네덜란드의 토양법체계는 토양보호법을 기점으로 주변에 환경관리법, 건축법등을 통해 토양환경의 보전을 하고 있으며, 공장지대나 주유소는 토양보호법의 테두리안에서 별도의 명령을 통해 관리되고 있다. 아울러 정화의 책임을 명확히 하였으며, 정화의 책임순서로는 오염원인자, 소유자, 권리행사자 순으로 되어 있으며. 정화는 오염자 스스로 정화를 하도록 유도하고 그렇지 않을 경우에는 정부가 돈을 투자하여 정화를 행하고 있다. 아울러 건축물을 짓고자 할 경우에는 토양에 관한 조사를 하도록 하고 있으며, 토지를 사고 파는 과정에서는 반드시 토양의 질에 관한 정보를 확인하도록 행하고 있다.

Soil Environmental Policy in Netherlands (네덜란드의 토양환경정책)

  • The basic aim of the current policy is to achieve and preserve a sustainable soil quality. This means that soil must retain all its functions for years to come. The Soil Protection Act lays down a statutory "duty of care", which means that soil contamination occurring during certain activities must be cleaned up by the person who cause it. The Soil Cleanup (Interim Measures) Act(1983) was repeated on 15 May 1994, and its provisions, together with some ammendments and additions, were assimilated into the Soil Protection Act. These cleanup regulations are intended to deal with "old cases" of soil contamination, i.e. cases that came to light before 1 January 1987, when the Soil Protection Act entered into force. The urgency for cleanups is dependent upon the actual exposure. In most cases actual exposure win be less than potential exposure (underlying C-values) because only a few exposure routes are present. Cleanup of sites where exposure exceeds maximum tolerable risk levels are considered urgent, and the actual risk level is used to prioritize the cleanup.oritize the cleanup.

  • 우리나라는 2000년에 제조물책임법이 제정하여 2002년 7월 1일부터 시행하였으며, 제조물의 제조, 설계, 표시등의 결함으로 인하여 발생한 손해에 대한 제조업자 등의 손해 배상책임을 규정하고 소비자의 결함 입증부담 경감과 피해자의 보호를 도모하자 하고 있다. 제조물의 표시등의 결함은 지시결함이나 경고결함에 관한 것으로 제조자는 그 위험에 의한 사고를 방지 회피할 수 있도록 소비자에게 정보를 제공하여야 하나 이를 이행하지 않아 발생된 결함이다. 본 논문에서는 A사(社)의 공기정화기 B모델 사용설명서에 나타난 정보제공사항을 주의 경고표시 가이드 등에 따라 검토하였으며, 그 결과 일부 지시 및 경고사항에서 보완해야할 사항이 발견하였다. 보완사항은 제안사항으로 기업내부 에서 처리하되 전문성이 부족한 분야는 외부의 PL전문가의 협력하에 바람직한 개선안이 도출될 수 있을 것이다.

  • The significance of soil environment is gradually increased due to the soil and underwater contamination caused by petroleum leak accidents. It requires a high cost and long period for the purification of soil compared with other environmental matrix such as water and air. For this reason, it has been embroiled in a legal conflict to find the pollution source and charge of cleanup. In this study, we analyzed the physical properties and typical additives of jet fuel to search a method that can distinguish kerosene and jet fuel contamination. In particular, the chemical marker in kerosene was visualized by the developer and the additives in jet fuel, such as antioxidant and metal deactivator were detected by GC-MS. This study could be used to judge petroleum source at soil contaminant accident sites.

  • 전자해도는 각국의 수로국이 자국의 영해에 대해 책임 생산하는 기존 종이해도의 디지틀 형태이며 국제수로기구가 제정한 표준에 의해 제작된 데이터이다. 전자해도는 기본적으로 항해에 사용하도록 제작되었으나 데이터의 정화도와 유용성 때문에 다양한 분야에 사용될 것이 확실하다. 이에 본 논문에서는 항해분야 뿐만 아니라 기타 GIS 분야에 사용될 국내 전자해도에 대해 개발한 ENC Converter를 이용하여 Text 형태로의 변환 및 DB에 저장하고 이를 이용하여 데이터에 대한 고찰을 수행하였다. 데이터의 변환은 여러 가지 GIS 데이터 형식으로의 변환에 대한 요구를 충족시키기 위한 것의 중간 단계로써의 의미를 갖고 있으며 국내 데이터에 대한 각종 분석 및 고찰은 데이터에 대한 여러 가지 정보를 제공할 것이다. 이를 위해 ENC Converter의 기본 알고리즘과 프로그램을 소개하고 변환된 데이터를 이용한 각종 통계 및 간단한 분석을 수행하였다. 이러한 분석 및 고찰은 데이터 제작자에게 더 좋은 질의 데이터를 생산하도록 함과 동시에 사용자로 하여금 자신에게 맞는 형태의 데이터를 추출하여 사용하도록 하기 위한 것이다.

Policy Suggestions for Soil Contamination Prevention and Management of Inactive or Abandoned Metal Mines (휴.폐금속광산지역의 토양오염관리정책의 평가)

  • Attempts were made to analyze the national policy of soil contamination prevention and management of inactive or abandoned metal (IAM) mines in Korea. This approach focused on legal systems and legislation, remediation technology development, and the arrangement or distribution of budgets pertaining to national policy since the mid 1990's. Prevention of Mining Damage and Recovery Act enacted. Defines the roles, responsibility and budget of the government when recovering mine damages. However, in 2005 there still remains to improve the national policy of soil contamination prevention and management of IAM mines. Analysis of national and industrialized foreign countries including the United States, the United Kingdom, and the Netherlands suggest the following improvements: i) arranging distinct regulations between strict and non-strict liability criteria for potentially responsible parties; limiting innocent and non-strict liability depending on the period of incurred mining activity, ii) enhancing participation of local communities by enforcing law and legislation, iii) establishing a national database system of (potentially) IAM contaminated sites based on the Website-Geographic Information System, iv) carrying out site-specific risk assessments and remediation of IAM contaminated sites, v) preparation and distribution of clean-up fund at mine sites adequately, and vi) technology development for the cleaning of IAM contaminated sites; awarding positive incentives of a legal nature for participants applying newly developed technology in IAM mines.

  • In Korea, soil is being transported in and taken out for the purpose of national land development, but the soil is being moved without consideration of soil contamination. Therefore, this is a policy-focused study of the management system on soil moving. In this study, we analyzed current state of domestic and foreign management and suggested three alternatives for management of soil moving in 1) self-regulation, 2) obligatory regulation, 3) phase-in according to types of regulation. In order to establish a clear and reasonable management system for soil movement in the future, it is necessary to improve the legal and institutional limitations of the current soil environmental law as suggested by this study.
