국내 정보보호관련 법규 분석

  • 본 논문에서는 최근 급격하게 증가하고 있는 해킹, 컴퓨터바이러스 유포 등 각종 전자적침해행위, 개인정보의 광범위한 수집과 오·남용, 음란·폭력정보의 범람, 익명성·비대면성을 악용한 인권 침해행위 및 신종 사이버범죄 등의 정보화 역기능에 대처하기 위한 정보보호관련 법규들이 제·개정되어 효과적으로 대응할 수 있게 되었으나 관련 법규들간의 상호 조정이나 정비 및 제정이 지속적으로 이루어져야 하므로 이를 위해 정보보호 문제와 관련된 법체계를 분석하고 법·제도의 개선방향을 제시한다.

  • 본 논문에서는 최근 급격하게 증가하고 있는 해킹, 컴퓨터바이러스 유포 등 각종 전자적 침해행위, 개인정보의 광범위한 수집과 오·남용, 음란·폭력정보의 범람, 익명성· 비대면성을 악용한 인권 침해행위 및 신종 사이버범죄 등의 정보화 역기능에 대처하기 위한 국내 컴퓨터범죄관린 처벌법규가 제·개정시 강화되어 어느 정도 효과적으로 대응할 수 있게 되었으나 국내외 컴퓨터범죄관련 처벌법규 체계를 조사·분석하여 관련 법·제도의 개선방향을 제시한다.

Design for Spatial Information for Effective Implementation of the Convention on the Rights of Persons with Disabilities (장애인권리협약의 효과적 이행을 위한 공간정보 구축방안 연구)

  • The Convention on the Rights of Persons with Disabilities is the international conventions to acknowledge that persons with disabilities have dignity as human being and to give us duty to make an effort for protection of persons with disabilities' rights. This study deducts several tasks in spatial information field to fulfill the Convention on the Rights of Persons with Disabilities effectively. First of all, For the deduction, this study starts by considering accessability, personal movement, freedom of expression and accessability to information. Second, this study defines persons with disabilities as the spatial information what ensure for prior considerations. Third, this study deducts some requirements on spatial information of persons with disabilities on the basis of the survey targeting persons with disabilities and the expert opinion, and suggests objectives, strategies, tasks, systems for effective implementation of the Convention on the Rights of Persons with Disabilities. Especially, this study sets up a goal on spatial information establishing strategy of persons with disabilities as 'Disadvantaged groups like persons with disabilities can obtain requirable information without distinction of person, thereby pursuing the convenience of life and improving the quality of life.

  • To effectively and quickly respond to new forms of terrorism, a more organically integrated and coordinated system will be needed. As establishing the grounds of such a system based on laws would be most in congruence with legalism, it would be desirable to fundamentally establish an antiterrorism act. However, enactment of such counter-terrorism laws must be accomplished by means with which human rights violations against citizens may be minimized, contrary to what has been the case with third world nations. The act will need to include clauses that may relieve organizations, such as national human rights committees or citizen groups, of concerns over potential human rights violations. To address vulnerabilities of investigative rights issues which relate to cases relevant to acts of terrorism being delegated to the National Intelligence Service, the investigative jurisdiction shall be assigned to the public prosecutors and law enforcement officials as with other criminal proceedings. As for public concern that establishing the Anti-Terrorism Center under the National Intelligence Service, a secret service agency, may infringe upon human rights, functional and organizational dualism of the Anti -terrorism Center would be worth taking into account.

Analysis on North Korea Information Research Trend in Korea (최근 북한정보 연구동향에 대한 분석)

  • The purpose of this research is to analyze research trend of 400 north korea information studies from 2010 to 2014 in korea. The research has narrowed the scope of analysis in five fields : political diplomacy, economy, the military, social culture, human rights in north korea. The result of this research shows that each field evenly counts for 20% of the entire research. According to the types of publications, not only research papers but also graduate theses and books comprise a large proportion of the north korea information study. In the past, the north korea information study focused on political diplomacy and the military, but this research revealed different outcome. Now the study of north korea information has wide variety of subject, but it requires a qualitative growth. It remains still the problem of credibility in research data.

  • 본 논문에서는 인권이 조명되는 요즘 문화콘텐츠에서 여성이나 성소수자 캐릭터가 조금씩 등장하기 시작했지만, 여전히 보기 힘든 장애인 캐릭터, 그중 게임콘텐츠에 집중해 알아보고자 한다. 게임에서는 주로 장애가 없는 성인 남성이 주인공으로 등장하나, 장애인 캐릭터가 아예 등장하지 않은 것은 아니다. 지금까지 게임에 나타난 장애인 캐릭터는 어떤 종류의 장애를 가지고, 장르에 따라 어떻게 표현되는지 연구하였다.

A Study on limit of Policeman's Exertion in Police Questioning (불심검문시 경찰관의 유형력행사의 한계)

  • Police questioning is police measure for acquiring information or inquiring an identification without questionee's will in order to accomplish the goal under the Police Act. However, like spear and shield, it has its own inherent limits between both sides of public power and human right and has stirred an hot issue in our society for longtime. The core problem is whether policeman can force a questionee stop when the questionee refuses policeman's stop requirement, the first step for police questioning. Some opinions argue that police questioning has somewhat effects on crime prevention and suspect arrest but people still have inconvenience and refusal from experiences of reckless police questioning in the past. Because of this, the police needs to recover people's trust on police questioning. In order to do so, in case of police questioning, human right should be superior to crime prevention or suspect arrest. This is the time's call. So when there is a police questioning, policeman's exertion of it on the questionee who refuse it should be conducted under strict conditions.

  • This paper attempts to explore the place of human and disability rights from the perspective of Social Welfare within the context of the UN Disability Rights Convention of 2006. The overall discussion is focused especially upon the situations of human and disability rights in the Democratic People's Republic of Korea (North Korea) as it is being challenged to drastically address the issues of human rights in general, and disability rights in particular. The UN Disability Rights Convention challenges every ratified State party to commence legal reforms, legal harmonization, and policy and program developments to implement the Convention. Both North and South Korea are not exceptions to this. Even without drawing upon the UN's the Commission of Inquiry on Human Rights in the Democratic People's Republic of Korea, the dire situation of human rights in North Korea is well documented. However, this paper does not assume South Korea's human rights are any way superior to that of North Korea. This paper spells out areas for further action common to two Koreas and to any other nations for that matter. Apart from the general discussion on disability rights, the distinctive contribution of this paper lies in the fact that it has endeavored to draw upon any latest information and data on North Korea. It relied on various sources from UN and also from North Korea itself. One can note that North Korean disability authorities are making strenuous efforts to improve human rights of persons with disabilities in their desires to seek assistance from outside. It also shows an enormous need for international cooperation in seeking financial and material supports. This paper notes the latest political development between North and South Korea in taking "phased" steps for peace and stability as a positive sign for North and South Koreans' DPOs collaboration under the banner of International Cooperation of the article 32 of the UN Disability Rights Convention. More critically, this paper points to the further need to improve the overall data bases to ensure balanced legal reforms, policy developments and sharpen the areas of international collaboration.

  • 신원확인을 위하여 생체정보를 수집하거나, 이용하는 데 있어서 준수하여야 할 생체정보 보호대책에 관한 중요사항을 정함으로써 생체정보의 안전한 이용 환경을 조성하고, 개인의 권리와 이익을 보호하는 것을 목적으로 한다. 본고에서는 유무선 통신환경에서 생체정보가 수집${\cdot}$저장${\cdot}$전송${\cdot}$폐기 전 과정에서 발생 가능한 취약점과 위협을 정의하고, 이에 대한 기술적${\cdot}$관리적 보호대책에 대한 가이드라인을 제시하고자 한다. 한편, ITU-T, ISO 등 국제 표준 및 국내 TTA 단체 규격 등과 호환 가능하도록 보안대책을 제시함으로서 국가 간의 생체정보에 대한 보호조치 방안에 관하여 상호 연동성을 보장한다. 본고는 유비쿼터스 환경에서 생체인식 국가인프라가 구축되는 시점에서 발생할 수 있는 생체정보에 대한 불신감과 인권침해 등의 사회적인 논란을 최소화하고 개인의 생체정보 보호기술의 발전과 관련 응용서비스 활성화에 기여할 것이다. 또한 전자여권${\cdot}$ 선원신분증${\cdot}$ 국제운전면허증${\cdot}$ 전자주민증 등 공항${\cdot}$항만${\cdot}$육로의 출입국관리에 생체정보의 활용이 전 세계적으로 보급 확산되는 시점에서 생체정보 활용 및 생체인식시스템에 대한 신뢰성을 제공함으로서 국내 생체인식산업의 활성화에 기여할 수 있다고 기대한다.

A Study on the Current State of the Integrated Human Rights of the Elderly in Rural Areas of South Korea (농촌지역 거주 노인의 통합적 인권보장 실태에 관한 연구)

  • This study purported to investigate the current state of human rights of older adults residing in rural areas of Korea. The study utilized, as an analytic framework, 4 priority directions (1. "older persons and development", 2. "rural area development", 3. "advancing health and well-being into old age", and 4. "ensuring enabling and supportive environments") with 13 task actions recommended by Madrid International Plan of Action on Ageing (MIPAA). Furthermore, the study examined gender differences in all items included in the analytic framework. Data was collected by the face-to-face survey on 800 subjects aged 65 and over. Statistical analyses were conducted using STATA 13.0 program. The main results were summarized in order of 4 priority directions as follows. First, average working hours per day were 6.2, and men reportedly participated in economic activities and needed job training more than women, while women participated in lifelong education programs more than men. Awareness of fire and disaster prevention facilities was low in both genders. Second, accessibility to the support center for the elderly living alone as well as protective services for the vulnerable elderly was found to be low. IT-based services and networking were used more by men than women, and specifically, IT-based financial transactions and welfare services were least used. Third, medical check-ups and vaccinations were well received, while consistent treatments for chronic illnesses and long-term care services were relatively less given. In addition, accessibility to mental health service centers was considerably low. Fourth, although old house structures and the lack of convenience facilities were found to be circumstantial risk factors for these elders, experiences of receiving housing support services were scarce. The elderly were found to rely more on informal care, and concerns for their care were higher in women than men. Plus, accessibility to elderly abuse services was markedly low. Based on these results, discussed were implications for implementing policies and practical interventions to raise the levels of the human rights for this population.
