A Study on the Intellectual Property Rights Protection and Features of Korea.EU FTA (한.EU FTA의 지적재산권 보호와 특징)

  • Free Trade Agreement (FTA) between the Korea, of the one part, and the EU and its member states, of the other part, has been effective, as of 1 Jul 2011. EU enlarged its members up to 27 countries including Romania and Bulgaria in 2007, and stood up as the second largest trading partner to the Korea right after the China. FTA, generally, shows the several different figures according to the countries concerned on the agreement The EU has long history and cultural, educational assets. In addition to that, the EU also has economical, industrial bases. Therefore, the EU seeks fruitful profits utilizing its intellectual property rights. There are copyrights and related rights, trade marks, geographical indications, designs, and patents, etc. on the Chapter 10. intellectual property rights of the Korea EU FTA. Among them, the others except geographical indications seem to be somewhat the terms advantageous to the Korea. It is possible to ask further requirements to the Korea in the years to come because the EU member countries are very much interested in the practical profits of intellectual property rights. Thus, it would be essential tasks for us to review the intellectual property rights protection and features of the Korea EU FTA.

  • This study explored the characteristics of media contents in the past, present and future. Also, it investigated the problems in terms of production of contents and circulation in order to find an effective way of providing contents that can keep pace with ubiquitous environment as well as one source multi use in various platforms and channels. In conclusion, it is viewed easy to expect that content would be the most valuable assets in ubiquitous media environments and the importance of contents will be more growing. Rather than game and enjoyment-related contents, more informative and cultural programs will be more valuable so policy-makers as well as industry need to more cultivate this area. In addition, this study presented the method for copyright protection and suggested that governmental policy fostering independent production should also be followed.

  • This study is to examine the possibility of applying the Article 35-4 of the Copyright Act and the relevant regulations of the enforcement decree of the same law to the construction and service of digital library. The background and necessity of the revision were understood by examining the related regulations and discussions in previous studies, including Articles 31 and 50 of the Copyright Act. Then, the detailed contents of the provision were analyzed by referring to the laws, enforcement decrees, and ordinance of the Ministry of Culture, Sports and Tourism. In addition, through comparison with Articles 31 and 50 of the Copyright Act, the characteristics, significance, limitations, and problems of this provisions were analyzed. Based on this, we proposed four ways to increase the effectiveness of this provision.

  • In Korean society, digital contents such as VCC has introduced a new medium of advertisement and has become a culture. This research aims to investigate consumer characteristics for different types of consumption patterns for services dealing with digital contents. A total of 96 statements were extracted from literature review and popular press articles and 39 participants participated in this study. The results show 6 types of consumption patterns: Gak-jang-ee, Second-level Celebrity, Viewers, Politicians, Humanists, and Paris Hilton. These groups demonstrate consumer's behavioral characteristics and personal values. This study is meaningful in that it provides an insight for marketing strategies for corporations dealing with digital contents such as VCC.

A Study on the Transition of Elements of the Book Colophon in Korea (우리나라의 도서 판권기 기술요소 변천 고찰)

  • Colophon means an element to describe bibliographic areas of the concerned book on the specific space like a back of the title page or the last page of a book. Colophon functioned as an information source when cataloging in a library, an area concerning the copyright and as an useful information to readers. The publication of a new book has begun since early 1900s in Korea. And the element of the colophon is dependent on changes in the social and cultural environment. Among the element of the colophon early 1900s until now, the elements consistently appear on the title and the author, a place of publication, a publisher, the date of publication and the price. Additional the elements according to the change of social environment are the edition, ISBN, the registration of publisher, the address of publisher and an author career. On the other hand, omitted elements are the address of author, the account number and the seal. In the future, the size of the book is additionally wanted to describe in the colophon.

A Meta-Analysis of Internet-Related Policy Research in Communication (인터넷 관련 규제정책 연구의 동향분석)

  • This study reviewed and ascertained policy researches relating to the Internet in the field of communication. With using a meta-analysis, this study attempts to classify 44 academic papers from 2000 to 2009 by research theme, methodology, theoretic rationale, related sub-theme, and targeted service and area. It is found that the themes of preceding researches examined herein were limited to the 4th domain in Developmental Model of Media Research. Such researches mainly relied on exploratory studies and only a few of them addressed theoretic rationales. Also, most of Internet regulation discussions focused on content regulation and general internet service. Lastly, researchers discussed laws having bearing on the Internet and social-cultural issues of the Internet.

  • Korea government has established clear cost estimation standard based on a survey of e-learning contents development cost and presented 'e-Learning Contents Development Cost Estimation Guidelines' that reflect the characteristics of the e-learning industry. However, if there is no institutional support, this guideline and system fails to achieve the purposes and objectives. And it is likely to be facing a dead document. Therefore, the policy foundation is required. This study suggested the following policy; stepwise activation of cost estimation standard, enact announcement and periodically adjustment of cost estimation standard, installation and operation of cost estimation standard operational committee, conjunction with the e-learning industry survey, cultural diffusion of co-owned copyright, systematic monitoring of the e-learning contents development process, research on activating policy of cost estimation standard, conjunction with the standard contract for enhancing policy effectiveness.

An analysis on the factor and types of plagiarism of Korean animation (한국 애니메이션의 표절요인과 유형분석)

  • In the 1970s, Korea actively produced so many animated works which is called the "golden age" of korean animation. However, Korea imported and subcontracted foreign animations than creating original works and, there has been a constant controversy that many of the korean animations imitated foreign works. Therefore, this paper aims to analyze the factors that caused this and its patterns, focusing on works suspected of plagiarism in Korean animation during the 1970s and 1980s. First, the focus will be on the definition and composition of plagiarism in art creation, secondly, on the political-ideological, industrial-administrational, production-structural, and copyright awareness aspects of the factors of plagiarized animation. Thirdly, 30 korean animations produced at the time will be analyzed on the degree of design theft and plagiarism based on six criteria focusing on characters' shapes and color arrangements. By analyzing the social factors and patterns of plagiarism, this study aims to provide a social and cultural understanding of academic value about the process of korean animation's development.

A Case Study on the Online Fractional Investment Securitization Platform (온라인 분할 투자 증권화 플랫폼 사례 연구)

  • With the development of information and communication technology, online fractional investment platforms have emerged through the convergence of online platform technology and new investment techniques for asset-backed derivatives. In this study, the concept and previous studies of the online fractional investment platform business, commercialization models and service processes, market status, and pending discussions and alternatives were presented. Recently, the Securities and Futures Commission's decision on securitization of split ownership has become an important guide to the stable business sustainability of platform operators, but academic research is needed according to the current status and case analysis. To identify specific market issues, examples of representative online fractional investment securitization platform businesses such as "MusiCow" for music copyright, "Tessa" based on art, "Kasa" for real estate, "Piece" based on real assets, and "BangCow" for Korean beef shipments were analyzed. Through the case analysis of this study, the characteristics of the business model according to the basic assets of the online fractional investment platform were compared and presented. Since most business models are judged to be securitic, they must comply with the provisions of the Capital Markets Act or be recognized as the target of innovative financial services. From a practical point of view, it is meaningful in that it presented improvement directions that online fractional securitization platform operators should consider and organized institutional considerations for investor protection.

The Present Situation and Challenges of the Russian Music Industry: Centered on the Digital Sound Sources (러시아 음악 산업 현황과 과제 - 디지털 음원을 중심으로 -)

  • The purpose of this paper is to examine the current situation and background of the Russian consumer music market, where digital music sources are making great strides in the noted recent years. In addition, music storage technology, media and change are considered together in this report. Moreover, Russia is the 12th largest music market in the world. The Russian music industry is following the recent trend of the global music industry, where the digital music market is growing rapidly on many different levels. The explosive growth of the digital sound sources in Russia's music industry is attributed to the explosive increase in available consumer downloads, streaming sound source service, and the increase in the number of digital sound sources using mobile technologies due to the development of the Internet. In particular, the sales of the available and accessible streaming sound sources are expected to grow explosively by the year 2020, which is expected to account for more than 85% of total digital music sales. In other words, the spread of smartphones and the resulting changes in the lifestyle of the Russians have created these changes for the global consumer of music. In other words, the time has come for anyone to easily access music and listen to music without a separate audio or digital player. And the fact that the Russian government's strong policy on the eradication of illegal copying of music is becoming an effective deterrent, as is also the factor that led to the increase of the share of the digital sound source to increase sales in Russia. Today, the Russian music industry is leading this change through the age and process of simply adapting to the digital age. Music is the most important element of cultural assets, and it is the beneficial content, which drives the overall growth of the digital economy. In addition, if the following five improvements(First, strengthen the consciousness of the Russian people about copyright protection; Second, utilizing the Big Data Internet resources in the digital music industry; Third, to improve the monopoly situation of digital music distributors; Fourth, distribution of fair music revenues; and Fifth, revitalization of a re-investment in the current Russian music industry) are effective and productive, Russia's role and position in the world music market is likely to expand.
