우리나라에서는 벤처생태계의 구성이 태생적으로 정부 주도로 법제화된 정부자금의 지원이 기초가 되어 이루어지면서 공적 자금의 정책적 목적에 따라 운영되어왔다. 따라서 벤처투자기구에 대해서 이해상충 가능성 배제, 고도의 윤리성, 공정성 및 투명성 등을 요구하는 등 강한 규제가 반영되게 되었다. 이러한 공적규제가 일면 타당성이 있을 수 있으나, 공적규제 위주의 관리감독 체계는 규제의 영향을 크게 받는 한국 벤처투자 시장의 성격상 민간자금의 유입을 제한할 수 있다. 민간 중심의 벤처투자 시장으로 전환하기 위해서는 공적규제를 강화하기보다는 자율규제 영역을 확대하여 업계의 전문성과 효율성에 친화적인 규제 환경을 조성할 필요가 있다. 따라서 본 연구에서는 벤처투자 시장의 자율규제 가능 영역을 살펴보고, 벤처투자기구의 운용사 관점에서의 자율규제 방안을 제시하였다. 구체적 방안 중 하나로는 출자자 사이의 자치적 규범이라고 할 수 있는 규약의 표준이 참여자의 전문적인 식견을 최대한 반영하여 마련된 것이므로, 펀드 결성 이후 출자자 사이의 규약을 둘러싼 분쟁이 발생하는 경우 이를 자율적으로 해결할 수 있는 1차적인 분쟁 조정 절차를 마련해 볼 수 있다.

영국이나 독일의 경우, 현물 증권시장은 수백년의 오랜 역사를 가지고 있는 반면 선물시장은 일천한 역사를 가지고 있다. 이에 따라 선물시장은 독자적인 위치를 확보할 기회가 없었으며, 90년대의 전산화와 이에 따른 거래소 합병 열풍으로 현물과 선물을 함께 거래하는 통합거래소가 주종을 이루게 되었다. 선물업 규제도 증권업 규제에 흡수되어, 선물업계의 자율규제는 유럽에서 찾아볼 수 없게 되었다. 반면 미국에서는 증권시장과 선물시장 모두 전문적인 발전의 역사가 길며 증권업과 선물업의 분리가 뚜렷하고 업계에 관한 전문성을 가진 협회 위주의 자율규제가 활성화되어 있다. NFA식 자율규제 방식은 전 세계적으로 성공적이고 효율적인 선물규제방식으로 평가되고 있는데, 선물시장 참여자와의 대화와 직접적인 의견교환으로 정부의 획일적이고 경직된 법집행에서 탈피하고 있다. 우리나라의 경우 선물업계의 실정을 정확하게 파악하고 있는 민간 전문기관에 의한 자율규제가 필요하다. 특히 시장참여자들과의 직접적인 접촉을 통해 전문적인 선물산업의 발전에 기여하는 미국 NFA와 같은 선물협회 중심의 자율규제가 절실하게 필요하다.

자율운항선박은 제4차 산업혁명 시대의 핵심기술인 사물인터넷과 빅데이터, 인공지능 등이 집약된 미래 고부가가치 선박으로 주목받고 있는 반면, 실제 선박 운항 중 많은 위험요소들로 선박 안전상의 우려가 제기되고 있다. 해양교통에 있어 안전규제는 해사안전 증진 및 해양사고 위험성을 최소화하기 위한 중요요소라고 할 수 있으며, 자율운항선박 시대에서도 동일하게 작용할 것으로 보인다. 이에 자율운항선박 시대 준비를 위한 안전규제의 재정립은 선박의 안전운항을 위한 안전관리체계 정비를 위한 핵심사항이라고 할 수 있으며. 최근 국내·외에서 논의되고 있는 자율운항선박 운항을 위한 규제 개발 역시 중요한 의미를 가진다. 본 논문에서는 자율운항선박 운용을 위한 안전규제체계 개선을 위해 실제 상용화를 앞둔 자율주행자동차 안전위험 이슈 분석 사례를 기반으로 자율운항선박 운용에 따른 안전위험 이슈를 도출했다. 이러한 결과는 자율운항선박의 운용을 위한 규제 개발 논의 시점에서 향후 자율운항선박의 상용화 및 안전규제체계 마련을 위한 기초자료로 활용 할 수 있을 것으로 기대된다.

In the current discourse landscape where the opinions of stakeholders on game self-regulation are opposed, this study was conducted for the purpose of finding improvements by examining the effects of media reports on self-regulatory policies or perceptions. From July 2018 to June 2020, all articles reported for about two years were selected and the final 325 data were used for the study. For detailed frame analysis, the first and second frames were derived inductively. In the results of the study, it was analyzed that the in-depth understanding of the topic of self-regulation, the use of objective data, and the diversity of information sources were insufficient throughout the report.

This study aims at presenting practical self regulation system for digital game, especially optimized to Korea through the comparative analysis of system at home and abroad. For this, this study conducted a comparative analysis about various countries adopted self regulation system, such as America, Japan, and European Union. We drew some implications on the Korean practical policy for the digital game. First, self regulation organization should be consisted of market-friendly form. Second, though self regulation organization is a autonomous system of market, the organization should take rights to regulate illegal case. This would be a good way not only to reduce unnecessary institutional regulations but also to take socially image of reliable media. Third, government should provide self regulation organizations financial assist. This policy means that the organizations make a role fairly and objectively.

민간자율규제와 정부개입의 최소화의 조율은 업계의 자율규제를 기본으로 하여 정부의 법 정책적인 보호 및 규제를 병행하여 해결하는 것이 바람직할 것이다. 특히, 소비자 보호 및 개인정보보호에 관해서는 업계의 충실한 자율규제를 촉구하고, 정부의 개입이 불가피하다면, 보다 명확하고 구체적인 조건과 범위 내에서만 허용되어야 할 것이다. 이에 본 논문에서는 전자상거래 관련 국제규범 형성의 전망을 중심으로 국내 전자상거래 규범 형성과정에 있어서 정부의 대응방안을 제시하였다.

This study takes a critical perspective that current vertical regulatory framework for broadcasting, telecommunications, films and games cannot cope with media development in the age of convergence. Changes in media environment mitigate the uniqueness of terrestrial television causing doubts as to why television contents should be treated more strictly than the rest of media contents. Consensus is being reached that horizontal regulation would be the appropriate regulatory measure for media contents. However, which content should be aligned to what level of regulations have not been fully dealt with. The paper shows that the current regulatory framework which is established according to each delivery platform is no longer valid in convergent media environment. It shows why all content regulation should be applied in platform neutral manner. Then it also suggests both short and long term regulatory changes that need to be made in order to meet the future challenges in media convergence era.

The study attempted to explain the differences among the willingness of companies to accept the self-regulation. The study exemplified the $CO_2$ emissions record labelling program, as a self-regulation program which is considered as a concrete action for corporate social responsibility and substantiality management movement. The study investigated how companies respond to the request from a government to accept the program, which may be potentially contributed to both higher social and financial performance. It is hypothesized that first the company may decide whether the acceptance decision is strategic or non-strategic issues. when considered as non-strategic, the decision will be made on the basis of short term expected returns and costs comparison. It is hypothesized that when considered as strategic, the decision will be strongly influenced by the type of corporate perceptions toward environmental regulations, which has been accumulated by past experiences. Also, the study investigated the good management theory and the slack resources theory which differently predict the direction between social performances and financial performances. The results identified the significant relationships among most variables and supported the slack resources theory. Further, the ethical perception positively influenced the willingness to accept the self-regulation.

IT 기술의 발전과 법 규제 등 비즈니스 환경의 변화에 따라 기존의 정보보호 접근방법에 대한 변화의 필요성이 대두되고 있다. 다양한 정보보호 노력에도 불구하고 정보보호의 발전 속도는 IT 기술의 급속한 변화를 따라가기 어려운 실정이며, 끊임없이 발생하는 보안사고는 예방 중심 보안체계의 한계를 보여주고 있다. 최근 금융권에서부터 자율규제에 대한 논의가 이루어지고 있으며, 이러한 변화에 따라 정보보호의 효율성과 효과성뿐만 아니라 비즈니스의 지속가능성을 동시에 만족시키기 위한 혁신적인 관점에서의 새로운 접근방법이 요구되어진다. 본 고에서는 정보보호 혁신 모델을 통하여 자율규제 환경에서의 정보보호의 새로운 접근방법 구현을 위해 고려해야 할 사항들을 제시한다.

최근 확률형 아이템이 이용자들에게 투입 비용보다 높은 가치의 아이템을 획득할 수 있을 것이라는 막연한 기대감을 갖게 만들어, 게임 이용자의 사행성을 조장하고 과소비를 부추긴다는 우려가 제기되고 있다. 특히 복잡한 확률구조와 관련하여 허위로 표시하는 등 거짓 또는 과장 광고가 만연하여 게임 업계의 자율규제가 실효성을 잃고 게임제작업자가 허위로 확률을 고지하여 이용자들을 기만하는 사례 등이 사회적으로 문제가 되고 있다. 이에 국민의힘 하태경 의원이 일정 규모 이상 게임제작업자는 게임물이용자위원회를 두도록 하는 게임산업진흥에 관한 법률 일부개정(안)을 2021년 3월 24일 대표발의하였는데, 이 법안이 게임산업을 과도하게 규제한다는 비판이 제기되고 있는바, 해당 법안을 분석하여 입법취지에 부합하는 개선방안을 제시하고자 한다.
