건설기계임대차 표준계약서 제정, 시행

  • 공정거래위원회가 건설기계임대차 분야에 있어서 불평등한 계약관행을 개선하고 공정한 거래질서를 확립하기 위해 최근 "건설기계임대차 표준계약서"를 제정했다. 이에 따라 국토부는 지난 6월 10일 산하 공공기관 관계자 등과 간담회를 갖고 표준약관으로 제정된 건설기계임대차 표준계약서가 공사대장의 작성.비치.관리와 함께 공사현장에서 널리 사용, 정착되어 건설공사의 투명성이 제고될 수 있도록 적극적인 협조를 당부했다. 이번에 제정된 건설기계임대차 표준계약서는 지난 해 대한설비건설협회를 비롯한 4개 단체와 국토해양부가 협의를 거쳐 공정위에 건설기계임대차 표준계약서 표준 약관을 공정위에 심사, 청구한 것을 공정위가 승인한 것이다.

A Study on the Protecting of Personal Information in Offline Transactions : Focused on the Housing Lease Agreements (오프라인 거래에서 개인정보 보호방안 : 주택임대차계약을 중심으로)

  • Recently, the proportion of housing lease has been increasing to an overwhelming level in line with the increase of single-person households and the change in the form of housing. In the normal case, the use of rental-type housing is subject to a housing lease agreement through a licensed real estate agent. In the event of a transaction conclusion, licensed real estate agent shall issue a contract containing the personal information of the lessee, the renter, and the licensed real estate agent to the transaction party. In this case, it is necessary for the lessee to provide the contract to a third party. This paper analyzes relevant laws and regulations and the status of housing transactions, focusing on personal information processed between offline housing lease agreements. And when issuing a contract through IRTS, we propose a way to protect personal information by providing a third party in three forms: information Data Subject-based, Purpose of usage-based De-identification, and Certificate of Contract.

Analysis of the Redemption Risk of Renters Using CoLTV (CoLTV 지표를 이용한 임대차주의 상환위험 분석)

  • This paper analyzes the redemption risk of renters by estimating the LTV and CoLTV with finance market big data (individual credit information) and housing market big data (actual housing transaction data). The analysis showed that when using LTV, the redemption risk was higher in the case of the monthly renter than of the chonsei renter. On the other hand, when using CoLTV, the chonsei renter had a higher redemption risk than the monthly renter. This implies that there is a need to activate a guarantee system, such as risk management using the CoLTV index and the chonsei deposit return guarantee because it is possible for renters to experience losses on their chonsei deposits due to the higher redemption risk. Another implication is that the risk manager should consider the individual characteristics of renters because of the different effects of the redemption risk stemming from the characteristics of the rental contract and the personal characteristics of the renters. CoLTV was just a concept until this study calculated it using housing big data and actual housing transaction information. It helps identify the redemption risk through the characteristics of renters and their contracts.

Problems and Solutions for the Term of Existence of the Housing Lease in the Digital age (디지털시대에 있어서 주택임대차 존속기간에 대한 문제점과 개선방안)

  • The Housing Lease Protection Act was enacted from March 5, 1981 as Law No. 3379 to guarantee the stability of residential life and legal status. After then, there were many problems, but through several times revision, it had improved insufficient part. However, in order to give guarantees actually the position strengthen for homeless poor people many issues still need to be solved and it has been raised. Along the way, with the introduction of the tenant renewal claims, in February 14, 2015, the National Assembly planned to discuss current issues by operating the Special Committee for housing welfare of ordinary people in the extra session. In the current, however, the conflict of the pros and cons is shown clearly. Meanwhile, because the contract renewal claim of tenant was not guaranteed, if the minimum duration of the lease will be lapsed, contract renewal is dependent on the intention of landlord. Thus, the residential stability of homeless poor could become unstable. Therefore, in this paper, to stabilize the residential living for tenants who are in poor status, analyze our term of existence regulation and through the compared to the national legislation about the term of existence, it will try to propose the specific legislative approach to the problem.

대법원 판결 디이제스트 - 대법원 공정거래 사건 판결 요지(2012. 7.~8.)

  • 대법원이 2012년 7월부터 8월까지 사이에 선고한 일부 판결을 소개한다. 대법원으로서는 위 기간 동안 네 분의 대법관님이 퇴임하시는 등 업무적으로 공백이 있었다. 법리적으로 큰 의미가 있는 사건은 아니지만 사례판결로서 의미가 있는 판결이 몇 건 선고되어 이를 소개한다. 그러나 글의 마지막 부분에서는 많은 주목을 받았던 10년 공공임대주택의 표준임대차계약서 조항에 관한 판결을 소개하기로 한다.

컨테이너터미널 적정 임대규모 검토

  • 컨테이너터미널의 규모는 내용년수 기간 동안 해당 터미널의 관리, 운영, 경쟁적 지위에 영향을 미칠 뿐만 아니라 해당 항만의 경쟁구조에도 영향을 미친다. 따라서 항만당국과 터미널 운영사는 임대차계약을 체결하기에 앞서 터미널 규모의 중요성을 이해할 필요가 있다. 이론상 특정 설비/기업의 규모는 전형적으로 최소효율규모(MES)와 관련하여 규정되지만, 컨테이너터미널의 규모는 이론과 실제상 MES와 기타 여러 요소가 결합되어 결정되는 것으로 알려지고 있다. 소위 운영사가 선호하는 적정 컨테이너터미널 규모는 항만거버넌스 구조와 목표, 시장규모와 구조, 기술변화와 운영상의 고려요소, 선사의 운항패턴 등에 의해 결정된다. 이에 본 논문에서는 전세계 주요 항만의 컨테이너터미널 적정 임대규모를 검토하여 우리나라에의 시사점을 제시하고자 한다.
