A Study About a Trial for Damage of the Right to Sunshine in Apartments (공동주택의 일조환경 피해 판정에 관한 연구)

  • This paper presents the results of a case study of a dispute for the damage of the right to sunshine between B and W Apartment Complex in the N city. Recently a number of disputes for the right to sunshine increase in urban areas because the residents' demand for pleasant residential environment is getting stronger. In particular, problems related to sunshine, which were not recognized during the construction, have come up to the surface over time as people's concern over residential environment is growing. According to a recent interpretation of the right to sunshine in urban areas, moreover, there have been a series of legal decisions starting that damage of the right to sunshine to neighboring apartments must be indemnified for even if the violating apartment was designed and constructed legitimately according to relevant construction laws applied when the building was constructed. Thus this study examined the effects and the scope of damage on the right to sunshine through a case study in order to provide basic materials necessary to rope with related civil affairs.

  • Recently, many troubles about the right of light have been arising ceaselessly as taller and more dense the buildings have been in the urban. The present time, the right of light is not stipulated legally. For solving above problems, there spend so too much lawsuit expenses and time on the damages about construction stopped and delayed, according to subjective decisions instead of scientific and rational solutions. The past studies of the right of light weren't based on the analytic data and depend on the simple view of point. So, those of studies gave trust to people hardly, only were treated as the ways on the decision about construction among non-engineers. Therefore, this paper studies the efficient solution of problems about the right of light through analysis about mass of sunlight according to season and the hour using a simulation technique on the civil construction.

A Study on the Sunshine Environment Around Urban Redevelopment Area Using a GIS Data (GIS 자료를 활용한 도시 재개발 주변 지역의 일조 환경 분석)

  • In this study, the changes of the sunshine environment due to the construction of buildings were analyzed by season. Using a geographic information system (GIS) data, the topography and the buildings were constructed around Pukyong National University (PKNU) in Busan. The numerical model was performed for a week in each season, before and after the construction of buildings. Even before the construction of the high-rise building complex, the area of sunshine block is wide due to the apartment complex located in the southeast of the PKNU campus and the mountain in the south. After the construction, the sunshine-blocked area became wider after the sunrise and before the sunset. The area of sunshine block after 1 hour at sunrise increased by 1.60%, 1.50%, 1.58% and 1.36% in the vernal equinox, summer solstice, autumnal equinox and winter solstice, respectively. The building complex in the east (south) of the PKNU campus made shadow in more than 1,000 m (750 m) toward the west (east) just before the sunrise (sunset). Especially, the sunshine duration in PKNU campus decreased by 46.61%, 22.75%, 58.56%, and 11.31% in the vernal equinox, summer solstice, autumnal equinox and winter solstice, respectively. The analysis of the sunshine duration for a dormitory building showed that the construction of the building complex in the south of the PKNU campus reduced the sunshine area of the western (southern) wall of the dormitory by 30.91% (49.45%) for a winter week.

  • Seasonal climatic factors associated with tobacco quality grade and production rate were analyzed. The degree of influence on yield distribution rate in high guality tobacco leaues was highly positive with the average temperature in early May, but negatively related to those in late May and early June. Positive correlations were noticed between the degree of influence and sunshine hours in Middle June, late June and late May in decrease order, while negative degree of influence was higher in early May than in late May, The order influenced by recipitation in a positive direction was early May, late May and middle May. Negative influence was noticed in middle and early June with a great degree.

  • 벼의 생육과 수량에는 토양과 생물환경 못지 않게 기상환경도 중요하다. 기상환경 중에서도 기온과 일조시수의 영향은 매우 커서 이에 대한 연구가 많이 이루어 졌다. 따라서 본 시험에서는 여수지역에서의 10년간 기상조건과 벼의 수량성을 비교하였던바 생육 초기의 영양생장기에 비하여 생육후기의 생식 생장기에서의 높은 고온과 많은 일조시간(일사량)은 증수되는 경향이 었다.

  • 본 연구의 목적은 GIS 공간분석을 이용하여 음영에 따른 노면결빙예상구간을 정량적으로 평가하는데 있다 산악지역의 도로는 절토 및 터널구간이 많아서 겨울철에는 결빙구간이 발생될 우려가 있으며, 이는 교통 안전사고를 크게 야기시킬 수 있다. 따라서 도로의 기본설계에서부터 각 구간에서의 일조 환경 및 노면결빙예상구간을 정량적으로 정확하게 예측할 수 있는 분석이 필요하다. 본 연구에서는 동해고속도로 중 약 29km구간에 대하여 3차원 모델링, 일조 시뮬레이션, 지오데이터베이스 구축, GIS 중첩 기능에 의한 공간분석을 통해 노면결빙 예상구간을 추출할 수 있었다. 연구결과, GIS를 이용할 경우 기상조건 별로 도로의 일조영향에 따른 노면결빙 예상구간을 정량적으로 추출할 수 있었으며, 연구대상지역 중 상당한 구간이 결빙의 위험에 노출되어 있음을 알 수 있었다. 또한 GIS를 이용한 렌더링 기법이 기존의 음영기복 방법보다 정확하며, 3차원 상에서 그림자의 변화를 시각적으로 판단할 수 있음을 알 수 있었다. 향후 본 논문이 도로관련 법제도상의 노면결빙구간에 대한 규정을 제정하는데 크게 이바지할 수 있을 것으로 생각되며, 도로 설치 구조물의 배치 및 도로포장의 종류 등을 고려한 추가적인 음영구간추출 연구가 필요하다고 판단된다.

Effects of the Daylight Disturbance on the Growth and Yield of Spray Chrysanthemum 'Yellow Cap' and 'Peach PangPang' (일조방해가 스프레이 국화 '옐로우캡'과 '피치팡팡'의 생육 및 수량에 미치는 영향)

  • This study was carried out to analyze the effect of changes in the light environment caused by the daylight disturbance on the growth, flowering, and cut flower quality of spray chrysanthemums. The spray chrysanthemum 'Yellow Cap' and 'Pitch PangPang' cultivars for cut flowers were artificially shaded to interfere with 66% of sunlight compared to the non-shading, and then the growing and flowering characteristics, and cut flower yield were investigated accordingly. There was no significant difference in the cut flower yield per unit area between the shading and the non-shading treatments. However, the number of days to flowering was 72.1 days for the 'Yellow Cap' and 65.2 days for the 'Pitch PangPang', which were delayed by 14.1 and 8.9 days, respectively, compared to the non-shading light. In the shading treatment, the flower diameter and the number of flowers also decreased by 10% and 15%, and 30% and 28% for both 'Yellow Cap' and 'Pitch PangPang', respectively. The stem length also decreased by 10% and 20%, the stem diameter by 23% and 37%, and fresh weight by 32% and 33%, respectively. The shading treatment delayed the flowering of chrysanthemums and reduced the growth such as flower diameter, number of flowers, and the length and weight of cut flowers. Based on these results, the daylight disturbance by artificial buildings is expected to reduce the productivity and quality of cut flowers by limiting the light intensity needed for chrysanthemum growth, flower bud differentiation, and flower development. Therefore, further research is needed on the rate of decrease in yield and market value according to the degree of shading to relieve damage to chrysanthemum growers caused by the daylight disturbance.

  • 2005년 2월 16일 교토의정서 발효로 인해 향후 전 제조업체가 직접 영향을 받게 되었으며, 이에 대한 자구책 마련이 시급한 현실로 다가왔다. 따라서 에너지 다소비 산업구조인 주정산업도 에너지 절감형 생산체제 구축으로 온실가스의 배출량을 감축하는 한편 기후변화협약이 우리 주정산업 제조원가에 미치는 영향에 대하여 미리 예측하여 자구책과 주정산업 보호를 위한 적극적인 대비책 마련하는데 일조하고자 본 원고의 목적이 있다.

  • 지구온난화로 인해 세계 곳곳에서 기온상승이 관측되고 있으며, 이는 전지구적 기후시스템의 변화를 보여주는 대표적인 예이다. 온도를 비롯한 강수량, 풍속, 증발량 등의 기상학적, 수문학적 인자들이 각각 서로에게 영향을 주고 받으며 복잡하게 변화할 것이고, 그 변화폭도 점점 커질 것이다. 증발에 영향을 미치는 인자들은 크게 세 가지로 나뉘는데, 태양복사에너지, 온도, 바람, 기압, 습도와 같은 기상학적인자, 증발표면의 특성인자 그리고 수질인자로 분류할 수 있다. 증발에 영향을 주는 인자들은 예전부터 알려져 있지만 이들 간의 복잡한 상호작용에 대해 정확히 이해하기는 쉽지 않다. 본 연구에서는 댐유역의 증발량에 영향을 미치는 기상인자 파악을 위해 2008부터 2016년까지 관측된 낙동강수계 내 안동댐과 남강댐의 기상자료(기온, 강수량, 풍속, 상대습도, 기압, 일사량, 일조시간, 전운량)를 이용한 변화를 분석하였으며, 다변량 통계기법인요인분석을 통해 증발량과 상관성이 높은 인자들을 분류하였다. 안동댐과 남강댐 공통적으로 증발량과 기온, 기압이 같은 요인으로 분류되고 높은 상관성을 보였으며, 강수량, 일조시간, 일사량, 전운량이 같은 요인으로 분류되었다. 국내의 증발량 측정지점에 대한 추가적인 분석과 영향인자를 이용한 다변량회귀식과 인공신경망 통해 증발량 미측정 지점의 증발량 산정이 가능할 것으로 판단된다.
