The Effects of the Capital Adequacy and Liquidity Regulation on Internet Primary Banks (인터넷전문은행의 자본적정성과 유동성 규제에 관한 연구)

  • Basel III (Third Basel Accord or Basel Standards) is a global, voluntary regulatory framework on bank capital adequacy, stress testing, and market liquidity risk. Basel III regulatory ratios include capital adequacy, asset soundness, and liquidity. The capital adequacy variables include BIS capital adequacy ratio, BIS tier 1 capital ratio, and tangible common equity ratio. The asset soundness variables include non-performing loan ratio and non-performing loan coverage ratio. The liquidity regulation variables include KRW liquidity coverage ratio and foreign currency liquidity coverage ratio. This study aims to investigate how capital adequacy standard affects efficiency of internet primary banks. As a result of this study, BIS capital adequacy ratio of domestic internet primary banks is lower than that of commercial banks. In order to maintain sustainable operation considering capital adequacy regulations, it is necessary to expand additional capital. In addition, the delinquency rate and non-performing loan ratio of domestic internet primary banks is gradually increasing due to the maturity of high-yield loans in 2019.

  • Recently, the regulation issues for the zero-rating began to be proliferated. The corresponding regulators in charge of Internet services of all the countries of the world illustrated the various spectrums, rather than the similar policy line. In contrast, the oversee regulators not only recognized that zero-rating might be somethings to do with the net neutrality regulation, and but also actively debated regarding the validity for the regulation. However, any domestic study examining the issue has not endeavored yet. Therefore, the purpose of the study is to identify the validity of net neutrality regulation of zero-rating. Specifically, the study provided the features of zero-rating, the relationship with this new regulation and traditional regulations, and the various arguments and policies in major countries. The results of the study would be utilized as a reference in planning the regulation and countermeasure, from the corresponding policy makers and business operators.

  • This paper proposes a desirable regulatory measure for the rapidly growing shared economic platform. The development and innovation of digital technology is expected to create new services and new economic and industrial values, but it also raises concerns, challenges about social trust issues arising from conflicts of interest with existing industries. Although sharing economies also creates new forms of supply and demand and grows rapidly around the world with innovative trading methods, institutional limitations are still being exposed in the major cities in terms of conflicts with existing industrial values. In order to reduce the social costs associated with the regulatory process and reach the appropriate regulatory policy goal, this paper proposes a co-regulation approach considering the sharing economic characteristics.

  • Nowadays Internet is the greatest and most participating media of prompting expression with 37 million users in Korea. Internet enables collective communications between social members and contributes to form sound public opinions and to develop democracy while it has negative aspect to distribute massively crime by illegal posting which is forbidden by the Criminal Act. Criminal actors who involve to diffuse information on Internet consist of three categories of information provider, user and internet service provider. Illegal posting generated on Internet is originated from IP and the criminal regulation on it is useless and meaningless because of its countless of users and ambiguous boundary with liberty for expression. Accordingly, the only criminal policy means to prevent danger by illegal posting on Internet is to regulate ISP which saves illegal posting and mediates contacts among users. In spite of it, legislation to regulate ISP is unprepared. The prudent legislative review should be done. And it should be accordance with the doctrines of propriety and vagueness of the principle of "nulla poena sine lege".

  • Profiling-based recommendation services provide the convenience of easily accessing specialized content for individuals on the user side and provide an important profit model on the corporate side. Despite the utility of these recommendation services, the issues such as personal information infringement and restrictions on consumer options are emerging, and certain regulatory movements for profiling recommendation services are actively underway. Under the circumstance, there are concerns that the introduction of regulations without a close review of regulatory effectiveness and side effects will weaken the competitiveness of domestic companies in the global market. This study systematically analyzed how companies providing profiling-based recommendation services perceive the corresponding regulations.

  • IPTV는 기술적으로 TV에 PC적 기능이 더해지고 인터넷 프로토콜(IP)을 통해 인터넷과 연결되는 서비스로, 국내 초고속인터넷의 속도가 VDSL, 광랜과 같은 서비스의 등장으로 최대 100Mbps에 이르러 동영상 콘텐츠의 실시간 스트리밍 서비스가 가능한 환경이 구현되었다. IPTV 도입을 통해 산사건 방송, VOD 등의 기본적인 서비스뿐만 아니라, 양방향 광고, IPTV 민원발급 및 IPTV 공공서비스 제공 등 다양한 응용서비스의 개발 및 활성화를 기대하였다. 또한 IPTV를 통해 유료방송의 경쟁을 촉진시키고 케이블TV의 디지털 전환을 촉진시킴으로써 시청자들의 복지를 향상시킨다는 취지도 함께 있었다. 정량적으로는 IPTV가입자가 2012년에 이르러 보수적으로 290만가구, 낙관적으로는 450만 가구에 이를 것으로 예상하였으며, 관련 시장규모도 동년도에 약 7,515억원에 이를 것으로 전망하였다. 하지만, 2011년 말이 이미 450만 가입자를 돌파하고 2012년 8월 500만 가입자를 유치하면서 IPTV 서비스는 본격적인 mass market을 형성해 나가고 있다. IPTV 시장이 확대해 나가면서 유료방송 가입가구 수도 증가하였는데, 도입당시인 2008년 말 1,740만 가구가 유료방송에 가입하여 104%의 보급률을 보였으나 2011년 6월말 현재 가구수 대비 유료방송 가입자구수는 127%로 증가하였다. 이렇게 IPTV서비스 시장이 확대되고는 있으나, 정부의 신규 서비스에 대한 과도한 요금규제, IPTV와 경쟁하는 케이블방송사(SO) 계열의 콘텐츠 사업자(CP)들의 방송채널 공급거절 및 지상파 방송사의 과도한 재전송 대가, 전국 권역사업자인 IPTV에 대한 권역별 가입자점유율 규제, IPTV의 차별성으로 내세웠던 T-Commerce 및 양방향 광고에 대한 규제는 앞으로 개선해 내가야할 과제이다. 이에 본고는 IPTV의 시장성과를 조망하고, 시장의 지속성장을 위해 필요한 제도개선 방향을 살펴보았다.

  • 홍콩은 3G MVNO를 제도적으로 도입한 대표적인 사례이다. 홍콩의 규제당국 OFTA는 3G MNO에게 네트워크 용량의 30%에 대해 개방을 의무화하였고, 3G MVNO에게 강력한 권리를 부여하는 라이센스를 발급하였다. 이로써 MVNO 사업자에게 3G 주파수를 보유하지 않고서도 3G 서비스를 제공할 수 있는 기회가 제공되었다. 흥콩의 규제당국은 3G MVNO제도를 도입함으로써 3G 시장의 조기정착, 통신시장의 경쟁활성화, 소비자 혜택의 증대를 기대하였다. 우리나라는 2.3GHz Wibro(휴대인터넷) 라이센스에 네트워크 용량의 30%를 MVNO에 개방해야 한다는 도입근거를 마련함으로써 Wibro 시장의 MVNO제도가 주요 이슈가 되고 있다. 본 연구에서는 홍콩의 3G MVNO제도 도입과정과 제도적 특성을 분석함으로써 국내 Wibro 시장의 MVNO제도 도입에 참고가 될 수 있는 시사점을 제시하고자 한다.
