  • 우리 헌법은 인간의 존엄과 가치 그리고 행복을 추구할 권리를 보장하고 있으며, 편의증진법과 교통약자법을 통해 장애인등이 교통수단, 여객시설 및 도로 등을 비장애인들과 차별 없이 이용하여 이동하고, 도로와 대중교통수단, 공공 건축물과 주거 등 생활 필수시설에 자유롭게 접근하기 위한 접근권을 보장하고 있다. 우리나라는 이동권의 보장을 편의시설 제도라는 독자적인 체계를 통해 이루어지고 있으며, 이를 실질적으로 보장하기 위하여 장애물 없는 환경 인증 제도(BF 인증제도)를 도입하였다. 시행 15년을 맞은 BF 인증제도는 양적으로는 많은 발전을 가져왔지만, 질적으로 특정 건축물 등 일부에 대한 인증 편중 현상이 있으며 안전취약계층에 대한 재해 안전확보에 대한 고려가 포함되지 않아 부진정한 이동성과 접근성의 보장이라는 한계를 가지고 있다. 이동권 보장이 얼마나 잘 이루어지느냐는 그 나라의 사회 안전망이 얼마나 잘 갖추어져 있는지 판단하는 척도라 할 것이며, 따라서 이러한 이동권 보장은 위험상태에서의 안전한 피난을 함축하고 있으며 중첩적으로 국가의 기본권 보호 의무의 이행과 관련된다. 이에 따라 이동권과 접근권의 증진을 위한 BF 인증 규정을 안전 규범으로 보완하여 장애인과 비장애인이 사회의 일원으로서 평등한 인격적 주체로 공동체에 기여하는 안전한 사회적 환경의 조성이 긴절히 요청된다고 할 수 있다.

A Study on Legal Issues of Data Portability and the Direction of Legislative Policy (개인정보 이동권의 법적 이슈와 입법 정책 방향)

  • The right to data portability needs to be introduced to strengthen the self-control of data subjects and promote personal data use. However, the right to data portability constitutes a high risk of invasion of privacy of data subjects and may infringe on the property rights of data controllers, so careful and thorough design is warranted. The right to data portability can intensify the concentration and monopoly of personal data, result in problems of overseas transfer of personal data held by public institutions, and enrich only the profits of giant platforms by burdening the data subject with high transfer cost. By contrast, SMEs are more likely to endure a personal data deprivation. From the proposed amendment to the Personal Data Protection Act are raised various legal issues such as. i) Whether to include inferred/derived data, personal data held by public institutions, activity data, sensitive data, and personal data of third parties within the scope of data portability; ii) whether SMEs are included in the data porting organization; iii) whether to exclude SMEs or large platforms from the scope of the data receiving organization; iv) Whether to allow the right to transmit to other data controllers, v) Whether to allow the overseas transfer of personal data held by public institutions, vi) How to safely exercise the right to data portability, vii) the scope of responsibility and immunity of a data porting organization, etc. The purpose of this paper is to propose the direction for legislative action based on various legal issues related to data portability.

  • 유럽연합(EU)의 GPDR(개인정보보호일반규정)시행에 따라 개인정보를 활용하는 사업자 입장에서는 개인정보 보호도 중요하지만 활용측면에 더 많은 관심을 보이고 있다. 개인정보 보호와 활용에 따른 균형점을 찾는 제도적 정착을 위해 개인정보 이동권에 대한 요구가 생겼다. 국내 개인정보 관련 법률에는 아직 근거가 없으며 개인정보처리자의 독립적 데이터 보유에 따른 책임 강화와 정보주체가 자신의 데이터를 관리하는 권리를 가지고 데이터 활용을 할 수 있는 개인정보 자기결정권이 더 요구된다. 이에 따라 본 논문에서는 GDPR의 개인정보 이동권에 대한 현황 및 준수사항을 알아보고 각 나라별 개인정보 이동(data portability)에 따른 개인정보 활용방안과 고려사항을 제시하고자 한다. 개인정보이동에 한 형태로 국내 마이데이터 시범 사업이 정착하기 위한 법칙, 기술적 대응사항을 제시하고자 한다.

  • 사람은 자신의 이동에 기계를 사용하기 시작했고 그 발전속도는 항공기의 발달로 극에 달한 느낌이다. 그러나 이러한 이동수단은 필연적으로 사고를 동반하는 것 또한 현실이다. 각종 이동수단 즉 교통수단 가운데서 사고 발생률의 면에서는 단연 항공기가 가장 낮다고 하지만 항공기 사고는 한번 나면 대형사고이고 인명의 살상이 많기 마련이다. 항공기 사고는 오늘날 사고 내용을 자세히 살펴보면 고정익기 보다는 회전익이 더 많고 성층권을 비행할 때 보다는 대기권을 운행할 때가 더 많다.

The Status of Mobility Disadvantaged Persons with Physical Disabilities & Suggested Improvements in Chungnam (충남지역 지체장애인의 이동권 실태 및 개선방안 연구)

  • This study investigated the general characteristics of mobility disadvantaged persons with disabilities, and to suggest implications to ensure personal mobility with the greatest possible independence for the physically disabled in community. The survey questionnaire included the categories as follows: the general characteristics of the participants, the status of outing and mobility, usage of low-floor buses & taxi for the disabled, service improvement, and mobile support center. Data collected from 219 with physical disabilities were analyzed for this purpose by using descriptive statistics. The study results showed that 54.6% of the total tended to go out everyday, and 17.0% rarely. 53.4% could go out without any assistance, and the major obstacles not to go out were stairs and inconvenience of public transportation. 26.9% used low-floor buses, and 71.1% preferred to use taxi for the disabled. The average waiting time for the usage of low-flow buses and taxi was 66.57 minute and 42.65 minute, separately. 78.7% insisted that the function of mobile support center in the community should be expanded, whereas only 49.8% recognized the role of mobile support center. Based on the study results, the researchers suggested to facilitate access by persons with disabilities to mobility aids, and to improve the actual state of pedestrian environment. In addition, the function of mobile support center should be expanded to help the mobility disadvantaged persons live independently in community, thereby contributing to the promotion of their quality of life.

A Simulation of Mobile Base Station Placement for HAP based Networks by Clustering of Mobile Ground Nodes (지상 이동 노드의 클러스터링을 이용한 HAP 기반 네트워크의 이동 기지국 배치 시뮬레이션)

  • High Altitude Platform (HAP) based networks deploy network infrastructures of Mobile Base Station (MBS) in a form of Unmanned Aerial Vehicle (UAV) at stratosphere in order to build network configuration. The ultimate goal of HAP based network is a wireless network service for wide area by deploying multiple MBS for such area. In this paper we assume multiple UAVs over designated area and solve the MBS placement and coverage problem by clustering the mobile ground nodes. For this study we assumed area around Cheju island and nearby naval area where multiple mobile and fixed nodes are deployed and requires HAP based networking service. By simulation, visual results of stratospheric MBS placement have been presented. These results include clustering, MBS placement and coverage as well as dynamic reclustering according to the movement of mobile ground nodes.

The Changes of Urban System Reflected in Daily Movement: 2005-2012 (일일 인구이동으로 본 국토공간의 도시체계 변화: 2005년과 2012년)

  • This paper examined the changes of urban system through the network and the flow pattern reflected in daily movement in Korea. Because daily movement reflects trip pattern, urban system formed by inter-city linkages can be recognized in terms of living sphere. While population movements between cities have the number of linkage systems of city network and the number of traffic regions composed of the origin and destination has increased respectively. Nevertheless, spatial extent of Capital region and Busan region has been expanded. In Gangwon-do in which Seoul-oriented high-speed transportation network has developed, separation of living sphere between Yeongdong area and the Soyanggang cultural region formed around Chuncheon was intensified. Living sphere that includes Daejeon and the surrounding cities has been expanded to the southern Gyeonggi-do. The existing living sphere formed in Jeollanam-do was fragmented into the east and west around Mokpo and Suncheon due to the weakened centrality of Gwangju. Living spheres formed by spatial interaction were consistent with regional administrative boundary. Considering the increased interaction between Seoul and its surrounding cities, the development of global city-region centered on Seoul is expected.

The Impact of Internal Migration on Wage Growth among College Graduates (지역이동이 대졸자의 임금 변화에 미치는 영향)

  • This paper examines the impact of internal migration on wage growth among college graduates using Propensity Score Matching methods. We define migration as moving between Seoul Metropolitan Area (SMA) and non-SMA based on the locations of graduates' first and second jobs. We also take the direction of migration into account for examining the wage premium in SMA. In order to estimate the impact of migration on wage growth, we use the Graduate Occupational Mobility Survey (2010GOMS) coupled with other supplementary data such as College Scholastic Ability Test score and local characteristic variables. The results reveals that graduates moving from SMA to non-SMA do not experience significant wage growth. However, we find that graduates moving from non-SMA to SMA experience an increase in their monthly wage about 170,000~186,000 KRW on average (9.5~10.3% of their monthly wage on the first job).

Performance Analysis of a Mobile Stratospheric Communication System with Channel Codings over Rician Log-Normal Fading Channel Models (라이시안 로그노말 페이딩 채널 모델에서 채널 부호를 사용한 이동 성층권 통신 시스템의 성능 분석)

  • There have been increased concerns on mobile stratospheric communication system(SCS) for the purpose of advanced service of personal and high speed communication systems. In fact, this SCS is considered and studied for IMT-2000 service by ITU. Although, it is important to make accurate channel model for prediction of the SCS performance, there is no measured channel data in this system. Thus, in this paper, we estimate the performance of SCS bye use of channel model provided by Corazza(2) and modified by You(3). And also, the effects of channel codings on system performance are analyzed by deriving bit error performance based on realistic Rician log-normal fading channel models. The performance results are divided into three kinds of areas with three kinds of elevation angles 20$^\cire$, 45$^\cire$, and 80$^\cire$. And also the effects of forward error correction channel codings on system performance with Hamming(7,4), HCH( IS,7) and convolutional code of constraint length 3 and code rate R=1/2.
