법령과고시(1) - 건설산업기본법 시행령 및 시행규칙 개정

  • 우수 건설업체의 자본금 등록기준 완화 등을 주요 골자로 하는 건설산업기본법 시행령 및 시행규칙이 지난 11월 14일 개정 공포되어 11월 15일부터 시행에 들어갔다. 대한설비건설협회는 그동안 건설공사에 하도급으로 참여하는 회원사 보호를 위해 국토교통부, 공정거래위원회에 건설산업의 불공정 하도급 거래 관행 제도개선을 지속적으로 건의해 왔다. 그 결과 정부가 지난 해 6월 국토교통부 등 5개 부처 합동회의에서 건설산업 불공정 거래관행 개선 방안을 발표했으며, 올해 5월에는 후속 조치로 상습체불 건설업자 명단 공표 등을 골자로 건설산업기본법을 개정하고 지난 11월 15일부터 시행에 들어갔다. 이에 따라 상습체불건설업자 명단 공표 방법, 저가낙찰 공공공사의 기준 정하는 방법 등 법률에서 위임받은 사항과 그 시행에 필요한 사항을 정하고, 경험 많은 우수건설업체의 자본금 등록기준 완화, 하도급률 산정 기준의 명확화 등 현행 제도의 운영상 미비점을 보완했다.

Improvement and Expected Effect of Construction Supervision System for Mix-Use Residential Building (주상복합건물의 감리제도 개선방안과 기대효과)

  • As buildings are changing variously from the side of use, efficiency and size, the construction qualities are more importantly recognized. Supervision system was enacted in the Residential Building Law in 1990 and responsibility supervision system in the Construction Engineering Management Law in 1994, respectively. However, recently revised supervision system in 2003 has some limitations: the present problems of appointing supervisor, disposing the supervisors, supervisor's works. Therefore, the aim of this study is to improve the present supervision system for mix-use residential building. By implementing the proposed revised supervision system, it will be able to expect quality improvement, confidence of the owner and the user, development of construction technology, and increase international competitiveness of supervision company.

Constitutional Limits of the Medical Fee Payment System and the Unconstitutionality of Fixed Payment System (진료수가제도의 헌법적 한계와 정액수가제의 위헌성 -헌법재판소 2020. 4. 23. 선고 2017헌마103 결정을 중심으로-)

  • In the health care system, medical fee payment is a very important and basic factor. The National Health Insurance Act adopted a contract system, and the content of the contract is to be determined the unit price per relative value scale. Accordingly, in the National Health Insurance system, the costs of health care benefits are adjusted each year according to inflation or changes in economic conditions. On the other hand, in the Medical Care Assistance system, the Medical Care Assistance Act does not prescribe the method of determining the medical payment, and all matters are delegated to the Minister of Health and Welfare. Accordingly, the Minister has adopted a fixed-payment system for hemodialysis treatment since 2001. A constitutional petition was filed in 2017 against this fixed-payment system, and the Constitutional Court rejected the petition in 2020. In this study, we examine the meaning and content of the medical fee payment system, focusing on the above constitutional petition case, and present three principles as constitutional limits on the system. The first of its principles is the principle of legality, the second is the principle of prohibition of comprehensive delegation, and the third is the principle of proportionality. From that point of view, There are many unconstitutional elements in the fixed-payment system on hemodialysis.

  • If the function of the national infrastructure is suspended due to natural disasters and social disasters, the damage of the national infrastructure can be a serious threat to the national security as well as the life, body and property damage of the people. In this paper, we examine the domestic and overseas trends of the national system protection system and examine the domestic and overseas trends of the national system protection system. The detailed function of the essential function continuity, essential function, succession order, authority delegation, continuity facility, continuity communication, We examined the specific issues related to testing, education and training, transferring control and directing authority, analyzing the system related to the national infrastructure protection plan, and examined the specific problems and suggested an effective improvement plan for the critical infrastructure protection system.

Participatory Budgeting's Types and Policy Implications by Participatory Institutions and Participatory Levels (참여기구와 참여수준에 따른 주민참여예산제도의 유형과 시사점)

  • Participatory budgeting has been introduced and proliferated with differentiated types by Local Finance Act which had been revised in 2011. This study aims to classify the types of Participatory Budgeting by participatory institutions and participatory levels and suggest the implications. We have reviewed the participatory budgeting operation ordinances, operating plans and operating systems of 243 local governments. And the participatory budgeting can be divided into five types. First, submission of opinion type found in 100 local governments is characterized by operating without participatory institutions. Second, commission type found in 85 local governments is characterized by having only participatory budgeting committee. Third, regional meeting type found in 21 local governments is characterized by having participatory budgeting committee and regional meeting or only regional committee. Fourth, public-private partnership type found in 30 local governments is characterized by having citizen-government meeting. Fifth, delegated power type found in 7 local governments is characterized by having policy fair or mobile voting, or both. Analysis showed that institutionalization levels of participatory budgeting is not high because many local governments(76.5%) are belong to submission of opinion type or commission type in South Korea. For developing participatory budgeting, participatory institutions, such as citizen-government meetings, policy fair or mobile voting, should be adopted and proliferated in more and more local governments.

An effect of the internal marketing policies of financial institutions on the job satisfaction and customer orientation of employees (금융기관의 내부마케팅정책이 종업원의 직무만족과 고객지향성에 미치는 영향에 관한 연구)

  • This study examined the effect of the internal marketing policies of financial institutions on the job satisfaction and customer orientation of employees. Many studies have examined internal marketing policies. On the other hand, these studies focused the employees in the service industries (e.g. travel agencies, airlines and hotel, etc.) With the drastic change in financial institutions in recent years, financial institutions are conscious of the importance of customer service and have increased their efforts to manage and train their employees (e.g. expansion of empowerment, education and training, management support, and compensation system). The authors conducted an empirical analysis based on the assumption that these internal policies are effective in increasing the job satisfaction of employees and further influence the customer orientation. The results showed that 'empowerment, management support and compensation system' of internal marketing policies have meaningful effects on job satisfaction, whereas the education and training does not. In addition, job satisfaction has a meaningful effect on the customer orientation and on a mediating effect between internal marketing policies and customer orientation. These results indicate that the internal marketing policies of financial institutions can help improve job satisfaction and customer orientation.

A Comparative Study on the Legislative System of IPRs Management of government R&D outputs in Korea and U.S.A (한.미 국가연구개발사업의 지식재산권 관리제도 비교)

  • With the advance to the knowledge-based economy, science and technology (S&T) has been recognized as key factor in a nation's competitiveness. To cope with this kind of new trend Korean government has tried to increase the R&D investment and to streamline acts and regulations concerning national R&D activities. Korea's total R&D expenditure for the year 2007 amounted to about 31.3 trillion won including government R&D of 8.9trillion won. With these efforts the capacity of Korea S&T has made great strides recently. Korea was ranked world's top 7 in R&D investment, top 12 in S&T paper publication and top 4 in patent application. Korean government enacted several pieces of legislation concerning S&T : the "Technology Transfer Promotion Act (1999)"; the "Framework Act on Science and Technology (2000)"; and the "Presidential Regulation for Managing the Government R&D Programs (2001)." In addition, the government has put a lot of effort into promoting the commercialization of technologies developed in public sector and improving the infrastructure of technology transfer and commercialization. However in spite of these various efforts, the technologies obtained from the public sector have not been transferred to the industry properly. Only 24.2% of technologies developed in the public for the year 2005 were transferred to industry. The royalty revenues of the public for the year 2005 was 1.5% of their total R&D expenditure. It shows only a third of the percentage of royalty revenues for the public sector in the U.S.A. and a second of Europe. There are many obstacles of public technology transfer such as immaturity of technology market, lack of licensing experience, and inadequacy of legal system and government policy. In this study I compared the Korean legislative system of patent management of government R&D outputs with the American system, derived problems from Korean system, and suggested proper alternatives.

Strategy for Improving Forestland Classification System in Korea (산지이용구분제도의 개선방안 연구)

  • The objective of this study was to analyze 'Forestland Classification System' in Korea and to develop a strategy for its improvement. A survey was conducted in this study based on the Delphi technique, one of the interactive survey method relying on a panel of experts. The result indicated that the existing 'Forestland Classification System' was initiated for reasonable management of forestland, but now it turned into one of the most strict management restrictions. To improve forestland management in Korea, it was suggested to adopt 'Forest Function System' in this study. Moreover, to avoid indiscreet landuse conversion that might be occurred by substituting the 'Forest Function System' for the 'Forestland Classification System', it was suggested to adopt 'Forestland Conversion Propriety Assessment System'. In fact, landuse conversion has been regulated by the 'Environmental Impact Assessment System', but this system appeared inadequate to be applied to the forested area. Illegal acts for having permission of landuse conversion for reserved forests was another big issue in the forestland management. For example, alteration of the reserved status of forests or partition into patches smaller than the size limit has been attempted. Thus in this study, it was strongly recommended to take sanction against such illegal acts. In order to enhance the efficiency of forestland management, it was also suggested to integrate administrative agencies related to the landuse conversion or to take over the charge to local governments.

The Effects of Internal Marketing Activities by Contracted Food Service Management Company (위탁급식전문업체의 내부마케팅 전략에 관한 효과분석)

  • The purpose of this study were to a) clarify the current practice of internal marketing by contracted food service management companies, b) analyze the effectiveness of current internal marketing practices. The survey was conducted between October 12 and November 2, 2002 with the 10 contracted food service management companies; 6 large, and 4 small & medium sized companies. No significant difference was existed with the categories of internal marketing. However significant differences were existed with the service education, sanitary education, periodic interviews, rewards for best employees, incentive payments, paid -leave allowances, job function allowances, and position classes including unit manager, dietician and cook of MBO. The actual administration of internal marketing strategies showed that, the significant differences were existed with education, paid-leave, and employee welfare systems among position classes. Also the significant differences were existed with all categories of internal marketing between large and small & medium sized companies. In general, small & medium sized companies score of the internal marketing performance was lower than that of large sized companies. Therefore, the segmented internal marketing strategies depending on the analysis not only demand for employees but also the size of company, were required to be an effectively and efficiently managed contracted food management companies.

Incentive Structures in the Compensation for Public Expropriation (공공수용 보상에 관한 유인체계 분석)

  • We study incentive structures of public developers and land owners in the process of public expropriations using a sequential game model. In the model, we show that there is an incentive for the public developer to give more compensation than just compensation that are defined by law. Also the model shows that there is an incentive for the land owners to revolt strategically against the public expropriation. Then an ideal authority delegation model is introduced to resolve the problems, where an independent appraiser determines the compensation for the expropriation. In the real world, improving the independence of appraisal process is critical to make the system closer to the ideal authority delegation model. So this paper concludes by making a few policy suggestions to improve the current appraisal system.
