외국인선원 관리제도의 문제점 및 개선방안에 관한 연구

  • 이 연구는 우리나라 외국인 선원관리제도의 현황을 고찰하고, 제도상의 문제점과 개선방안을 외국인 선원을 고용하고 있는 선주회사와 선박관리회사 그리고 선원관리회사 대상의 설문조사 결과를 분석하여 제시하였다. 이러한 연구결과는 외항상선에 승선하는 외국인 선원에 대한 보다 효율적이고 체계적인 관리에 기여할 수 있을 것이다.

A Study on the Problems and Improvements of the Management System for Foreign Seafarers Boarding Korean Ocean-Going Vessels (우리나라 외항상선에 승선하는 외국인 선원 관리제도의 문제점 및 개선방안에 관한 연구)

  • This study investigated the current status of the management system for foreign seafarers boarding Korean ocean-going vessels and analyzed the problems and suggested measures for improvement through the survey of shipping companies, ship management companies, crew manning companies and related associations. The conclusion is summarized as follow. First, it is necessary to reorganize and apply the collective agreements or the laws applicable to the foreign seafarer separately in regard to the foreign seafarer related laws and collective agreements applied in the same way as the Korean seafarer. Second, it is necessary to change the decision-making to shipowner in deciding on the number of foreign seafarers employed by the Korean ocean-going vessels or if the decision-maker remains the same, the relevant laws must be clearly defined pertinent to the decision-maker. Additionally, the number of foreign seafarers should be applied for each position and ship's type. The third is to expand the recognition arrangement for certificate of ships' officers to Eastern Europe and Asian countries to expand the range of options for hiring foreign seafarers. The fourth is to prevent the waste of administrative manpower by simplifying complicated and unnecessary administrative procedures from hiring and boarding of foreign seafarers. The fifth is to establish a systematic training and education system for foreign seafarers in cooperation with related shipping companies and government authorities, associations and so on. This study will contribute to providing a more efficient and systematic management of foreign seafarers boarding Korean ocean-going vessels.

A Study on the Systematization of Education after the Entry of Foreign Seafarers who is On-boarding in Ocean-going Merchant Vessel in Korea (외항상선 외국인선원 입국 후 교육의 체계화에 관한 기초연구)

  • In line with the transformation of the shipping industry, the number of mixed-manning ships is on the rise - bringing foreign sailors aboard with their local sailors. During on-board work, a culture is formed according to mixed-manning, which leads to changes in on-board living environment. This causes various problems such as communication problems, and lack of education and training. In order to identify and solve problems caused by mixed-manning, this study presented a plan for systematic education of foreign seafarers. The officials in charge of the affairs of foreign sailors conducted questionnaire surveys at various shipping lines. The questionnaire survey results were analyzed using the IBM SPSS Statistic 26 program. Three improvement measures were proposed to solve the problems after identification of the types of education, education methods, and problems of foreign employees. This study revealed that it is imperative to systematize related education of foreign seafarers based on the results of the survey.

Supercargo and Temporary Passengers (화물관리인과 임시승선자)

  • This research paper examines the history and present of 'temporary passengers' prescribed in Paragraph 9 of Article 5 of the Ships Safety Act Enforcement Regulations and suggests improvement plans referring to the examples of legislation of other countries. In 2015, Ministry of Ocean and Fisheries made authoritative interpretation that Paragraph 9 of Article 5 of the Ships Safety Act Enforcement Regulations, which prescribes special cargo drivers such as agricultural, marine or livestock vehicles as temporary passengers, is applied only to passenger ships and not to cargo ships such including Ro-Ro cargo ships. As the authoritative interpretation of the Ministry does not agree with not only the traditional interpretational methodology but also the interpretational methodology that are commonly used today, it lacks logical basis and looks unpersuasive. Paragraph 9 of Article 5 of the Ships Safety Act Enforcement Regulations can be applied not only on passenger ships but also on cargo ships. Also in case of Ro-Ro cargo ships, it is logically contradictory and against fairness not to acknowledge special cargo vehicle drivers as temporary passengers when there is no problem with safe navigation and safety of passengers on board even when the sailor, the sailor's family and the ship owner may be acknowledged as temporary passengers. To avoid unnecessary disputes and lawsuits, improvement plans using theory of legislation through statutory reform is more desirable. Therefore, the P aragraph should be amended to "Supercargo who deals with cargo that requires special care due to the characteristics of the cargo, such as transportation vehicles for agricultural products, marine products, livestock, explosives or flammable materials (drivers can serve as supercargos)" to reflect the distinct characteristics of cargo and ship navigation in Korea including the current distribution system, while setting an objective standard based on common sense of ordinary people and not on arbitrary interpretation.
