  • PLM과 ERP의 정보 및 프로세스 통합은 개개의 기여도 함보다는 훨씬 큰 종합적인 이익을 가져오기 위하여 조직 전반에 걸쳐서 사용자들의 생산성을 제고한다. 그러나 이러한 이익을 얻기 위하여 정보는 조직을 통하여 자유로운 흐름이 있어야 한다. 이러한 통합의 범위를 결정하는 것은 복잡한 작업이 될 수 있다. 반드시 고려되어야 할 인자로는 다음과 같다. - 데이터 및 포로세스 소유권 - 정보의 마스터 출처 정의 - 필요한 통합 수준 - 제품 설계 및 생산의 두 영역에 걸쳐있는 프로세스를 어떻게 관리할 것인가? - 공통된 용어를 사용 각 회사에서 PLM과 ERP를 통합하는 최상의 방법을 결정할 때, 필요로 하는 것에 우선권을 두어야 한다. 즉, 희망하는 것 보다는 비즈니스상 요구되는 사항에 대한 것이다. 개발, 초기적용, 진행중인 유지보수를 포함하여 소유총비용(total cost of ownership)을 계산한다. PLM-ERP 통합은 데이터 통합 그 이상의 작업임을 명심하여야 한다. 이익을 최대화하기 위하여 제품과 관련된 정보, 프로세스. 조직 및 구성원의 광범위한 범위를 포함하여야 한다. 기업의 진취적인 노력에도 불구하구, 경영진의 지원은 성공에 결정적이다. 고심하고 있는 경영진이나 문제들을 인정하고 있는 사람들은 제품개발 프로세스 내에서 PLM과 ERP 통합의 필요성, 솔루션 및 이익에 대하여 필요한 교육을 제공받는 것을 필요로 하고 있다. 더욱이 그들은 성공을 보장하는 통합, 지침제공, 후원 및 자원의 사전 행동하는 지지자가 되기를 희망한다.

A Study on 'Romalpa' Clause under SGA (SGA상 'Romalpa' 조항에 관한 연구)

  • This study examines Romalpa clause as an extended or enlarged retention of title clause under SGA. Under a simple retention of title clause, the seller retains title to goods supplied until the goods have been paid. A simple retention of title gives the seller super-priority interest in other creditors of the buyer without registering a charge. Aluminium Industrie Vaassen BV v. Romalpa Aluminium Ltd introduced the concept of 'extended reservation of title(so called 'Romalpa clause') in English law. It is because the Court of Appeal held that under an extended reservation about title clause the seller can trace his title into money which constitutes the proceed of sale by the buyer of goods supplied by the seller. However, since Romalpa case, the courts are reluctant to uphold the seller's extended title. Under Romalpa clause, the seller attempts to extend his protection by laying claims to new products manufactured from his goods or to proceeds of sale by the buyer. Where the seller's goods are lawfully used by the buyer to create new goods, the property in the new goods will generally vest in the buyer. It is because there has been discomfort if the seller gains the windfall profit of the new goods. Moreover, regarding tracing proceeds of sale by the buyer, the courts held that the seller must establish fiduciary relationship with the buyer. If the fiduciary requirement cannot be established, the extended retention of title clause is seen as a charge over the proceeds, and void if not registered. For these reasons, it is difficult that the claims based on the extended retention of title clause would be upheld.

International Legal Status of U.S. Citizens Property Right to Space Resources (미국 국내법령상 우주자원 소유권의 국제법상 의의)

  • Space Treaty Article 2 stipuates non-appropriation by sovereignty, and in any other means. Interpretative controversies has continued as regards the meaning of any other means. It is not clear whether appropriation by private entity is also prohibited or not. Furthermore, the controverse around the binding force of Article 1 has made worse the controversy regarding such appropriation. U.S. Congress has enacted the law regarding the space resouce mining in 2015. Its main purpose is to alleviate legal unstability which U.S, private companies have faced, and it provides some provisions regarding private rights about space resources. Original bill, H.R. 1508 included the property right. Amendment to the bill is to ensure that an "asteroid resource utilization activity" is inter-preted as on a single asteroid and not on any asteroid. The use of the word "in situ" in defining space resources simply means resources in place in outer space; but any such resource within or on an asteroid would need to be "obtained" in order to confer a property right. The use of the word "in situ" in merely defining a space resource in the bill is not equivalent to claiming sovereignty or control over celestial bodies or portions of space. Further, there is clear Congressional direction in the bill that the President is only to encourage space resources exploration and utilization, including lowering barriers to such activity, "consistent with" and "in accordance with" US international obligations. Federal courts are granted original jurisdiction over entities defined in ${\S}$ 51301(4) and in-situ asteroid resources that have been removed from an asteroid by such entities. Federal courts are not granted jurisdiction over outer space, the Moon, other celestial bodies, or the asteroid from which the in-situ natural resource was removed. It is said that the Space Resource Utilization Exploration Act of 2015, talked about the rights of private players to own-kind of a "finders keepers" law.

  • It seems extremely incongruous that genocide, crimes against humanity and war crimes could ever be justified or excused by 'defensive force'- self-defence, defence of others and defence of property. Nonetheless, art 31(1)(c) of the Rome Statute of the International Criminal Court codifies defensive force as a ground for excluding criminal responsibility. This provision was controversial and extremely difficult to negotiate at the Rome Conference of 1998, largely due to the conceptual differences that exist in respect of criminal defences between the various domestic legal systems of the world. This paper analyses the drafting history and wording of art 31(1)(c) in order to clarify the precise scope of defensive force under the Rome Statute. It then seeks to ascertain the applicability of the provision to genocide, crimes against humanity and war crimes, and to thereby explore the nature of these crimes and the intended prosecutorial strategy of the International Criminal Court.

A study on the 3D- cadastre surveying by GPS (GPS를 이용한 3차원의 지적의 도입방안과 문제점)

  • When cadastre system was first introduced in Korea, we only uses the surface of the land and thus its form was very simple. Nowadays on account of the development of architectural technology, the rapid expansion of population and urbanization, the cubic utilization of land including the land usage of underground and surface space is widely settled. This article studies the function of cadastre and public notice to encourage cubic utilization of the land, argues the necessity of 3D-cadastre system to protect property right, and suggests the GPS land measurement as a possible measure.

  • It is anticipated that there will be radical disputes over land ownership in the event of the advent of the era of UAM. As such, policy alternative is presented by analyzing and researching relevant laws at home and abroad on the means of legislating 'Regulations on compensation for use of air space above land' in preparation of such occurrence. As the results of the study, it is deemed to limit the range of the land ownership in accordance with UAM operation as follows. First, it is proposed to newly enact regulation to limit the ownership of air space of land owner to the public space above the elevation of 200m as stipulated under the Article 78 of the Aviation Safety Act. Second, as the result of analysis made for the option of making compensation from the perspective of the property right of land ownership and option of not making compensation from the perspectives of public interest and concerns in the event of operation of UAM within the air space below the elevation of 200m, it is deemed that legislative decision is necessary through more extensive studies in the future.

  • 본 연구에서는 수변구역의 효율적인 관리를 위하여 토지에 대한 자연적인 형상을 나타내는 수치정사 영상과 필지를 중심으로 토지에 대한 물리적 현황 및 소유권이 미치는 범위를 나타내는 지적도면을 중첩한 수치정사영상지적도의 제작방법의 효율성을 모색하였다. 이를 통하여 수변구역 경계관리를 위하여 작성된 수치정사영상지적도는 수변구역의 경계관리 목적 이외에도 다양한 분야에서 매우 광범위하게 활용될 수 있을 것으로 기대된다. 또한 향후 지적재조사사업 시행시 임야 및 농경지의 경계를 새로이 설정할 경우 경제적이고 시각적이며 활용적인 측면에서 매우 효과적인 방법임을 확인할 수 있다.

  • 인터넷 사용의 발달로 디지털 미디어 영상에 대한 불법 복제, 불법 배포 등의 문제가 완연해짐에 따라 영상의 제작자의 소유권과 저작권을 보호할 수 있는 워터마크 기법이 많이 연구되고 있다. 워터마크 시스템은 워터마크 삽입 후, 삽입정보를 알 수 없어야하는 비가시성 특성과 여러 공격에도 훼손되지 않고 추출될 수 있는 강인함을 가지고 있어야 한다. 이에 본 논문은 이산 웨이블릿 변환(DWT)으로 생성되는 부대역의 점유 주파수대역 특성과 공격이 이 부대역들에 미치는 영향을 분석하고, 이를 사용하여 디지털 워터마킹을 수행하였을 때 추출률을 최고로 하기 위해서는 변환된 부대역이 특정 범위내의 해상도를 가져야 한다는 것을 보인다. 본 연구는 실험적 방법으로 모든 부분연구는 실험에 의해서 결정된다.

  • 디지털 전환 시대를 맞아 일상생활 대부분이 온라인으로 이동하면서 온라인상에서 자신을 나타내는 신뢰할 수 있는 신분증의 필요성이 커지게 되었다. 신원 확인 방법은 중앙 집중식 모델에서 현재는 자기주권신원 모델로 변화하는 과정에 있으며 사용되는 핵심 기술은 탈중앙 식별자 DID(Decentralized Identifier)이다. DID는 기존 신원 체계와 달리 개인의 데이터 소유권을 개인에게 돌려줘 데이터 주권을 지킬 수 있게 해줌으로써 개인의 정보 공유 범위를 결정하는 SSI(Self Sovereign Identity)를 실현하는 기술이다. DID를 이용하면 데이터의 무결성, 투명성을 보장하는 자격 증명(Verifiable Credential, Verifiable Presentation) 발급이 가능하며 이를 검증하는 데이터는 모두 블록체인에 올라가 있는 것이 특징이다. 본 논문에서는 실제 서비스와 유사한 시뮬레이션 환경을 구축하여 자격 증명의 사용자 프라이버시를 보호하는 방법인 BBS+서명 기법에 대해 알아보고자 한다.

Litigation for Determination of Boundary under German Law (독일법상의 경계확정소송)

  • There is no provision regarding the 'litigation on land boundary' under the Korean laws. Therefore, there are disputes in theory with respect to its nature, requirements for litigation, criteria for determination, etc., and it is necessary to establish the provisions of the law on this issue in the future. For this legislation, it is necessary to conduct a comparative consideration on laws of other countries which have completed the relevant provisions. This study, as a first step, researches a history of litigation for determination of boundary under the Roman law and medieval law, and furthermore introduces the German law which has relatively completed legal provisions on litigation for determination of boundary. In addition to common ownership litigation, the German law has established a provision on litigation for boundary as a judicial procedure considering a special place, called as a dispute on ownership of adjacent land, on the assumption that it is difficult or impossible to prove the boundary. The primary purpose of this litigation is to clarify a true boundary, and if such clarification is impossible, a boundary is discretionally created in accordance with the statutory standards under Article 920 of the German Civil Act (BGB). It means creation of the scope of land ownership by operation of decision, not only by the 'discovery of original boundary'. Both cases are different from each other in the aspect of judicial decision, but embracing them into one is a lawsuit for determination of boundary under the German law. Under the Korean legislation, it is necessary to make a theory containing two different criteria for determination into a single type of litigation, considering such aspects.
