  • The current juvenile law has to be improved in the following respects: First, there is no clear and objective basis for the process divided into criminal and protective dispositions. Second, the spirit of legislation to protect the boy is understandable, but when reviewing the application process of the juvenile law to actual juvenile crimes, it is hard to find such spirit. Third, in dealing with juvenile protection cases, the outcome and process of disposal should be reflected in the boy's protection ideology. Finally, efforts should be made to shorten the processing period of the case, curb the transfer of violent criminals to juvenile detention center, and integrate the latter part of the first and sixth disposition.

  • Taking the perspective of children's welfare, this study aimed at critically analyzing the system of notification disposition which institutionalized children have experienced. Notification disposition is a juvenile justice process that, when a child (10 th 18 years old ) has been delinquent or is at risk for delinquency, is initiated without investigation or prosecution procedures by direct notification to a judge from the caregivers, school principals, chief probation officers, or directors of child care institutions. The data used in the analysis included case records of probation offices, and court sentencing documents of juvenile protective dispositions. Results showed that notification cases were initiated by directors of child shelters/care institutions. The most common reasons of notification were theft, runaway, physical violence, drinking, and smoking. Furthermore, there were more controversial reasons, such as "bad influence on another institutionalized children", "showing no remorse", "no sense of guilt"and "challenge of rearing in institutions" Based on the results, we discussed three problematic aspects of the direct notification system by directors of childcare institutions : (1) too much reliance on the judicature judgment of juvenile court; (2) less stability of the judicial status of notified children, and (3) inadequacies of the notifying eligibility for directors of child care institutions.

  • This study conducted a comparison analysis of the differences by scope between juvenile delinquents, under sentence of juvenile protective disposition, and normal middle high school boys' self-esteem and sociality; it aims to search for the correctional policy to prevent juvenile delinquency. I conducted a survey, as a sampling target, of students (84) at Daedeok Juvenile Reformatory, located in Daejeon-si, Korea, and the normal middle high school boys (230). The results of analysis showed that in the analysis of self-esteem difference, juvenile delinquents were found high in the global self-esteem and school-academic self-esteem, but the normal adolescents were found high only in the scope of family-parents self-esteem. In leadership, a subordinate scope of sociality, juvenile delinquents showed the high result, and in independence and cooperativity, normal adolescents were found high. In conclusion, as the distinction between self-esteem and sociality is different by scope, depending on the individual's characteristic and environment, it suggests that the correctional policy through the customized plan is effective at preventing delinquency.

  • The purpose of this study is to understand in depth the gambling experiences of delinquent juveniles who have dropped out of school and analyze the content and meaning of gambling experiences. Thus, utilized a Giorgi's phenomenological research method. Data was gathered through in-depth interviews, and the gambling experiences of six youths who are under juvenile law protective disposition were examined through a four-step analytic process. From the results, 6 parent components and 18 sub-components were derived. That is, "the temptation of close gambling", "trapped in the bridle of gambling", "deterioration of life", "damaged of non-official networks relationship", "corruption of existence" and "attempts to escape gambling" were appeared. These results are meaningful because they have allowed researchers to identify the essential meaning and experiential structure of delinquents juvenile' gambling experiences outside of school, which has not been studied thus far. Further, this study has empirical value as its framework includes a joint analysis in terms of welfare and gambling addiction and focuses on a precarious population-delinquent juveniles who have dropped out of school. The results provide a foundation from which practical implications and policy alternatives for the prevention and treatment of gambling problems in delinquent juveniles dropped out of school.
