Legal System Reasearch Relating to Retaliatory Crime (보복범죄 관련 법제연구)

  • Social unrest from retaliatory crimes is increasingly becoming problematic. Recently, there was an accident involving a suspect who went to a hospital and committed acts of retaliatory violence 11 times. This person's reasoning was that he was imprisoned due to the hospital's reporting to the police. He was consequently arrested in Boeun Choongbook on December 27th 2014. Accidents like this one take place frequently around our surroundings. There are regulations and systems in place. Nevertheless, similar cases that continue to take place makes us wonder if criminal judicial systems work well. Lukewarm responses to retaliatory crimes is not only threatening social security, but also placing fears in the minds of ordinary citizens. If retaliatory crimes take place, most citizens become apprehensive about criminal judicial activities of the police and mistrust for criminal judicial system. This at times discourages people from reporting incidents and could eventually increase crime rate and cause various social problems. Even though there are legal and systemic control measures, retaliatory crime is an increasing trend. This study is going to examine tendencies of internal retaliatory crimes and discuss legal-systemical responses.

Factors Influencing Health Risk Behaviors of the Chronic Mental Illness in the Community (지역사회 만성정신질환자의 건강위험행위 영향요인)

  • The study was done to identify factors influencing the health risk behavior of the chronic mental illness in the community. A cross-sectional study design was used in this study. The sample was 255 chronic mentally ill persons from D city and C province and who agreed to participate in the study. Data were collected on August-september, 2011 and analyzed using the SPSS/WIN 20. Stress event, insight and depression had significant correlations with health risk behavior. Hierarchial regression analysis showed gender (men), diagnosis (schizophrenia), stress event, insight and depression together explained 24% of variance in health risk behavior. Findings of this study allow a comprehensive understanding of health risk behavior of the chronic mentally ill persons in community. It is necessary to integrated health promotion programs designed for this population should focus on these factors for effective behavioral modification.

  • The demand that needs 'Digital Legacy', a notion that an Internet user can transfer his private blogs, e-mail and financial assets to inheritors and party interested when he died suddenly in the accident, has been growing recently. This issue has become a social hot potato since Justine Ellsworth's father in USA sued Yahoo for the right to access his son's Yahoo e-mail account after Justine Ellsworth had died in Iraq, in November, 2004 and the problems happened to deal with suicide-related blogs and homepages when great entertainers in Korea committed suicide and soldiers' parents in the situation of warship Chonan tragedy in Korea demanded access to soldiers' homepages and e-mail accounts. The point at issue focuses on the property matters about the digital information of the deceased and the relationship between the deceased and the Internet Service Provider(ISP). This research looks into the trend of judicial precedents and laws related to the digital information of the deceased and suggests the preliminary data of the next research.

Social Discourse Analysis on Title and Role of Library: Focusing on Controversy over 'The Forest of Wisdom', Paju Bookcity (도서관 명칭과 역할에 대한 사회적 담론 분석 - 파주출판도시 '지혜의숲'에 대한 논란을 중심으로 -)

  • This study used social discourse analysis and analyzed social discourse on library reflected in media, social media, interview and diary of persons concerned, particularly focusing on controversy over whether 'The Forest of Wisdom' should be called a 'library'. The study analyzed a three-dimensional framework, including media report that eventually developed a social 'discourse event', social media surrounding this issue, and interview with persons in the library community and publishing industry regarding discourse. This study draws a conclusion that 'The Forest of Wisdom' rather led social discourse over the role of library especially when traditional library is faced with new demands for discourse and changes. It is meaningful in that this issue provided an opportunity for library and the publishing industry to think over and develop ways for autonomous discourse that seeks their true value.

  • 오늘날의 경찰활동의 가치는 범죄통제에 초점을 두는, 즉 범죄진압을 강조하는 사건지향적인 경찰활동이라 할 수 있는 전통적인 경찰활동에서 순찰 등의 강화를 통한 범죄예방에 중점을 두는 지역사회 경찰활동으로 그 중심이 옮겨가고 있다. 이러한 지역사회 경찰활의 철학을 실천하는 전략으로서 문제지향적 경찰활동이 강조되고 있다. 이에 본 연구에서는 도시범죄와 관련하여 현실적으로 범죄문제에 대응할 수 있는 범죄예방전략인 문제지향적 경찰활동의 이론적인 틀을 모색하고자 하는데 연구의 목적을 두었다. 이를 위해 문제지향적 경찰활동의 기본적인 개념과 특징, 그리고 문제지향적 경찰활동 실천의 핵심인 SARA모델과 사례를 살펴보았다.

Problems in Psychological Debriefing and Suggestions for Best Practice (심리적 경험보고(debriefing)의 문제점들과 올바른 적용을 위한 제언)

  • This study introduces major models of psychological debriefing that has been utilized as an early psychological intervention after traumatic incidents and examines the controversy on the effects of psychological debriefing. It is difficult to make consistent conclusions regarding its effects based on the previous research data. Therefore, this study examines the major issues related to psychological debriefing and suggests the important points for best practice in crisis situations.

A Qualitative Study on Intervening Work Experiences of Hospital-Based Child Protection Team on Child Abuse Death Cases (병원 학대피해아동보호팀의 아동학대 사망사건 개입경험 연구)

  • The aim of this study was to explore the work experiences of hospital-based child protection team staffs who had intervened the child abuse cases resulting in death. In order to gather the relevant data, all 62 child protection teams registered nationwide were contacted and 5 teams which had actually experienced at least one child abuse deaths were found. The staffs (hospital social workers and doctors) who belonged to these teams were intensively interviewed, and the interviewed materials were thoroughly analyzed by qualitative research methodology. The result showed that treatment delay was the most important obstacle to prevent unnecessary deaths of the victims. Some abused victims were sent to the hospital only after their physical condition had so gravely deteriorated. In other cases, custodians' bland denial or refusal to treatment made impossible the timely intervention to save the child lives. Nevertheless, child protection team staffs' reasonable suspicion and active intervention could sometimes uncover the hidden truth that child abuse was the actual cause of death. These incidents were regarded as a team's meaningful accomplishments by team members. Meanwhile, lack of awareness and excessive burden about the role and responsibility of mandated reporter precluded medical staffs' active involvement. Also, substantiating the abuse suspicion by securing positive evidences was found to be a facilitatory factor for the rapid public intervention. On the basis of these results, several practice and policy implications were discussed to improve the early detection process, securing evidence and uncovering the actual cause of death in child abuse deaths.

  • Information society which came due to advance of Information Technology improved the social and economical productivity as well as the quality of national life. But behind the right function the adverse effect as cyber terror is serious and become a big issue. Recently, hackings on a big scale occur frequently. The personal information stored in Internet company is leaked and customers are badly damaged by paralysis of banking system. Also hacking attacks by North Korea occur frequently. It causes confusion in our society and a threat to national security. In this paper, the trend of domestic cyber terror is observed and the countermeasure against cyber terror is proposed.

Theoretical Re-inquiry on Gilles Deleuze's Thought about Alfred Hitchcock's Film (알프레드 히치콕 영화에 대한 들뢰즈 사유의 이론적 재고찰)

  • This paper has conducted a theoretical re-inquiry on Gilles Deleuze' thought about Alfred Hitchcock' film based on the image of thought in relation with the concept and theory about film. So, the purpose of this article is to explore that film can acquire the academic significance as a philosophy including an academic denomination of social science and Arts. According to the findings, Gilles Deleuze appeared that A. Hitchcock used the mental-image which can transform the perception-image, the action-image, and the affection-image in film and make the relation including the way which it is developed between character and event. Also, as the mental-image can change the meaning of film, camera is the essence and mental referent. And the mental-image makes the other images a specific frame, permeates into image and transforms it. This paper sets limits to some problems that Deleuze's thought about film generalizes to filmic theory, but has a importance to inquiry new research as a theoretical introspection for the practical discussion about the relation between film and philosophy.

Images of Law and Reality in TV Legal Series: Focusing on (TV 법정 프로그램에 나타난 법 이미지와 현실구성: <실화극장-죄와 벌>을 중심으로)

  • Can law be combined with television entertainment programs? This paper explores the ways in which law systems and law culture are reflected in and reflect the television legal series. TV legal series, such as legal dramas and infotainment shows, provide platforms for the audiences, who otherwise have few opportunity in real life, to engage with legal systems in societies. Adopting loosely dramatized reality programs, these legal series not only entertain and inform audiences but also educate citizens. This paper combines analyses of theoretical debates on law and television with analysis of TV text. The result shows that , dramatized enactment based on true stories and criminal cases, may have an important ideological role in which fictionalized dramas mask the hard realities and authoritative legal systems. By doing so, TV legal shows play their roles not as mere symbolic representation but as powerful institutions that construct the image of law and reality.
