The activity to share personal daily life through social media is becoming more common. In this case, photographs as well as text are used a lot; it has been as easy as winking to clip others' photographs just as it's very easy to take and post pictures. If the picture is the photographic work protected by the copyright law, however, the clipping should be paid close attention. If you use others' photographic works without authorization, you infringe their copyright; if you post them on your social media such as blog, you infringe the right of reproduction, interactive transmission and exhibition. Even though the clipping is permitted, if you'd like to use the photographic works for a profit-making purpose, you should get additional authorization. Others' photographic works are occasionally altered and used for the purpose of avoiding the argument in relation to the infringement of copyright; this act means that it's the infringement of the right of reproduction, the right to preserve the integrity and the right of the production of derivative works for degrees of alteration. We can download others' photographic works with a few mouse clicks thanks to the technology of capturing the screen; we have to recognize that all the acts technically possible are not always legal.

영상시대, 책에도 사진저작물의 이용이 늘어나면서 저작권 문제가 새로운 쟁점으로 떠올랐다. (본지 제231호 참조) 출판사들은 사진저작물의 이용 한계와 범위에 대해 정확히 모른 채 제작을 해온 것도 사실이다. 이 글에서 필자는 "본문과 필연성이 인정되는" 인용의 경우, 별도로 저작권자의 허락을 받지 않아도 사진저작물으 이용이 가능하다고 해석하고 있다. 이같은 해석은 저작권 문제에 새로운 논쟁의 단초가 될 수 있다. 많은 관심을 바란다.

The purpose of the study is to analyze the judicial precedents of the copyright relating to advertising focusing on the photographic works and find the characteristics of the legal principles of the copyright infringement or no. As the results of the analyses of the exact 6 precedents, the creativity of the works was the main issue of the judgment of the copyright infringement or no, comparing that 'on the basis' and 'practical similarity' were mainly applied the judgment. It is implied that the photographic works depending on the technologies are more difficult to prove their creativity, and the simple photo of the product itself without or lack of the photographer's creative effort and labor is not acknowledged as a copyrighted work in advertising area.

Upon ruling that two photographs of "Solsum(located in Samchuk city)" are not substantially similar, issues on the level of protection for the copyrighted photographs expecially on landscape, which appearance could be similar whoever takes, were raised. Accordingly, this study summarizes and suggests the standards of expression differentiating from idea on photographic works. The results are as such. Elements of expression on photographs are positioning of subject, framing, selection of camera angle, control of light's direction and quantity, length of exposure, speed of shutter, timing or posing of the shutter. kinds of emulsion, methods of development, and any other methods of creative and characteristic photography. On the other hand, elements of ideas of photographic works are theme, concept, feeling, appearance of objects, time or season of taking a picture, vantage point, choice of horizontal or vertical angle, etc. As a result, this study reconfirms that copyright law entitles photographers to copyright as to their minimal degree of creativity, not as to their sweat of brows.

Currently, the market of digital contents such as e-books, cartoons and webtoons is growing up, but the copyrights infringement are serious issue due to their distribution through illegal ways. However, the technologies for copyright protection are not developed enough. Therefore, in this paper, we propose the NSS-based publication classification method for copyright protection. Using histogram calculated by NSS, we propose classification method for digital contents using SVM. The proposed algorithm will be useful for copyright protection because it lets us distinguish illegal distributed digital contents more easily.

온라인상의 사진 저작물들은 쉬운 복제와 수정으로 인하여 지적재산권에 많은 침해를 입히고 있다. 본 논문에서는 사진가들의 저작권을 보호하고 사용자의 편리성을 제공하는 스톡사진 어플리케이션을 설계하고 구현하였다. 본 논문에서 설계하고 개발한 어플리케이션은 사진을 업로드/다운로드 할 수 있으며, 사진의 저작권을 인정할 수 있도록 사진의 정보를 담아 사용자의 거래 간에 사진의 정보도 같이 전송한다.

In order to solve the problems that fingerprinting technologies and image identification technologies for digital music and videos identification scanned have not yet been enough to identify scanned cartoon books, the copyright project granted from the Korea Copyright Commission(Project title: Identification and Copy Protection Technology of Scanned Text/Comic Books) secured basic solutions for scanned cartoon books. The first result of the research project in 2013 was focused on the identification technology applied to abnormally scanned cartoon books. As subsequent research for the project, studies in the year of 2014 has been to provide solutions to identify cartoon books which abnormally scanned and occurred with transformations and distortions and solutions to protect the system from trials to devitalize functions of the identification system through various attacks. This paper is to propose a model for a system for identifying abnormally scanned cartoon books as a way of enhancing the identification rates for identifying abnormal bookscans and transformation attacks.

인터넷을 비롯한 통신기술의 비약적인 발전과 보급, Mpeg, Jpeg 등의 멀티미디어 데이터 압축기술의 발전으로 인하여 문서, 사진, 동영상, 오디오 데이터 등의 다양한 매체들이 디지털화되어 고속으로 전송이 가능하게 되었다. 이러한 멀티미디어 컨텐츠(Multimedia Contents)에 대해 누구나 쉽게 저장과 접근, 이용 가능하게 됨으로써 저작물에 대한 소유권 문제가 큰 이슈로 부각되었다. 본 논문에서는 이러한 멀티미디어 데이터의 저작권을 보호하기 위한 방법들을 살펴보고 각 기법의 특성을 고찰한다. 또한 각 기법들간의 관계 및 체계를 분류하고 저작권 보호에 효율적인 워터마킹(Watermarking)기법과 스테가노그라피(Steganography) 및 핑거프린팅(Fingerprinting)기법을 비교 분석한다.

누드사진에 대한 저작물성을 판단하였던 대법원 1990. 10. 23. 선고 90다카8845 판결에서 소위 '음란물'을 저작물로서 인정하여 저작권법상에서 보호하기 시작하였다. 최근에는 일명 "음란물 등 헤비업로더 사건(대법원 2015. 6. 11. 선고 2011도10872 판결)"을 통해 음란물의 저작물성을 다시 한 번 인정하였고 이후 일본 AV제작사의 저작권 침해금지 가처분신청에서도 저작물성을 인정하였다. 하지만, 여전히 음란물의 저작물성 인정 여부에 대해서 사회적으로 논란이 있고 정보통신망 이용촉진 및 정보보호 등에 관한 법률에 의해 음란물 유통에 대한 형사처벌 조항이 있어서, 음란물 보호에 대해서 저작권법과 정보통신망 이용촉진 및 정보보호 등에 관한 법률이 충돌하는 양상이다. 본 글에서는 우리나라의 판례와 미국의 판례 등을 검토하여 현재 상황 속에서 음란물의 저작물성을 인정하는 것이 적절한지에 대해서 연구하려고 한다.

In order to succeed to the 'Traditional Play Series 1~9' by Prof. Sa Jinsil, this article sought the contact points between the traditional drama and the elementary drama education that Prof. Sa Jinsil held. The educational perspective of the prof. Sa Jinsil is reflected specifically in the seventh and eighth volumes. However, these educational perspectives are similar to those presented in the 2015 revised curriculum. It is also similar to the cultivation of humanities through theater education. In other words, the similarity is confirmed in that the target is creativity-interdisciplinary type human. The foresight of the prof. Sa jinsil in the education for creativity-interdisciplinary type human is confirmed. On the other hand, in order to cultivate creativity-interdisciplinary type human, it is also required to cultivate the ability to 'fun speaking' as well as 'logically speaking'. In this regard, I presented Jaedam, one of the Korean traditional plays, as an alternative. The reason for this is as follows; (1)It is possible to succeed Korean traditional theater performance style through regular class. (2)Students can develop emotional and empathy skills through fun speaking education. (3)Students will develop persuasive storytelling skills. At this time, the traditional play series 1~9, which contains the works of Prof. Sa Jinsil, and cultural ideas and educational ideas, will be useful.
