  • 도시의 발전으로 인해 시 도를 비롯한 시가 및 건조지역의 토지이용은 매우 복잡하게 변화되었다. 과거 농경이 주된 경제활동인 경우 주거지역은 매우 단순한 형태로 구성되었고 논, 밭, 산림 지역 등이 주를 이루었지만, 도시로 산업이 집중, 발달하고 인구가 밀집되며 주거지역, 상업, 공업, 교통지역 등 시가지역은 매우 다양하고 복잡하게 변화되었다. 도시가 발달하며 주거지의 건물가치와 상업 및 공업지역의 자산, 교통 및 공공시설의 공공적 가치가 상승하였고, 침수 발생시 사유재산 및 사회적 피해가 증대되고 있다. 시가 및 건조지역은 대부분 불투수율이 높은 지역으로 구성되어있으며, 이러한 도시에서 침수가 발생할 경우 지표수의 이동, 매설된 관거의 형상과 통수능에 의한 월류가 주된 원인으로 작용하여, 도로 및 건물의 형태에 의해 매우 복잡한 형태로 침수현상이 나타난다. 이러한 도시의 침수피해를 분석하기 위해 복잡하고 고 가치화된 도시의 토지이용 특성을 잘 반영한 침수 피해분석이 필요하고, 피해를 줄이고 재산을 보호하기 위한 치수시설의 도입에 따른 피해액 감소 및 경제성 분석이 우선시 되어 효율성과 타당성을 판단할 수 있어야 한다. 토지이용 특성이 반영되지 않을 경우 피해액을 다소 과소, 과대하게 산정할 수 있다. 홍수피해의 경제성을 분석하기 위한 방법에는 다차원 홍수피해 산정방법이 있으며, 경제성 분석은 하천의 정비상태, 하도 및 관거, 제방 및 유수지 등 홍수 방지시설 등 구조적, 비구조적 대책을 모두 대상으로 하여야 하며, 인명과 재산이 집중된 도시의 경우 보다 정확한 피해액을 산정할 필요가 있다. 본 연구는 과거 침수피해가 있었던 도림천 유역을 대상으로 도시지역의 유출모의에 적합하다고 알려진 SWMM 모형을 활용하여 도시유출 해석 및 침수현상을 분석하였으며, 다차원 홍수피해 산정방법을 활용하여 주거, 상업 및 공업자산을 반영하기 우해 토지이용 특성에 따른 침수피해액을 분석하였다.

  • The Yangsan Forest Management Station (YFMS) of Korean German Forest Management Project (KGFMP), working with the 6 legal villages of Uljugun, Kyongnam, led the forest owners in the area to organize the Forest Management Cooperative (FMC) voluntairily for improvement of private forest management and fostered it as a model from May 1975 to Apr. 1984. YFMS sent out FMC a forest manager as a forestry expert carrying out the leading extension program at the equal position with forest owners and gave FMC financial, administrative and technical assitances. During the 6 years from 1977 to 1982, 4 FMC were founded and are being operated democratically. 228 forest owners have taken the membership of their own free will and the forestland of the members covers 2,567 ha equivalent to 57% of the total private forest in the area. During the period the total area of the planting and tending is 4,185 ha, this means that a member executed 3.1 ha of forest operations per year in average, showing the high willingness on forest operations. In addition the joint works have resulted in the joint properties equivalent to 27 million Won and it will be an important foundation for operation of FMC which is a forest owners's cooperative organization for improvement of private forest management in this area. The total expenditure spent for the fostering of FMC amounted to 497,587 thousand Won and 58% of them were charged from KGFMP funds, 27% from the forest owners and 15% from public funds. The expenditure for investment was 273,104 thousand Won and 59% of the sum were appropriated as subsidies at the national level. The forest owners charged 43% of that and this means that each member invested approximately 100 thousand Won to his forestland per year in average. For the extension program 169,503 thousand Won were spent and it can be explained that 5,885 Won were spent per ha a year. The organization of FMC operated autonomously in a democratic way and the horizontal and leading extension system, which aspects the human rights, were very much effective in fostering the cooperative organization of forest owners for improvement of private forest management.

Because we decide on a course about completed inspection of hazardous substance, it is needed that adjust the task performed by a corporation of the exert skill and the duty performed by the task that a authorized corporation on the civil law or the commercial law To adjust the duty, the Fire Service Act, that is suitable to the purpose and principle, should constitute a measure of the duty. With the object of insure the safety of the hazardous substance, when the fire survice act establish a corporation of the expert skill. There is the will of lawmakers that need organization to have the power of the professional technology. The state excise the will that insure the safety of hazardous materials facilities on the basis of the professional technology and facilities, and construct to establish a corporation of the expert skill. Therefore as concentrate on the technology to need to insure the safety of the facilities of hazardous substance to be suitable on the purpose of laws and take responsibility and reports to a corporation of the expert skill.   • 기후변화로 인한 집중호우가 빈번히 발생하고 있으며, 도시지역에서는 호우에 의한 침수피해가 더욱 빈번히 발생하고 있다. 인구와 건물이 밀집한 도시지역은 불투수율이 높아 호우 발생시 홍수 위험도가 커지고 있으며, 침수에 의한 사유재산뿐만 아닌 사회기반시설에 대한 피해도 증가하고 있다. 도시는 건물과 건물 사이로 도로 네트워크가 복잡하게 설계되어있다. 이러한 건물과 도로들은 투수성이 떨어지며, 지하공간과 건물들이 발달하여 유역지표면의 가하학적 형상이 매우 복잡하게 변화하고 있다. 도시지역은 저류 및 침투능이 부족하고, 지역의 특성에 따라 내수배제시설이 부족하여 우수관망에 대한 우수배제의 의존도가 높으며, 호우에 의한 침수와 관거 월류에 의한 침수피해 발생시 우수는 도로를 따라 저지대로 흐르며 침수지역이 넓어지게 된다. 이와 같은 도시지역의 침수를 예측하기 위한 침수해석에는 지형의 높낮이, 형상을 고려한 예측이 필요하다. 특히 건물 및 도로망이 복잡한 지역일수록 지형이 정교하게 고려되어야 한다. 지형이 적절히 고려되지 않은 침수해석은 침수예상지역을 다소 과대 또는 과소하게 나타낼 수 있고, 침수심을 제대로 반영하지 못한 결과가 도출될 수 있다. 건물과 도로가 밀집된 도시지역에서 이러한 문제가 발생할 경우 예상치 못한 지역에서 침수가 발생하여 피해를 줄 수 있으며, 이는 곧 인명과 재산피해로 이어지게 된다. 본 연구에서는 과거 침수피해가 있었던 도림천 유역을 대상으로 지형자료의 해상도에 따른 침수분석을 실시하였다. 우수관망과 도시지역의 유출모의에 적합하다고 알려진 SWMM 모형을 활용하여 LiDAR(Light Detection And Ranging), 10m DEM, 1:1,000 수치지형도를 활용하여 지형상세도의 변화에 따른 침수모의를 실시하였다.

Case Analysis of Conflicts in Renewable Power Generation Projects Using Non-cooperative Game Theory (비협조적 게임이론을 활용한 신재생발전사업 갈등 사례분석)

  • The government is encouraging the expansion of renewable energy facilities through national renewable energy policy. However, the installation of renewable energy generation facilities has led to local resident complaints due to landscape degradation, electromagnetic wave emission, real estate devaluation, and environmental pollution. This creates conflicts between power project developers and residents, making the progress of projects more difficult. This study applies non-cooperative game theory to analyze eight cases of renewable energy projects where conflicts between developers and residents were resolved through resident's investment participation. By accepting investments from local stakeholders, residents achieved returns ranging from a maximum of 25 % to a minimum of 4.1 %. It was found through game theory analysis that a dominant strategy involves residents agreeing to the development of the project and the developers sharing a portion of the profits with the residents. The analysis results show that the point where dominant strategy meet forms a Nash equilibrium, and at the same time becomes the Pareto optimal point, benefiting both power generation operators and residents.

  • 암반 내에 공동을 굴착하여 LPG 혹은 원유를 저장하는 경우 공동에서의 지하수 유입량은 공동상부의 수압과 공동내의 가스압과의 관계를 파악할 수 있는 정량적인 지표가 된다. 공동내의 유입량은 되도록 일정하게 유지되는 것이 굴착등의 시공단계와 공동 운영 및 유지관리면에서 유리하며, 유입량의 급증 혹은 급감이 일어나는 경우는 그 원인을 조기에 규명하여야 한다. 이를 위해서는 지하수위, 가스저장압, 수막공 주입압 등에 따른 공동주변의 유동장 해석, 공동내로의 지하수 유입량 해석을 실시해야 한다. 지하저장공동의 유입량 해석에 있어서는 공동의 정확한 형상을 반영하기 위해서 유한요소법이 보편적으로 사유되어 왔으나 한번 설정한 유한요소망으로부터 공동의 설계요소를 변경하는 작업은 수원하지 않아 설계전단계에서 공동 및 수막 시설의 다양한 배치에 따른 모의를 수행하는데는 다소 무리가 있다. 이러한 불편함은 경계부의 형상과 조건만으로 내부점에서의 미지변수 계산을 효과적으로 수행할 수 있는 경계요소법을 도입함으로써 극복할 수 있다. 따라서 본 연구에서는 지하공동으로 배수되는 유입량 산정을 위해 경계요소법을 근간으로 한 2차원 지하수 흐름모형을 구성하였고, 이를 지하저장공동이 위치한 A기지에 적용하여 상부경계조건인 지하수위의 변화, 수막공 주입압 등에 따른 공동내의 유입량과 공동저장압과의 관계를 정량적으로 분석하였다. 분석 결과를 지하저장공동의 운영 및 유지관리에 활용될 수 있도록 수식화하여 제시하였다.

  • 우리나라는 깨끗한 상수원수를 확보하고 각종 오염과 유해물질의 유입을 원천적으로 차단하여 상수원의 수질보전을 위해 필요하다고 인정되는 지역을 상수원보호구역으로 관리하고 있다. 상수원 수질관리를 위해 상수원보호구역 내에서는 명백한 오염유발행위 일체를 금지하고 있으며 건축물 신축 등 개발행위에 대해서는 공익시설 및 보호구역에 거주하는 주민의 소득기반 및 생활환경 개선을 위한 최소한의 행위만을 허가하는 등 강한 규제를 시행하고 있다. 상수원보호구역제도의 상수원 관리효과와 비례하여 상하류 지역의 사회적 갈등에 대한 개선요구도 증가하고 있다. 상수원보호구역 내 강한 규제로 인해 상류주민들은 재산권의 제약으로 사유재산에 대한 형평성문제 및 수처리 기술개발이 향상되어 과거와 같은 강한 입지규제에 대한 합리적 규제기준 조정을 요구하고 있으며 하류 지역에서는 상수원보호구역의 완화로 인해 발생할 수 있는 수질악화를 고려하여 강한 규제의 유지를 요구하고 있다. 이와같이 상수원보호구역제도로 인한 상류와 하류의 이해관계가 달라 이에 대한 합의가 이루어지지 않고 있다. 본 연구는 상류주민들의 재산권제약에 대한 피해정도와 하류주민들의 수질보호로 인한 편익을 정량적으로 비교해 봄으로써 상수원보호구역으로 인한 사회적 갈등 조정에 대한 정책적 시사점을 도출하고자 한다.

The Actual Conditions and Improvement of the Eco-Forests Mater Plan, South Korea (우리나라 생태숲조성 기본계획 실태 및 개선방향)

  • This study was carried out to the actual conditions and improvement of the eco-forests master plan in South Korea, and suggested its problems and improvement direction. Results from survey and analysis of limiting factors or constraints in the construction plans of eco-forests in Korea revealed that there were highly frequent problems involving site feasibility, topographic aspect, and existing vegetation. The results of survey on the status of land use indicated that the average ratio of the use of private estate was 29.7%, so then it was estimated that a great amount of investment in purchase of eco-forest site would be required. Results from survey on major introduced facilities showed that there was high frequency of introduction of infrastructure, building facility, recreational facility, convenience facility, and information facility, and that there was low frequency of introduction of plant culture system, ecological facility, structural symbol and sculpture, and the likes. There was just one eco-forest park where more than 500 species of plants grew, and the result of investigation indicated that the diversity of plant species in 11 eco-forest parks was lower than the standards for construction of eco-forest. Results from analysis of the projects costs revealed that investment cost in facilities was higher than planting costs, and that a large amount of investment was made in the initial stage of the project. There was no planned budget for the purpose of cultivating and maintaining the plants and vegetation after construction of eco-forest. The basic concepts in construction of eco-forests were established according to the guidelines presented by the Korea Forest Service; however, the detailed work of the project was planned with its user-oriented approach. Then the construction of eco-forest was being planned following the directions, which would lead to development of a plant garden similar to arboretum or botanical garden. Therefore, it is required that the architect who designs eco-forest as well as the public officer concerned firmly establish the concepts of eco-forest, and that, through close analysis of development conditions, a candidate site to fit the purpose of constructing eco-forest be selected, and also a substantive management plan be established upon completion of construction of eco-forest.

Proposal for Amendment of the Basic Environmental Policy Act ('BEPA') Article 31 (환경정책기본법 제31조 무과실책임규정의 개정방안)

  • The Basic Environmental Policy Act (BEPA) (Law No. 4257 effective 1. August 1990) sets forth the basic policies and administrative framework for environmental preservation, leaving more detailed regulations, and emission controls to separate laws targeting air, water, and solid waste, etc. The BEPA Article 31 adopts an unprecedented strict liability standard for damages as an absolute liability. The BEPA Article 31 provides for liability as follows. If a company is alleged to have caused damage through pollution of the environment, it will be liable for damages unless it can show that the pollution did not cause damages, or that it did not actually cause pollution. If the company did cause pollution, and if the pollution is the cause for the damages in question, the company will be liable irrespective of whether it was negligent or otherwise at fault. If there are two or more companies involved in the pollution, but it is unclear which company caused the damages, all of the companies will be jointly and severally liable for the damages. In this paper, the author attempts to uncover the problems of BEPA Article 31 and then seeks desirable amendments by comparing it to the German Environmental Liability Act. First, it will be necessary to provide definitions of 'companies etc.'. Second, it will be necessary to enumerate the kinds of company facilities. Third, it will be necessary to provide exclusionary clauses on material damages. Fourth, it will be necessary to show 'presumption of cause and effect'. Fifth, it will be necessary to provide a clause on 'right to information'. Sixth, it will be necessary to provide a clause for force majeure. Seventh, it will be necessary to take measures to secure abundant liability for damages which can be caused by the owner of the facility, the potential polluter. Finally, it is appropriate that Korea now legislate an Environmental Liability Act akin to the German Environmental Liability Act.

A Design Aspects of Historic Parks Preserving Buried Cultural Heritages - In the Case of Neunggok Prehistoric Remains Park, Ansan Singil Historic Park, Yongjuk Historic Park - (매장문화재 보존형 역사공원의 설계 양상 - 능곡선사유적공원, 안산신길역사공원, 용죽역사공원을 대상으로 -)

  • This study derived the design aspects by carrying out the case study of Neunggok prehistoric remains park, Ansansingil historic park and Yongjuk historic park to which are taken measures to preserve undesignated cultural heritages after studying the related laws & regulations and the systems as the design conditions of historic park preserving buried cultural heritages. The results of the study are as follows. First, according to the laws & regulations related to the historical parks, the historic sites should be preserved and utilized at the same time and can have history-related facility spaces, squares, rest spaces, exercise spaces, education & culture space, and convenience spaces. Second, by the space organization and the circulation system emphasizing only the preservation of buried cultural heritages, the feature-preservation space and the functional space are separated and due to not accepting the usage behavior considering peripheral land use, the effectiveness of the historical park was low. Third, the passive feature-preservation methods such as the preservation of the exposed site in architectural methods, the reproduction of the dugout hut, and the planting Royal azaleas or displaying stone after covering up the location of the pit dwellings with soil and the usage mainly for viewing have weakened the identity of the historical park. Fourth, the fence preventing users' access interferes experiencing the features, and the vertical structure protecting the upper part of the exposed features has overwhelmed the landscape of the historical parks. Fifth, it was difficult to figure out the feature space only by the texts mainly on terminologies and the excavation photographs presented on the information signs which introduce the buried cultural heritages.
