  • Large accidents such as the recent to the ringing years Pat disaster they become apparent in the human resources, the cause of the accident is also the site corresponding manual member and management blind spots, are aggregated such as safety frigidity. Big problem is safe frigidity of workplace than accident. It is also a reason to introduce a punitive damages system in offices and business owners that caused the direct safety accident from this point. Punitive damages agent and compensation for mental damage, by so as to compensate for far more money than the actual damages, which carry a punishment nature to prevent a situation where the tort is repeated. Currently, it admits "compensatory damages system" corresponding to the damage that gave basically damage by law, but are subject to criticism that not properly relief victims. However, there is a need for the introduction of punitive damages system for safety accident prevention. This is, this system, while to prevent the recurrence of the reverse safety accident, strive to investment and management for safety, healthy companies can operate in the direction of giving more opportunities, national companies that are ignoring and threatening the safety, but to leave because the match also to social justice.

  • 대리운전업체에 소속되어 있는 대리운전자가 대리운전 보험에 가입한 경우, 보험료는 대리운전자가 직접 부담하는 경우가 대부분이나 계약당사자인 보험계약자는 대부분 대리운전업체로 되어 있다 보니 약관내용에 대해 제대로 설명을 듣지 못했다는 이유로 보상범위 등을 둘러싼 분쟁이 발생하는 경우가 많다. 본고에서는 차주가 동승하지 않은 채 대리운전자가 차량을 운전하던 중 발생한 사고를 대리운전보험에서 담보하는 '대리운전 중 사고'로 볼 수 있는지 여부를 다룬 사건을 소개하고자 하는데, 쟁점 가운데 약관의 설명의무와 관련 사항을 일부 언급하고 있어 동 내용을 살펴보고 나아가 약관 설명의무의 법적 성격 및 유사 분쟁사례 등을 개관하고자 한다.

  • Personal information is a requisite for financial transactions as well as a core asset of financial companies. However, as a side effect of the information society, personal information infringements have emerged as significant social risks, causing realized loss to individuals and companies. This study analyzes results of financial and emotional loss in terms of consumer loss and also presents usefulness of insurance in order to minimize such actual damages as a means of risk transfer. In addition, this study investigates components and premium calculation principles of compensation insurance against personal information invasion and finally presents policies to activate these insurance product. As a method of risk management, insurance not only is a useful tool to guarantee consumer protection and companies' financial soundness simultaneously but also provides a basis of quantitative measurement of IT risks.

  • 1988년 이전에는 한국의 석유화학공장은 다른 나라에 비하여 관리상태나 손해상황이 양호한 공 장으로 여겨져 거의 안전도조사(underwriting survey)가 실시되지 않았으나 1989년 이후부터 보험사고가 급격히 증가, 보험금 지급이 많아져 위험조사를 실시한 후 보험을 인수하게 되었다. 일반적으로 석유화학공업의 내용연수는 15년에서 20년으로 보고 있으며 미국, 일본 등 선진국 에서도 건설한지 20년을 전후해서 사고가 다발한다는 점은 국내 석유화학공장의 안전성 확보대 책에서 중요한 점을 시사한다. 석유화학공업의 안전성 확보대책으로서 해외재보험자가 요구하고 있는 "경영전반적인 위험관리"를 도입 추진하여야 할 것으로 사료된다. 여기에는 사전적 손해 방지대책을 포함하는 위험통제는 기본적으로 이루어져야 하며 사후적 대책인 위험재무도 경영 효율이 극대화되도록 하여야 한다. 그러나 최근 들어 국내공장의 사고빈발로 해외재보험자들이 재물손해의 자기부담금액(deductible)인상(business interuption)의 Time Excess연장(7일에서3 0일) 등의 보험조건을 강화하고 있다. 따라서 외국의 사고 경험에 비추어 국내 플랜트의 내용연 수가 거의 다 되어서 사고발생위험이 잠재하고 있고 석유화학공업의 특성상 사고빈도는 낮으나 손해규모가 대규모이고 국가경제에 기여하는 비율이 타산업에 비해 월등히 크다는 점 등에서 안전대책에 대한 경영자의 관심제고를 밑바탕으로 한 위험관리의 정착화, 안전기준 등의 국제 수준으로 향상 및 전문기술인력 확보를 통하여 사고발생 억제에 대하여 소홀히 해서는 안된다고 사료된다.안된다고 사료된다.작 원리 및 제조방법에 대하여 기술한다. 2차원 그래픽의 기능만으로도 충분한 역할을 수행할 수 있지만, 그 다음 단계인 기본설계나 상세설계와의 자료 공유를 생각하면, 3차원 그래 픽이 필요하다. 다만, 3차원 그래픽 기능을 추가하기 위해 많은 노력이 요구되는데, 현재 PHIG S와 x-window가 결합되어 PEX라는 라이브러리로 개발되고 있으므로 차후의 연구에 포함될 수 있을 것이며, 이 글에서는 간단한 2차원 그래픽 기능만을 이용하였다. 앞으로 PEX의 기능을 적 절히 구사하면, 좋은 효과를 볼 수 있을 것이다. 279cm 되게 하고 선축은 팬톰의 27번 절편과 28번 절편의 접변과 최대 전단면의 교차선과 일치시켜 양방향에서 15분씩 조사하여 전단면에서 선량을 측정하였다. 팬톰내 선축상 중앙점의 선량을 기준으로 다른 부위의 선량을 비교하였다. 두경부와 복부, 폐의 하반에서 선량의 차이는 $\pm$ 10% 이내였고, 폐의 상반과 어깨와 골반 부위에서 선량은 10%이상 저선량을 보였다. 특히 어깨부위에는 30%이상 저선량을 보였다. 이로부터 서울대병원과 유사한 조건에서 코발트로 전신조사하는 경우에는 폐나 두경부에 대응하는 조직보상체를 이용하기보다는 어깨부위에 선량을 추가하는 것이 바람직할 것이라고 생각한다.alpha$ 부분공간들의 합공간 역시 on-semistrbtifiable over $\alpha$ 하다. 6. 폐연속 net-cevering 함수에 의하여 cn-semistratifiable over $\alpha$ 성질이 보존된다. 보잘것이 없었고, 현재에도

Legal Issue in Case of Death or Injury of an International Crew While on Board (국제항공운송 승무원이 항공기내에서 사상(死傷)을 당한 경우 법률관계 - 국내외 판례의 분석을 중심으로 -)

  • Air passengers may be compensated for damages based on the above agreement when the passenger suffers an accident to the extent that they are recognized as an accident under Article 17 of the Montreal Convention in 1999. If a flight or cabin crew and passengers both undergo an accident, passengers are subjected to compensation under the Montreal Convention however flight cabin crews will be compensated by the Labor Law, which is the governing law in the labor contract with the airline. The flight or cabin crew boarding the aircraft work is on a work contract, not a passenger transport contract. Therefore, if the flight or cabin crew on the aircraft is injured due to an accident, and the air carrier is liable for default due to a labor contract, the Labor Law, workers or survivors claim damages due to illegal acts against the employer. In which case, civil law will apply. In this regard, if a Chinese cabin crew working for a Chinese airline dies due to an accident in the Republic of Korea, whether the family of the deceased claims damages against the Chinese airline or not has international court jurisdiction in the Republic of Korea, which is the place of tort. We examined whether it is the law of the Republic of Korea or whether it's the Chinese law, the law applicable to the work contract, is applied. Also, Seoul District Court 1995.5.18. The sentence 94A 14144 was found that if the injured crew during the flight work was not satisfied with the insurance compensation under the Labor Standards Act and the Industrial Accident Compensation Insurance Act, he could claime to damage under the civil law against an air carrier or third parties responsible for the accident. After examining several acts in several countries it's undeniably crucial to clearly understand the definition of "passenger" as stated in the Fridolin Santer case.

제조물책임법(製造物責任法) 도입(導入)의 경제적(經濟的) 효과(效果)와 입법방향(立法方向)

  • 소비자 보호 및 효율적 자원배분, 기업의 안전증진 유인제공, 제도의 국제적 조화를 위하여 제조물책임법(製造物責任法) 제정의 필요성이 제기되고 있다. 현재 제조물로 인한 사고는 민법(民法)에 의하여 보상받고 있으나 그 입증책임이 과중하고, 현재 우리나라 생산물배상책임보험(生産物賠償責任保險)이 전체 손해보험에서 차지하는 비중은 0.1%에 불과(미국 10%)하여 그 비용이 아직 미미하므로 제조물책임법제(製造物責任法制) 도입의 안전증진효과가 경제적 손실보다 클 것으로 예상된다. 법제정시의 기본방향은 소비자에게 단순히 보상을 제공하는 법제가 아닌, 기업의 책임과 제품결함이 밀접히 연관되어 배상(賠償) 및 사고억제(事故抑制)의 유인과 효과를 극대화하는 것이어야 한다. 추정규정의 도입은 소비자(消費者) 피해구제(被害救濟)를 용이하게 하지만, 디자인 및 경고결함(警告缺陷)과 결합되면 제조자가 제품사고의 모든 가능성에 대해 완벽한 정보를 가지지 않는 한 제조자의 책임이 되어 제조물책임(製造物責任)의 불확실성(不確實性)을 높이고, 결과적으로 기업에게 절대책임(絶對責任)을 부과하게 되어 제품개발과 혁신을 위축시키는 등의 부정적(否定的) 영향을 초래할 위험이 크다. 따라서 결함의 추정은 인정하지 않아야 하며, 제품개발 및 혁신을 도모하기 위해 개발위험항변(開發危險抗辯)은 인정되어야 한다. 손해배상액(損害賠償額) 상한(上限)을 두지 않는 것이 경제적으로 효율적이고 연대책임을 인정하여 유통업자의 안전제고유인(安全提高誘因)도 강화하는 것이 효과적이다. 중소기업을 포함한 모든 기업에게 입법후 1년 정도의 준비기간(準備期間)을 주는 것이 바람직할 듯하며, 배상책임보험(賠償責任保險)은 의무화하지 않는 것이 경제적으로 효율적이다. 기계, 전자, 운송용기기, 건설, 화학, 식 의약품, 가스제품, 완구, 운동용구 등이 영향을 크게 받을 것으로 예상되지만 법제이용(法制利用)의 편의가 개선되기 전에는 소송의 증가는 미미하리라 예상된다.

  • 국내 굴지의 금융 기관들이 해킹에 따른 전산 사고 등으로 홍역을 치르고 있다. 특히 고객 정보가 유출되거나 멸실된 경우는 상당액의 금전적 보상도 따를 것으로 보아 회사의 손해도 만만치 않을 것이다. 더 큰 문제는 고객들의 불신에 따른 기업 이미지 손상이다. 이것은 돈으로 환산할 수 없는 가치로 오랜 기간 악 영향을 끼칠 수밖에 없다. 우리 협회 회원사의 경우 개인 고객의 정보를 직접 취급하는 일이 거의 없어 걱정이 덜되지만 대부분의 기업 정보가 전산으로 처리되고 있는 만큼 그 보안 상태를 점검해 볼 필요가 있다.

Insurance system for legal settlement of drone accidents (드론사고의 법적 구제에 관한 보험제도)

  • Recently, as the use of drones increases, the risk of drone accidents and third-party property damage is also increasing. In Korea, due to the recent increase in drone use, accidents have been frequently reported in the media. The number of reports from citizens, and military and police calls regarding illegal or inappropriate drone use has also been increasing. Drone operators may be responsible for paying damages to third parties due to drone accidents, and are liable for paying settlements due to illegal video recording. Therefore, it is necessary to study the idea of providing drone insurance, which can mitigate the liability and risk caused by drone accidents. In the US, comprehensive housing insurance covers damages caused by recreational drones around the property. In the UK, when a drone accident occurs, the drone owner or operator bears strict liability. Also, in the UK, drone insurance joining obligation depends on the weight of the drones and their intended use. In Germany, in the event of personal or material damage, drone owner bears strict liability as long as their drone is registered as an aircraft. Germany also requires by law that all drone owners carry liability insurance. In Korea, insurance is required only for "ultra-light aircraft use businesses, airplane rental companies and leisure sports businesses," where the aircraft is "paid for according to the demand of others." Therefore, it can be difficult to file claims for third party damages caused by unmanned aerial vehicles in personal use. Foreign insurance companies are selling drone insurance that covers a variety of damages that can occur during drone accidents. Some insurance companies in Korea also have developed and sell drone insurance. However, the premiums are very high. In addition, drone insurance that addresses specific problems related to drone accidents is also lacking. In order for drone insurance to be viable, it is first necessary to reduce the insurance premiums or rates. In order to trim the excess cost of drone insurance premiums, drone flight data should be accessible to the insurance company, possibly provided by the drone pilot project. Finally, in order to facilitate claims by third parties, it is necessary to study how to establish specific policy language that addresses drone weight, location, and flight frequency.

A Study on the Insured Perils of fishing Vessel Insurance Clauses (어선보험약관의 담보위험에 관한 연구)

  • Fishing vessel insurance of National Federation of Fisheries Cooperatives indemnifies the assured against marine losses by reason of maritime perils, that is to say, perils of the seas, sinking, stranding, collision, extraordinary action of winds waves and fire, damage, salvage. Therefore this insurance is a rational protective measures for preserving fishermen's property by the exposure to maritime perils. But there may be some problems on the perils covered by fishing vessel insurance clauses bemuse these clauses are not clearly and accurately prescribed in part. Especially where the assured may claim payment from fortuitous accidents or casualties of the seas musing the loss, they used to raise a question in argument about the ambiguity of these clauses. So these problems may need to be reformed for the purpose of preventing or decreasing those of the assured, the fishermen. After drawing out some problems on the perils covered by fishing vessel insurance clauses, this thesis will suggest the improving schemes on the perils covered by these clauses.

Compensation for Personal Injury and the Insurer's Claim for Indemnity - Focused on the NHIC's Claim for Indemnity - (인신사고로 인한 손해배상과 보험자의 구상권 - 국민건강보험공단의 구상권을 중심으로 -)

  • In a case in which National Health Insurance Corporation (NHIC) pays medical care expenses to a victim of a traffic accident resulting in injury or death and asks the assailant for compensation of its share in the medical care expenses, as the precedent treats the subrogation of a claim set by National Health Insurance Act the same as that set by Industrial Accident Compensation Insurance Act, it draws the range of its compensation from the range of deduction, according to the principle of deduction after offsetting and acknowledges the compensation of all medical care expenses borne by the NHIC, within the amount of compensation claimed by the victim. However, both the National Health Insurance Act and the Industrial Accident Compensation Insurance Act are laws that regulate social insurance, but medical care expenses in the National Health Insurance Act have a character of 'an underinsurance that fixes the ratio of indemnification,' while insurance benefit on the Industrial Accident Compensation Insurance Act has a character of full insurance, or focuses on helping the insured that suffered an industrial accident lead a life, approximate to that in the past, regardless of the amount of damages according to its character of social insurance. Therefore, there is no reason to treat the subrogation of a claim on the National Health Insurance Act the same as that on the Industrial Accident Compensation Insurance Act. Since the insured loses the right of claim acquired by the insurer by subrogation in return for receiving a receipt, there is no benefit from receiving insurance in the range. Thus, in a suit in which the insured seeks compensation for damages from the assailant, there is no room for the application of the legal principle of offset of profits and losses, and the range of subrogation of a claim or the amount of deduction from compensation should be decided by the contract between the persons directly involved or a related law. Therefore, it is not reasonable that the precedent draws the range of the NHIC's compensation from the principle of deduction after offsetting. To interpret Clause 1, Article 58 of the National Health Insurance Act that sets the range of the NHIC's compensation uniformly and systematically in combination with Clause 2 of the same article that sets the range of exemption, if the compensation is made first, it is reasonable to fix the range of the NHIC's compensation by multiplying the medical care expenses paid by the ratio of the assailant's liability. This is contrasted with the range of the Korea Labor Welfare Corporation's compensation which covers the total amount of the claim of the insured within the insurance benefit paid in the interpretation of Clauses 1 and 2, Article 87 of the Industrial Accident Compensation Insurance Act. In the meantime, there are doubts about why the profit should be deducted from the amount of compensation claimed, though it is enough for the principle of deduction after offsetting that the precedent took as the premise in judging the range of the NHIC's compensation to deduct the profit made by the victim from the amount of damages, so as to achieve the goal of not attributing profit more than the amount of damage to a victim; whether it is reasonable to attribute all the profit made by the victim to the assailant, while the damages suffered by the victim are distributed fairly; and whether there is concrete validity in actual cases. Therefore, the legal principle of the precedent concerning the range of the NHIC's compensation and the legal principle of the precedent following the principle of deduction after offsetting should be reconsidered.
