독점규제및공정거래법에관한법률을 적용하는데 있어 사업자의 개념은 매우 중요하다. 왜냐하면 동 법은 ''사업자''를 법적용 대상으로 하고 있기 때문이다. 즉 ''사업자''는 법적용에 있어 가장 기초되는 개념 중의 하나라고 할 수 있다. 그러나 실제로는 법적용 대상 사업자인지 여부가 애매한 경우가 있으며, 이러한 문제는 EU 등 외국의 경쟁법 집행에서도 마찬가지로 논의된다. 본 글에서는 판례를 중심으로 EU에서의 논의를 간단히 소개해보고자 한다.

There have been affluent studies on the development of new drugs and these efforts have been crystallized into a separate field of pharmacology. Yet, a normative analysis pertinent to the development of new medicine is still in a dire need, except for studies regarding medical ethics. This piece of work aims to contemplate on the legal issues concerning the development of new drug, encompassing each and every stage of the development. In order to maximize the practicability of the research method adopted as aforementioned, this work strives to analyze the developing process of COVID-19 vaccine. The first step would be to introduce the developmental stages of inventing a new drug, especially that of a COVID-19 vaccine. After then, legal issues related to each developmental stage would be discussed. Henceforth, the legal analysis would contribute to predicting upcoming legal complexities and will be able to offer normative implications for the invention of new medicines.

정보화사회의 역기능으로 크게 문제가 제기되고 있는 불건전정보를 억제하기 위하여 정보통신윤리위원회가 발족되었고, 지난달에는 "정보통신윤리강령"까지 선포하였다. 앞으로 이 위원회가 불건전정보의 퇴치에 크게 기여할 것으로 기대하면서 불건전정보의 유통사례와 법적대응을 살펴본다.

최근 악의적인 해킹이나 산업 스파이에 의한 정보유출 등이 날로 늘어남에 따라 정부 차원에서의 관련 법제도 강화나 적극적인 대응에 대한 방법론 등이 크게 대두되고 있다. 이에 컴퓨터 내에 남아있는 전자적 증거들을 실제 법적인 효력을 가지도록 하는 연구가 활발하게 이루어지고 있는 실정이다. 이러한 전자적 증거로서 가장 많이 사용되어지는 것이 로그 정보라 할 것이다. 기존의 로그정보는 분산된 호스트에 따른 관리의 문제와 무결성과 인증의 문제를 지니고 있다. 이 논문에서는 이러한 문제를 해결하기 위해 분산된 로그 정보를 실시간으로 암호화하여 중앙의 특정 서버에 저장하는 방법을 사용한다. 이를 통해 무결성과 출처의 인증이 보장된 실시간 정보에 의한 법적 신빙성을 획득할 수 있다.

In the aftermath of a recent outbreak of Middle East respiratory syndrome (MERS), legal matters on the spread of epidemics have emerged as major social issues in Korea, with the awareness that rampant contagious diseases are disasters in society. Problems arose over damages arising from patients who contract infectious diseases, compensation for people under quarantine and for a partial, or entire, shutdown of hospitals, and information disclosure on infectious diseases. As epidemic-linked problems have never been socially disputed in Korea, the relevant legal issues appear to be studied comparatively less than other areas. As interests are heightened over legal issues on infectious illnesses amid the MERS scare, in-depth, further research on such legal issues should be conducted in an utmost effort to prevent and make preparations for epidemics which potentially become a social disaster, such as new Hong Kong flu, Ebola virus and Zika virus.

Registered security guards carry out police duties as civilian police who are in charge of security service, and so they have a two-fold status: a civilian in terms of a social standing and a policeman in the way that they execute the authority of security. The problem caused by this legal position is that their legal rights and obligation can be unclear in the task-action and working relationship. This paper attempts to study their functions, rights, and legal duties through the interpretation of the related positive law so as to reveal the problems that may spring from this ambiguous status of registered security guards. This endeavor illuminates their legal status specified in the positive law in and around the Act on the police assigned for special guard, observing their functions and the legal duties in the pursuit of their tasks, and ending up pointing out the problems of the positive law. As a result of research work, the most significant problems, even if multifarious, are the avoidance of the state reparation in the responsibility for the illegal behavior in connection with their operation; the unconstitutionality of the disciplinary punishment regulation originated from the entrust with full powers; the imperfection of the rules about the cooperative ties with the police; the possibility of human rights abuse caused by the ban on the labor dispute; the equality problems from the dual pay system; and the inadequacy of the codes about the recruitment qualification and method. This research is intended to help achieve the purpose of the security of national critical facilities through the smooth execute of duties as well as the protection of the guards' rights. Besides, the key focuses posed in this paper are worthy of being developed more accurately through the following researches.

Game industry is certain to change rapidly as its attribute. Therefore, It's not easy that the law response to reflect the technological change of game industry properly, and a new legal issue that is difficult to cover with the existing law. Recently, Court battle or cases about games are socially receiving attention. Nevertheless, Research accumulation about the legal action to response this is rare situation. The legal system that is related games mostly approach in the regulation and punishment of one-sided administration so far. Relatively, Approach from the game industry development and promotion act standpoint is low. Shrinking rapidly the current game industry is not an irrelevance to this. So It is necessary to reconstruct rationally in side that embrace with variety of views of members of the society and interests about current game-related laws, systems and regulation instruments. Access to how will develop competitiveness of the game industry in legal aspects and how will promote the balanced development between game industries are needed. The problems that needs to handle in legal aspect such as game development, game distribution, and game usage which in the part of the game industry are getting more and more in the future. Therefore, there is a need to review consistently in the legal aspect for the game industry promotion.

본 연구는 자동차 급발진 사고에 관한 안전장치 개발에 그 목표를 두고 있다. 최근들어서 자동차 급발진 사고는 사회문제화되고 있고, 인명피해뿐만 아니라 자동차회사와 소비자간의 법적 피해 보상문제가지도 대두되고 있으며, 최근 자동차 설계구조의 문제가 있다는 법적 해석이 나오기도 했다. 본 연구는 자동변속기를 장착한 자동차의 급발진 방지용 변속레버 제어장치에 관한 것으로 구체적으로는 브레이크 페달을 밟고 있어야 변속레버조작이 이루어지도록 한 변속레버 제어수단을 솔레노이드 작동에 의한 스토퍼로 제어하되 스토퍼를 걸림 작동부로 간편하고 있도록 한 안전장치이다.
