이 연구는 국회 원내 생산성의 평가 범주를 법안심사, 예 결산심사, 국정감사의 3개 범주로 나누고, 법안심사, 예 결산심사, 국정감사의 산출물을 국회의원에게 투입된 비용으로 나눈 결과를 역대 국회별 정부유형별로 비교하여 민주화 이후 국회생산성의 추이를 종합적으로 평가했다. 국회 원내 생산성을 측정해본 결과, 정부유형이 법안심사, 예 결산 심사, 국정감사 생산성에 영향을 미치고 있음을 확인할 수 있었다. 단점정부는 법안심사에서 대통령과 집권당에 우호적인 환경을 제공해 줌으로써 전체 법안 가결의 생산성이 높아진다. 그러나 예 결산 심사의 생산성은 정부예산의 수정률이 낮아짐으로써 생산성이 낮아지고, 국정감사 역시 행정부의 정책집행에 대한 지적사항을 반대당 지배 국회보다 적게 산출함으로써 생산성이 낮아진다. 반면 분점정부는 대통령과 집권당에게 비우호적인 입법 환경을 제공함으로서 법안심사의 생산성은 낮은 반면, 정부 예산안의 삭감비율이 높아지면서 예 결산 심사의 생산성은 높아지고, 국정감사에서 행정부에 대한 다수의 시정요구를 함으로써 국정감사의 생산성 역시 높아진다. 결국 생산성의 높고 낮음이 문제가 아니라 생산성의 내용이 중요하다. 생산성의 '절대값'보다 생산성의 내용과 성격에 대한 이해가 선행되어야 하는 이유가 여기에 있다.

This study examines the effects of members' legislative performance on their renominations in the $19^{th}$ Korean National Assembly. We measure how many bills each member has proposed and passed in the Assembly. In addition, we also include rate of passing bills as an indicator of legislative performance. Particularly, we analyze 320 members in total, and 270 members who got in on the competition for nomination separately. The empirical findings of our study show that, firstly, among the total members in the Assembly, as they propose bills more and pass bills fewer, they are more likely to be renominated in the very next election. However, this is a result of different types of members rather than legislative performance. Secondly, among the members who actually competed for renomination, the legislative performance of members can not affect their renomination. Therefore, we argue that it is necessary to stipulate nominations criteria and transform top-down nomination method to bottom-up one in order to raise responsiveness and enhance representative democracy.

The purpose of this study is to find out what factors influence lawmakers' voting decisions in the plenary session. In particular, the study examines causes and characteristics of waffling and strategic waffling, which express opposition or abstention in a discharge petition or a vote at the plenary session despite participating in a bill sponsorship. The study on waffling is meaningful because it has not been covered in previous literatures. To this end, the Gadeokdo New Airport Special Act, which the National Assembly passed in February 2021, was set as an analysis target. The study examined the factors that affected legislators' voting decisions and participation in bill sponsorship and who were related with waffling. Statistical results showed that the age variable influenced the motion of the bill while seniority and party affiliation had an effect on the participation of the bill. Likewise, the study found that party affiliation and district had an influence on the approval of the bill. In addition, the analysis of waffling showed that lawmakers with higher seniority tended not to participate in the vote. It could be interpreted that lawmakers with more legislative experience judged that they would benefit from strategic waffling. There is a limit to understanding lawmakers' decision-making and waffling through a limited analysis of the Gadeokdo New Airport bill. However, given that lawmakers tend to choose avoidance strategies in ambiguous situations, and given the high intelligence of lawmakers who know better than anyone about the future impact of a new bill, the decision-making shown by lawmakers in each stage of the situation is a prudent judgment gained from their experience. It indicates that it is necessary to research the legislative activities of lawmakers in various ways.

기획재정부는 공사의 분할 분리발주 관련규정 등을 정비하고 최저가낙찰제 확대유예 등의 내용을 담은 국가계약법 시행령 개정안을 지난 11월 8일 입법예고 했다. 이 법안은 20일 동안 업계 의견을 수렴한 후 법령안 심사 및 차관 국무회의 등을 거쳐 공포될 예정이다. 이번 국가계약법 시행령 개정안은 그동안 대한설비건설협회가 전사적으로 추진해 온 분리발주 법제화와 최저가낙찰제 연기 방안을 담고 있어 건설업계의 관심이 집중되고 있다. 분할 분리발주 규정은 분리발주가 보다 활성화 될 수 있도록 대상을 구체화했으며, 사업의 계획단계부터 분리발주 가능 여부를 판단토록 개선됐다. 또한 300억 이상에서 100억 이상으로 확대될 예정이던 최저가낙찰제 확대 방안은 오는 2015년까지 2년간 유예되고 최저가낙찰제 대체 방안으로 종합심사제가 제안되는 등 정부의 입 낙찰제도 개선 방향의 가닥이 잡혔다.

세정제, 접착제 등 각종 화학생활용품은 음용하거나 흡입할 경우 중독 등의 위해가 우려되며, 특히 어린이의 안전 확보가 요구되고 있다. 2002년 국민건강보험 심사평가원 자료에 따르면 중독사고로 인한 병원 진료건수는 연간 8,300여건인 것으로 조사됐으며 사망자수도 연간 8.8명에 이른 것으로 나타났다. 소비자보호원에 따르면 서울 등 5대 도시에 거주하는 629가구에 대한 실태조사 결과 13.2%가 중독사고 경험, 91%가 "어린이보호포장" 도입을 희망하고 있는 바, 지난 달 22일부터 어린이보호포장이 의무도입됐다. 본고에서는 어린이보호포장의 올바른 정착을 위해 법안에 대해 살펴본다.

Korea ship management industry originated from overseas seamen employment business since 1963 in the Republic of Korea. Recently, new trend of shipping business has developed in a separate way with ship's ownership and management, that is, cargo business which is in charge of shipowner and practical affairs for ship operation which is in charge of specialized ship management company. Ship Management Industry is being focused as a new development engine with the anticipation of continuous development over 10% a year leading a competitiveness and saving cost in the world market. Therefore, "Draft Ship Management Industry Development Act" was suggested by the shipping business group and academic scholars as a result of continuous research for a long time. This was also submitted to the national assembly for adoption as a national law. The purpose of this paper is to make a contribution to the development of Korea ship management industry through the consideration of each article of this draft Act implications and suggestion of legal and institutional improvements. The result of this study will ultimately contribute to the growth of the Korean ship management industry and enhance their business scope internationally. For the above mentioned purpose, I focus on nurturing and supporting Korea ship management industry, and accreditation of superior ship management industry, etc. within the scope of the submitted draft act.

본지는 2016년 10월호(통권 365호)와 2017년 2월호(통권 369호)를 통해 국회에 계류되어 있는 원자력 관련 법률안 및 일부개정법률안 36건을 소개한 바 있다. 그 이후 5월 24일 현재 '원자력발전소의 단계적 폐쇄 및 에너지전환 특별법안'이 발의되었고, 원자력안전법 일부개정법률안 6건, 방사성폐기물 관리법 일부개정법률안 1건, 발전소주변지역 지원에 관한 법률 일부개정법률안 2건 등이 발의되었다. 발의된 의안들은 현재 해당 소관위 심사중이며 본회의에서 처리된 의안은 아직까지 없다. 올해 2월 22일 이후 제안된 의안들을 사안별로 나누어 제안 이유와 주요 내용, 의안 전문을 게재하며 사계의 진단을 기대한다.

건설업계의 뜨거운 감자였던 건설산업기본법 개정안이 지난 11월 7일 국무회의에서 의결, 통과됨으로써 12월 5일 국회 건설교통위원회 법안심사소위원회 상정과 12월 6일 국회 건설교통위원회에서 의결을 앞두고 있다. 대한설비건설협회는 이번 건산법 개정에서 건교부가 주장하는 선진화된 건설생산체계 개선이 되기 위해서는 일반∙전문 겸업제한 폐지시 형평에 맞는 법개정이 되어야 한다고 일관되게 주장해 왔다. 즉“일반∙전문 겸업제한을 폐지할 경우 전문건설업자간의 공동도급 금지조항을 폐지하여 단순 복합공사의 원도급 입찰 참가자격 부여와 CM업을 활성화하여 CM에 의한 공종별 발주 등이 필요하다”고 주장했다. 건산법 개정안의 귀추가 주목되는 가운데 대한설비건설협회의 건산법 개정 추진현황을 게재한다.
